[1. CALL TO ORDER]

[4. APPROVAL OF AGENDA]

[5. ADMINISTRATOR'S REPORT]

[00:01:34]

THIS IS TEST NUMBER: 2 4 F1

[00:08:21]

THEY'RE FAILING TO DO MR. KINARD. I THINK YOU HAVE A DOCUMENT THAT ENDS UP CONFORMING WITH WHAT COUNCIL HAD DISCUSSED AND APPROVED ON SEPTEMBER 14TH AT LEAST IN MY OPINION. I THINK I THINK THOSE THINGS WOULD MAKE IT CONFORM WITH WHAT THAT GENERAL SENSE WAS. MR. BROWN MR. ALEX BROWN IS ON THE LINE AS WELL.

AND WHO IS REPRESENTING THIS TINY COMMUNITY? MR. BROWN, MR. BROWN, ASHLEY

AND OTHER MEMBERS OF THE GROUP . >> MR. BROWN DOES NOT HAVE AN AUDIO SERVICE AT THE MOMENT. HE HAS VIDEO. ALEX, DO YOU.

DID YOU CONNECT WITH YOUR AUDIO ? YEAH, HE'S GOING TO CALL AND I THINK SO THAT HE CAN SPEAK HE CAN SEE US ALL BUT HE CAN'T. HE'S NOT GETTING ANY.

NOT GETTING ANY AUDIO, SARAH. I TOLD HIM TO USE THE NUMBER IN THE WEBEX INVITE TO SPEAK AND

HE'LL THEN ALSO BE ABLE TO SEE . >> THAT'S RIGHT.

I'LL JUST SEE WHERE IT SAYS ALEX. JOIN THE MEETINGS AS WELL.

THIS IS THEIR TIME VISUALLY BUT IT'S NOT THERE. HE CAN'T HEAR US.

SO WE'RE TRYING TO GET HIM TO CALL IN BUT I DON'T SEE HIM PICKING UP A PHONE.

SO I'VE TEXTED HIM TO USE HIS PHONE. ALEX, CAN YOU HEAR US? OKAY. HE'S GOT US. OKAY.

>> I APOLOGIZE. OK. YOU'RE ON ALEX.

HOW ARE WE DOING? >> EVERYBODY GOOD? LET ME LET ME GO.

LET ME INTRODUCE ALEX TO THOSE OF YOU WHO DON'T KNOW HIM. ALEX IS SERVING ON THE 278

[00:10:04]

COMMITTEE WITH ME ON HILTON HEAD FOR THE PAST YEAR AND A HALF.

AND HE IS A CANDIDATE FOR ELECTION TO THE TOWN OF HILTON HEAD CAPITAL FOR WARD 1.

>> THANK YOU, LARRY. I APOLOGIZE MY ASSISTANT HAS MET FOR TWO DAYS SO I'M TECHNICALLY CHALLENGED THE I DID NOT GET A CHANCE TO HEAR SENATOR DAVIES'S REMARKS BUT YOU AND I HAVE BEEN WORKING VERY CLOSE TO AS TO MAKING SURE THAT WE HAVE A FINE PRODUCT.

>> AT THE END OF THE DAY A 8 COURT OR AS LARRY MENTIONED, I'VE SERVED ON TWO HEAVILY A COURT THAT WAS APPOINTED BY THE TOWN OF HILTON HEAD WITH VERY DIVERSE 2010 THERE.

>> I'M GLAD YOU BROUGHT THAT BECAUSE WE HAVE NOT MAKE A SELECTION AS TO THE REAL

PREFERRED ALTERNATIVE AT THE BEGINNING 20 21. >> SO WE'VE MISSED A LOT OF TIME HERE WHICH IS QUITE UNDERSTANDABLE CONCERNING OUR ENVIRONMENT WITH COAL CODED.

BUT THIS IS A VERY, VERY IMPORTANT PROJECT AND THE MORE CONVERSATIONS AND DIALOG EVEN IF THEY ARE TOUGH NEEDS TO CONTINUE TO HAPPEN. SO THE PURPOSE OF MY STATEMENT TONIGHT IS I AM IN ABSOLUTE SUPPORT OF A THIRD PARTY CONSULTANT BEING BROUGHT ON BOARD SCOPE OF WORK THAT HAS BEEN WORKED ON BY MISS JACOBS AND HER STAFF.

I'M SURE TOM HAS ALLUDED TO SOME AREAS WHERE WE DEFINITELY NEED TO FOCUS ON THE MITIGATION PIECE THE COMMUNITY INVOLVEMENT FOR ME IS TERRIBLY IMPORTANT. DEAL T DOES HAVE A NEPA PROCESS THAT THEY ARE FOLLOWING BUT IT IS CONCERNING TO ME THAT AS I MAKE MY WAY AROUND THE TOWN OF HILTON HEAD THEY ARE STILL MEMBERS OF THE COMMUNITY THAT HAVE NO IDEA WHAT IS GOING ON

WITH THIS PROJECT. >> THAT TO ME DOES NOT EXPLAIN VERY GOOD COMMUNICATIONS PROCESS EVEN IF WE ARE FOLLOWING SOMETHING FEDERALLY MANDATED THROUGH THE LEGAL PROCESS. I'D ALSO LIKE TO ENCOURAGE THAT.

WE HAVE A SENSE OF OWNERSHIP WITH THIS PROJECT. I UNDERSTAND THAT S.E. DST IS LEADING THE NEPA PROCESS BUT BEAUFORT COUNTY ALONG WITH HILTON HEAD STRIVE FOR EXCELLENCE AND AT THIS POINT IT IS BEING PERCEIVED AT LEAST IN THE CORNERS THAT I VISIT THAT THERE IS NO ONE IN CHARGE OF THIS PROJECT. I WOULD JUST ENCOURAGE THAT WE REIN THAT BACK IN AND MAKE SURE THAT THERE IS A SENSE OF OWNERSHIP BETWEEN THE TOWN IN THE COUNTY AND PROMISE TO DO MY PART TO MAKE SURE THAT HILTON HEAD IS ON BOARD WITH THAT. I'M PUTTING MUCH PRESSURE ON THE MAYOR AND TOWN COUNCIL TO DO SO AND I WILL JUST CLOSE WITH JUST STATING THAT A PROJECT OF THIS MAGNITUDE IS GOING TO HAVE A LEGACY FOR A LONG TIME. IT DOESN'T REALLY MATTER WHERE YOU IT'S MORE FROM ABROAD OR SELF OR ABROAD BUT BUF COUNTY AS A WHOLE INCLUDING HILTON HEAD AND OF COURSE JENKINS VALENS HAVE AN OPPORTUNITY HERE TO REVITALIZE OUR SITUATION AND NOT JUST POUR MORE PAVEMENT THROUGHOUT THEIR UNINTENDED CONSEQUENCES NOT JUST IN WINDMILL HARBOR TICKETS. THAT'S GO COMMUNITY. BUT HILTON HEAD AS A WHOLE HAVE GRAVE CONCERNS ABOUT THE FINAL PRODUCT AND HOW IT'S GOING TO AFFECT OUR QUALITY OF LIVES.

IN THAT AREA IT'S JUST AGAIN ENCOURAGE US TO REGAIN OWNERSHIP OF THIS PROJECT, WORK TOGETHER ON THIS PROJECT AND GET US TO A PLACE WHERE WE CAN ALL BE PROUD OF THE OUTCOME.

>> THANK YOU VERY MUCH FOR THOSE COMMENTS. OK.

WE WILL MOVE ON TO THE AGENDA REVIEW THE CHAIRMAN MAKE A BEFORE YOU MOVE ON.

>> MR. GLOVER. YES. THANK YOU, SENATOR DAVIS AND MR. BROWN FOR YOUR PRESENTATION. I AM VERY SUPPORTIVE OF THE LAST COMMENT DAVIS MADE WHICH IS THE LANDSCAPE PLANNER. I THINK WITH THAT IN PLACE

[00:15:08]

WOULD GIVE THE OPPORTUNITY FOR THE WHOLE COMMUNITY TO SEE EXACTLY HOW THAT PROJECT LOOK.

BEFORE WE EVEN BEGIN. SO I APPRECIATE THAT, SENATOR DAVIS.

THANK YOU, MR. RUDMAN. >> TWO THINGS. ONE, I THINK EVERYBODY IS BUILDING SUPPORT FOR DOING THE HERITAGE AND CULTURAL DISTRICT. I BELIEVE THAT THE TOWN OF CERTAINLY THAT IS WILLING TO LEAVE THAT AND OBVIOUSLY IT NEEDS TO BE DONE IN PARALLEL.

SO WE THANK THE SENATOR FOR HIS LEADERSHIP IN GETTING US TOGETHER.

SECONDLY, A QUESTION FOR ASHLEY. WE APPROVED 40000.

I SAW THAT THE ESTIMATED COST IS 120. WHAT'S THE PATH FORWARD ON THE DOLLARS AND WE DO WE HAVE TO GO TO IN OUR IF Q OR WHATEVER HCR AN EXISTING CONTRACT AND I'LL

LET GERRY PRO-LIFE SPEAK TO THAT. >> YES.

WE HAVE HCR C.R. EXISTING CONTRACT. SO THIS WOULD BE IN THE CONTRACT EXTENSION ON THEIR DEBT. OUR PROPOSAL WOULD BE THAT WE HAVE FUNDING THAT'S ATTRIBUTED FROM THE JENKINS PROJECT THAT WOULD GO TOWARDS THIS THANK.

>> BASICALLY WHAT COULD HAPPEN IS THAT BRIAN COULD TAKE THIS UP WITH PUBLIC FACILITIES NEXT WEEK AND THEN WE COULD APPROVE IT AT COUNCIL TWO WEEKS FROM NOW.

>> YES, THAT'S THE PLAN. YEAH, THAT'S THE PLAN. MR. HER VERSION WORKS FOR ME.

>> THANK YOU, MR. CHAIRMAN. I I WOULD AGREE THAT THE THE LANDSCAPE ARCHITECT WOULD SEEM LIKE A GOOD IDEA. A LARGE PART OF THE FEEDBACK THAT I'VE GOTTEN CONSTITUENTS IS THAT THEY DON'T WANT TO SEE A CONCRETE MONSTROSITY AS THEY COME ON TO THE ISLAND.

>> SO I THINK THAT THAT EXERCISE WOULD GO A LONG WAY TOWARD ALLEVIATING THAT

CONCERN. >> I WANT TO THANK MR. DAVIS FOR PRESENTING MR. COVER .

DID YOU HAVE A COMMENT? OK. NO FURTHER COMMENTS.

THANK YOU TO MR. DAVIS AND MR. BROWN FOR PRESENTING. POINTS ARE WELL TAKEN AND WE WILL MOVE ON AS QUICKLY AS WE CAN TO SATISFY EVERYONE IN THIS PROCESS.

IT IS IMPORTANT TO EVERYONE. THANK YOU. A QUICK REVIEW OF THE AGENDA.

[6. AGENDA REVIEW]

AS YOU SEE WE DO HAVE A CONSENT AGENDA. IT IS BY THE VARIOUS COMMITTEES . SO THESE THESE ARE SECOND READINGS AND REZA MOTIONS BECAUSE THIS WILL CATCH US UP TO THE THIRD READINGS. AND WITH THESE BECAUSE THAT'S THE WAY IT HAD TO BE DONE AND THEN WE'LL BE BACK TO THE SCHEDULE WHERE WE HAVE SECOND READINGS AND PUBLIC HEARINGS. WE HAVE OBVIOUSLY THE MASK ORDINANCE WILL BE A LENGTHY ITEM AND SEVERAL OTHER ITEMS THAT WE HAVE TO TAKE CARE OF THE SCHOOL IMPACT FEE.

THE REASON THE SCHOOL IMPACT FEE IS ON HERE AGAIN IS BECAUSE WE SAID AT OUR PRIOR MEETING THAT WE POSTPONE HONED ANY ACTION UNTIL THIS MEETING OCTOBER 12TH TO SEE IF IN FACT THE ENTIRE GOVERNMENTAL AGREEMENTS WERE DONE. IF THEY ARE NOT DONE AS YET THAT WE CAN ACT ON THEM, WE SHOULD REMOVE THIS ITEM FROM THE AGENDA.

>> SO MR. KATZMAN, I SPOKE WITH ME TODAY AND THOSE EDUCATORS ARE NOT DONE YET.

>> OK. SO THEN WE SHOULD REMOVE THIS ITEM FROM THE AGENDA FOR CONSIDERATION. AND SO WE WILL MAKE A RECOMMENDATION AS WE APPROVE THE AGENDA TO REMOVE THAT ITEM . ANY OTHER COMMENTS REGARDING

THE AGENDA FOR THE COUNCIL MEETING SEEING NONE. >> WE WILL NOW MOVE ON TO THE NEXT ITEM WHICH IS NEW BUSINESS. IS THERE ANY NEW BUSINESS TO COME BEFORE THE CAUCUS BEFORE WE GO INTO EXECUTIVE SESSION FOR THREE DISTINCT ITEMS SEEING

[EXECUTIVE SESSION]

NONE? I WILL ASK FOR A MOTION TO GO INTO EXECUTIVE SESSION.

PLEASE DON'T MOVE THE CHAIRMAN SO THAT I CAN SET IN MAKES THE MOTION AND MR. GLOVER MAKES THE SECTION WE ARE GOING TO GO INTO EXECUTIVE SESSION FOR ITEMS 8 9 AND 10 1 IS AN INVESTIGATIVE PROCEEDINGS REGARDING ALLEGATION OF CRIMINAL MISCONDUCT, A DISCUSSION OF EMPLOYMENT APPOINTMENT COMPENSATION PROMOTION, DEMOTION, DISCIPLINE OR RELEASE OF AN EMPLOYEE, A STUDENT OR A PERSON REGULATED BY A PUBLIC BODY.

[00:20:05]

>> AN ITEM NUMBER 10 IS ACTUALLY TO ITEMS FOR RECEIPT OF LEGAL ADVICE WHERE LEGAL ADVICE RELATES TO A PENDING THREATENED OR POTENTIAL CLAIM OR OTHER MATTERS COVERED BY THE ATTORNEY CLIENT PRIVILEGE SETTLEMENT OF LEGAL CLAIMS IN THE WITHHOLD WHITEHALL MATTER.

AND WITH REGARD TO RETIREE HEALTH INSURANCE WE WERE MOTIONED.

AND SECOND WITHOUT EXCEPTION WE WILL GO INTO CLOSED SESSION. THE CHAIRMAN.

MR. CHAIRMAN. FRANK. I THINK THERE'S A NUMBER 10 IT SAYS WHITEHALL MANNER. IT HAS NOTHING. I DON'T THINK I THINK IT'S JUST THE RETIREE HEALTH INSURANCE. IS THAT CORRECT? THAT'S CORRECT.

THOSE TWO ITEMS. WELL, ARE WE GONNA TALK ABOUT WHITEHALL WAS IT? YES. I GUESS WE'RE GOING TO FIND INFORMATION ABOUT WHITEHALL.

OKAY. I MISUNDERSTOOD THE WAY IT WAS WRITTEN.

>> IT WAS SUBJECTS. ALL RIGHT. THANK YOU.

YEAH. ANY OTHER TIME SO THIS WILL BE APPROVED WITHOUT EXCEPTION.

ARE THERE ANY EXCEPTIONS? SEEING NONE WE HAVE N
