WE WILL NOT WOULD STILL HAVE COUNCIL MEMBERS DECIDING WHAT ORGANIZATIONS THEY WANT TO LAY LIAISON ON WITH BOARDS AND COMMISSIONS AND ALSO EXTERNAL ORGANIZATIONS THAT THEY WANT TO LIAISON WITH. BUT WE WILL HAVE THAT BY THE

[8. PUBLIC COMMENT PERIOD]

NEXT MEETING AND HAVE LIAISON REPORTS. ONE OTHER SMALL CHANGE THAT WE MADE WAS TO MAKE ALL THE PUBLIC COMMENT PERIOD AT THE BEGINNING OF THE MEETING.

THAT'S THAT WAY IT DOESN'T HAVE TO BE BY AGENDA ITEM AND HOPEFULLY THAT WILL ACCOMMODATE THE PUBLIC IN A MANNER THAT THEY CAN COME. WE STILL HAVE THE THREE MINUTE LIMIT AND AT THIS TIME WE ARE GOING ASK FOR PUBLIC COMMENT. WE HAVE TWO PEOPLE SIGNED UP.

I'D LIKE TO REMIND EVERY MEMBER OF THE PUBLIC WHO'S RECOGNIZED TO SPEAK LIMIT THEIR COMMENTS TO 3 MINUTES AND OBSERVE THE FOLLOWING PROTOCOL ADDRESS THE CHAIRMAN AND IN SPEAKING AVOID DISRESPECT TO COUNCIL IN ANY PERSONALITIES CONFINE THEMSELVES TO QUESTIONS THE JURISDICTION OF COUNCIL BE MINDFUL AND RESPECTFUL THOSE WHO ARE PRESENT AND OTHERS WHO MAY BE WATCHING ON TELEVISION. I'D ALSO LIKE TO REMIND THE PUBLIC THEY MAY HAVE QUESTIONS . WE WILL NOT RESPOND BUT IF YOU HAVE A QUESTION THAT WE CAN HAVE STAFF OR OTHER PEOPLE LOOK INTO AT THAT TIME YOU'LL WRITE IT DOWN AS PART OF YOUR PUBLIC COMMENT WILL WE'LL IT FURTHER BUT WE'RE NOT ANSWERING QUESTIONS DURING PUBLIC COMMENT IS FOR US TO LISTEN TO YOU SO THE FIRST PERSON WHO SIGNED UP WAS RUSSELL WALSH AND HE'S IF HE'LL COME FORWARD HE'S GOING TO TALK ABOUT CODE ENFORCEMENT .

YES. THINGS. I'M RON WALSH MORNING THANK COUNCIL FOR GIVING ME THE OPPORTUNITY TO SPEAK TO YOU SECOND TIME CONCERNING THE SAME MATTER I CAME HERE SPOKE ABOUT THE FOUR ONE WE REMOVED BEAUFORT EVERYBODY WANTS TO MOVE TO BEAUFORT BECAUSE THIS BEAUTIFUL PLACE I WAS BORN AND RAISED HERE AND IF I BUY A PIECE OF PROPERTY IN BEAUFORT FIRST THING I'M GOING TO DO IS GET A SURVEY CORRECT AND WE GET A TRUE SURVEY AFTER THAT RIGHT AND IMPACT FEES SEPTIC ELECTRIC.

WELL, SOME PEOPLE DON'T THINK THAT THEY HAVE TO ABIDE BY THESE RULES OF AN AND I JUST LOST THE PLACE THAT I WOULD HAVE BEEN POLICE IN FOR 28, 29 YEARS FOR CONSERVATION, FOR HUNTING, FOR TURKEYS AND DEER, ALL THE THINGS AND A PERSON HAD BOUGHT SOME PROPERTY IN FRONT OF ME AND THIS IS THE SECOND TIME THIS HAS HAPPENED TO ME AND IT WAS ALL BOTH ON HALF ACRE THAT THEY HAD BOUGHT BUT THEY'D CLEARED TREES THAT ARE PROTECTED AND YEAH THE TREE FARM SHALDON ROAD I'M PARTLY RESPONSIBLE FOR BEING PART OF THAT AND I NEVER THOUGHT I'D BE A TREE HUGGER. THAT'S WHAT I SAID THE FIRST TIME I CAME IN THE TRUST YOU KNOW FOR ONE AS SOON AS A PERSON STARTED CLEARING AND WITH MINE AND THINGS LIKE THAT AND THEY WERE FOUND IN CONTEMPT OF COURT BY OUR MASTER INEQUITY MR. DUKES HE'S NOT THE MASTER NEXT WELL I THINK WE HAVE ONE RIGHT NOW BUT WE DO NEED IN MASTER AND EQUITY THE PERSONS

[00:25:03]

FOUND IN CONTEMPT OF COURT THREE OR FOUR TIMES THAT PUT JAIL ON ANYTHING CONTINUES TO CLEAR CLEARING OTHER PEOPLE'S TREES THAT ARE PROTECTED LIVE OAKS OVER 20 INCHES AND FOLLOWED THEM UP ON AN ATTORNEY. MR. WALLACE I'LL SAY NAME ONTARIO MOOSE ON HIS PROPERTY NEXT TO IT AND THEY WERE THERE AGAIN TODAY NO SITE PREP, NO NO PERMIT. SO I IMMEDIATELY CALLED THE COURTHOUSE AND SAYS WELL I KNOW I'VE GOT TO HAVE A PERMIT OR SURVEY OR A TREE BEFORE I DO ANY OF THIS.

WELL, AS A RESULT I'VE LOST THAT 2829 ACRES THAT I'M TO LEASE AND FOR ALL THOSE YEARS FOR ME AND MY GRANDSON FOR ME THE LAW IF I BUY A HALF ACRE OR ACRE I'LL GET TO SURVEY IT FIRST. I'LL GO BY RULES THE LAW AND I'M GOING TO ADDRESS THE THE TREE ISSUES, THE IMPACT FEES AND I'M GOING TO PAY THEM AT COUNTY COURTHOUSE.

THAT MONEY GOES TO US ALL. EVEN THE FINES FOR THIS PERSON DOING THIS THAT MONEY GOES TO ALL WE'VE GOT NOW WHAT FIVE SIX ASSISTANT COUNTY ADMINISTRATORS AND TRIED TO CALL THIS COUNTY ADMINISTRATOR AT LEAST ON MY PHONE FOR OVER TWO WEEKS AND I LEFT A MESSAGE TO GET IN TOUCH WITH HIM. BUT ANYWAY IT'S GOT TO STOP THIS CLEARING WITHOUT THE PROPER PERMITS AND WITHOUT A SURVEY BEING DONE FIRST BECAUSE THEY'VE ENCROACHED ON TO PEOPLE'S PIECES OF PROPERTY AND I'VE LOST MY LEASE BECAUSE THIS AND THIS CONTINUES TO HAPPEN.

THANK YOU MR. ALL FOR COMING YOU. OKAY.

NEXT WE HAVE ELIZABETH HAYES AND THE TOPIC IS PINE ISLAND. HI, GOOD EVENING.

MY NAME IS ELIZABETH AND I JUST WANTED TO DIRECT MY WHAT I HAVE TO SAY ALSO TO MR. YORK GLOVER AS WELL. IT'S FUNNY THAT THE COMMUNITY MEMBERS, LEADERS AND INFLUENCERS ARE OKAY WITH THE LAND BEING LEFT ALONE UNDEVELOPED AND NOT BENEFITING THE GULLAH PEOPLE. IRONICALLY WHEN GULLAH GEECHEE LAND IS LEFT ALONE AND UNDEVELOPED THE ONLY ONES BENEFIT FROM THAT ARE THE CITY AND COUNTY COUNCILS AND ORGANIZATION LIKE CCL MY I JUST WANT TO SAY THAT IT'S A LITTLE DISHEARTENING AND CONFUSING TO ME THAT MR. GLOVER NO LONGER SUPPORT THE PINE ISLAND DEVELOPMENT OF THE SIX HOLE GOLF COURSE WITH A 400 PLUS ACRE CONSERVATION THAT WILL PROTECT THE LAND.

IT WILL EXACTLY IT WILL DO EXACTLY WHAT YOU SAY THAT YOU STAND WHICH ARE IT WILL BRING ECONOMIC AND CULTURAL GROWTH A SPECIAL FOCUS ON BALANCING DEVELOPMENT AND PRESERVING THE UNIQUE CHARACTER SAINT HELENA ISLAND. IT WILL PROMOTE ECONOMIC OPPORTUNITIES TAILORED TO SAINT HELENA ISLAND. IT WILL EXPAND THE PUBLIC INFRASTRUCTURE AND PROTECT BOTH FAMILY INTERESTS AND LOCAL PROPERTY VALUES.

BUT YOU SUPPORT AN AIRPORT UPGRADE THAT WILL DO NOTHING FOR YOUR COMMUNITY.

IN FACT IT WILL AID IN THE GENTRIFICATION OF YOUR VERY OWN COMMUNITY.

SECONDLY I WOULD LIKE TO POINT OUT HOW BEAUTIFUL THE PLANS ARE FOR THE YMCA THAT'S COMING TO HARTVILLE. BUT MY QUESTION TO YOU MR. GLOVER IS AFTER SEVEN YEARS IN YOUR SEAT AND LISTENING TO MISS CAREY FOR SEVERAL YEARS WHY NOT A YMCA OR A MULTIPURPOSE COMMUNITY CENTER A PLAN FOR YOUR COMMUNITY? LASTLY I ALSO I EMAILED YOU AGAIN LAST WEEK TO NO AVAIL YOU STILL DIDN'T RESPOND. I STILL HAVEN'T FOUND ANY OF YOUR OTHER ARTIFACTS. I'M STILL LOOKING IF YOU COULD PLEASE JUST LET ME KNOW WHAT THEY AND I'LL ADD THEM TO THE SCORECARD THAT I'M PUTTING TOGETHER FOR YOU SO.

IT WOULD BE YOU KNOW, SORT OF PEOPLE CAN KNOW I NEED YOUR HELP TO HELP YOU I NEED YOU TO HELP ME HELP YOU SO CAN GIVE THE PEOPLE WHAT THEY WANT WHICH IS WHAT'S REALLY GOING ON AND WHAT YOU ARE REALLY FOR THEM IN THE COMMUNITY. THANK YOU.

THANK KNOW WE HAVE DO WE HAVE ANY LIGHT SIGN UPS FOR PUBLIC COMMENT? NO. OKAY. NONE OF THAT TIME AT THIS TIME.

OKAY. THE NEXT THING ON THE AGENDA IS ORDINANCES BY READINGS WE'RE GOING TO START WITH THIRD READING AND OUR VICE CHAIRMAN MR. IVANEK IS GOING TO GO THROUGH THESE AND WE'LL GO TO THIRD SECOND AND THEN FIRST READINGS AND WITH PUBLIC

[9.a. 2025/01 AN ORDINANCE AMENDING BUDGET ORDINANCE 2024/25, TO REFLECT THE APPROVAL OF USE OF GENERAL FUND -FUND BALANCE FOR $3,300,000 FOR FLEET SERVICES VEHICLE AND EQUIPMENT PURCHASES Vote at First Reading on November 12, 2024 - 10:0 Vote at Public Hearing and Second Reading on December 9, 2024 - 11:0]

COMMENT THOSE I'M GOING TO TURN IT OVER TO HER JUST TO START WITH THE THIRD READING THANK YOU ORDINANCE FOR THE THIRD READING IS AND WE ARE NOW NAMING OUR ORDINANCES SO YOU CAN EASILY FIND THEM WE DIDN'T PUT THE NUMBERS PREVIOUSLY 2020 5/01 IS AN ORDINANCE AMENDING BUDGET ORDINANCE 2024 SLASH 25 TO REFLECT THE APPROVAL OF USE OF GENERAL FUND FUND BALANCE

[00:30:06]

FOR $3,300,000 FOR FLEET SERVICES VEHICLE AND EQUIPMENT PURCHASES.

THE FIRST READING WAS NOVEMBER 12. THE SECOND READING AND PUBLIC HEARING WAS DECEMBER 9TH. CAN I HAVE A MOTION PLEASE? SO MOVE.

THANK YOU. SESSION NO SECOND. THANK YOU MR. GLOVER.

MR. ROBINSON DO YOU WANT TO GIVE THE PUBLIC A BRIEF RECAP? WE THINK IT'S IMPORTANT THAT THE PUBLIC CAN HEAR THE RECAP EVEN THOUGH WE HAVE TALKED ABOUT THIS AD INFINITUM.

I FEEL YES, MA'AM, I CERTAINLY WILL. SO THIS $3.3 MILLION REQUEST FROM FUND BALANCE IS FOR THE PURCHASE OF VEHICLES FOR VARIOUS DEPARTMENTS THROUGHOUT THE COUNTY. THE AMONG THE LIST WHICH IS IN THE BACKUP MATERIAL, THERE'S ABOUT 26 VEHICLES IN THAT LIST. THAT INCLUDES SOME ADA VANS, 88 COMPLIANT VANS, SOME BUS I THINK THERE'S A BUS IN THERE FOR SENIOR THOSE TYPES OF THINGS AS WELL AS VARIOUS SMALL VEHICLES THROUGHOUT THE ORGANIZATION THERE ARE VERY FEW OF THOSE VEHICLES ARE ADDITIONAL VEHICLES THE LARGE MAJORITY OVER 90% OF THOSE ARE REPLACEMENT OF OLDER VEHICLES THAT HAVE SEEN THEIR LIFE BEYOND THEIR LIFE EXPECTANCY OF THEM.

I THINK ANYBODY HAVE A QUESTION FOR MR. ROBINSON OR DISCUSSION ON THIS ITEM.

I MEAN REALLY WE'VE TALKED ABOUT THIS QUITE A BIT. ALL RIGHT.

THANK YOU. THANK YOU. SO I'D LIKE TO TAKE A VOTE ALL IN FAVOR OF THIS MOTION. PLEASE RAISE YOUR HAND. I'LL OPPOSE.

OKAY. PASSES. THANK YOU.

WE'RE GOING INTO ORDINANCES FOR SECOND READING AND THESE WILL BE FOR PUBLIC HEARING AND

[10.a. 2025/02 AN ORDINANCE AMENDING THE COMMUNITY DEVELOPMENT CODE (CDC): SECTION A.6.40 (PERMITTED ACTIVITIES) TO ALLOW LODGING: SHORT-TERM HOUSING RENTAL (STHR) IN DALE COMMUNITY PRESERVATION DISTRICT (DCP) AND SECTION A.7.40 (PERMITTED ACTIVITIES) TO ALLOW LODGING: SHORT-TERM HOUSING RENTAL (STHR) IN DALE MIXED USE DISTRICT (DMU) (PUBLIC HEARING) Item The item was approved without objection at the Community Services and Land Use Committee Meeting on November 12, 2024. (Recusal: Councilman Dawson) Vote at the First Reading on December 9, 2024 - 11:0]

SECOND READING ORDINANCE 2025 SLIDE SHOW TWO IS AN ORDINANCE AMENDING THE COMMUNITY DEVELOPMENT CODE REFERRED TO AS THE CDC SECTION 8.6. 40 PERMITTED ACTIVITIES TO ALLOW LODGING SHORT TERM HOUSING RENTALS IN DALE COMMUNITY PRESERVATION DISTRICT AND SECTION 8.2 7.40 PERMITTED ACTIVITIES TO ALLOW LODGING SHORT TERM HOUSING RENTAL IN DALE MIXED USE DISTRICT SO CAN I HAVE A MOTION PLEASE? THAT'S A MOVE.

OKAY MR. GLOVER SECOND I'LL SECOND MR. CUNNINGHAM. MR. MERCHANT WHY IS HE HERE? OKAY. CHATHAM VICE-CHAIR OH YES. I'M GOING TO HAVE TO RECUSE MYSELF FROM THIS YES YOU ARE THIS AGENDA ITEM THE APPLICANT AND MYSELF WE BOTH HAVE THE SAME LAST NAME I CAN'T SAY THAT WE RELATED BUT NEVERTHELESS FOR THE OF CONFUSION FROM A PUBLIC SCRUTINY POINT OF VIEW MY LIKE YOU MADAM CHAIRMAN I MAKE A COMMENT IT HAS ON HERE LIVE ALL VOTES MR. DAWSON NEVER VOTED SO YOU SHOULD HAVE BEEN IN THERE ACCUSED HIMSELF.

ALL RIGHT. BUT IT SHOULD BE TEN ZERO ONE IF WE HAVE TO GET A REFUSAL FORM FOR HIM FROM HIM FOR LAST ONE HE DIDN'T FILL IT OUT. GOT YOU.

OKAY, WE'LL JUST HOUND HIM FOR THAT. GOTCHA.

OKAY. OKAY. THE ITEM WHEN IT WAS FIRST APPROVED NOVEMBER 12 AND IT DOES SAY RECUSAL COUNSEL DOES IS IT RIGHT BUT THEN MOST OF THE VOTE IN FIRST READING WAS DECEMBER 9TH TO THIS. SO YOU WANT TO SPEAK MR. ATKINSON LET THE PUBLIC KNOW ABOUT SURE. SO IN A NUTSHELL WHAT THIS DOES IS IT ALLOWS FOLKS IN THAT DISTRICT IF IT PASSES THE OPPORTUNITY TO APPLY AND PARTICIPATE IN THE SPECIAL USE SHORT TERM RENTAL PROCESS, IT DOESN'T GUARANTEE ANYBODY YOU'LL GET A SHORT TERM RENTAL. IT JUST ALLOWS FOR THE APPLICATION FOR SHORT TERM RENTAL WHICH IS A SPECIAL USE IT GOES TOWARDS VOA THE PROPERTIES WILL BE POSTED.

THERE'LL BE PUBLIC HEARINGS. THANK YOU. SO SINCE IT'S BEEN MOTIONED AND SECONDED I WILL OPEN IT UP TO THE PUBLIC. IS THERE ANYONE THAT WISHES TO SPEAK ON THIS MOTION FROM THE PUBLIC? SPEAK NOW OR FOREVER HOLD YOUR PEACE KIND OF THING. SEEING NO ONE I WILL TURN TO COUNSEL ANYONE HAVE FURTHER DISCUSSION. I WOULD JUST LIKE TO FOLLOW UP WITH MR. GLOVER FOR A REASONINGS BEHIND IT TO SUPPORT HIS MOTION. THE REQUEST IS CONSISTENT WITH THE GOALS AND OBJECTIVES OF POLICIES OF A COMPREHENSIVE PLAN.

IT IS NOT IN CONFLICT WITH ANY PROVISIONS THIS DEVELOPMENT CODE OR THE CODE OF ORDINANCES AND IT WOULD RESULT IT WOULD RESULT IN LOGICAL AND ORDERLY DEVELOPMENT PATTERN.

AND LASTLY NUMBER SEVEN FOR IT WOULD NOT IN ADVERSE IMPACTS OF THE NATURAL ENVIRONMENT INCLUDING BUT NOT TO THE WATER AIR NOISE STORMWATER MANAGEMENT, WILDLIFE VEGETATION OR NATURAL FUNCTIONS OF THE ENVIRONMENT. THANK YOU MR. CUNNINGHAM I

[00:35:02]

THANK YOU TO MR. CURRY HERE AND YOU DIDN'T HAVE TO DO IT TO MAKE THE DREAM WORK BABY.

RIGHT. OKAY. ANY OTHER ANY DISCUSSION THEN SO ALL IN FAVOR OF PASSING THE MOTION RAISE YOUR HAND PLEASE ALL ALL OPPOSED AND WE HAVE ONE

[10.b. 2025/03 AN ORDINANCE AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS FOR THE ACCEPTANCE OF RIGHT-OF-WAY OR TEMPORARY CONSTRUCTION EASEMENTS ON REAL PROPERTY ASSOCIATED WITH THE STUART POINT ROAD SIDEWALK PROJECT (PUBLIC HEARING) Vote at First Reading on December 9, 2024 - 11:0]

RECUSAL. OKAY. YOU AND FERDINAND'S 2020 5/03 IS AN ORDINANCE AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS FOR THE ACCEPTANCE OF RIGHT OF WAY OR TEMPORARY CONSTRUCTION EASEMENTS AND REAL PROPERTY ASSOCIATED WITH THE STEWART ROAD SIDEWALK PROJECT AT THE FIRST READING WAS DECEMBER 9TH SO THIS IS A PUBLIC HEARING CAN I HAVE A MOTION PLEASE? NO MOTION, THANK YOU, MISS BROWN. SECOND I CAN.

RIGHT. THANK YOU, MR. GLOVER. WE NEED TO GET MR. DAWSON IN.

OH YEAH. WE CAN LET HIM BACK IN NOW. MR. FREDERICKS, YOU WANT TO GIVE A QUICK RECAP ON THIS ONE, PLEASE FOR? THE PUBLIC SURE.

THANK YOU. SO THIS IS ONE OF OUR 24 PATHWAYS FROM THE 2018 SALES TAX AND WHAT WE'RE DOING HERE IS ASKING PERMISSION WHOLESALE FOR THE ROAD? I BELIEVE THERE'S OVER 30 PROPERTIES 38 PARCELS THAT WE'RE ACQUIRING SOME FORM OF INTEREST WHETHER THAT'S RIGHT AWAY OR EASEMENT. AND WE HAVE AN EXHIBIT BASICALLY ALLOWING US TO THAT SHOWS THE IMPACTS AND THEN WE'LL BE REACHING OUT AND COORDINATING WITH AND EVERY PARCEL OWNER ON THIS ROADWAY TO SECURE THAT RIGHT FOR THIS PROJECT ANYTHING THAT'LL TAKE AWHILE QUITE A WHILE. I WISH IT MOVED FASTER BUT AS YOU CAN IMAGINE WITH 38 DIFFERENT PARCEL OWNERS IN AN APPRAISAL AND HOW LONG THAT WOULD TAKE AND THEN FOR THIS ROAD AND OTHERS IT'S QUITE TAKEN.

THIS IS A SECOND READING PUBLIC HEARING SO ANYONE FROM THE PUBLIC CARE TO COMMENT ON THIS MOTION SEEING NO ONE I'M GOING TO ASK IF ANYONE ON COUNCIL HAS A DISCUSSION ON THIS.

THERE'S SOMETHING IN THIS. YES, IF I MAY THIS PROJECT IS IN MY THIS IS ONE OF THE PROJECTS OF THE 2018 SALES TAX REFERENDUM AND. AS WE'VE SAID IN THE DISCUSSION JUST NOW, THAT IS TAKING A LONG TIME AND THAT'S PART OF THE ISSUE WE HAVE WITH TRYING TO GET THE LAST REFERENDUM PASSED. MANY PEOPLE SAYING THAT THEY HAVEN'T SEEN ANY PROGRESS THE 2018 AND WE WERE TRYING TO DO THE 2024 REFERENDUM AND SO I THINK UNTIL WE GET THIS A LOT OF MOVING COMPLETED TO SHOW WE ARE ACCOMPLISHING SOME THINGS THEN THAT WILL THAT WILL PERHAPS GIVE US A BETTER CHANCE OF GETTING FUTURE REFERENDUMS PASSED.

BUT THIS IS IN MY DISTRICT SO I'M GOING TO MOVE THAT WE GO AHEAD AND AND APPROVE THIS RECOMMENDATION. OKAY. ANYBODY ELSE FOR DISCUSSION? ALL RIGHT. ON FAVOR OF APPROVING THE MOTION, PLEASE RAISE YOUR HAND TO YOU, SIR. WE ALREADY HAD A SECOND IN MOTION.

ANYBODY OPPOSED? THANK YOU, MR. JOHNSON FOR THE COMMENT THOUGH THAT'S IMPORTANT

[10.c. 2025/04 AN ORDINANCE AUTHORIZING THE COUNTY ADMINISTRATOR TO ENTER INTO A LEASE AGREEMENT WITH MITCHELVILLE PRESERVATION PROJECT, INC. FOR SUITE 134 AND SUITE 142 OF THE COUNTY-OWNED OFFICE BUILDING LOCATED AT 539 WILLIAM HILTON PARKWAY ON HILTON HEAD ISLAND (PUBLIC HEARING) Vote at First Reading on December 9, 2024 - 11:0]

THAT WE CONTINUE TO TELL THE PUBLIC WE'RE WORKING ON THAT. ALL RIGHT.

THE NEXT ONE 2020 5/04 IN ORDINANCE AND SECOND READING AUTHORIZING THE COUNTY ADMINISTRATOR TO ENTER INTO A LEASE AGREEMENT WITH MITCHELL VALE PRESERVATION PROJECT INC.

FOR SUITE 134 IN SUITE 142 OF THE COUNTY OWNED OFFICE BUILDING LOCATED AT 539 WILLIAM HILTON PARKWAY ON HILTON HEAD ISLAND CAN I HAVE A MOTION REMOVED? THANK YOU, MR. REED. THE SECOND AND MR. GLOVER SECOND.

THE FIRST READING OF THIS WAS DECEMBER 9TH. MR. AMUNDSEN, DO YOU WANT TO SPEAK TO THIS AND AGAIN WE DO THIS SO THE PUBLIC KNOWS WHAT WE'RE TALKING ABOUT EVEN THOUGH WE'VE DONE IT A FEW TIMES GO GOOD EVENING. THIS IS THE MAJOR BILL PRESERVATION PROJECT HAS BEEN IN OPERATION FOR A WHILE. I'VE COME TO COUNCIL TELL THE GREAT THINGS THAT THEY HAVE DONE. THEY'VE OCCUPIED THE FRONT SPACE FOR QUITE SOME TIME. THEY'VE ASKED TO EXPAND AND WE DO WANT TO MAKE SURE THAT ALL THE LEASES ARE OFFICIAL AND UNIFORM AND SO THIS COMING BEFORE YOU FOR THE OFFICIAL APPROVAL FOR THEM TO OCCUPY THAT SPACE GOING THANK YOU, THANK YOU I'LL OPEN IT TO PUBLIC ANYONE IN THE PUBLIC WISH TO COMMENT ON THIS MOTION ? OKAY. SO YOU KNOW 101 NOW I'M GOING TO COUNCIL MEMBERS NOW MR. WHAT

[00:40:03]

I HAVE SAID IS THAT GOOD? MR. GLOVER. THOUGHT YOU WANTED TO SPEAK NO NO NO. I WAS RAISING MY HAND EARLY FOR APPROVAL.

OH, LOOK AT HIM. HE'S JUMPING THE GUN. OKAY, NO DISCUSSION.

THEN I WILL COME FOR A VOTE IN FAVOR OF THIS MOTION. RAISE YOUR HAND.

[10.d. 2025/05 AN ORDINANCE TO INVEST $4,300,000 FROM THE GENERAL FUND - FUND BALANCE IN AN INFRASTRUCTURE DEVELOPMENT PROJECT AT BEAUFORT EXECUTIVE AIRPORT (ARW) TO FUND CONSTRUCTION OF AIRCRAFT HANGERS (PUBLIC HEARING) Vote at First Reading on December 9, 2024 - 10:1]

ANYONE OPPOSED? I THINK IT PASSES 2020 5/05 IS AN ORDINANCE AND PUBLIC HEARINGS TO INVEST $4,300,000 FROM THE GENERAL FUND BILLIONS IN AN INFRASTRUCTURE DEVELOPMENT PROJECT AT BEAUFORT EXECUTIVE AIRPORT TO FUND CONSTRUCTION OF HANGARS AND THE VOTED THE FIRST READING WAS TEN ONE CAN I HAVE A MOTION PLEASE SO MOVED OKAY MR. BARTHOLOMEW THE SECOND OKAY. OKAY I KNOW IT'S LATE BUT IT'S OKAY MR. CUNNINGHAM SO NOW IT'S GOING THE PUBLIC HEARING FIRST AND I'LL OPEN IT TO THE PUBLIC ANYONE HAVE A COMMENT ON THIS.

OKAY I SEE NO PUBLIC HEARING ANY MEMBERS WISH TO DISCUSS I. MADAM CHAIR.

MADAM VICE CHAIR, I WOULD LIKE TO MOVE THAT WE POSTPONE THE SECOND READING OF THE ORDINANCE TO INVEST $4.3 MILLION FROM THE GENERAL FUND FUND BALANCE AND INFRASTRUCTURE DEVELOPMENT PROJECT AT THE EXECUTIVE TO CONSTRUCT AIRCRAFT HANGARS UNTIL STAFF IS PREPARED TO OFFER ALTERNATIVE FUNDING SUGGESTIONS FOR OUR CONSIDERATION THANK YOU SHE MADE A MOTION CAN I HAVE A SECOND TO THE AMENDED MOTION I SECONDED UNDERSTAND WHAT YOU SAID I THINK I DID DO AND I READ IT AGAIN I NEED A READING YOU SAID THE STAFF HAS A RECOMMENDATION ON ALTERNATIVE TO GIVE US THE STAFF IS PREPARED TO OFFER OUR TURN INTO FUNDING SUGGESTIONS FOR OUR CONSIDERATION WE'RE POSTPONING THIS MOTION UNTIL THE STAFF BRING BACK THIS OPTIONS ALTHOUGH THAT SUGGESTION YOU ARE STILL SEEKING OUT.

OKAY. OKAY. MR. GLOVER'S SECONDED FOR DISCUSSION THAT DO WE HAVE TIME WE ASK SHOULD MR. MOORE DO OVERTIME? I MEAN YES. FEEL FREE TO JUMP ON IT SHOULD BE THE NEXT PUBLIC FACILITY NEEDED THE AIRPORT STAFF AND JERRY FOR TONIGHT WE ALL MET REGARDING A DIFFERENT FUNDING OPTION THAT NOT INVOLVE ANOTHER LOAN FROM THE GENERAL FUND FUND BALANCE SO WOULD LIKE TIME TO REVIEW AND BRING IT BACK TO THE FINANCE COMMITTEE FOR APPROVAL AND THEN FROM THERE TO YOU GOING TO THE FINANCE COMMITTEE NEXT WEEK VERY WELL NOT NEXT WEEK YEAH.

OH OKAY. NEXT FROM THE END OF THE MONTH WHEN'S THE NEXT ONE IS THE NEXT FUND. 20 SOME DAY. GIVE US AN IDEA WHERE BE THINGS THAT ARE NOW RIGHT THERE MONDAY TWICE SOMETIME AFTER FEBRUARY FIRST THERE WILL BE THE THIRD MONDAY IN FEBRUARY OH. OKAY WE'VE ALREADY HAD FIRST READING WHERE THE SECOND READING SO IF SHE NEEDS TIME HERE'S SOME CHANGES FOR YOUR CONSIDERATION TO COME AT THE SECOND READING. SO COME BACK TO COUNCIL NOT TO FINANCE IT WILL NOT GO AWAY IT COMES BACK HERE AND THEN WE'LL AMEND THE ORDINANCE PURSUANT TO IF YOU LIKE THIS ALTERNATIVES THAT COUNCIL OR THE STAFF PROVIDES FOR COUNCIL AND THEY CAN PROCEED ON TO THE THIRD READING. IF YOU GO BACK TO THE FINANCE COMMITTEE BACK TO SQUARE ONE, RIGHT? CORRECT. SO THE MOTION WAS TO POSTPONE IT INDEFINITELY BUT COME BACK TO COUNCIL TO A COMMITTEE. OKAY.

THEY WILL DETERMINE IF YOU WANT TO REMAND IT BACK COMMITTEE. NO, NO, NO.

WE HAVE A MOTION THE SECOND AT THIS TIME TO POSTPONE IT AND THAT'S OUR STAFF INPUT DEFINITELY AND DEFINITELY THERE'S NO RATE ATTACHED TO IT UNTIL THEY COME BACK AS WE ALL DO AND DEFINITELY WE HAVE SIGN ON THE DATE RIGHT WHAT IT WOULD COME BACK TO COUNTY COUNCIL THAT SECOND READING SO BECAUSE NO MAJOR CHANGES CAN HAPPEN AFTER THE SECOND READING IT WAS IT COULD HAPPEN BUT THEN YOU HAVE PROOF FOR THE SECOND DAY AGAIN CRAFT STAFF ISN'T TO BRING IT BACK AT THE NEXT COUNCIL MEETING IN TWO WEEKS IS WHY THEY ASKED FOR A DEFINITE CORRECT GOODBYE. OKAY. THANK YOU.

OKAY. FURTHER DISCUSSION OR QUESTION ON THIS WHY YES.

SHOULD WE GO IN? DID YOU SAY YOU HAD FOUND THE MONEY OR YOU'RE LOOKING FOR IT? NO, JUST LOOKING FOR AN ALTERNATIVE FUNDING SOURCE TO DO NOT COMING FROM FUND BALANCE BUT OTHER AREAS. DO YOU THINK YOU'LL HAVE ANY SUCCESS DOING THAT OR IS THAT A PREMATURE QUESTION? VERY PREMATURE I'M GOING TO TRY.

THIS MAY NEVER HAPPEN. THAT'LL BE FOR Y'ALL TO VOTE ON.

WE'RE JUST GOING TO PRESENT YOU WITH SOMETHING THAT DOES NOT ADD TO THE DEFICIT NET POSITION FOR THE OH MORE GOOD AT PRESENT SOMETHING WE WILL YES SO KNOW THAT IT WILL BE WHAT'S CURRENTLY IN FRONT OF YOU OKAY . UM I'M NOT GOING TO REVERT TO MY FIRST QUESTION EVEN THOUGH I DON'T THINK YOU ANSWERED IT. YOU SEEM TO HAVE ANSWERED IT BY

[00:45:01]

SAYING YOU'RE COMING BACK TO GIVE US AN OPTION BUT YOU DON'T HAVE THE OPTION YET.

NO, YOU KNOW BUT CONFIDENT YOU CAN FIND IT WE'RE GOING TO PRESENT AN OPTION FOR YOU TO VOTE ON. YEAH, THAT'S ALL SHE'S GIVING YOU, MR. IT COULD BE THE SAME OPTION PRESENTED TODAY IF YOU DON'T FIND ENOUGH DIFFERENT SOURCE OKAY MADAM I WANT TO MAKE SURE I UNDERSTAND THE MOTION IS ON THE FLOOR. NO.

IF I VOTE IN FAVOR OF THIS MOTION IT DOES NOT KILL THE PROJECT.

THOSE PHONE THOSE. OKAY. OKAY.

JUST WHAT MAKES YOU THINK THAT THE PROJECT TO BE KILL OF THIS THINK WE NEED TO FIND ANOTHER ALTERNATIVE FUNDING IS THIS WHICH IT MAY INCLUDE FAR AS I'M CONCERNED FUND BALANCE BUT NOT ALL OF IT. BUT THAT'S ALL THIS IS JUST A TWO WEEKS IS NOT ENOUGH BUT MAY BE THE FIRST MEETING IN FEBRUARY OR THE SECOND IN FEBRUARY BUT WE JUST CAN'T GIVE YOU A DATE CERTAIN UNTIL SHE HAS TIME TO EXPLORE AND FIND ALTERNATIVE AS THAT.

AND IF YOU REMEMBER WHEN WE TALKED ABOUT THIS IN FIRST READING DECEMBER 9TH WE HAD A PRETTY ROBUST THAT'S CORRECT. I'M SURE PINKY CAN AT THAT. SO WE'RE GOING TO CONSIDER SOME OF THE QUESTIONS THAT COUNCIL HAD AT THAT MEETING AS WELL TO BRING THAT BACK.

SO THAT'S WHERE A LOT OF THIS COMES FROM, CORRECT? THANK YOU.

APPRECIATE THAT. SO LET'S VOTE ON BOTH. GO AHEAD.

I HAVE ONE QUESTION FEEL FREE NOT TO ANSWER IF YOU DON'T WANT TO IS THIS AT A REQUEST OF THE STAFF OR REQUEST OF A COUNCIL MEMBER COMES THE POSTPONEMENT YOU LOOK FOR OTHER OTHER SOURCES. YEAH IT WAS REQUESTED ME OKAY THAT'S CORRECT CFO DID DID MAKE THAT IT'S TO JUST MAKING SURE THAT YOU'RE MAKING THE REQUESTS AND NOT SOMEBODY UP HERE.

FULL DISCLOSURE I TRIED TO STOP IT BEFORE I GO TO THAT MEETING. SOUNDS GOOD TO I'M IN FULL SUPPORT. THANK YOU. ALL RIGHT, LET'S TAKE A VOTE ON THE AMENDMENT THAT MS.. BROWN SAID ALL IN FAVOR RAISE YOUR HAND.

OKAY. I'LL OPPOSE ONE OPPOSED. JO, WERE YOU IN FAVOR? YES. OKAY. SO NOW WE HAVE TO VOTE ON THE ORIGINAL. NO, NO, NO. WE TOOK THE AMENDMENT.

THERE'S NO SECOND READING. THIS IS NOW POSTPONED UNTIL SHE GETS HER CORRECT INCOME.

[11.a. 2025/06 AN ORDINANCE PLACING LAND PURCHASED BY PROJECT MICRO INTO AN EXISTING MULTICOUNTY INDUSTRIAL PARK]

OKAY. GOOD LUCK ON WORKING THAT OUT. YEAH.

OKAY. NOW I MOVE TO ORDINANCES FOR FIRST READING SO THERE'S NO PUBLIC HEARING ON THIS 2025 SHOW SIX IS AN ORDINANCE PLACING LAND PURCHASED BY PROJECT MICRO INTO AN EXISTING COUNTY INDUSTRIAL PARK. CAN I HAVE A MOTION PLEASE? SO THANK YOU, MR. JOHNSON. MRS. GLOVER AND WOULD YOU LIKE TO TALK ABOUT IT? GO AHEAD. I'LL INTRODUCE JOHN FOR FURTHER DETAILS.

THIS HAS COME TO FINANCE AND DEVELOPMENT ADMINISTRATION COMMITTEE PREVIOUSLY IT ALSO CAME TO COUNCIL BUT IT WAS THE FORM OF AN APPROVAL AND THAT HAS TO BE DONE BY ORDINANCE.

SO WE WANTED MAKE SURE THAT WE CROSS OUR T'S AND DOT OUR EYES SO IT'S COMING BACK FOR FIRST READING OF AN ORDINANCE TO DO THESE ITEMS AND HE CAN ANSWER SOME QUESTIONS ABOUT PROJECT MICRO WE'VE ALSO BEEN FAMILIAR WITH THEM BECAUSE WE APPLIED FOR AND HAVE RECEIVED GRANT FUNDS ON BEHALF OF THE COMPANY THAT'S NAMED T.L AND GENERAL. WE HAVE TAKEN BOTH OF THESE UP AT THE SAME TIME WHAT WE WOULD NEED TO DO SEVERAL STEPS BECAUSE ONE IS A REVENUE.

YEAH I KNOW I KNOW YOU'VE BEEN HERE A WHILE SO I'LL TRY TO BE BRIEF AS YOU RECALL WILL JOHNSON APPEARED WITH ME IN THIS CHAMBER TO GIVE AN OVERVIEW OF WHY WE DO ASSESS OUR C'S OR SPECIAL SOURCE REVENUE CREDITS AND IT'S A WAY IN SOUTH CAROLINA OF OF LOWERING THE TAX RATE TO MANUFACTURERS TO MAKE THEM FEEL WELCOME IN SOUTH CAROLINA AS YOU KNOW THE STATED TAX RATE AND SOUTH CAROLINA IS ABOVE 10% FOR MANUFACTURERS BUT.

YOU WOULDN'T HAVE A BOEING AND YOU WOULDN'T HAVE A MERCEDES BENZ AND ALL THE BIG MANUFACTURING YOU HAVE IN SOUTH CAROLINA IF COMMUNITIES DIDN'T DO THIS AND WE'VE BEEN OVER OVER IT A FEW TIMES AND I'D BE HAPPY TO QUESTIONS BUT TELL AND CO PROMISES TO BE A GOOD MEMBER OF OUR COMMUNITY. GERALD DAWSON AND I HAVE MET WITH THE PRINCIPALS THEY ARE LOOKING TO INVEST $7 MILLION IN OUR COMMUNITY, CREATE TWO JOBS AND AVERAGE INCOME IN EXCESS OF 125,000 ON AVERAGE. SO THESE ARE GOOD JOBS. A LOT OF TIMES COUNCIL MEMBERS HAVE ASKED ME WELL WHY AREN'T WE SEEING AEROSPACE? THIS IS AN AEROSPACE SUPPLIER A DEFENSE SUPPLIER COMING TO OUR COMMUNITY REALLY OPERATIONS FROM UTAH TO BEAUFORT.

WHY BEAUFORT BECAUSE THE PRINCIPLES OF LIVING IN BEAUFORT AND YOU HEARD THAT FROM YOUR LONG TIME EMPLOYEE SO WE ACTUALLY WE SHOULD GET SOME OF THE FOLKS WHO SPOKE TONIGHT OUR PROMOTIONAL MATERIALS THANKS TO JOCELYN SUGGESTING THAT TURN WHEN WE DO ASSESS OUR

[00:50:06]

C'S WE'RE REQUIRED BY LAW TO LOOK AT WHAT THE IMPLICATIONS THE IMPACT OF THE PROJECT SO HAVE AND WE'RE PUTTING THE CART BEFORE THE HORSE SO YEAH I'LL COVER I'LL COVER THAT IN JUST I'LL MAKE TWO MORE TWO MORE TWO MORE COMMENTS BUT THE IMPACT OF THIS PROJECT WELL IT'S 41 JOBS IT'S PROJECTED THE MULTIPLIER EFFECT BECAUSE WHEN YOU PUT A JOB IN A COMMUNITY THEY'RE THEIR SALES AND EVERYTHING ELSE JUST IN THE FIRST THREE YEARS THEY'LL BE $25 MILLION IN LOCAL SALES GENERATED OUT OF THIS FACILITY .

THE MULTIPLIER EFFECT ON JOBS IS 75 AND THE CUMULATIVE THIS IS JUST AFTER THREE YEARS IS A $17 MILLION TOTAL IMPACT FROM WAGES ON THIS PROJECT THE SS IN ORDER TO DO AN SS RC YOU HAVE TO PLACE THE PROPERTY IN AN MCI MULTI COUNTY INDUSTRIAL PARK AND OUR STANDARD PARTNER FOR THESE HAS BEEN JASPER COUNTY UNLESS DIRECTED BY THE COUNCIL WE ENJOY 99% OF THE BENEFIT AND THEY ENJOY 1% OF THE BENEFIT AND JUST TO GIVE YOU AN IDEA THE SS C OVER 20 YEARS A LOT OF COMMUNITIES DO A 30 YEAR AGREEMENT. I THINK IT'S KIND OF HARD TO IMAGINE WHAT THE CHALLENGES WOULD BE 30 YEARS FROM NOW. SO WE'VE ALWAYS GONE 20 YEARS BUT THE TAX LIABILITY THAT TIME ON THIS PROJECT WOULD BE 2.2 MILLION BY PUTTING IN THE SS OR C THE THE NET TAX OVER THAT TIME WOULD BE REDUCED FROM 2.2 MILLION TO 1.8.

BUT YOUR FIRST ORDER OF BUSINESS IS TO THE PROJECT THE LAND IN THE MCI THE MULTI BILLION IS THERE A QUESTION ON THAT PART. OKAY.

AND REMIND THE PUBLIC MCI IP WHAT DOES IT MEAN AGAIN IN CASE MULTI COUNTY INDUSTRIAL PARK OKAY. AND WE'RE PARTNERING WITH JASPER COUNTY, CORRECT.

OKAY ANY OTHER QUESTION AND THE FIRST MOTION ALL RIGHT. LET'S TAKE A VOTE ALL IN FAVOR

[11.b. 2025/07 AN ORDINANCE FOR BEAUFORT COUNTY TO ENTER INTO A SPECIAL SOURCE REVENUE CREDIT AGREEMENT WITH PROJECT MICRO]

OF THIS MOTION. RAISE YOUR HAND ANYONE OPPOSED .

NO. OKAY. NOW WE'LL GO TO 2020 5/07 AN ORDINANCE FOR BEFORE COUNTY TO ENTER INTO A SPECIAL SOURCE REVENUE CREDIT AGREEMENT WITH PROJECT MICRO THAT'S THE C MR. O'TOOLE KEEPS MENTIONING YES YEAH.

I NEED A MOTION. I'LL MAKE THAT MOTION. ALL RIGHT, MR. BURTON OH, OKAY.

ALL RIGHT. YOU ALL DID. AND LOGAN WILL SECOND IT.

OKAY, MR. O'TOOLE. ANYTHING ELSE? I REALLY DID HAVE TIME TO SHARE IT IN A GLOBAL SENSE, SO I'M GOING TO BE MERCIFUL AND NOT BE ANYBODY EVER QUESTIONED ON MOTION? NO, I DON'T HAVE A QUESTION. I DON'T USE TO JOHN'S CREDIT THIS PROJECT PROJECT MICRO IS REPLACING THE PRIOR BUSINESS THAT CLOSED DOWN DUE TO THE COVID BUT THAT WAS THE PROCESS SAME PLANT THAT WE PUT OUT THERE.

OKAY, PROJECT MICRO IS GOING THE SAME BUILDING DOING SOME UPGRADE FOR LIKE JOHN SAID A $7.1 MILLION INVESTMENT 42 EMPLOYEES. SO WE'RE WE'RE MAKING STRIDES AS FAR AS DIVERSIFYING OUR ECONOMY SO WE DON'T HAVE, YOU KNOW, A TAX BASE SO THAT WE DON'T HAVE TO RELY ON TOURISM AND PROPERTY TAXES. THAT'S A VERY GOOD POINT.

YES ANYBODY ELSE COMMENT IS MR. CUNNINGHAM YEAH, I WOULD PIGGYBACK A LITTLE BIT THERE, BUT THIS IS JUST THE SAME THING WE'VE BEEN PREACHING FOR THE PAST COUPLE OF YEARS WHEN YOU GET AN ANCHOR BUSINESS THIS IS HOW LOCAL BUSINESSES SMALL BUSINESSES CAN CONTINUE TO THRIVE AS WELL. PEOPLE LIKE TO HEAR BECAUSE THEY DON'T THINK THAT A KROGER OR SOMEBODY LIKE THAT IS LOCAL BUSINESS BUT LOCALS WORK THERE AND WHEN YOU OPEN UP SOMETHING LIKE A KROGER OR A BIG BUSINESS OTHER BUSINESSES BUILD AROUND IT.

IT'S JUST THE WAY IT WORKS IS HOW YOU'RE ABLE TO SUSTAIN THAT ECONOMY SO YOU CAN GET ALL LAYERS LIKE MR. DAWSON'S TALKING ABOUT SO WELL DONE IS THINK OF ANY OTHER QUESTIONS? MR. GLOVER JUST ONE FEEDBACK AND MAKE SURE I UNDERSTAND TWO THEY ALREADY PLANNING ON EXPANDING BY PURCHASING MORE LAND RIGHT? YEAH AND STAFF'S BEEN VERY HELPFUL AND GOVERNMENTS AND MERCHANT HILLARY AUSTIN BEFORE THIS COMPANY MADE THIS PURCHASE THEY SAT DOWN WITH STAFF AND THEY ALREADY PLANNED IT'S A 15,000 SQUARE FOOT FACILITY THEY EXPECT DOUBLE THE SIZE AND AND GOING INTO IT THE STAFF DID A GREAT JOB OF BEING ACCESSIBLE AND EXPLAINING TO THEM WHAT THE OBSTACLES WERE WHAT THE CHALLENGES WERE AND HOW TO ACHIEVE WHAT THEY NEEDED TO DO BECAUSE WE'D HATE TO HAVE SOMEBODY COME IN HERE WHO NEEDS EXPAND AND END UP ON THE WRONG PATH SO SO YOU KNOW A BIG PART OF OUR OUR SALES APPROACH WAS

[00:55:05]

THE PROFESSIONALISM OF COUNTY STAFF. THANKS FOR ASKING.

THANK YOU FOR THAT AND ANY OTHER DISCUSSION OR QUESTION. ALL RIGHT.

I'LL ANSWER THE VOTE ALL IN FAVOR OF THIS MOTION PLEASE SIGNIFY BY RAISING YOUR HAND.

MR. PRESIDENT. OKAY, SO IT'S UNANIMOUS. THANK YOU, MR. TAYLOR.

[12. EXECUTIVE SESSION]

APPRECIATE IT. THANK YOU THAT CONCLUDES OUR READINGS.

OKAY. NUMBER 12 WE'RE IN WE ARE GOING TO ADJOURN TO EXECUTIVE SESSION BEFORE I READ THROUGH THE ITEMS FOR EXECUTIVE SESSION IN THE FUTURE.

ANOTHER SMALL CHANGE WE'RE GOING TO MAKE IS TO HAVE EXECUTIVE BEFORE THE REGULAR COUNTY COUNCIL MEETING SO THAT THE PUBLIC CAN BE HERE AT BEGINNING OF OF EXECUTIVE SESSION OR THEY CAN CHOOSE COME WHEN COUNTY COUNCIL STARTS AND THERE MAY BE THINGS TO COME OUT OF AN EXECUTIVE SESSION THAT WILL BE BROUGHT UP RIGHT AT THE BEGINNING OF COUNTY COUNCIL.

THIS HAS BEEN DONE IN SOME OTHER COUNTIES AND WE'RE GOING TO TRY IT AS A BEST PRACTICE IN HOW IT WORKS TRYING TO BE MORE MINDFUL OF PEOPLE WHO COME TO OUR MEETINGS WHO HAVE TO TRAVEL LONG DISTANCES AND ALSO SO THAT THEY FIND OUT WHAT HAS HAPPENED IN EXECUTIVE SESSION AS THE MEETING STARTS. WE ARE GOING TO COVER THIS 5:00 RATE.

WAS THAT IS YES THE GOAL FOR THAT RIGHT BE FIVE THE GOAL IS AND IF WE HAVE SOMETHING THAT NEEDS TO GO BEYOND THAT HOUR WE CAN ALSO CHANGE THE AGENDA AND HAVE MORE TIME FOR EXECUTIVE SESSION IF NEEDED SO I'M GOING TO READ THROUGH THE ITEMS FOR EXECUTIVE SESSION FIRST RIGHT INTO SOUTH CAROLINA CODE SECTION 30, DASH FOUR, DASH 70 A TO RECEIPT OF LEGAL ADVICE WHERE THE LEGAL ADVICE RELATES TO PENDING LITIGATION THAT IS CONCERNING COUNTY VERSUS MASHBURN AT ALL BUCKWALTER REX AND B IS PERSUADED TO CAROLINA CODE SECTION 30 DASH FOR DASH 78 TO RECEIPT OF LEGAL ADVICE WHERE THE LEGAL ADVICE RELATES TO PENDING LITIGATION COUNTY AT ALL VERSUS AIRBNB SHORT TERM RENTAL AND LICENSE LITIGATION SEE IS PERSUADED TO SECTION CODE C 30 DASH 472 RECEIPT OF LEGAL ADVICE WHERE THE LEGAL ADVICE RELATES TO PENDING LITIGATION COUNTY VERSUS DAVID COLEMAN AND LAST IS PERSUADED THE SOUTH CAROLINA CODE 30 DASH FOR DASH 78 TO RECEIPT OF LEGAL ADVICE WHERE LEGAL ADVICE RELATES TO MATTERS COVERED BY THE ATTORNEY CLIENT PRIVILEGE DISCUSSION RELATED TO PRIVILEGED COMMUNICATIONS BY COUNTY ATTORNEY'S STAFF AND COUNSEL AND WE THINK THERE MAY BE A COUPLE OF THESE ITEMS WE WILL HAVE ACTION OUT OF EXECUTIVE SESSION.

THANK YOU AND ARE SURE YOUR MOTION TO MOVE TO EXECUTIVE SESSION I HAVE A SECOND I'LL CERTAINLY MOVE ON FAVOR I'M SORRY I .

[13. MATTERS ARISING OUT OF THE EXECUTIVE SESSION]

YEAH I HAVE SEVERAL ITEMS I'D LIKE TO ENTERTAIN A MOTION FROM MR. MCLELLAN REGARDING ITEM B PLEASE. SURE. IN THE MATTER OF CHARLESTON AT ALL THE AIRBNB AT ALL SHORT TERM RENTAL LITIGATION I THE COUNCIL ACCEPT THE SETTLEMENT OFFER AND AUTHORIZE COUNTY ADMINISTRATOR TO EXECUTE A SETTLEMENT AGREEMENT AND THE AMOUNT DISCUSSED IN EXECUTIVE SESSION TO SETTLE A LAWSUIT AGAINST AIRBNB FOR THEIR FAILURE TO COLLECT AND REMIT LOCAL ACCOMMODATIONS, TAXES AND BUSINESS LICENSE FEES RELATED TO SHORT TERM RENTALS IN RURAL BEAUFORT COUNTY THE PRO-RATED AMOUNTS THAT BEAUFORT COUNTY RECEIVES BE APPORTIONED AND DISTRIBUTED AS FOLLOWS 90% TO LOCAL ATTACKS AND DEPOSITED INTO THE LOCAL TAX ACCOUNT AND 10% TO THE BUSINESS LICENSE FEES AND DEPOSITED INTO THE GENERAL. I HAVE A SECOND SECOND THAT SECOND COUNCILMAN DOBSON OKAY.

WE'RE IN DISCUSSION. ANY COMMENTS DISCUSSION? YES SIR? YEAH, I DO REALLY LIKE THE MOTION. I REALLY WOULD LOVE TO SEE SOME ADDITIONAL FUNDING FOR RAMPS FOR WHAT RAMPS WITH EQUAL 88 COMPLIANT RAMPS.

YES. YES. OKAY.

WE'LL LOVE TO SEE THAT HAPPEN THAT COULD GO 30 TAX. YEAH.

OKAY. ANY OTHER COMMENTS ACTUALLY I WAS THINKING THE SAME THING I GUESS WHAT YOU SAY SO YOU SEE ME I'M TRYING TO THINK HERE YEAH SAME SAME THING I'D LIKE

[01:00:07]

TO SEE AND THERE IS A CRITERIA FOR USE FOR ACCOMMODATION TAX IS THAT IT FALLS UNDERNEATH THAT AND IT FALLS INTO SOMETHING TO BE DECIDED AT ANOTHER ANOTHER DAY WHERE THAT 90% WOULD GO BUT IT'S ANY OTHER DISCUSSION BEFORE WE TALK ABOUT WELL I JUST POINT OUT THAT LOOK CURRENTLY WE DO FUND BOAT RAMP REPAIRS OUT OF LOCAL ATX. THAT'S CORRECT.

AND THAT'S WHERE WE'RE TALKING ABOUT PUTTING THIS MONEY, RIGHT? CORRECT. CORRECT. OKAY.

ALL RIGHT. A SHOW OF HANDS FOR THE MOTION ALL IN FAVOR I THAT'S UNANIMOUS. OKAY, GREAT. AND WE HAVE ANOTHER MOTION CONCERNING THE SAME SUBJECT. YES, THE EXPENSE CHAIRMAN I MOVE THAT COUNCIL THE OFFER BY OUR OUTSIDE COUNSEL AND THURMAN KIRCHNER IN TERMS TO AMEND OUR FEE AGREEMENT WITH THEM AND AUTHORIZE THE COUNTY ADMINISTRATOR TO EXECUTE THE AMENDED FEE AGREEMENT AS IT RELATES TO THE LAWSUIT AGAINST AIRBNB FOR THEIR FAILURE TO COLLECT AND REMIT LOCAL ACCOMMODATIONS TAXES AND BUSINESS LICENSE FEES RELATED TO SHORT TERM RENTALS IN RURAL COUNTY. DO I HAVE A SECOND? I'LL SECOND IT.

ALL RIGHT. SECOND AMENDMENT MR. BARTHOLOMEW DISCUSSION.

I JUST WANT TO SAY THE REASON WE'RE CHANGING THE FEED'S ACTUALLY GOING TO SAVE AS WELL AS INCREASE ARE THE AMOUNT THAT WERE PUT INTO THE ACCOUNTS BY ROUGHLY AROUND $60,000.

SO THAT'S A WIN FOR THE TAXPAYERS RECORD. ANY OTHER DISCUSSION IF NONE BY SHOW OF HANDS ALL IN FAVOR OF THE MOTION BY MY GROUP. GOOD NEWS .

OKAY NUMBER ANOTHER ITEM FROM EXECUTIVE SESSION WHERE WE WANT TO BRING FORWARD IS IS THE RECEIPT OF LEGAL ADVICE WHERE THE LEGAL ADVICE RELATES TO MATTERS COVERED THE ATTORNEY CLIENT PRIVILEGE JUST A QUESTION RELATED TO COMMUNICATIONS BY COUNTY ATTORNEYS WITH STAFF AND THIS WAS DEEMED ON OUR EXECUTIVE SESSION TO HAVE A MOTION YES MR. HOWARD. I'LL MOVE THAT COUNSEL AWAY. THE ATTORNEY CLIENT PRIVILEGE FOR LEGAL ADVICE RECEIVED AN COMMUNICATIONS BETWEEN JUNE 2021 AND AUGUST 2023 FROM OUR COUNTY ATTORNEYS AND OR RETAINED TO COUNTY ADMINISTRATION COUNSEL OR BOTH WITH THE EXCEPTION OF MATTERS THAT INVOLVE ACTIVE LITIGATION OR MATTERS THAT INVOLVE MEDIATION OR SETTLEMENT NEGOTIATIONS AND THAT ALL OF THESE COMMUNICATIONS BE PROVIDED TO THE STATE ETHICS COMMISSION PURSUANT TO THE SUBPOENAS DATED FEBRUARY 27, 2024 AND THEIR RENEW REQUEST IN DECEMBER 2024. I HAVE A SECOND 1/2 THE SECOND BY MR. DISCUSSION DID YOU WANT TO ELABORATE ANY MORE ABOUT IT? OH MR. FOLEY NO WE CAN YEAH THAT'S PRETTY SPECIFIC. ALL RIGHT, ALL IN FAVOR SHOW YOUR HANDS AS UNANIMOUS.

OKAY. NO FURTHER BUSINESS. WE ARE ADJOURNED
