HOW ARE YOU TODAY? WELL THEN GOOD AFTERNOON CHAIRMAN AND MEMBERS OF COUNCIL. THANK YOU FOR ALLOWING ME TO BE HERE TODAY. I'D LIKE TO SHARE JUST A FEW HIGHLIGHTS FROM DETENTION CENTER. WE'RE IN THE PROCESS OF RENOVATING OUR CURRENT FINGERPRINT MACHINE ROOM TO INCLUDE A NEW SCANNER MACHINE. THIS MACHINE WILL COME BACK CONTROL BANNED FROM ENTERING INTO THE FACILITY AND MAKING IT TO THE GENERAL POPULATION AREAS. WE ALSO PURCHASE A CORE EMR SOFTWARE THE ELECTRONIC MEDICAL RECORDS THE MEDICAL DEPARTMENT WILL STILL USING MANUAL METHOD PEN AND PAPER CORE EMR A MORE SIMPLIFIED METHOD OF CHARTING MEDICATION MANAGEMENT AND SCHEDULING.WE'RE CURRENTLY SEEING AN INFLUX OF MORE INMATES CHARGED WITH VIOLENT CRIMES ON STABLE MENTAL CAPACITY AND INMATES WHO ARE CODEPENDENT ON DRUGS AND ALCOHOL.
THAT IS WHY I AM TO WELCOME THOMAS MCMANN. HE IS THE NEW ALCOHOL AND DRUG COUNSELOR. HE'S WORKING INMATES ONE ON ONE AND IN SMALL GROUP SESSIONS TO ADDRESS THEIR ISSUES AS IT RELATES TO DRUG AND ALCOHOL ONE OUR HOPE IS TO REDUCE RECIDIVISM, EDUCATION AND SUPPORT. WE'RE ALSO PLEASED TO HAVE JAMES BEEN HE IS THE NEWEST MEMBER TO A MENTAL PROGRAM. HE'S A MENTAL HEALTH PHYSICIAN . HE PROVIDES ASSESSMENTS AND TREATMENT TO INCLUDE MEDICATION WHICH AIDS IN THE MANAGEMENT OF THESE INMATES AS THE POPULATION RISES.
WE'RE ALSO DEALING WITH STAFF SHORTAGES. WE ARE 33 STAFF MEMBERS UP.
HOWEVER WE HAVE DEDICATED OFFICERS STILL SERVING. WE CURRENTLY HAVE 27 OFFICERS WITH FIVE OR MORE YEARS, FIVE WITH OVER 20 YEARS AND ONE WITH 25 YEARS OR MORE.
WITHIN THE NEXT 3 TO 10 YEARS WE COULD POSSIBLY LOSE UP TO 15 OFFICERS DUE TO RETIREMENT.
WE'RE WORKING HARD INTERNALLY TO SHOW THEM JUST HOW MUCH THEY ARE TRULY VALUED.
WE'RE EXCITED TO BE WORKING WITH SIERRA HOME THE NEW RECRUITING SHE'S IMPLEMENTING
[00:05:03]
INNOVATIVE WAYS TO BRING NEW APPLICANTS TO THE FACILITY AND .LASTLY I WOULD LIKE TO THANK MR. ROBINSON IN HIS DUAL ROLE. HE FINDS THE TIME TO STILL GIVE US SUPPORT WHEN WE NEED IT. THANK YOU. DO YOU HAVE ANY? ABSOLUTELY. SO MENTAL HEALTH IS THAT WHAT HIS NAME IS? JIM BEAN? YES. JAMES BEAN.
AND HE IS IS HE A PSYCHIATRY. HE IS A NURSE PRACTITIONER FOR BE FROM MEMORIAL HOSPITAL MENTAL HEALTH DEPARTMENT AND YOU'LL BE SEEING SOME GOOD THINGS COME.
OH, YES. YES. HIS IS TO SEE UP TO TEN INMATES A DAY. OKAY. ANY OTHER QUESTION? SURE. YES. IS HE WORKING FULL TIME OR IS HE A ITINERANT OR RESOURCE PERSON COMING IN? HE HE IS A CONTRACT WORKER WITH BEFORE MORE BECAUSE WE CONTRACT THEM FOR A OUR MENTAL HEALTH SERVICES BUT THE PHYSICIAN USED TO COME ONCE A WEEK. MR. BEAN IS THERE LIKE EVERY DAY? WELL, YES. THE OTHER QUESTION I REALLY HAVE IS ON YOUR 33 SHORTAGE.
YES. AND YOU SAID HALL IS REALLY WORKING WITH YOU JUST TRY TO BE . WHAT HAS BEEN SOME OF THE PROBLEMS AND IT'S NOT REALLY THE THE NUMBERS THAT I'M CONCERNED ABOUT IS THE ONES THAT YOU CURRENTLY HAVE THAT STILL TO WORK OVERTIME SO YOU KNOW IN DEALING STRESS LEVEL I GUESS YOU'RE DEALING WITH STRESS LEVEL AS WELL WITH WORKERS. I MEAN YOU CAN ONLY DO SO MUCH IN A WEEK'S TIME. SO I'M JUST WONDERING HOW IS ALL THAT WORKING OUT AT THIS TIME? WELL, CURRENTLY WE HAVE DONE A LOT OF DIFFERENT THINGS FROM WE USED TO WORK TEN HOUR SHIFTS AND WE SWITCHED TO 12 HOUR SHIFTS.
CURRENTLY ONLY BECAUSE IT'S AN EMERGENCY SITUATION. BUT AS YOU KNOW THAT JAIL ACROSS THE COUNTY COUNTRY IS SHOWING BUT WE'RE DOING EVERYTHING THAT WE CAN TO MAKE SURE THAT WE'RE GIVING THEM TIME OFF WHEN NEEDED AND JUST TO MAKE IT EASIER FOR THEM.
WELL, I UNDERSTAND. YES. I GUESS JUST DEALING WITH WHAT KIND OF TIMETABLE YOU WORKING ON AND TRYING TO REDUCE THAT NUMBER AND IT'S SOME YOU KNOW THE WORKERS MAY SOME MENTAL HEALTH EVENTUALLY IF YOU KEEP IT UP YOU KNOW WHAT I MEAN? SO I'M JUST CONCERNED ABOUT ALL OF THAT. WELL, I CAN SAY THAT WE VISITED MANY WE'VE DONE RECRUITMENT JUST LAST WEEK OR WEEKS AGO WE HAD A HIRING EVENT THAT WE WAS A PART OF AND WE'RE DOING MANY HIRING EVENTS. SO WE HAVE ONE COMING UP SHORTLY. IS THE MILITARY A SOURCE OF A RECRUITMENT? YES AND NO. OKAY. USUALLY THEY RETIRE FROM THE THEY GO BACK HOME. SO DO GO TO THEIR RECRUITMENT EVENTS AS WELL BUT WE DON'T GET AS MANY APPLICANTS. OKAY. THANK YOU, MISS GREAT.
YES, SIR. ANYBODY ELSE? I JUST HAD MR. GLOVER TOUCHED ON ONE OF MY THINGS OR ANY OF THE OTHER ONES THE MENTAL HEALTH.
I THINK IT'S GREAT. I MEAN WE ALL KNOW WHAT HAPPENED HERE ABOUT TWO YEARS AGO WHEN WE REALLY STARTED TO TALK ABOUT DIFFERENT OPTIONS THAT WE NEED TO DO.
AND THAT'S WHY I TALKED ABOUT GETTING A NEW CENTER AND CENTER LOCATION OF BEAUFORT COUNTY.
MY QUESTION IS DO WE HAVE A PROGRAM INTACT AS THROUGH YOU SINGULARLY BUT AS A GROUP TO STILL CHECK UP WITH THESE PEOPLE AFTER THEY LEAVE OUR SYSTEM? I KNOW WE'RE WE'RE NOW PROVIDING MENTAL HEALTH DAILY AS YOU SAID INSIDE THE DETENTION CENTER. WHAT HAPPENS WHEN THEY GO BACK OUT TO.
I MEAN LET'S CALL IT THE REAL WORLD? WELL THEY DO FOLLOW UP.
OKAY. WE DO HAVE FOLLOW WE DID. YES.
GOOD. THAT WAS MY BIGGEST QUESTION. ANYBODY ELSE? CONRAD THANK YOU. YOU'RE WELCOME. THERE'S ANYTHING ELSE WE CAN DO WITH THE STAFFING THEN PLEASE LET US KNOW. OKAY.
WILL DO. I MEAN IT'S IT'S DEFINITELY A FOR THE COUNTY.
YES, SIR. ALL MOVING ON TO OUR AGENDA ITEMS FOR THE DAY.
[8. RECOMMEND APPROVAL TO COUNCIL FOR FIRST READING OF AN ORDINANCE AMENDING CHAPTER 99 STORMWATER MANAGEMENT, ARTICLE II STORMWATER MANAGEMENT UTILITY SECTIONS 110, STORMWATER SERVICE FEE BILLING, DELINQUENCIES AND COLLECTIONS; AND 113, ENFORCEMENT AND PENALTIES OF THE BEAUFORT COUNTY CODE OF ORDINANCES - Brian Hulbert, Deputy County Attorney]
NUMBER RECOMMEND APPROVAL TO COUNCIL FOR THE FIRST READING OF AN ORDINANCE AMENDING CHAPTER 99 STORMWATER MANAGEMENT. ARTICLE TWO STORMWATER MANAGEMENT UTILITY UTILITY SECTIONS 110 STORMWATER SERVICE FEE BILLING DELINQUENCIES[00:10:03]
COLLECTIONS AND 113 ENFORCEMENT AND PENALTIES OF THE COUNTY CODE OF ORDINANCES.BRIAN I THINK WE HAVE A COUPLE COMING UP TOGETHER. DO I HAVE A MOTION TO OPEN THIS UP FOR HIM? DO AND NINE TOGETHER. SEPARATELY REGARDING INTENDED TO OCEAN. ITEM NUMBER EIGHT HAVE A MOTION TO HAVE A SECOND PLEASE.
I'LL SECOND TAB WITH THE SECOND Q. YES SIR.
GOOD AFTERNOON COUNSEL. THIS IS AN AMENDMENT TO OUR STORMWATER FEE AND WHAT THIS WILL DO IS CLARIFY THE LANGUAGE OUR CODE ADDRESSING PENALTIES AND THAT PENALTIES APPLY TO ALL OF OUR STORMWATER PROPERTIES ANY PROPERTY IN THE COUNTY THAT'S REQUIRED TO PAY STORMWATER FEE IF THEY DON'T PAY IT ON TIME THEY'LL BE SUBJECT TO THE PENALTY AND THEY'LL HAVE TO PAY IT BACK IN THE SAME TIME PERIOD AS YOUR PROPERTY TAX PERIOD.
SO THE SAME CALENDAR IN THE STATE STATUTE UNDER TITLE 12 OR THE PENALTIES ARE ASSESSED FOR LATE PAYMENT OF YOUR PROPERTY TAX. THE FIRST PAYMENT IS A 3% PENALTY IF YOU MISS IT. THE SECOND ONE YOU ADD 7% ON TOP OF THAT AND THEN THE THIRD ONE ANOTHER 5% FOR A TOTAL OF 15% TO YOUR PROPERTY TAXES. THIS WILL MAKE SURE THAT THERE'S NO MISUNDERSTANDING AS TO WHETHER OR NOT THERE'S A PENALTY UNDER OUR STORMWATER FEE. IF YOU'RE LATE PAYING THE FEE YOU HAVE TO PAY THE PENALTY THE SAME AS YOU DO PROPERTY AND THIS MAKES IT MUCH EASIER FOR THE AUDITOR TO COLLECT THOSE TAXES AND DO THE CALCULATIONS. OKAY. THIS ALSO PUTS A METHOD FOR THE COUNTY TO MAKE THEIR PAYMENT OF THE STORMWATER FEES FOR ALL THE COUNTY OWNED PROPERTIES MUCH EASIER BY JUST A LEDGER TRANSFER FROM ONE ACCOUNT TO THE STORMWATER FEE.
THAT'LL MAKE IT MUCH EASIER FOR DENISE AND HER PEOPLE IN THAT FEE EVERY YEAR.
AND THEN THE FINAL PART IS I PUT IN THE MAXIMUM PENALTY I TOOK IT FROM $1000 TO $500 BECAUSE THE JURISDICTION PENALTY FOR ANY LOCAL GOVERNMENT, MUNICIPALITY OR COUNTY IS $500 IN THE SUMMARY COURT WHICH OURS IS THE MAGISTRATE'S COURT.
WE DON'T HAVE THE AUTHORITY UNDER STATE STATUTE TO IMPOSE A PENALTY ABOVE $500.
NO. IN TRUTH IF THEY GET THEY TOOK IT IN A FINE OF $500.
THEY'RE GOING TO PAY 1080 250 WHEN YOU PUT ALL THE STATE ASSESSMENTS ON TOP OF THE RIGHT . BUT THE MAXIMUM PENALTY WE CAN PUT IN FOR ANY ORDINANCE THAT WE PASS AT THE COUNTY IS $500 OR ANY DISCUSSION. THIS WILL BE PASSED WITH NO OBJECTION. JUST QUICKLY SEVERAL YEARS AGO WE FILED A LAWSUIT THE MILITARY YOU YOU. IS THIS THAT JUST VAGUELY. WE'RE STILL PURSUING THAT WE STILL BELIEVE THAT FEDERAL GOVERNMENTS, STATE GOVERNMENTS AND LOCAL MUNICIPALITIES TO PAY THE STORMWATER FEE JUST LIKE ANYBODY ELSE. AND THAT'S WHY THE COUNTY PAYS A STORMWATER FEE BECAUSE HOW WOULD IT BE FAIR FOR US TO EXCLUDE OURSELVES, THE OTHER GOVERNMENT ENTITIES OR SPECIAL PURPOSE DISTRICTS? EVERYBODY THAT OWNS THE PROPERTY HAS TO PAY THE STORMWATER FEE FROM THEIR FAIR .
AND THAT'S STILL BEING PURSUED AND I BELIEVE BRITTANY'S ONE THAT'S STAYING ON TOP OF THAT HERE. YES. IF I MAY WAS SO ON THAT ISSUE THAT CAME UP BEFORE BRIAN JOINED US SEVERAL YEARS AGO. COUNCIL AUTHORIZED US TO RETAIN COUNSEL TO INVESTIGATE THAT AND CONSIDER PURSUING IT. WE GOT THE POINT WHERE WE ASKED COUNCIL FOR AUTHORIZATION TO FILE A LAWSUIT AGAINST FEDERAL GOVERNMENT.
I THINK WE EVEN HAD THE COMPLAINT DRAFTED UP. OUR LAWYERS AND COUNCIL VOTED NOT TO DO THAT AND. WE HAVE NOT PURSUED THAT SINCE. SO IT'S A KIND OF A DEBT IT'S A DEAD ISSUE FOR US RIGHT NOW. BUT IF COUNCIL DECIDES THEY WANT TO RAISE IT AGAIN, WE CAN SO THEY WILL BE THE ONLY ENTITY THAT WOULD NOT BE BASED ONE. IF WE ARE NOT PURSUING IT THEN WE'VE NOT COLLECTED FROM THE FEDERAL GOVERNMENT AND WE WOULD AS TOM SAID, HAVE RE-INSTITUTE OR INSTITUTE A LAWSUIT TO PURSUE TO HAVE A COURT TELL THEM THAT THEY HAVE TO MAKE THAT PAYMENT. THEY CAN TEST THIS THROUGHOUT THE COUNTRY SAYING THAT THEY'RE NOT REQUIRED TO MAKE PAYMENTS. OKAY. OKAY.
THANK YOU. THANK YOU. ANY OTHER QUESTIONS? THIS WILL BE DONE WITH NO OBJECTION UNLESS WE PASS AN NO OBJECTION.
[9. RECOMMEND APPROVAL TO COUNCIL FOR FIRST READING OF AN ORDINANCE AMENDING ORDINANCE 2023/32 AN ORDINANCE TO AMEND THE BEAUFORT COUNTY ORDINANCE ESTABLISHING A ROAD USE FEE - Brian Hulbert, Deputy County Attorney]
ALL RIGHT. NUMBER NINE AND TEN I WOULD LIKE TO TAKE THEM TOGETHER FROM EACH OF IS EASIER. TAKE THEM SEPARATE. OKAY, THAT'S FINE.WE'LL TAKE EVERYTHING. NUMBER NINE RECOMMEND APPROVAL. THE COUNSEL FOR THE FIRST READING OF AN ORDINANCE AMENDING ORDINANCE 2023 SLASH 32 AN ORDINANCE TO AMEND THE ORDINANCE ESTABLISHING A ROAD USE FEE SO MOVED SECOND TO SECOND BARTHOLOMEW THE SECOND
[00:15:05]
OKAY COUNCIL WILL RECALL THAT IN SEPTEMBER OF LAST YEAR WE PASSED A NEW ORDINANCE FOR THE ROAD USE FEE INCREASE IN FROM $10 TO $20. AFTER THERE WAS SOME QUESTION IN THE STATE AS TO THE VALIDITY OF DIFFERENT ROAD USE FEES THAT HAVE BEEN IMPOSED THROUGHOUT THE STATE SO WE KEPT OUR ORIGINAL AT $10. WE RAISED IT THROUGH THE YEARS AND THEN AFTER THIS DISPUTE AROSE A FEW YEARS AGO THE COUNTY REDUCED BACK TO THE $10.AND THEN IN SEPTEMBER WE PASSED THE NEW ORDINANCE ALL THE JUSTIFICATION TO MEET ALL THE CHALLENGES IN THE LANGUAGE TO SATISFY THE COURTS IN OUR OPINION AND WE IMPOSED A FEE OF $20 TO THE MIKE, PLEASE. CAN YOU HEAR ME NOW, SIR? A LITTLE BETTER.
ALL RIGHT. SO IN SEPTEMBER WE RESET THE FEE, INCREASED IT FROM $10 TO $20 IN THE LANGUAGE IN THE ORDINANCE THAT WE PASSED IN SEPTEMBER, HOWEVER WE OPENED IT UP TO OUR EVERY VEHICLE REGISTERED. THE COUNTY HAD TO PAY THE $20 ROAD FEE PRIOR TO WE ONLY REQUIRED THE VEHICLES THAT WERE REQUIRED TO BE WERE ON OUR TAX RECORDS PAY THAT FEE SO THAT EXCLUDED THE PEOPLE WERE 100% DISABLED AND THE MILITARY THAT REGISTERED THE HERE. SO THIS LANGUAGE HERE REQUIRING THAT IT JUST BE THE MOTOR VEHICLES REQUIRED TO BE LICENSED WHICH ARE CARRIED ON OUR TAX RECORDS THE COUNTY PAYING THE $20 FEE JUST PUTS IT INTO THE PAST PRACTICE AND MAKE IT CONSISTENT WITH WHAT WE'VE BEEN DOING OVER THE PAST 20 YEARS. ANY QUESTIONS? NO, THIS WILL BE DONE WITH NO OBJECTION AS WELL AND SEE NO OBJECTION.
[10. RECOMMEND APPROVAL TO COUNCIL FOR FIRST READING OF AN ORDINANCE TO AMEND CHAPTER 2 ADMINISTRATION, ARTICLE VII FINANCE, DIVISION 2 FEES AND SERVICE CHARGES GENERALLY, SECTION 2-437 ROAD USE FEE OF THE BEAUFORT COUNTY CODE OF ORDINANCES - Brian Hulbert, Deputy County Attorney]
NUMBER TEN RECOMMENDED APPROVAL. THE COUNCIL FIRST READING OF AN ORDINANCE TO AMEND CHAPTER TWO ADMINISTRATION ARTICLE V11 FINANCE DIVISION TWO FEES AND SERVICE CHARGES GENERALLY SECTION 2-4 37 ROAD USE FEE OF COUNTY CODE OF ORDINANCES WE HAVE A MOTION SO MOVED I'LL MAKE SECOND SECOND HOWARD THANK YOU.OKAY THIS WILL AMEND THE ORDINANCE FOR ROAD USE FEE IN OUR VIEW FOR COUNTY COURT OF ORDINANCES THAT'S ON LINE THAT SEES. OKAY SO THIS WILL TAKE IT AND SET THE ROAD USE FEE $20 TO MATCH THE FEE THAT YOU RAISED IT TO LAST SEPTEMBER SO TO MAKE THAT CORRECTION AND THEN IT WILL ALSO MAKE THE CHANGE THAT THE ROAD USE FEES HAS TO GO INTO A SPECIAL RELIGIOUS ACCOUNT AND ONLY BE USED FOR THE ROAD USE MAINTENANCE THAT PURPOSE THERE TO BRING IT INTO COMPLIANCE WITH THE STATE STATUTE SO IT MAKES THE LANGUAGE $20 AND IT'S SET AT $20. THE CODE OF ORDINANCES PREVIOUSLY REQUIRED EVERY YEAR COUNTY COUNCIL REVIEW IT TO DETERMINE WHETHER OR NOT AN INCREASE IN THAT FEE WAS REQUIRED OR NECESSARY. THIS TAKES THAT REQUIREMENT BECAUSE WE SET THAT FEE AT $20 AND IF STAFF THAT THERE'S A NEED TO INCREASE THE FEE THEY'LL COME FORTH WITH THE REQUESTED AMENDMENT SET WHAT THE NEW FEE IS WHEN IT'S AN APPROPRIATE TIME TO INCREASE THE FEE IN THEIR OPINION. OKAY.
SO THAT JUST MAKES TO WHERE IT GOES TO THE SPECIAL ACCOUNT IT'S ONLY SPENT ON THOSE USES INSTEAD OF $20 AND IT DOESN'T INCLUDE ANNUALLY IS JUST WHEN IS DETERMINED BY STAFF TO BE APPROPRIATE TO INCREASE THE FEE. OKAY.
THERE'S BEEN NO OBJECTION. NUMBER TEN ALSO PASSED WITH NO OBJECTION.
[11. RECOMMEND APPROVAL TO COUNCIL FOR FIRST READING OF AN ORDINANCE AUTHORIZING THE INTERIM COUNTY ADMINISTRATOR TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS FOR THE ACCEPTANCE OF PROPERTIES PURSUANT TO A DEVELOPMENT AGREEMENT BETWEEN BEAUFORT COUNTY AND CHEROKEE BEAUFORT, LLC - Jared Fralix, Assistant County Administrator & Neil Desai, Public Works Director]
THANK YOU BRIAN. MOVING ON TO NUMBER 11 RECOMMEND APPROVAL OF COUNSEL OF FIRST READING AN ORDINANCE ORDINANCE AUTHORIZING THE INTERIM COUNTY ADMINISTRATOR TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS FOR THE ACCEPTANCE OF PROPERTIES PURSUANT TO A DEVELOPMENT AGREEMENT BETWEEN COUNTY AND CHEROKEE LLC. WE HAVE A MOTION I'LL MAKE MOTION, MR. CHAIRMAN. THANK YOU, MISS. OUR SECOND CIRCUIT.THERE YOU GO. I BELIEVE IS JARED HARRIS. NEIL ARE YOU DOING THIS ONE? MARGARET AFTERNOON, SIR. AND COMMITTEE MEMBERS. SO BEFORE YOU IS THE ORDINANCE TO ACCEPT CHEROKEE FARM ROADS INTO THE COUNTY SYSTEM PER THE D.A. ABOUT DEVELOPMENT AGREEMENT BUT TEN YEARS AGO WE WERE OBLIGATED TO BRING THIS IN.
SINCE THEN WE HAVE BEEN MAINTAINING IT AND THIS WOULD JUST FORMALIZE THE ROAD AS FAR TO BRING IT INTO THE COUNTY SYSTEM MUST BE DONE ALSO. NO OBJECTION.
YES. AND I SEE NO OBJECTION AS WELL. AND NUMBER 11 WILL ALSO PASS BEFORE YOU LEAVE, NEIL, I HAVE TO SAY I KNOW YOU HAVE UP ABOUT CLEMSON RIGHT NOW SWEET 16 YOU HOW ABOUT UNIVERSITY SOUTH CAROLINA GAMECOCKS I'M GOING TO PLEAD THE FIFTH ON THAT ONE.
[12. RECOMMEND APPROVAL TO COUNCIL OF A RESOLUTION AND AN INTERGOVERNMENTAL AGREEMENT BETWEEN BEAUFORT COUNTY AND HILTON HEAD ISLAND FOR WILLIAM HILTON PARKWAY SAFETY AND PEDESTRIAN IMPROVEMENTS (FISCAL IMPACT: not to exceed amount of $600,000 to be funded from the Hilton Head Island/Daufuskie Island Road Impact Fees account 2300-30-0000-54500-I2300 with a remaining balance of $800,000. The Town shall submit paid invoicing documentation to the County for reimbursement) - Jared Fralix, Assistant County Administrator]
MOVING ON TO NUMBER 12 RECOMMEND APPROVAL THE COUNTY TO COUNSEL A RESOLUTION IN AN IGA BETWEEN BEAUFORT COUNTY AND HILTON HEAD ISLAND FOR HILTON PARKWAY SAFETY AND PEST PEDESTRIAN IMPROVEMENTS. DO WE HAVE A MOTION MOVED AND A SECOND PLEASE.I'LL SECOND THAT. THANK YOU TAB AT THE SECOND. ALL RIGHT, GERARD SO THIS IS NOT THE BRIDGE PROJECT, CORRECT ? WE GOT THAT RIGHT AWAY.
[00:20:04]
YEAH, WE KNOWN THAT BECAUSE THE ROOM'S EMPTY. YEAH, THAT'S RIGHT.THAT'S RIGHT. SO WHAT IS IS LAST YEAR OR TWO YEARS AGO COUNTY COUNCIL SUBSCRIBED SOME FUNDS FOR US TO GET STARTED. WE DIDN'T DO SALES TAX IN 2022 SO WE'RE GOING TO COME BACK IN 2024 AND THERE IS SOME FUNDING SET ASIDE FOR ENGINEERS STAFF TO GET STARTED ON PROJECTS. WE'LL GET A LOT OF PROJECTS STARTED THAT ARE END DESIGN AND SOME PROJECTS THAT WE'RE GOING TO GET STARTED SAFETY PROJECTS FOCUSED THAT REQUIRE A LITTLE RIGHT AWAY ACQUISITION AND LITTLE UTILITY COORDINATION AND PERMITTING.
SO THINGS THAT WE CAN GET OUT ON THE STREET RELATIVELY QUICKLY SO THROUGH DISCUSSIONS WITH HILTON HAVE WE ASKED FOR PROJECT AREAS THAT THEY COULD IDENTIFY ON THE ISLAND? WE COULD SUBSCRIBE SOME OF THE FUNDING FOR THAT BUT LIEU OF USING THAT FUNDING WE'VE SET ASIDE THAT FUNDING FOR SOME OTHER PROJECTS. WE'RE GOING TO USE SOME IMPACT FEE FUNDING THAT WE HAVE FROM THE WHOLE IMPACT FEES FEES TO USE THAT UP SINCE IT FITS NEED AS A SAFETY PROJECT AND IT'S SPECIFICALLY TO THE AREAS THAT THEY IDENTIFIED WERE DIFFERENT AREAS ALONG TO 78 SO THEY PICKED OUT TWO AREAS ON 278 FOR SOME PEDESTRIAN AND STRIPING ACCOMMODATIONS FOR THOSE TYPE OF SAFETY IMPROVEMENTS AND THE INTENT IS THAT THEY WOULD DO EVERYTHING ON THE PROJECT FROM THE DESIGN TO THE CONSTRUCTION ADMINISTRATION AND WE WOULD THAT THROUGH OUR IMPACT FEE PROGRAM FOR A TOTAL OF UP TO $600,000 AND THAT'S WHAT THIS AGREEMENT ESTABLISHED. CAN YOU WALK ME THROUGH AND YOU SAID COMING THROUGH IMPACT FEES, CAN YOU WALK ME THROUGH HOW THAT'S GOING TO BE ADMINISTERED? I WAS JUST READING THROUGH AND IT SEEMS LIKE A REIMBURSEMENT WE'RE DOING IT SO THEY'LL THEY'LL MINISTER THE PROJECT ONCE THEY HAVE AN INVOICE FROM THE CONTRACTOR THEY'LL SEND US AN INVOICE UP TO THE $600,000 THRESHOLD AND WE'LL PAY BACK THAT THAT PROJECT AND IF IT GOES ABOVE THE 600 IT WOULD BE ON THE TOWN THE TOWN OF HILTON THAT FINISHED FUNDING AND THE REMAINING BALANCE OF THE 800 INSIDE THAT ACCOUNT IS THAT BEFORE OR AFTER THIS TRANSACTION THAT'S BEFORE. SO WE'D HAVE ABOUT $200 200,000.
OKAY. AND THIS IS THE OLD IMPACT FEE SO.
WHAT WE'RE TRYING TO DO IS TO UTILIZE ALL THE FUNDING OUT OF THOSE BECAUSE STARTED LAST YEAR WE ADOPTED THE NEW IMPACT FEES AND WE'RE STARTING COLLECTION THOSE SO WE'RE TRYING TO SPEND OUT THE EXISTING INVESTORS SO THAT ACCOUNT BE CLOSED WHEN IT'S FINISHED BECAUSE WE HAVE NEW AGREEMENTS, NEW INVESTORS. THAT'S CORRECT AND THAT'S WHAT WE'RE TRYING TO GET TO WITH FINANCE TO CLOSE OUT ALL ACCOUNTS AND UTILIZE THE NEW ACCOUNTS PERFECT. QUESTION YES, MA'AM. APPROXIMATELY HOW MUCH IS LEFT IN THERE OF THE OLD IMPACT IS IT WORTH? SO WE HAVE THREE DIFFERENT IMPACT FEES THE OLD SO WE HAVE THE BLUFFTON AH WE HAVE THE HILTON HEAD THE FIRST SKI WHICH IS ABOUT 800,000 AND I DON'T HAVE THE NUMBERS OFFHAND FOR THE OTHER ONES BUT WE ONE FOR BLUFFTON AREA AND THEN ONE FOR NORTH OF THE BRYCE IS JUST THE ONE FOR THAT'S GREAT BUT WE'RE WE'RE ACTIVELY TO SPIN THE OTHERS EXHAUST AS LIKE ANY OTHER DISCUSSION OVER QUESTION SO TO PIGGYBACK FROM MR. CUNNINGHAM IT WOULD MAKE MORE SENSE TO ME IF ON THE AIR SAID SAID CURRENT BALANCE IS 800,000 BECAUSE WHEN YOU READ IT IT IMPLIES YOU TAKE OUT THE 600 DAYS 800 OKAY WE CAN WE CAN MODIFY THAT LANGUAGE MOVING CURRENT BALANCE WOULD BE THEN REMAINING BALANCE PAST WOULD BE 200,000 RIGHT I UNDERSTAND. OKAY WE CAN DO THAT.
ANY OTHER DISCUSSIONS CAN THIS BE DONE WITH NO OBJECTION AND I SEE OBJECTION MOVING ON NUMBER
[13. RECOMMEND APPROVAL TO COUNCIL FOR A REQUEST TO PURCHASE 48 RECYCLING ROLL-OFF CONTAINERS ($408,530). (FISCAL IMPACT: Per the original ARPA ordinance (2022/06), $2,000,000 of ARPA funds were allocated to Solid Waste & Recycling. Those funds have already been transferred to the Solid Waste Enterprise Fund and the funds have been divided into separate line items within the Solid Waste account. The quote for the purchase of these containers is for $408,530. The remaining Solid Waste & Recycling ARPA funds will be $1,591,470. The funding for this item is from account the Solid Waste & Recycling non-capital equipment account: 5010-90-1340-52600 with an available balance of $408,747.01) - Jared Fralix, Assistant County Administrator & Neil Desai, Public Works Director]
13 RECOMMEND APPROVAL OF THE COUNCIL FOR REQUEST TO PURCHASE 48 RECYCLED ROLL OFF CONTAINERS IT LOOKS LIKE AT $408,000 IS THAT PER CONTAINER? I WAS ABOUT TO SAY OH WE'RE IN THE WRONG BUSINESS ALL RIGHT. CAN I HAVE A MOTION PLEASE? I'LL MAKE THE MOTION IN A SECOND. ALL RIGHT, PERFECT. IT SHOULDN'T TAKE LONG.YEP, YEP. I LOVE YOU GUYS ALREADY GOT IT PULLED OUT THERE.
SO THE EXISTING RECYCLING CONTAINERS ARE FROM A NORTH. ANOTHER THAT'S CURRENTLY IN CONTRACT BACK IN JANUARY CAME TO THIS COMMITTEE ENTER A CONTRACT WITH AN IDEA.
WITHIN THAT CONTRACT WE HAD OPTIONS. ONE WAS A LEASE SLASH RENT AND ONE WAS A PURCHASE. SINCE WE WERE ABLE TO FIND THIS THESE ROLL OFF CONTAINERS AND HAVE FUNDING THROUGH OUR WE DECIDED TO PURCHASE THEM OUTRIGHT AND WE'LL AMEND THE CONTRACT AS ENTERED INTO TWO. THE OTHER GOAL IS TO TAKE THESE CONTAINERS AND TO WRAP THEM WITH RERUN IN OUR CHARACTERS SO CAN HAVE A LITTLE BIT MORE ADVERTISEMENT DIDN'T KIND OF SPREAD THE WORD ABOUT RECYCLING IS THAT BROKEN INTO THIS PRICE OF THE PURCHASE OR WILL THAT BE THE PRICE IS THE PRICE OF THE PURCHASE IS JUST THAT WHAT'S LISTED HERE JUST
[00:25:02]
FOR THE GAMES WILL COME BACK AND WRAP THEM UP WITH WITH THE OPERATIONAL MONEY FROM SOLID WASTE OKAY. AND WHICH ACCOUNT IS THAT COMING OUT OF OUR WASTE RECYCLING? NO SIR. ARPA FUNDS WERE ALLOCATED FOR THIS AND OUT OF THOSE FUNDS IT WAS DIVVIED UP AND ONE OF THE FUNDS WAS A NON CAPITAL EQUIPMENT PURCHASE AND WHERE THIS FUNDING WILL COME FROM FOR THE PURCHASE OF THESE PERFECT ARE THESE ARE SELF CRUSHING CANS. NO SIR THEY'RE NOT THEY'RE JUST THE NEXT THING WHEN YOU ROLL OUT THE NEXT ONE IS OKAY OH PERFECT.ANY OBJECTION? ALL RIGHT, THIS WILL PASSED WITH NO OBJECTION AS WELL.
[14. RECOMMEND APPROVAL OF REQUEST TO PURCHASE QTY-13 WASTE COMPACTOR UNITS FOR BEAUFORT COUNTY CONVENIENCE CENTERS (FISCAL IMPACT: $624,021.42) - Jared Fralix, Assistant County Administrator & Neil Desai, Public Works Director]
NUMBER 14 RECOMMENDED APPROVAL REQUEST TO PURCHASE 13 QUALITY OR WASTE COMPACTOR UNITS FOR BEAUFORT COUNTY CONVENIENCE CENTERS FISCAL IMPACT $624,000. IF YOU HAVE A MOTION I'LL MAKE THE MOTION A SECOND TO YOU FIRST AND SECOND. SO CHAIRMAN, THE EXISTING CANS HAVE OUTLIVED THEIR SERVICE LIFE. THEY'RE ABOUT 14 OR 15 YEARS OLD. TYPICALLY THEY GET ABOUT TEN YEARS.WE STARTED TO NOTICE AN INCREASE IN SERVICE FOR SOME OF THESE CANS PAST SEVERAL YEARS AND SO BASED ON EVALUATIONS FROM FROM THE PLUS OURSELVES AND OUR OPERATIONAL FOLKS IT MADE SENSE TO PURCHASE THEM WE BUDGETED THIS FOR 24 BUDGETS.
THE FUNDING IS AVAILABLE AND WILL COME OUT FROM THE SOLID WASTE RECYCLING AND THESE ARE THE ONES SELF CRUSHING CANS. YES SIR. ANY OTHER DISCUSSION OR QUESTIONS. NO, NO. THAT'S ALL RIGHT.
[EXECUTIVE SESSION]
THIS WILL ALSO BE DONE WITH NO OBJECTION. THANK YOU, MR. ZACK.ALL RIGHT, MOVING ON. EXECUTIVE SESSION PURSUANT TO ASSET CODE SECTION 30 DASHBOARD 78 TWO TO ENGAGE IN DISCUSSIONS AND NEGOTIATE OPTIONS AND SIT AND SEND IT TO PROPOSED CONTRACTUAL ARRANGEMENTS. I HAVE A MOTION PLEASE A MOTION IN A SECOND WE WILL INTO EXECUTIVE SESSION WITH NO OBJECTION AND I SEE NO OBJECTION.
IF WE COME OUT THERE MAY BE MATTERS ARISING OUT OF EXECUTIVE SESSION . THANK YOU. ALL RIGHT.
WE ARE BACK FROM EXECUTIVE SESSION. WE HAVE NO ITEMS COMING OUT OF EXECUTIVE SESSION TODAY FOR THE PUBLIC FACILITIES AND SAFETY COMMITTEE.
