ONE I'D LIKE YOU TO TO CALL THE COUNTY COUNCIL AGENDA FOR MONDAY SEPTEMBER 14TH.
[1. CALL TO ORDER]
TO ORDER ITEM NUMBER ONE HAS BEEN DONE. WE ARE HERE.I WOULD LIKE ALL OF YOU TWO GUYS FOR THE PLEDGE OF ALLEGIANCE AND OUR FIRST FIVE VISE CHAIR PAUL SOMERVILLE WILL LEAD US IN THAT. PAUL, YOU ARE ON.
IF NOT, I WILL DO IT. GOT IT. OK.
I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS. ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL. WHO WOULD VALUE YOUR HEADS PLEASE? LORD MAKE US AN INSTRUMENT OF YOUR PEACE WHERE THERE IS HATRED LET US BRING LOVE WHERE THERE IS A FENCE. LET US BRING PARDON. WHERE THERE IS DISCORD LET US BRING UNION WHERE THERE IS ERROR LET BRING TRUTH. WHERE THERE IS DOUBT BRING FAITH. WHERE THERE IS DESPAIR. LET US BRING HOPE WHERE THERE IS DARKNESS. LET US BRING YOUR LIGHT WHEN THERE IS SADNESS.
LET US BRING JOY. O M. THAT IF NOT SEEK SO MUCH TO BE CONSOLED AS TO CONSOLE, TO BE UNDERSTOOD, AS TO UNDERSTAND, TO BE LOVED, TO LOVE FOR IT IT IS IN GIVING THAT ONE RECEIVES IT IS IN SELF FORGETTING THAT ONE FINDS IT IS IN PARDONING THAT ONE IS PARDONED, IT IS IN DYING THAT ONE IS RAISED TO ETERNAL LIFE. A MAN TASTE MAY I HAVE EMOTION?
>> I'M SORRY. PUBLIC NOTIFICATION OF THIS MEETING HAS BEEN PUBLISHED, POSTED AND DISTRIBUTED IN COMPLIANCE WITH THE SOUTH CAROLINA FREEDOM OF INFORMATION ACT ALSO KNOWN AS FOIL. ITEM IS THE APPROVAL OF THE AGENDA.
[3. APPROVAL OF AGENDA]
WILL ONE OF THE MEMBERS OF COUNCIL PLEASE MAKE A MOTION TO APPROVE THE AGENDA?>> SO MOVEMENT CHAIRMAN THIS IS. >> MR. FLOWING MAKES THE MOTION A SECOND PLEASE. SECOND THE MOTION. COUNCILMAN HOWARD MAKES THE SECOND DOOLEY MOTION MADE AND SECONDED. ARE THERE ANY OBJECTIONS? SEEING NO OBJECTIONS. THE AGENDA IS APPROVED AS STATED.
[4. ADMINISTRATOR’S REPORT]
THE NEXT ITEM WILL BE THE ADMINISTRATORS REPORT ASHLEY JACOBS POLICE GIVE US A REPORT.GOOD EVENING, MR. CHAIRMAN. >> AND MEMBER OF THE PANEL WHO I HAVE CREATED FOR YOU.
WELL, THE FIRST IS THERE ARE ONLY 16 DAYS LEFT TO COMPLETE THE 2020 CENSUS.
I WANT TO ENCOURAGE ALL CITIZENS TO DO SO BY GOING TO THE COUNTY WEBSITE OR TO 2020 CENSUS. DON'T GO. WE ARE UP TO 50 PERCENT RESPONSE RATE. SO WE HAVE IMPROVED OVER THE PAST FEW WEEKS BUT WE WILL CONTINUE OUR EFFORTS TO ENCOURAGE EVERYONE TO PARTICIPATE AND GET THAT RESPONSE RATE EVEN HIGHER. THE REGISTER OF DEEDS. DALE BUTTS HAS REPORTED REVENUE OF OVER EIGHT HUNDRED THOUSAND DOLLARS FOR THE OF AUGUST IN OVERALL REVENUE FOR FISCAL YEAR 21 OF ONE POINT FOR SIX MILLION. TO PUT THAT IN PERSPECTIVE FOR YOU IN COMPARISON IN AUGUST OF FISCAL YEAR 19 WE COLLECTED FOUR HUNDRED EIGHTY FOUR THOUSAND DOLLARS AND IN AUGUST THE FISCAL YEAR 20 WE COLLECTED 443.
WE'RE ALMOST DOUBLE WHERE WE'VE BEEN OVER THE PAST COUPLE OF YEARS.
SO OBVIOUSLY REAL ESTATE IN GUILFORD COUNTY IS BOOMING IN OTHER GOOD NEWS .
THE HILTON HIT AIRPORT HAS RECEIVED A GRANT THAT WILL FUND OUR COMMERCIAL RAMP EXPANSION.
THE GRANT IS FIVE POINT THREE MILLION DOLLARS AND THERE'S A 100 PERCENT FAA BRANDED FUND AND THAT AS PART OF THE CARERS ACT WE CONTINUE TO PURSUE THOSE FUNDS AND OTHER FUNDS FOR THE TERMINAL PROJECT. THANK YOU SO FUN ASHLEY. ANY QUESTIONS FOR ASHLEY? NO, JUST THE COMMENT I CAN PERSONALLY VOUCH FOR THE RED DIRT.
I KNEW YOU WERE SMILING UP FOR THAT ONE. OK, ALL RIGHT.
WE HAVE A DUPLICATION OF ITEM NUMBER FIVE AS ITEM NUMBER TWO .
[6. AGENDA REVIEW]
SO WE'LL SKIP THAT AND GO ON TO THE AGENDA OF REVIEW. AS I INDICATED TO EVERYONE, I SPENT THE BETTER PART OF FRIDAY NIGHT MOST OF SATURDAY AND ALL DAY SUNDAY GOING OVER THE THREE HUNDRED AND THREE PAGES OF AGENDA ITEMS AND TAKING A LOOK AT THIS.IF WE WERE TO FOLLOW THE AGENDA EXACTLY THE WAY IT IS, WE WOULD BE MEETING FOR WELL OVER THREE HOURS. MORE THAN LIKELY THREE AND A HALF HOURS.
SO NOW I HAVE BOILED IT DOWN INTO TWO SECTIONS. THOSE ITEMS THAT CAN BE TAKEN AS A CONSENT ITEM AND THOSE ITEMS THAT WILL MEET NEED TIME. SO IF YOU WILL FOLLOW WITH ME, I HAVE GONE THROUGH THE AGENDA. AND HERE ARE THE ITEMS THAT HAVE GONE THROUGH THE VARIOUS COMMITTEES WITHOUT ANY KIND OF CONTROVERSY AND THEREFORE SHOULD BE ADDED TO THE CONSENT
[00:05:07]
AGENDA WHICH IS ALREADY ITEMS ONE THROUGH EIGHT. INCLUDED IN THAT WILL BE THE FOLLOWING ITEMS. ITEM NUMBER ELEVEN ITEM NUMBER 12 13 14 WHERE I NEED TO TAKE 14 OFF THE CONSENT AGENDA BECAUSE I NEED TO RECUSE MYSELF FROM THAT ITEM.>> WELL YOU CAN RECUSE YOURSELF . >> THAT DOESN'T MEAN IT NEEDS TO COME OFF THE CONSENT AGENDA . WELL, YES SIR IT IS.
>> IT DOES BECAUSE IF I VOTE FOR THE CONSENT AGENDA THEN I WOULD BE VOTING FOR ITEM NUMBER 14 AND I CAN'T DO THAT. WELL, SO THE ONLY ALTERNATIVE WOULD BE FOR ME TO NOT VOTE ON ANY OF THE ITEMS IN THE CONSENT AGENDA. AND I WANT TO VOTE ON THOSE OTHER ITEMS. OKAY. BUT UNDERSTAND WHEN THE CONSENT AGENDA IS DONE I WILL CALL FOR ANY OBJECTIONS AT THAT POINT IN TIME YOU CAN DECLARE THAT YOU CANNOT VOTE ON THAT AND YOU CAN FILL OUT WHY YOU CAN'T VOTE FOR ITEM NUMBER 14.
>> JOE AT THIS IS A CLEAR PROCESS AND LET'S MOVE. >> FORTUNATELY THAT'S NOT IT'S NOT GONNA WORK THAT WAY BECAUSE I WANT TO VOTE ON ALL THE OTHER ONES AND I WILL VOTE ON NUMBER 14. WE'D HAVE TO THEN, YOU KNOW, DO HAVE A SEPARATE VOTE ANYWAY AND THAT WHICH IS WHAT YOU NEED TO DO. MICHAEL, I'LL LEAVE LEAVE IT
OFF IS WHAT I'M SAYING. >> ITEM NUMBER 17, ITEM NUMBER 19 20 21 22 TWENTY THREE TWENTY SEVEN TWENTY NINE THIRTY THIRTY ONE AND THIRTY TWO. THEY HAVE ALL GONE THROUGH THE VARIOUS COMMITTEES. THERE ISN'T A CONTROVERSY OVER THEM.
SO THOSE ONES COULD BE ON THE CONSENT AGENDA AND VOTED IN ITS ENTIRETY THAT THAT WAS WAY
PAST. >> ALL RIGHT. LET ME GO THROUGH THEM AGAIN.
THE CONSENT AGENDA ADDING TO THAT AGENDA ITEM ELEVEN TWELVE THIRTEEN SEVENTEEN NINETEEN TWENTY 21 22 23 TWENTY SEVEN TWENTY NINE THIRTY THIRTY ONE AND THIRTY TWO THE ONLY JOE IF I COULD I THINK THAT ITEM NUMBER ELEVEN DOESN'T REQUIRE A VOTE OF COUNCIL AND SO YOU WOULD NOT NEED TO PUT THAT CONSENTED JED JUST READ THAT NOTICE LIKE JUST EXACTLY WHAT
IT SAYS IS THE TITLE AND THAT IS SUFFICIENT. >> I THINK YOU NEED TO GIVE THE
DATE AS WELL BUT THAT IS SUFFICIENT. >> THERE IS NO VOTE NECESSARY FOR ITEM NUMBER ELEVEN. OK, WE CAN DO THAT. ALL RIGHT.
THE ONES THAT ARE ST.. >> YEAH THAT THE EARLY ONES THAT YOU MENTIONED MANY OF THOSE PUBLIC HEARINGS. SO IT SEEMS TO ME YOU EITHER NEED TO LEAVE THE SECOND READING AT THE SAME TIME OR YOU COULD DO ALL THE PUBLIC HEARINGS TOGETHER BECAUSE USUALLY MOST PEOPLE DON'T RESPOND IN THESE AND THEN EITHER TAKE THEM UP AS A GROUP
OR PUT THEM ON THE CONSERVATIVE AGENDA. >> BUT YOU CAN'T DO THE PUBLIC
HEARINGS ON THE CONSENT AGENDA . >> THAT'S CORRECT.
STU OF ALL RIGHT. SO YOU WILL GET TO VOTE NO. WHEN WE GO PAST 8:00 O'CLOCK NO
WHAT? >> AT LEAST THAT'S WHAT STU IS RECOMMENDING.
IS THAT YOU SAY WILL NOW HAVE A PUBLIC HEARING ON ITEM NUMBER ELEVEN NOT ON THE AGENDA REGARDING A TEXT AMENDMENT TO THE COMMUNITY DEVELOPMENT CODE. IS THERE ANY PUBLIC COMMENT AND THEN YOU SAY THIS PUBLIC HEARING IS NOW CLOSED. WELL, MOVE ON AN ITEM NUMBER 13 AT A PUBLIC HEARING AND SECOND READING A PUBLIC HEARING REGARDING AN ORDINANCE FINDING THAT PHILLIP ISLAND PUBLIC SERVICE DESK GUARDS ANY PUBLIC COMMENT? THIS PUBLIC HEARING IS NOW CLOSED. THESE MATTERS ARE NOW PART OF
THE CONSENT AGENDA FOR VOTING AND ACT SUFFICIENT. >> OK, WE CAN DO THAT.
I APPRECIATE THAT. THANK YOU. AND THAT APPLIES TO A NUMBER 17 AS WELL. DID YOU HAVE THE YOU HAD NUMBER 17? YEAH. SO IT'S GOING TO BE DOWN 13, 14 AND 7 AND THE REST ARE JUST
[00:10:04]
FOUR. ALL RIGHT. >> WE WILL NEED MORE TIME FOR ITEMS SEVEN EIGHT. NINE, 15, 16. AND I WANT TO TALK ABOUT 16 MOMENTARILY 18, 24, 25, 26 AND 28. THOSE ARE THE ONES THAT ARE GOING TO NEED SOME SORT OF DISCUSSION. SOME ARE GONNA BE LENGTHY.
OTHERS NOT NECESSARILY IN ITEM NUMBER 16. I AM GOING TO LOOK FOR SOMEONE TO MAKE THE FOLLOWING MOTION FOR ITEM NUMBER 16. THE MOTION THAT I AM PROPOSING IS THIS I MOVE THAT THE SECOND READING OF AN ORDINANCE OF THE COUNTY COUNCIL BEAUFORT COUNTY, SOUTH CAROLINA ESTABLISHING AND ADOPTING A SCHOOL IMPROVEMENT IMPACT FEE TO BE IMPOSED ON ALL NEW RESIDENTIAL DEVELOPMENT IN THE SOUTH BEAUFORT COUNTY SCHOOL SERVICE AREA TO BE POST OWNED UNTIL OCTOBER 12TH 2020 TO ALLOW COUNTY COUNCIL TO ESTABLISH INTERGOVERNMENTAL AGREEMENTS BETWEEN BEAUFORT COUNTY AND THE BEAUFORT COUNTY SCHOOL DISTRICT AND INDIVIDUAL IN INTERGOVERNMENTAL AGREEMENTS BETWEEN BEAUFORT COUNTY AND THE TOWNS OF BLUFFTON AND HILTON HEAD ISLAND AND THE CITY OF THE HARDY VILLE TO ENSURE PROPER IMPLEMENTATION AND ADMINISTER NATION OF THE SCHOOL IMPACT FEE ORDINANCE REASON BEING IN. KURT CAN WEIGH IN ON THIS.
WE DO NOT HAVE IGAD IN PLACE AS YET. THEREFORE IT IS PREMATURE FOR US TO HAVE A PUBLIC HEARING. AND SECOND READING OF AN ORDINANCE THAT WE DON'T KNOW IF WE HAVE AGREEMENT BETWEEN THESE ENTITIES WE RECOMMEND THAT THE IGAD BE DONE PRIOR TO ADOPTION.
>> SO THAT'S WHY I'M LOOKING FOR US TO POSTPONE THIS SO THAT THEY CAN HAVE THE ABILITY TO GET THE IGAD DONE. MR. CHAIRMAN, I'D BE GLAD TO MAKE THAT MOTION BUT I THINK IT MIGHT BE PREFERABLE IF SOMEONE IN THE SERVICE AREA SOUTH IS ABROAD MAKE IT AND THEN I CAN SECOND THAT HERE. THAT'S FINE. OK.
OK. I DON'T MIND BEING THAT IF YOU'LL E-MAIL THAT TO ME.
OH BOY I CAN'T YOU GET MICHAEL . >> I'LL BE GLAD TO SECOND IT.
YEAH. WHEN I DO IS WHEN WE GET TO THAT ITEM I WILL READ THAT MOTION AND THEN BECAUSE I WILL BE ASKING FOR A MEMBER OF COUNCIL TO MAKE THAT MOTION AND THEN YOU CAN MAKE THE MOTION SOMEBODY CAN SAY ALBERT GO AHEAD A SECOND NOW.
OKAY. ALL RIGHT. SO WITH THAT IN MIND, IF IN FACT WE HANDLE THE AGENDA TH&-PN AGREED UPON FIRST READINGS AND SOLUTIONS NEEDED TO STAY ON AS
[00:16:37]
AN ACTION ITEM PER AMENDMENT ON A WHILE AGO. SO TO SUM FORWARD NOW THAT'S THAT'S AN EXCELLENT POINT, SIR. I THINK THAT IS SOMETHING THAT WE AS THE EXECUTIVE COMMITTEE SINCE WE COMPOSE OF THE HEADS OF EVERY ONE OF THE COMMITTEES WILL TAKE THAT ITEM UP AND MAKE THE DECISION GOING FORWARD IF THAT'S WHAT WE WANT TO DO. THAT'S THE PLEASURE OF THIS COUNCIL. YOU KNOW, THIS PARTICULAR TIME JUST BECAUSE THIS AGENDA WAS SO LENGTHY, I TOOK IT UPON MYSELF TO TRY AND DO THIS IN A MANNER THAT WE CAN GET THROUGH EVERYTHING WE NEED TO GET THROUGH AND GOING FORWARD WE'LL .BUT THANK YOU. WE'LL PUT THAT ON THE NEXT EXECUTIVE COMMITTEE AGENDA IF IF I MIGHT JUST SPEAK TO THAT REAL QUICK. I THINK THE IN 10 OF COUNCIL ALL ALONG WAS THAT THAT FIRST READING REALLY SERVES AS NOTICE TO THE PUBLIC.
THEY WE ARE ACTIVELY CONSIDERING A SPECIFIC LEGISLATIVE MEASURE AND THAT IS THAT IT IS IN THE CONSENT AGENDA AND VOTED ON. I'VE ALWAYS THOUGHT WAS SUFFICIENT TO THAT PURPOSE. I LIKE THE IDEA OF SECOND READING BEING AN ACTION ITEM OF COUNCIL BECAUSE THAT PROVIDES US THEN WITH THE OPPORTUNITY TO OFFER MOTIONS TO AND OR DELAY OR SUBSTITUTE WHATEVER WE NEED TO DO THEN IF THAT IS CONCURRENT WITH A PUBLIC HEARING THAT PROVIDES AN EVEN BETTER OPPORTUNITY. STU RECOMMENDED A LONGTIME AGO THAT WE PROVIDE THE EARLIEST OPPORTUNITY FOR A PUBLIC HEARING SO THAT WE CAN OFFER THOSE AMENDMENT AND I ABSOLUTELY AGREE WITH THEM THAT THE PUBLIC WILL HAVE AN OPPORTUNITY TO OFFER AMENDMENTS OR THEIR THEIR THEIR THOUGHTS ON PENDING LEGISLATION SO THAT
SO THAT WE CAN HAVE THAT IN MIND AS WE AT LEAST MAKE IT. >> SECOND READING AND I'VE ALWAYS THOUGHT THAT'S A REALLY GOOD IDEA AND WE NEED TO CONTINUE HAVING PUBLIC HEARING AT SECOND READING AS MUCH AS POSSIBLE AT THE SAME TIME THE SAME MEETING WE ARE HAVING.
BRADY SO LET'S TRY TO KEEP THAT IN MIND AND WE'VE WE'VE ACCOMPLISHED THAT HERE WHICH IS
SEPARATING THE PUBLIC HEARING FROM THE VOTE. >> AND I THINK THAT'S FINE.
>> MY APOLOGIES. MY COMPUTER JUST CRASHED SO I JUST HAD TO.
SO I MISSED A COUPLE THINGS BUT HERE LET ME LET ME RECAP IT FOR YOU JOE BLAH BLAH BLAH BLAH
BLAH BLAH BLAH BLAH BLAH BLAH BLAH BLAH. >> NO, I LIKE WHAT YOU SAID AND
WE'LL WE'LL GET THAT DONE. OKAY I'LL DO IF I COULD. >> YEAH GO AHEAD.
YEAH. >> BUT MY BELIEF HAS ALWAYS BEEN THAT THE FIRST READINGS AS LONG AS WE TALK ABOUT THEM SERVE THE PURPOSE TO PUT THEM ON THE CONSENT AGENDA.
BUT THERE MAY BE SOME THAT ARE EITHER CONTROVERSIAL OR SO IMPORTANT.
IT'S WORTH TAKING IT OFF THE CONSENT AGENDA. I'VE ALSO BELIEVE THAT ANY NON-CONTROVERSIAL THIRD READINGS CAN STAY ON THE CONSENT AGENDA.
WE DON'T HAVE ANY HEROES TONIGHT. WELL YOU KNOW THE WHOLE IDEA IS THAT WE HAVE IN THIS PARTICULAR COUNTY COUNCIL THIS YEAR WE HAVE AN EXCEPTIONAL AMOUNT OF
[00:20:03]
INPUT AT THE COMMITTEE LEVEL BECAUSE THE VAST MAJORITY OF COUNCIL MEMBERS ARE AT.>> SO WHATEVER IS COMING OUT OF THE COMMITTEE REALLY HAS BEEN DISCUSSED IN DEPTH.
SO WHEN YOU GET TO THE COUNCIL MEETING, YOU KNOW THERE ISN'T A SHOCKER FROM THE VAST MAJORITY OF COUNCIL. OH, I DIDN'T KNOW WE WE DID THIS.
IT'S MAYBE ONE OR TWO THAT HAVE A PROBLEM WITH SOMETHING. SO YEAH, WE WILL FLESH ALL OF THIS OUT AND COME TO AN AGREEMENT THAT THIS IS A GOOD WAY OF MOVING FORWARD THINKS THE PUBLIC APPRECIATES HAVING THREE OR FOUR OR FIVE IMPORTANT ITEMS THAT WE TALK ABOUT IN AND FOCUS ON THOSE AND THEY CONTINUE IN FORM AND NOT BE TIED UP IN A LARGER NUMBER.
>> WELL, THAT'S THAT'S VERY TRUE THAT YOU KNOW THEY WANT TO GET TO THE MEAT OF THE MEETING.
WHAT IS HAPPENING, YOU KNOW, WHAT IS THE CONTROVERSIAL ISSUE OR ISSUES? WHAT IS THEIR INPUT AND GO FROM THERE? OK.
ANY OTHER ITEM OF DISCUSSION BEFORE WE GO INTO EXECUTIVE SESSION SEEING NONE PURSUANT TO
[EXECUTIVE SESSION]
THE SOUTH CAROLINA SECTION 30 DASH FOR 70S NUMBER TWO AN EXECUTIVE SESSION ITEM TITLED THE RECEIPT OF LEGAL ADVICE WHERE THE LEGAL ADVICE RELATES TO A PENDING CLAIM OR OTHER MATTER COVERED BY ATTORNEY CLIENT PRIVILEGE SETTLEMENT OF LEGAL CAIN CLAIMS OR THE POSITION OF THE COUNTY IN AN ADVERSARY ADVERSARY SITUATION INVOLVING THE ASSERTION AGAINSTTHE COUNTY OF A CLAIM. >> MAY I HAVE A MOTION TO GO INTO EXECUTIVE SESSION BY STARE
STILL MAKES THE MOTION OUR SECOND BRIAN MAKES THE SECOND. >> WITHOUT OBJECTION.
ARE THERE ANY OBJECTIONS SAYING NO
