[1. CALL TO ORDER ] [4. APPROVAL OF AGENDA ] [5. ADMINISTRATOR’S REPORT ] [6. AGENDA REVIEW ] [8. DISCUSSION REGARDING A SPECIAL MEETING ON OCTOBER 5TH FOR THE PURPOSES OF COMPLETING THE COUNTY ADMINISTRATOR’S EVALUATION ] [9. DISCUSSION AND POSSIBLE ACTION REGARDING COUNTY COUNCIL COMMUNICATIONS ] [10. DISCUSSION WITH POSSIBLE ACTION REGARDING A PLAN TO OPEN BEAUFORT COUNTY BUILDINGS ] [00:56:00] BUILDINGS, OUR ADMIN BUILDING IT IS THAT IS CLOSED TO THE PUBLIC UNTIL FURTHER NOTICE. [00:56:04] MANY OF THOSE OFFICES THOUGH ARE TAKING APPOINTMENTS AND SO WHEN WE HEAR FROM A CONSTITUENT [00:56:09] WE HEAR FROM A RESIDENT, WE MAKE AN APPOINTMENT TO MEET WITH THEM SO THAT WE CAN [00:56:13] ADDRESS OUR CONCERNS IF THEY NEED TO MEET IN PERSON. ALTHOUGH MOST OF THESE OFFICES [00:56:17] ARE PERFORMING THEIR DUTIES VIRTUALLY MYRTLE PARK THE BUILDING IS CLOSED. [00:56:23] SOME OF THE OFFICES ARE CLOSED TO THE PUBLIC BUT THE BUILDING ITSELF IS OPEN BECAUSE IT [00:56:27] HOUSES STATE AGENCIES AND THE PARK FACILITIES. >> OUR BUILDINGS ARE CLOSED, [00:56:33] OUR GYMS AND OUR POOLS. HOWEVER, ALL OF OUR OUTDOOR TEAM SPORTS ARE ACTIVE. [00:56:38] SO OUR TENNIS COURTS ARE OPEN. WE HAVE SOCK GOING ON AND WE'RE SIGNING PEOPLE UP FOR [00:56:43] BASKETBALL WHICH WILL START IN NOVEMBER. OF COURSE WE'LL HAVE TO WAIT [00:56:46] AND SEE HOW THINGS GO FOR NOVEMBER. BUT IF WE AREN'T ABLE TO [00:56:50] CONTINUE BASKETBALL IN NOVEMBER THEN WE'LL GIVE A REFUND OR SOMETHING. BUT THAT'S WHERE WE ARE BASICALLY WITH ALL OF THE BUILDINGS AND FACILITIES. WE. WE DO RECEIVE THE OCCASIONAL E-MAIL OR PHONE CALL. SOMEONE WHO NEEDS TO MEET IN PERSON AND WE ACCOMMODATE THEM. BUT MY PRIMARY CONCERN IS THE HEALTH OF MY EMPLOYEES AND THE PUBLIC. AND SO WE ARE STILL IN PANDEMIC. WE HAVE THE LATEST REPORT FROM DEEPAK IS THAT WE HAVE A LITTLE OVER 10000 HOSPITAL BEDS ACROSS THE STATE AND THOUSAND THREE HUNDRED AND FORTY FIVE OF THOSE ARE IN USE WHICH IS AN 83 PERCENT UTILIZATION RATE WITH ABOUT 10 PERCENT OF THOSE BEDS BEING TAKEN UP BY KOBE 19 PATIENTS. AND I HAD A COUPLE OF E-MAILS WITH RUSSELL BAXLEY BEFORE MEMORIAL HOSPITAL. >> ONE. YEAH. WE STILL HAVE A PRETTY FRAGILE HEALTH CARE SYSTEM. THE HOSPITALS ARE OPERATING ON PRETTY THIN MARGINS RIGHT NOW. THEY'RE STILL LIMITED CAPACITY FOR TESTING. SO WE DO HAVE A BIT OF A BROKEN SUPPLY CHAIN AS WE'VE SEEN. >> SO I MEAN I'M OPEN TO SUGGESTIONS BUT AGAIN MY INTEREST HAS BEEN TO PROTECT THE HEALTH OF THE EMPLOYEES AND THE PUBLIC. >> TO ME THAT'S A WONDERFUL MESSAGE OUT, ASHLEY. WHAT WE NEED TO DO IS TO LET THE PUBLIC KNOW ALL OF THIS AND I DARESAY THE PUBLIC STILL DOESN'T UNDERSTAND THE VARIOUS BUILDINGS JUST LIKE YOU SAID. AND AGAIN, HERE WE ARE IN A CAUCUS MEETING. THE VAST MAJORITY OF PEOPLE IN THIS CAUCUS MEETING ARE EITHER COUNCIL PEOPLE OR ADMINISTRATIVE PEOPLE. I DON'T KNOW IF THERE IS ANYBODY ON HERE WHO'S A MEMBER OF THE PUBLIC. SO THIS THIS IS AN IMPORTANT THING THAT WE NEED TO GET THIS INFORMATION OUT BECAUSE WE STILL HAVE A WAYS TO GO. MR. FLOWING. >> THANK YOU, JOE. I REMIND ALL THE COUNCIL MEMBERS AGAIN WE ARE MEMBERS OF THE GENERAL PUBLIC AS COUNCIL MEMBERS WHERE THE REPRESENTATIVE TO OUR GOVERNMENT AND I THINK IT'S IMPORTANT THAT WE GET ACTUALLY ITS MESSAGE OUT. SHE'S THE ONE WHO'S RESPONSIBLE FOR THE BUILDINGS AND THE PERSONNEL THAT COME IN THERE. AND I'D LIKE TO THANK HER FOR ALL SHE'S DOING TO ACCOMMODATE THIS NEW WORKING ORDER THAT WE'VE GOT IN ORDER TO HELP ALLEVIATE THE PRESSURE OF THIS PANDEMIC. YOU'RE DOING A GREAT JOB, ASHLEY. THANK YOU. AND I'D LIKE TO. I'D LIKE TO SAY THAT MY BIGGEST CONCERN IS NOT NECESSARILY THEY ARE THE OFFICES OPENING UP AGAIN. WE HAVE WE SEEM TO HAVE A PRETTY GOOD ACCOMMODATION FOR MOST OF THE THINGS THAT ARE REQUIRED. AND ON THOSE SMALL ITEMS THAT SMUDGE THE SMALL THINGS FOR ME RIGHT NOW. BUT I'M SURE FOR THE INDIVIDUAL IT'S A IT'S A PRETTY BIG ITEM WHEN THEY NEED TO FEED SOMEBODY THEY'RE ABLE TO DO THAT. AND I'VE GONE BY THE COURTHOUSE AND SEEN COUNTY EMPLOYEES OUTSIDE TALKING TO MEMBERS, THE GENERAL PUBLIC EXPLAINING WHAT IT IS THEY NEED TO DO. THEY'RE DOING A GREAT JOB. [01:00:01] I HAVE TO TELL YOU I WONDER WHEN WE'RE GOING TO BE ABLE TO START HAVING FACE TO FACE MEETINGS OF COUNTY COUNCIL SO THAT THE PUBLIC CAN ACTUALLY ATTEND AND GIVE THEIR THEY'RE THERE. THOMAS LOCUTION ALL RIGHT. TO ADDRESS US AND SPEAK TO US AND AND LET US HEAR WHAT THEY'RE THINKING BECAUSE THIS FORMAT DOESN'T WORK FOR THAT. AND I'D LIKE TO BE ABLE TO HEAR WHAT SKIP HOAGLAND ASKED TO SAY. THAT'S A PERFECT EXAMPLE. WHAT YOU KNOW WE NEED TO HEAR FROM PEOPLE WHO HAVE SOMETHING TO SAY AND I'D LIKE TO KNOW WHEN YOU THINK WE'RE GONNA BE ABLE TO ACTUAL HAD ACTUALLY HAVE FACE TO FACE MEETINGS THE E ABILITY TO GET TO TALK TO US. >> CERTAINLY THAT HAS BEEN ON MY MIND. I KNOW FOR A FACT OUR FIRST MEETING I KNOW OF THAT WE WILL HAVE TO HAVE IN PUBLIC WILL BEAN BE WHEN WE REORGANIZE COUNCIL AFTER THE ELECTION OF THE NEW MEMBERS AND THE RETURNING MEMBERS OF COUNTY COUNCIL WHICH WILL BE IN JANUARY BECAUSE WE HAVE TO SWEAR IN THE NEW MEMBER WE HAVE TO SWEAR IN THE THE MEMBERS WHO ARE RETURNING. WE HAVE TO ELECT CHAIR AND VISE CHAIR. AND SO THE PUBLIC WILL HAVE THAT OPPORTUNITY. WE'LL HAVE TO FIND THE RIGHT VENUE AND UNFORTUNATELY THE RIGHT VENUE FOR US IS NOT THE COUNTY OFFICE. THE LAST TIME THAT WE WERE QUOTE UNQUOTE SOCIALLY DISTANCE AT THE COUNTY OFFICE IT WAS A DIFFICULT MEETING BECAUSE SIX OF US WERE AT THAT DAY AND ON THE DAIS AND FIVE WERE BELOW. AND YOU KNOW, WHEN YOU WANT TO SPEAK YOU HAVE TO TURN AROUND TO SEE THE CHAIR. THAT WAS A DIFFICULT SETTING. SO WE'RE GOING TO HAVE TO FIND THE RIGHT VENUE TO DO WHAT WE NEED TO DO TO HOLD A PUBLIC MEETING. MR. MAYOR? YES. THE POINT OF COURSE THAT SMALLER BOARD THAT WAS THE CBO WAY THAT THEY MET AT THE GYM AND AT THE RECREATION FACILITY AND IT SEEMED TO WORK. I THINK I DON'T KNOW HOW MANY OF YOU WATCHED BUT IT SEEMED TO WORK PRETTY WELL AND THE DISTANCING BETWEEN THE PUBLIC PUBLIC DID GET TO SPEAK. I I YOU BRIAN YOU GOT AN EXCELLENT POINT. THE SOONER THE BETTER. AND IT MAY BE THAT SOME PEOPLE ON COUNTY COUNCIL ARE COMFORTABLE DOING THAT AND SOME ARE AND THOSE OF US WHO ARE MAYBE WE CAN DO IT THAT WAY. JUST A THOUGHT. >> HEY, IT'S A WONDERFUL DISCUSSION. MR. HERVEY SEAN, YOUR NEXT. THANKS, MR. CHAIRMAN. >> I THINK PORT ROYAL IS DOING THAT IS DOING THE SAME. LAST I SAW ONE OF THEIR MEETINGS. THEY WERE MEETING IN PERSON AND THEY HAD KIND OF IT'S HERE SET A YES THEY DID. YES. >> WELL WE'VE HAD MEETINGS, WALTER, THAT WORKED PRETTY WELL. >> I THINK DR. WOULD WORK. YEAH. THE RESTAURANT WAS GOOD. >> YEAH. CERTAINLY THAT SEEMS TO BE THE MOST APROPOS PLACE TO BEGIN PUBLIC MEETINGS BECAUSE IT'S A LARGE OPEN AREA. WE CAN SOCIALLY DISTANCE THE CHAIRS FOR INDIVIDUALS WHO COME THERE. THE MEETING THE TABLE IS LONG ENOUGH THAT WE CAN PUT IN THERE THAT WE CAN HAVE SEPARATION BETWEEN COUNCIL MEMBERS. SO YEAH, THAT'S THAT'S A STRONG POSSIBILITY. MR. RUDMAN. >> YES. MR. CHAIRMAN, I THINK WE COULD PERHAPS DO THIS IN TWO STEPS. IT SEEMS TO ME WE'RE AT A POINT THAT THE ELEVEN OF US COULD FIND A LARGE ENOUGH PLACE WHERE WE COULD LITERALLY HAVE ENOUGH SOCIAL DISTANCING AND GET STARTED AGAIN. BUT WE DON'T NECESSARILY HAVE TO HAVE THE PUBLIC FULLY ENGAGED AT THAT TIME AND THEN IT MAY BE SOME TIME AFTER WE FIGURE IT OUT WHEN WE CAN HAVE MORE PEOPLE COME. BUT I WOULD ENCOURAGE THE ELEVEN OF TO START TO MEET IN AND FACE TO FACE. I THINK YOU KNOW, CERTAINLY WE WE NEED JUST SIT AND DEVELOP A PLAN TO DO THAT. AND SO WE'LL COME UP. YOU KNOW, I WILL DISCUSS THIS WITH ASHLEY AS TO HOW WE COULD DO THE THE COUNCIL MEETINGS. I THINK FOR THE TIME BEING OUR COMMITTEE MEETINGS CAN REMAIN THE WAY THEY ARE OUR AGENDA MEETINGS CAN REMAIN THE WAY THEY ARE. BUT COUNCIL MEETINGS ARE IMPORTANT. THAT'S WHERE THE PUBLIC GETS TO SEE US INTERACT AND ACT. AND THAT'S AN IMPORTANT WAY OF DOING THINGS. SO YEAH, WE HAVE TO EXPLORE OR WHEN WE CAN DO THAT IN THE PROPER VENUE. OK. ANY OTHER QUESTIONS? SEEING NONE. >> OK. [11. DISCUSSION REGARDING SECOND READINGS AND PUBLIC HEARINGS ] ITEM NUMBER ELEVEN THERE IS AN ATTACHMENT TO HERE WHICH IS THE FLOW CHART OF AN ORDINANCE PASSAGE. NOW THIS IS THE WAY THE ORDINANCE IS SUPPOSED TO WORK. [01:05:06] OBVIOUSLY THE PUBLIC WEIGHS IN BEFORE THE FINAL ORDINANCE AND ORDINANCE HAS TO HAVE THREE READINGS AND A PUBLIC HEARING IN THE PAST. IT WAS ALWAYS DONE THAT THE HEARING WAS AT THE THIRD RANKING BOARD HAS BEEN CHANGED BY A PRIOR COUNCIL SO THAT WE HAD IT DONE AT THE SECOND READING. THERE IS A 15 DAY NOTICE IN BETWEEN THE TIME AND PLACE OF THE PUBLIC HEARING IN THE NEWSPAPER AND THEREFORE ON TONIGHT'S COUNCIL AGENDA. YOU WILL SEE THAT SIR ITEMS HAD TO BE MOVED TO A THIRD MEETING AND PUBLIC HEARING AT THE THIRD MEETING NOT THE SECOND MEETING BECAUSE WE JUST DIDN'T MAKE THE TIMELINE. SO THAT CONCERN WE HAVE IS WHAT IS COUNCIL'S PLEASURE ABOUT HAVING THE PUBLIC HEARING AT THE SECOND MEETING RATHER THAN THE THIRD? OR SHOULD WE JUST DO IT ALWAYS AT THE THIRD? SO I'D LIKE PEOPLE TO WEIGH IN ON THAT, MR. CHAIRMAN. >> MR. RUDMAN. YEAH, WE CHANGED IT A COUPLE OF YEARS AGO AND PART OF THE THOUGHT PROCESS WAS THAT IF WE WAIT THE THIRD READING AND WE REALLY DON'T HAVE THE INPUT FROM THE PUBLIC AND IN MANY TIMES THEY'VE DONE DEALS AND SO REALLY TO GET THE PUBLIC INPUT AT THE SECOND READING I THINK MAKES SENSE TO TRY TO ALWAYS DO IT UNLESS WE HAVE SOME CIRCUMSTANCES THAT MAKE IT DIFFICULT. >> BUT I WOULD LIKE THIS TO GO BACK TO A PUBLIC HEARING AT SECOND READING. >> THAT'S THAT'S THE WAY IT IS. WE JUST DIDN'T MEET THE TIMELINES TO TO DO THAT FOR SEVERAL OF THE ITEMS THAT ARE ON THE CONSENT AGENDA. AND SO WHAT WE HAVE TO DO IS MAKE SURE WE UNDERSTAND THIS FLOW CHART BECAUSE IT SHOWS FIRST READING AT LEAST ONE DAY TO THE SECOND READING IN AT LEAST SEVEN DAYS TO THE THIRD AND FINAL READING WHICH IS EIGHT DAYS. BUT THE FIRST READING I HAVE TO BE INTRODUCED 15 DAYS IS EVERYBODY UNDERSTAND THAT. >> DOES THAT MAKE SENSE OR AM I MISREADING THAT? >> NO, YOU'VE GOT IT. >> JOE, I THINK YOU'VE GOT A GOOD HANDLE ON IT. YEAH, I'D LIKE TO ECHO WHAT STU SAID IT. AND IF I REMEMBER CORRECTLY IT WAS HIS IDEA IN A REALLY MAKES A LOT OF SENSE FOR US TO RECEIVE PUBLIC INPUT AT A POINT WHERE WE CAN STILL AMEND AN ORDINANCE WITHOUT IT BEING REFERRED BACK TO FIRST READING IF YOU MAKE SUBSTANTIVE CHANGES BETWEEN THIS AND SECOND READING. YOU CAN STILL CONSIDER AND THEN VOTE A THIRD AND FINAL READING LATER ON. SO IT MAKES PERFECT SENSE TO GET PUBLIC INPUT AS EARLY IN THE PROCESS AS WE CAN. OKAY. >> YEAH. SO JUST AS LONG AS EVERYBODY KNOWS THIS IS THE PROCESS SO THAT WE MAKE SURE THAT WE'RE FOLLOWING THIS PROCESS AND YOU KNOW IT JUST HAPPENED THIS TIME AROUND. WE JUST COULDN'T MEET THE TIMELINES AND DEADLINES AND THAT'S WHY ITEMS THAT WERE ON THE AGENDA HAD TO BE MOVED FOR THE THIRD READING COMING UP. SO THAT'S WHERE WE ARE. ANY OTHER QUESTIONS ABOUT THIS? [12. COUNTY COUNCIL VALUES ] OKAY. THE LAST ITEM BEFORE WE GO INTO EXECUTIVE SESSION, BRIAN, IT WAS AS IF WE WERE MIND READING EACH OTHER WHEN YOU STATED THAT ,YOU KNOW, WE DISCUSSED THINGS AND THEN ONCE WE TAKE ACTION IT IS THE RESPONSIBILITY OF US TO INDICATE THAT THAT'S THE ACTION OF COUNCIL AND THEREFORE WHETHER WE WERE ON THE YES SIDE OR NO SIDE WANTS A DECISIONS MADE. WE RESPECT THAT DECISION AND WE MOVE FORWARD IN ALL OF MY YEARS WHEN I WAS IN EDUCATION. I DID ETHICS TRAINING FOR VARIOUS ENTITIES AND I USED THESE VALUES FROM MICHAEL JOSEPHSON. THERE ARE ELEVEN OF THEM OF WHO YOU ARE AND WHAT YOU STAND FOR AND WHAT YOU SHOULD BE WHEN YOU ARE IN THIS SETTING. SO I ASK EACH OF YOU TO TAKE A LOOK AT THIS TO REFLECT ON THIS WHEN YOU ARE MAKING DECISIONS, YOU KNOW THIS IS WHAT YOU SHOULD BE DOING AS A COUNCIL PERSON. AND ONCE THE DECISION IS MADE THIS IS THE DECISION OF COUNCIL AND WE MOVE ON FROM THERE. AND THE LAST THING IS SOMETHING THAT I ADDED. ITEM NUMBER TWELVE IS YOU HAVE [01:10:04] TO UNDERSTAND THAT WE ACTUALLY REPRESENT FOUR ENTITIES. YOU WERE ELECTED AS A COUNCIL PERSON REPRESENTING A SPECIFIC DISTRICT. AND I GET THAT. SO YOU REPRESENT THE DISTRICT THAT ELECTED YOU BUT NOT ONLY DO YOU REPRESENT THE DISTRICT THAT ELECTED YOU. YOU ARE A BEAUFORT COUNTY COUNCILMAN. SO YOU REPRESENT BEAUFORT COUNTY COUNCIL WHEREVER YOU ARE, WHATEVER MEETING YOU'RE IN, WHATEVER SIGNAGE YOU HAVE ON THERE THAT HAS YOU AS A MEMBER OF COUNTY COUNCIL. YOU REPRESENT COUNTY COUNCIL AND YOUR DISTRICT THEN YOU REPRESENT EVERY RESIDENT IN BEAUFORT COUNTY, NOT JUST THE DISTRICT YOU LIVE IN. EVERY RESIDENT OF BEAUFORT COUNTY. DECISIONS YOU MAKE HAVEN'T IMPACT ACROSS THE LINE. AND THEN FINALLY YOU AS A COUNCIL PERSON REPRESENT YOURSELF WHAT YOU SAY, WHAT YOU DO, HOW YOU SAY IT REFLECTS ON YOU AND I WANT US TO BE THE BEST COUNCIL WE CAN BE. I THINK ALL OF YOU ARE QUITE INTELLIGENT. I RESPECT YOU. YOU KNOW, I HAVE SAID THIS TIME AND TIME AGAIN AND I MEAN IT SINCERELY SINCE I BECAME CHAIRMAN AND I MADE THAT PLEDGE. YOU KNOW, YOU CAN CALL ME AND WE DISCUSS THINGS AND WHEN WE WE WE DO THAT. NOW I HAVE RECEIVED PHONE CALLS FROM EVERY SINGLE COUNCIL PERSON. WE HAVE DISCUSSIONS AND I THINK IT'S A GREAT WAY WE'RE WORKING TOGETHER. SO I THANK YOU FOR THAT. AND JUST PASS THOSE ON AS WE GO FORWARD. SO OUR ANY QUESTIONS ABOUT THAT OR ANY COMMENTS OK, SEEING NONE. I WOULD LIKE A MOTION IN SECOND [EXECUTIVE SESSION ] PLEASE TO GO INTO EXECUTIVE SESSION PURSUANT TO SECTION 30 DASH FOR A TO AN EXECUTIVE SESSION FOR THE RECEIPT OF LEGAL ADVICE OR LEGAL ADVICE RELATED TO A PENDING THREATENED OR POTENTIAL CLAIM OR OTHER MATTERS COVERED BY ATTORNEY CLIENT PRIVILEGE SETTLEMENT OF LEGAL CASE CLAIMS OR THE POSITION OF THE PUBLIC AGENCY. IN OTHER ADVERSARY'S SITUATIONS INVOLVED IN THE ASSERTION AGAINST THE AGENCY OF A CLAIM AND WE'RE GOING TO DISCUSS THREE SPECIFIC ITEMS ON MR. TAYLOR I CAN READ THOSE THREE SPECIFIC ITEMS. CAN I NOT? >> I THINK YOU HAVE TO GO. YES, YOU CAN. OK. THE FIRST WILL BE THE HILTON HEAD ISLAND LAWSUIT AND THE STATUS THEREOF. THE SECOND WILL BE THE AUDITOR LAWSUIT AND THE STATUS THEREOF. AND THE THIRD ONE WILL BE POTENTIAL RETIRE RE LITIGATE. MAY I HAVE A MOTION PLEASE? FOR THIS EXECUTIVE SESSION? SO MOVED. MR. CHAIRMAN, MR. FLOCK MAKES THE MOTION. >> MAY I HAVE SECOND PLEASE? SECOND CHAIR. OK, IT IS DULY MOTION. AND SECOND FOR THE CLOSED SESSION MAY I HAVE. ARE THERE ANY OBJECTIONS TO THIS? IF THERE ARE NO OBJECTIONS THIS WILL BE DONE IN ACCORDANCE WITH THE MOTION AND SECOND AND WE WILL NOW BE GOING INTO EXECUTIVE SESSION. THANK YOU. IT IS. 13 WILL PROBABLY COME OUT. WELL, WE WILL DEFINITELY COME OUT BEFORE WE GO INTO THE * This transcript was compiled from uncorrected Closed Captioning.
