WE URGE YOU TO DISPENSE WITH THIS NEWEST ATTEMPT TO ALLOW A DEVELOPMENT THAT WOULD SET A TRULY CATALYST TRAFFIC PRECEDENT AND DESTROY THE PROTECTIONS OF THE CPA AND THE COMPREHENSIVE PLAN THAT HAS BEEN IN PLACE FOR DECADES. AT THIS POINT THE DEVELOPMENT AGREEMENT THAT HAS BEEN SUBMITTED FOR CONSIDERATION IS SOUNDLY INCONSISTENT WITH THE RULES COUNTY. PINE ISLAND HAS TRIED EVERY ITERATION TO GET AROUND WHAT HAS BEEN THE VERY CLEAR POSITION OF COUNCIL SINCE 2020 TO THE ATTEMPTS HAVE BEEN CONSISTENTLY REJECTED AND NOW [00:10:01] COUNCIL HAS BEEN SUBJECTED TO LENGTHY LITIGATION BY THIS DEVELOPER BOTH IN STATE AND FEDERAL COURT. THEIR PLAN OF ATTACK HAS BEEN EVOLVING IN THE HOPES THAT THE POLITICAL PROCESS WILL WEIGH THEIR FAVOR. THE DEVELOPERS KNEW THESE WERE THE RULES WHEN THEY WENT UNDER CONTRACT AND COMMENCED TO TRYING TO SWAY COUNTY STAFF. THEY HAVE NOT SUCCEEDED TO THIS POINT AND THE COUNTY IS DOING THE RIGHT THING IN STAYING THE COURSE.
