COUNCIL SUBSEQUENTLY I BELIEVE A RESOLUTION SAYING THAT IT WOULD SUPPORT A GREEN ALLOCATION UP TO THE FULL FAIR MARKET VALUE OF THAT PROPERTY. A RELATIVE SURPRISE WAS RECEIVED. THE APPRAISAL CAME IN AT $9.85 MILLION. SO WITHIN THE CONFINES OR ASPECTS OF THE RESOLUTION THAT YOU ADOPTED $9.875 MILLION WOULD BE PUT TOWARD THAT PURCHASE AS OPPOSED TO THE 11.74 OR 5 MILLION THAT WAS IN THE EARLIER APPRAISAL WHICH LEAVES A DELTA OR SHORTFALL OF $1.895 MILLION TO COME UP WITH ORDER TO CLOSE ON THE PURCHASE THE PURCHASE NEEDS TO CLOSE SEPTEMBER 2ND IN ACCORDANCE WITH THE TERMS OF THE BID OR THE OPPORTUNITY TO PURCHASE THE PROPERTY WILL BE LOST. AS OF THE DAY OF CLOSING THERE WOULD BE FUNDS SUFFICIENT TO PAY FOR THE ENTIRE $11.75 MILLION TOTAL WOULD BE CONVEYED TO THE TOWN OF HILTON HEAD. IT WOULD PLACED IN PERPETUITY BY RECORDED DOCUMENT AND AS AS BEING NON DEVELOPABLE THERE SEEMS TO BE SOME DISAGREEMENT AS TO OF THE TWO APPRAISALS IS VALID THE TOWN OF HILTON HEAD HAS SOME CONCERNS ABOUT THE APPRAISAL THAT ESTABLISHED THE LOWER VALUE AT 9.87 $9.85 MILLION. THERE'S OBVIOUSLY NOT TIME TO RECONCILE THAT BY THE SEPTEMBER 2ND DEADLINE AND IT'S IMPORTANT THAT WE NOT GO BEYOND THAT CLOSING DEADLINE. SO SO WHAT I THINK MIGHT BE ACCEPTABLE AND WHAT I WOULD LIKE TO THROW THERE FOR YOU ALL TO CONSIDER IS CLOSING ON THE BASIS THAT I HAVE JUST OUTLINED WITH THE COUNTY PROVIDING 9.85 THE TOWN PROVIDING .89 5 MILLION AND THAT THERE BE AN AGREEMENT AT CLOSING THE TOWN AND THE COUNTY. AND THIS IS NOT UNCOMMON WHEN YOU'VE GOT DISPARATE APPRAISALS IS TO HAVE A THIRD PARTY COME IN A THIRD PARTY APPRAISER LOOK AT THE TWO APPRAISALS AND DETERMINE WHETHER OR NOT THERE'S ANY ADJUSTMENT NEEDED TO THE $9.875 MILLION APPRAISAL UPON WHICH THE COUNTY IS MAKING AN APPROPRIATION AFTER THAT PROCESS PLAYS OUT IF IT TURNS THROUGH THE MEDIATION THAT THE APPRAISED VALUE IS ACTUALLY HIGHER $9.875 MILLION THE IDEA WOULD BE THAT THE TOWN OF HILTON HEAD WOULD BE [00:45:02] COMPENSATED FOR THAT ADJUSTMENT UPWARD. CONVERSELY IF IT COMES BACK AND STAYS AT 9.8 75 MILLION AS THE MOST RECENT APPRAISAL SUGGESTS THEN THE TOWN OF HILTON HEAD IS ON THE HOOK AND THEY WILL PAY FOUR AND HAVE TO FINANCE FOR ITSELF THE REMAINING 1.75 MILLION WITH NO PROSPECT OF REIMBURSEMENT. SO IT SEEMS TO ME THAT THAT IS A WAY TO DEAL WITH THIS PARTICULAR SITUATION IN AN EQUITABLE WAY AND I PUT THAT OUT THERE FOR YOU ALL TO BE THINKING ABOUT AND FOR YOUR CONSIDERATION. SO I MEAN IT'S A DIFFICULT SITUATION BECAUSE I THINK IN FAIRNESS I THINK THE TOWN OF HILTON HEAD DID RELY UPON THAT EARLIER APPRAISAL AND THINKING THAT IT WAS GOING TO BE COVERED . BUT BY THE SAME TOKEN AN APPRAISED VALUE IS AN APPRAISED VALUE. OKAY SO THIS SEEMS TO ME TO BE A WAY TO RESOLVE THE MATTER POST-CLOSING BETWEEN THE TWO PARTIES SO THAT'S FIRST ITEM OF UPDATE I WANT TO PROVIDE YOU ALL. THE SECOND IS IN REGARD TO THE RELOCATION OF THE ST JAMES CHURCH AND THE ASSOCIATED CHERRY HILL SCHOOL WHICH AS YOU KNOW IS ADJACENT OR CLOSE TO THE RUNWAY OF THE AIRPORT AND IT HAS TO MOVE I MEAN FOR SAFETY PURPOSES THE PARISHIONERS, YOU KNOW, YOU KNOW, CANNOT CANNOT BE THERE. CURRENTLY THE ESTIMATE TO RELOCATE OR SORRY TO RELOCATE THE CHERRY HILL SCHOOL WHICH IS HISTORIC AS IS THE FIRST EDUCATION FOR OUR FREED AFRICAN-AMERICANS AND IT'S GOT TREMENDOUS HISTORICAL SIGNIFICANCE, THE COST OF MOVING THAT SCHOOLHOUSE TO THE NEW PROPERTY SITE WHICH IS KNOWN AS A FIVE ACRE TRACT OF LAND ON UNION SEMINARY CEMETERY AND THE COST OF BUILDING A NEW SANCTUARY AND A FELLOWSHIP HALL FOR SAINT JAMES THE ESTIMATE IS APPROXIMATELY 7.2 MILLION TO $9.2 MILLION. I MEAN THERE'S TWO BIDS THAT WERE SOLICITED THOSE WERE THE TWO BIDS THAT CAME IN. IF I HAD TO GUESS, I SUSPECT THE NUMBER IS PROBABLY SOMEWHERE BETWEEN THOSE TWO THOSE TWO NUMBERS BUT BUT THAT'S THE STARTING FIGURE FOR PURPOSES OF THE DISCUSSION TONIGHT I HAVE OVER PAST COUPLE OF YEARS SECURED $4.7 MILLION IN APPROPRIATIONS FROM THE STATE GENERAL FUND TO BE APPROPRIATED FOR THE PURPOSE OF FACILITATING THIS RELOCATION. I'VE COMMITTED THAT NEXT YEAR AND THE APPROPRIATION THAT A TOP PRIORITY OF MINE WILL BE TO REQUEST AN ADDITIONAL MILLION DOLLARS TOWARD THAT. SO YOU'VE GOT 4.7 MILLION AND STATE MONEY IN HAND. I FEEL CONFIDENT THE ABILITY TO GET AN ADDITIONAL $2 MILLION SO THAT GETS YOU $6.7 MILLION OF THE WAY THERE IF YOU SUBTRACT THAT $6.7 MILLION FROM THAT RANGE OF 7.2 MILLION AND 9.2 MILLION ADDS TO THE TOTAL COST IT LEAVES A DELTA TO BE HIT BETWEEN $500,000 OR $2.5 MILLION DEPENDING UPON WHERE THE FINAL ESTIMATE COMES. THE TOWN OF HILTON HEAD HAS EXPRESSED A WILLINGNESS AT LEAST INFORMALLY AND I BELIEVE A MAJORITY OF THE MEMBERS WOULD CONCUR THAT THEY WOULD CONVEY THE FIVE ACRE SITE UPON WHICH THE CHURCH IS TO BE RELOCATED WITH THE FELLOWSHIP HALL AND THE CHERRY HILL SCHOOL. THEY WOULD CONVEY FIVE ACRES TO ST JAMES ST JAMES AND TURN WOULD CONVEY THE ROUGHLY SEVEN ACRES UPON WHICH THE CHURCH AND CHERRY HILL SCHOOL IS ON NOW TO TWO HILTON HEAD. THE FIVE ACRE TRACT OF LAND AT THE TOWN OF HILTON HEAD WOULD BE CONVEYING HAS BEEN APPRAISED AT BEING WORTH ABOUT $1.2 MILLION MORE THAN THE SEVEN ACRES THAT THEY WOULD BE GETTING FROM SAINT JAMES PRIMARILY BECAUSE THE SEVEN ACRES IS PROXIMATE TO THE RUNWAY AND IT DOESN'T AS MUCH ECONOMIC UTILITY BELIEVE THE TOWN OF HILTON HEAD WILLING TO MAKE THAT SWAP AND THAT THAT $1.2 MILLION DELTA BETWEEN WHAT THEY OWN AND THEY'RE ACQUIRING WOULD BE THEIR CONTRIBUTION TOWARD THE. SO I THINK WHAT I WOULD SUGGEST THAT AN EQUITABLE RESPONSE FROM THE COUNTY AND KIND WOULD BE TO MATCH THAT TOWN OF HILTON HAD $1.2 MILLION APPROPRIATION PERHAPS WITH BACK END FUNDING OF THE FUND THE BACK LEG ON THE VERY END OF THE CONSTRUCTION BECAUSE WE HAVE STATE FUNDS THAT COULD BE UTILIZED SO IT WOULDN'T BE UNTIL THE BACK END TO THE EXTENT THAT IT CAME IN THE BID CAME IN CLOSER TO THE $7.2 MILLION. THAT WOULD MEAN YOUR CONTRIBUTION WOULD BE 500,000 INSTEAD OF 1.2 MILLION. CONVERSELY, IF IT COMES IN AT THE HIGHER APPRAISED ESTIMATED VALUE THAT'S A $2.5 MILLION [00:50:06] DELTA. YOU'RE THE 1.2 MILLION THAT I'M SUGGESTING WOULD BE EQUITABLE FROM THE COUNTY WOULD LEAVE A SHORT $1.25 MILLION UPON WHICH I WOULD THEN GO BACK TO THE WELL AT THE STATE OR I WOULD CONTINUE WORKING WITH SENATOR GRAHAM'S OFFICE REPRESENT CLYBURN'S OFFICE BOTH OF WHOM HAD INDICATED A WILLINGNESS TO HELP WITH PROJECT IRRESPECTIVE OF WHETHER OR NOT THE BID COMES IN THAT COMES IN LOW, I'M STILL GOING TO PUSH FOR THE FEDERAL APPROPRIATION. I THINK IT'S EQUITABLE. OKAY. I THINK IT'S IT'S IT'S IT'S SOMETHING THAT THE IS NOT GOING TO BE PROVIDING MONEY BECAUSE THIS IS NOT GOING THROUGH THE MULTI-YEAR NEPA PROCESS THAT YOU WOULD HAVE TO GO THROUGH AND BUT I DO THINK THERE IS A STRONG ETHICAL ARGUMENT TO BE MADE FOR THE PROPOSITION THE FEDS OUGHT TO HAVE SOME MONEY IN THIS AND BASED ON MY CONVERSATIONS WITH SENATOR GRAHAM'S OFFICE AND CLYBURN'S OFFICE, THERE WILL BE SOME MONEY. I'M FINE WITH THE UNDERSTANDING BEING THAT IF THERE ARE FEDERAL FUNDS THEY CAN THEN BE PUT TO USE TO REIMBURSE TOWN AND THE COUNTY FOR WHAT THEY PUT IN. I WOULD NOT SEEK TO HAVE THE STATE REPAID I WOULD SEEK TO HAVE OR I WOULD SUGGEST AND OBVIOUSLY THAT'S YOUR DECISION BUT I WOULD SUGGEST THAT THAT MONEY IF WE GET TO THE EXTENT IT WASN'T NEEDED COULD BE THE CONSTRUCTION BE USED TO REIMBURSE TOWN AND THE COUNTY IN AN EQUITABLE WAY SO THAT'S THE SECOND PIECE I WANTED TO UPDATE YOU ON THE THIRD IS IN REGARD TO SOMETHING THAT YOUR YOUR FELLOW COLLEAGUE MCCALLUM DID A LOT OF WORK ON IN REGARD TO ELECTION EQUIPMENT THAT'S ABSOLUTELY ESSENTIAL FOR THE NOVEMBER ELECTIONS IT IS PROJECTED THAT THE NUMBER OF THE VOTER TURNOUT IN THE NOVEMBER 2024 ELECTION IS GOING TO BE ABOUT 47% HIGHER THAN THE NUMBER THAT VOTED IN 2022. AND TALKING WITH THE MEMBERS OF THE ELECTION BOARD AND MARIA SMALLS, THE EXECUTIVE DIRECTOR, IT IS ABSOLUTELY CRITICAL GIVEN THOSE NUMBERS FOR AN ORDERLY, YOU KNOW, ELECTORAL PROCESS THAT ADDITIONAL EQUIPMENT THAT WILL PROBABLY COST SIX $700,000 . AT THE SAME TIME COUNTY COUNCIL BECAME AWARE OF POSSIBLE VIOLATION BY MR. GREENWAY OF THE COUNTY'S PROCUREMENT CODE POLICIES, REGULATIONS AND OR GUIDELINES REGARDING CONTRACTS FOR GOODS SERVICES PROFESSIONAL SERVICES PURCHASE ORDERS AND PICARD CREDIT CARD PURCHASES. COUNTY COUNCIL DETERMINED THAT VIOLATIONS COMMITTED BY MR. GREENWAY WARRANT THE TERMINATION OF HIS CONTRACT OF EMPLOYMENT AS A RESULT OF THE ALLEGATIONS AND COUNSEL'S OWN FINDINGS. COUNTY COUNCIL CONTRACTED WITH A CIVIL FIRM HAYNSWORTH SINGLER BOYD TO ENTER, AUDIT AND PROVIDE AN INITIAL REPORT REGARDING THE COUNTY'S HANDLING OF CONTRACTS FOR GOODS SERVICES, PROFESSIONAL SERVICES AND PURCHASE ORDERS FOR COMPLIANCE WITH THE COUNTY'S PROCUREMENT CODE POLICIES AND OR GUIDELINES FOR THE FOR THE CALENDAR YEAR 2023 AND FOR ALL AND COUNTY YEARS 2019 THROUGH 2023. COUNSEL'S GOAL WAS TO DETERMINE WHETHER THE CONTRACTS PURCHASE ORDERS AND PICARD PURCHASES MADE DURING THIS PERIOD VIOLATED THE COUNTY'S CODE AND POLICIES AND REGULATIONS AND TO BRING THE COUNTY COUNCIL'S ATTENTION TO COUNTY COUNCIL'S ATTENTION ANY SUSPECTED VIOLATIONS OF COUNTY OR STATE LAW. THE LAW FIRM DETERMINED THAT THERE WERE SEVERAL INSTANCES WHERE THE PROCESSING OF CONTRACTS PURCHASE ORDERS AND PICARD PURCHASES DURING THIS PERIOD WERE NOT IN COMPLETE COMPLIANCE WITH THE PROCUREMENT CODE AND COUNTY PROCUREMENT REGULATIONS. COUNCIL HAS CHARGED ITS NEW WITH CONDUCTING AN INVESTIGATION AND HIS FINDINGS TO COUNSEL. THAT FOLLOW UP IS NOW UNDERWAY . IN JULY 2024 COUNTY COUNCIL ISSUED A REPORT IN RESPONSE TO THE LAW FIRM'S FINDINGS. IT REINFORCED THE COUNTY'S ESTABLISHED REGARDING CONTRACTS PURCHASE ORDERS AND PICARD PURCHASES NOTING CHECKS AND BALANCES AND REQUIRED SUPERVISORS AREA APPROVALS AT APPROPRIATE LEVELS. THE LAW FIRM'S REPORT IS INTENDED TO SERVE AS AN INTERNAL AUDIT TO IDENTIFY AND ADDRESS PROCUREMENT ISSUES AND TO HOLD ACCOUNTABLE THOSE WHO MAY HAVE VIOLATED COUNTY POLICIES. THE COUNTY ADMINISTRATOR HAS STARTED REVIEWING THE IDENTIFIED PROBLEMS. STAFF INTERVIEWS WILL BE CONDUCTED TO DETERMINE INDIVIDUAL RESPONSIBILITY FOR ANY POLICY VIOLATIONS WHERE APPROPRIATE DISCIPLINARY ACTIONS THAT ARE CONSISTENT WITH THE COUNTY'S PERSONNEL HANDBOOK WILL BE ADMINISTERED.
