I WANTED TO ADDRESS YOU THIS MORNING OR THIS AFTERNOON, AND JUST TELL YOU THAT THE PLAN, THE PINE ISLAND PLAN AND DEVELOPMENT AGREEMENT, WHICH WE HAVE PROPOSED, IS A RESPONSIBLE NO IMPACT DEVELOPMENT THAT PROVIDES GREATER ENVIRONMENTAL PROTECTION, LESS IMPACTS, ALL WHILE CREATING MORE REVENUE THAN A LARGER, MORE DENSE NEIGHBORHOOD DEVELOPMENT, WHICH IS CURRENTLY ALLOW UNDER THE CPO ALSO CREATING JOBS AND SIGNIFICANT COMMUNITY INVESTMENTS.
UNFORTUNATELY, I ALSO NEED TO ADDRESS WHAT THE PLAN IS NOT.
WE'VE ALL SAT HERE, I'VE BEEN HERE, AND ALL THE COUNCIL MEMBERS HAVE HEARD FROM MANY OF THESE ANTI-DEVELOPMENT GROUPS, MANY OF WHICH ARE HERE, AND MANY OF WHICH HAVE PUT PEOPLE FORWARD BEFORE TO COMPLAIN ABOUT THREE PRIMARY THINGS WITH DEVELOPMENT OR DENSITY OR TRAFFIC.
AND THERE'S NOT ENOUGH INFRASTRUCTURE TO HANDLE.
BUT WE HAVEN'T HEARD THAT IN THIS SITUATION, AND THAT'S BECAUSE THOSE DON'T EXIST UNDER THIS DOWN ZONING PLAN.
AND SO WHAT HAVE THEY DONE? THEY PIVOTED TO PRECEDENT AND DESTRUCTION OF THE CPO AND BY WAY OF THAT DESTRUCTION OF A CULTURE, THESE ARGUMENTS ARE OBJECTIVELY FALSE AND INTENTIONALLY MISLEADING.
THE APPLICATION BEFORE YOU IS AN AMENDMENT TO A ZONING MAP ZONE REMOVAL OF A PRIVATE PROPERTY ON THE PERIPHERY OF THE CPO.

HAS BEFORE AT A PROPOSED DEVELOPMENT AGREEMENT THAT IS DEPENDENT ON COUNCIL VOTING TO CARVE OUT THE PINE ISLAND PROPERTY.
FROM THE LONGSTANDING PROTECTIONS OF THE CULTURAL PROTECTION OVERLAID DISTRICT, WE URGE YOU TO DISPENSE WITH THIS NEWEST ATTEMPT TO ALLOW A DEVELOPMENT THAT WOULD SET A TRULY CATASTROPHIC PRECEDENT AND DESTROY THE PROTECTIONS OF THE CPO AND THE COMPREHENSIVE PLAN THAT HAS BEEN IN PLACE FOR DECADES.
THE COUNTY HAS CONSISTENTLY TAKEN A STAND FOR THE COMMUNITY AND INDEED FOR THE STATE AND BEYOND, AND MY CLIENTS AND I ARE VERY PARTICULARLY GRATEFUL FOR THAT TODAY.
I'M SURE YOUR COUNSEL WILL INFORM YOU OF THE BASIC POINT THAT SECTION 6 31 70 OF THE DEVELOPMENT AGREEMENT ACT REQUIRES THAT A DEVELOPMENT AGREEMENT MUST BE CONSISTENT WITH THE GOVERNMENT'S COMPREHENSIVE PLAN AND LAND DEVELOPMENT REGULATIONS.
AT THIS POINT, THE DE DEVELOPMENT AGREEMENT THAT HAS BEEN SUBMITTED FOR CONSIDERATION IS SOUNDLY INCONSISTENT WITH THE RULES OF THE COUNTY.
ONE OF THE NEGATIVE ASPECTS OF THE DEVELOPMENT AGREEMENT PROCESS IS THAT THESE NEGOTIATIONS ARE BEHIND CLOSED DOORS AND DON'T GIVE THE PUBLIC THE INFORMATION THAT THEY NEED TO KNOW WHAT IS GOING ON, BUT BE THAT AS IT MAY, IT'S INAPPROPRIATE AT THIS TIME TO COMMENCE WITH THAT

PROCESS WHEN THE COUNTY HAS NOT AMENDED THEIR ORDINANCE.MEMBERS OF COUNCIL, WE'VE SEEN THIS SHOW BEFORE PINE ISLAND HAS TRIED EVERY ITERATION TO GET AROUND WHAT HAS BEEN THE VERY CLEAR POSITION OF COUNSEL SINCE 2022.
THE PRIOR ATTEMPTS HAVE BEEN CONSISTENTLY RE REJECTED.
AND NOW COUNSEL HAS BEEN SUBJECTED TO LENGTHY LITIGATION BY THIS DEVELOPER BOTH IN STATE AND FEDERAL COURT.
THEIR PLAN OF ATTACK HAS BEEN CONSISTENTLY EVOLVING IN THE HOPES THAT THE POLITICAL PROCESS WILL WEIGH IN THEIR FAVOR.
THE DEVELOPERS KNEW THESE WERE THE RULES WHEN THEY WENT UNDER CONTRACT AND COMMENCED TO TRYING TO SWAY COUNTY STAFF.
THEY HAVE NOT SUCCEEDED TO THIS POINT AND THE COUNTY IS DOING THE RIGHT THING IN STAYING THE COURSE.
WE URGE YOU TO STOP THIS LATE LATEST ATTEMPT AND THE SMOKE AND MIRRORS THE DEVELOPER IS PUTTING BEFORE YOU IN ITS TRACK.
