Consideration of an Ordinance Authorizing the Conveyance of Certain Real Property Owned by the Town of Bluffton to Beaufort County, Located Adjacent to 140 Buck Island Road and Consisting of 0.072 Acres, More or Less, and Identified as a Portion of Beaufort County Tax Map No. R610 031 000 0003 0000; and Authorizing the Execution and Recording of Associated Documents – First Reading - Stephen Steese, Town Manager] NEXT CONSIDERATION OF AN ORDINANCE AUTHORIZING THE CONVENIENCE CERTAIN REAL PROPERTY OWNED BY THE TOWN OF BLUFFTON TO BE A COUNTY LOCATED ADJACENT TO 140 BUCK ISLAND ROAD AND CONSISTING OF 0.072 ACRES MORE LESS AND IDENTIFIED AS A PORTION OF BEAUFORT COUNTY TAX MAP NUMBER ARE 61003100000030000 IN AUTHORIZING THE EXECUTION AND RECORDING OF ASSOCIATED DOCUMENTS MAYOR AND COUNCIL SO YOU KNOW WE PURCHASED 140 BUCK ISLAND ROAD BACK IN JANUARY DURING THE DUE DILIGENCE PERIOD WE NOTICED THAT A PORTION OF THE COUNTY STORMWATER POND WHEN THEY BUILT BLUFFTON PARKWAY WHEN THEY PUT THE STORMWATER POND IN THE TOP OF THE BANK ACTUALLY CROSSED OUR PROPERTY BY ABOUT FIVE FEET ON A COUPLE ON THE WEST AND THE SOUTH AND THEN A PORTION OF THE MULTIPURPOSE TRAIL THAT THEY BUILT ACTUALLY WENT ABOUT A FOOT OR TWO OVER ON OUR PROPERTY. WHAT WE WANT TO DO IS CLEAN THAT UP SO THIS SHOWS WHERE THAT IS SO YOU CAN SEE RED AREAS THERE AT THE TOP YOU CAN SEE WHERE OUR PROPERTY GOES AND YOU SEE THE LITTLE DASHED LINES FOR THEIR SIDE MULTIPURPOSE PATH ACTUALLY COMES ACROSS ON OUR PROPERTY AND THEN WHERE THE POND IS THOSE TWO RED AREAS YOU CAN SEE WHERE THE TOP OF BANK ACTUALLY COMES ON OUR PROPERTY . THIS WAS FOUND WHEN WE DID THE ATLAS REPORT THAT THE SURVEY AS PART OF THE CLOSING SO WE KNEW THIS WAS GOING TO BE AN ISSUE WE'VE BEEN WORKING WITH THE COUNTY EVER SINCE TO LET THEM KNOW THAT HEY YOU HAVE IMPROVEMENTS AT OUR OWN PROPERTY. WE NEED TO WE NEED TO DO SOMETHING ABOUT IT. THE EASIEST SOLUTION IS FOR US TO QUITCLAIM A SMALL PORTION OF OUR PROPERTY TO THEM. THE REASON WE WOULD WANT TO DO THAT IS MOSTLY FOR LIABILITY PURPOSES OUT OF A PORTION OF THE MULTIPURPOSE TRAIL IS ON OUR PROPERTY AND SOMEBODY SLIPPED ON THAT PORTION THEY'RE GOING TO FILED AGAINST OUR INSURANCE IF A PORTION OF THE STORMWATER POND IS ON OUR PROPERTY AND SOMEBODY FALLS INTO THAT STORMWATER POND THEY COULD POTENTIALLY TURN AROUND AND FILE SUIT AGAINST US. PART OF THAT STORMWATER POND IS ON OUR PROPERTY SO WE WANT TO MAKE SURE THAT WE'RE LIMITING OUR LIABILITY AND THAT THE COUNTY HAS ALL OF THEIR [02:20:04] FACILITIES ON THEIR PROPERTY. SO WHAT IS BEING PROPOSED IS TO ADDRESS TO OUR PROPERTY LINE AS YOU CAN SEE THAT IN RED IT MOVES IT SOUTH ABOUT THREE FEET SO WE DON'T THEIR MULTI-PURPOSE TRAIL ON OUR PROPERTY AND THEN IT MOVES OUR PROPERTY LINE ABOUT FIVE FEET OVER TO HAVE THE TOP OF BANK OUTSIDE OF OUR PROPERTY LINE YOU'LL SEE IT ALSO A RELOCATED TEN FOOT EASEMENT SO THE COUNTY CAN ACCESS THEIR POND TO DO MAINTENANCE ON THERE WE WANT THAT BE IN GOOD WORKING ORDER THAT'S A STORMWATER POND FOR THE PARKWAY SO WANT TO MAKE SURE THEY CAN ACCESS AND KEEP IT IN GOOD WORKING ORDER SO THAT'S WHAT WE'RE ACTUALLY APPROVING TONIGHT THAT'S WHY IT'S SUCH A SMALL PIECE OF PROPERTY IS .072 ACRES. IT'S JUST THOSE SLITHERS SO THERE'S A PROPERTY THAT YOU SEE THERE SO AGAIN I'VE TALKED TO LEGAL COUNSEL WELL AS THE INTERIM ADMINISTRATOR I HAVE NOT TALKED TO THE NEW ADMINISTRATOR. I'M MEETING WITH HIM THURSDAY BUT THEY ARE GOOD WITH ACCEPTING THIS. WE WOULD DO A QUICK CLAIM AND THEY WOULD HAVE TO GO BACK TO THEIR COUNCIL AND ASK THEM TO RECEIVE THIS PROPERTY ALL INTENTS AND PURPOSES FOR EVERYTHING WE'VE HEARD FROM THEM BETWEEN LEGAL AND ADMINISTRATOR IS THAT THEY SEE NO ISSUES WITH THEIR COUNCIL ACCEPTING THIS SO ONCE IT GOES TO THEM THEY WOULD JUST GO AND ACCEPT AND THEN RECORD THIS AS THEIR PROPERTY.
