JOSEPH PERCIVAL. THANK YOU VERY MUCH.

[9. CITIZEN COMMENTS PERIOD - 15 MINUTES TOTAL]

OKAY. WE ARE AT THE CITIZEN ANYONE WHO WISHES TO SPEAK DURING THE COMMENT OUR FIRST 15 MINUTES DURING THIS TIME WILL BE FOR AGENDA ONLY.

I SAW THAT PEOPLE HAVE SIGNED UP FOR THE FIRST COMMENT PERIOD AND THE SECOND COMMENT PERIOD TO SPEAK ABOUT THE CPO WE HAVE ONLY 15 MINUTES 3 MINUTES PER PERSON THE FIVE PEOPLE WILL BE ABLE TO SPEAK IF YOU WERE HERE FOR THE COMMUNITY SERVICE AND LAND USE COMMITTEE IT WAS THOROUGHLY DISCUSSED TO MOVE ON TO COUNTY COUNCIL ACTION. IT WAS PASSED THERE IT IS ON THE AGENDA TONIGHT FOR ACTION HERE. SO THAT BEING SAID, OUR FIRST PERSON TO SPEAK IS, JANET MACAULAY THANK YOU. OUR RESIDENT DELANO BLUFFS ST HELENA I SUPPORTED THE 1% GREEN SPACE SALES TAX PASSED OVERWHELMINGLY BY RESIDENTS THAT GOES INTO EFFECT MAY 1ST AND WILL IMPACT ALL OF US AND THAT IS TO PRESERVE LAND SCENIC NATURAL RECREATIONAL RULE OPEN SPACE DEEMED ESSENTIAL TO THE COUNTY'S QUALITY LIFE.

I HAVE SAT THROUGH HOURS OF MEETINGS AND IN THE LAST MEETING FOR THE VERY FIRST TIME I HEARD MR. GREENWAY STATE THAT THE COUNTY HAD TRIED TO PURCHASE PINE ISLAND AND THE OWNER WAS UNWILLING TO DEAL WITH THE COUNTY. I JUST RECEIVED A 200 MONTHLY INCREASE TO MY MORTGAGE ESCROW DUE TO INSURANCE AND TAXES. I FEAR FOR OUR RURAL COMMUNITY

[00:15:04]

. WHAT TYPE OF IMPACT IS THIS HAVING ON THOSE LIVED ON LIVING ON FIXED INCOMES, ON HEIRS, PROPERTY, FAMILY COMPOUNDS AND THOSE THAT FARM FISH THESE PRECIOUS LANDS AND FRAGILE WATERWAYS? I WILL DEFER TO MY ESTEEMED GOAL AND NEIGHBORS TO ADDRESS THE IMPACT ON CULTURE AND COMMUNITY ON THESE NATIONALLY DESIGNATED HISTORIC LANDMARKS. IF YOU'RE TRAVELING TO OR FROM THE ISLAND YOU, BETTER PACK A SNACK. A RESIDENT RECENTLY POSTED AN ARTICLE WENT ON TO ELABORATE AN ALL TOO FAMILIAR SCENARIO OF STANDSTILL TRAFFIC CAUSED BY AN ACCIDENT THAT COULD HAVE BEEN ME LAST FRIDAY 2 HOURS TO GET FROM DOWNTOWN BEAUFORT TO SAINT HELENA BUT THAT WAS ACTUALLY POSTED BY SOMEONE IN HILTON HEAD. I WOULD LIKE TO KNOW THE STATISTICS FOR THE NUMBER OF ACCIDENTS ON SEA ISLAND PARKWAY.

BEAUFORT COUNTY JUST REVISED IMPACT FEEDS BECAUSE OF THE GROWTH HERE BUT THOSE FEES DO NOT COVER ALL THE COSTS IMPACTS OF DEVELOPMENT. I WATCHED THE DEVELOPER FOR PINE ISLAND REPRESENTATIVE OF PINE ISLAND PROPERTY HOLDINGS LLC AS SPOKE BEFORE COUNCIL AND STATED HE COULD NOW SPEAK IN PUBLIC SINCE. HE LIVES AT ONE SAINT HELENA ROAD A WOODED LOT BY WAY MR. TROPICANA A DEVELOPER FROM BOSTON WAS ABLE TO SECURE THIS PROPERTY ORIGINALLY LISTED AT 28.5 MILLION FOR 18 MILLION AND HIS WORLD CLASS TEAM AS STATED HAS ALWAYS HAD A VISION OF BIGGER AND BETTER. HE COMMENDS HIS STAFF OF HIGH PAID EXPERTS FOR WORKING EXTREMELY HARD WITH COUNCIL OVER THE PAST TWO YEARS ON HIS BUSINESS MODEL THAT ALLOWS FOR SIGNIFICANT ECONOMIC IMPACT TO THE COUNTY MAKING COUNTY A FINE PLACE TO LIVE, WORK AND PLAY. DOES THIS NOT SEEM LIKE A BIT OF A CONFLICT THAT THE COUNTY IS PUTTING AN OFFER TO ISLAND BUT THEY'RE WORKING WITH THE DEVELOPER? I I SERIOUSLY DON'T BUY THAT A PRIVATE EXCLUSIVE GOLF COURSE WILL ADD ANYTHING POSITIVE TO OUR RESIDENTS I IMPLORE AS OUR ELECTED REPRESENTATIVES NOT TO ALLOW FOR PRIVATE DEVELOPMENT AGREEMENTS ON LARGE TRACTS OF LAND. AND BY THE WAY, HE HAS NEVER ONCE SPOKEN TO THOSE OF US DIRECTLY IMPACTED WHOSE POWER LINES TO PINE ISLAND OR ON OUR YARDS NEVER ONCE AND. SO I WANT TO KNOW WHAT IS THE COUNTY DOING TO ENSURE THAT WE ARE INCLUDED IN THE DISCUSSIONS FREQUENT THE READING GLAD IF A DEAL ONE MORE AGAIN I THE QUEEN COULD HEAD ONE BODY TO GET YOU NATION FROM SAINT HELENA ISLAND MUFAMADI FROM PALAWAN ISLAND AS WE SAID FINALLY ONE AND ATOLL ISLAND AND OF ISSUE I KNOW A VENUE I KNOW WE BINION AND WE AIN'T GOING NOWHERE TO ALL THE TIME SO ME CRACK FOR DEEP LIKE A NATION THING I GOT AT IT FOR ALL OF WE WHO TOOK OUT A GUY WHO THIS YEAR CULTURAL PROTECTION OVERLAY DISTRICT FOR TECH I CORRECT MY DAUGHTER AS WE SO FUN THE RECORD I COULD GET THIS SHUTTING RIGHT BECAUSE YOU'RE AND WHEN I SPOKE BEFORE SAID I TALKED ABOUT KOREA AND ALL KIND OF THINGS I NEVER SAID SO I'M GOING TO SPEAK THIS WAY SO HOPEFULLY YOUR TRANSCRIPT IS CORRECT.

I AM ALSO THE CHAIR OF THE CULTURAL PROTECTION OVERLAY DISTRICT COMMITTEE.

IN THE PAST I CHAIRED THAT COMMITTEE AND WE WERE ALLOWED IN AFFORDED THE OPPORTUNITY TO BE ON THE OFFICIAL AGENDA TO PRESENT OUR WORK TO THIS BODY THIS TIME THAT IS NOT THE CASE AND I WOULD LOVE TO KNOW WHY THE PROTOCOL NOW V4 HAS DISPLACED EVEN THE LEADER OF A COMMITTEE THAT THE COUNTY INSTALLED FROM PRESENTING ON BEHALF OF THAT COMMITTEE THAT WE HAVE TAX AMENDMENTS THAT STRENGTHEN THE CULTURAL PROTECTION OVERLAY IN ACCORDANCE WITH THE 2040 COMPREHENSIVE PLAN. I WANT TO TAKE MY TIME NOW IN A PUBLIC PART TO SAY THIS I HAVE A LETTER OFFICIALLY FROM ME AS THE CHIEF AND HEAD OF STATE FROM THE GULF NATION A LETTER THAT LAYS THE LEGALITIES AND HOW THE CPO DISTRICT IS LEGALLY DEFENSIBLE FROM THE SOUTH CAROLINA ENVIRONMENTAL LAW PROJECT AND ALSO LETTER IN SUPPORT OF CONTINUING TO KEEP THE CULTURE OF PROTECTION LAKE DISTRICT INTACT FROM SENATOR CHIP CAMPS. THEN I ALSO SENT EARLIER BY EMAIL THE 9230 SIGNATURES WE ARE NOW AT 9300 SIGNATURES ON A PETITION ON CHANGE.ORG TO SAY TO THIS COUNTY THAT AS THE BIBLE SAYS WHERE THERE IS NO VISION, THE PEOPLE PERISH. THIS COUNTY HAD A VISION BROUGHT TO THEM BY NATIVES OF SAINT HELENA ISLAND ME BEING ONE OF THEM IN 1998 THIS COUNTY THEN IN 1999 VOTED TO CREATE THE CULTURAL PROTECTION OVERLAY DISTRICT IN ACCORDANCE WITH EVEN SOUTH CAROLINA LAW. IT EVEN MORE CRITICAL NOW TO CONTINUE TO KEEP AN INTACT AND TO STRENGTHEN IT SO I HOPE THAT WHAT HAS JUST COME BEFORE YOU FROM THE PREVIOUS MEETING THAT TOOK PLACE AT 3:00 WILL BE VOTED FAVOR OF BY THIS BODY BECAUSE SAINT HELENA ISLAND IS THE EPICENTER OF GULLAH GEECHEE CULTURE. IT STILL EXISTS AND IN THIS TIME OF CLIMATE CHANGE ISSUES. YOU NEED RECOGNIZE THE IMPACTS AND WHAT THE SEA ISLAND BARRIER

[00:20:03]

ISLANDS DO IS THE MAINLAND BUT MORE THAN THAT GOD'S ANOINTING BECAUSE WE BE GULLAH ANOINTED PEOPLE PROTECTS US AND WE THAT THAT FALLS ON YOU AS YOU DELIBERATE TONIGHT AND THAT YOU LOOK AT THE LAW AND KEEP THE LAW OF THIS ACCOUNT IN PLACE THAT'S THERE SINCE 1999 TO PROTECT GULLAH CULTURE OF SAINT HELENA ISLAND. THANK YOU THANK YOU TO ALL HONORED CHILDREN FOR OPPORTUNITY. JOHN HOSKINS BROWN.

GOOD EVENING. I'M DR. DIANE HOSKINS BROWN AND I CHAIR THE GEECHEE CULTURAL HERITAGE CORRIDOR COMMISSION AS A NATIONAL AREA AND THE NATIONAL PARK SERVICE.

WE OPPOSE ANY ACTION THAT CONTRADICTS OR CHANGES THE CURRENT 30 YEAR CULTURAL PROTECTION OVERLAY. IT PROTECTS THE UNIQUE HERITAGE ASSET THAT IS SAINT HELENA ISLAND SAINT HELENA ISLAND AND SAINT HELENA ARE THE HEART OF THE CORRIDOR.

SAINT HELENA RETAINED ITS SENSE OF PLACE, COLOR, HERITAGE AND RURAL QUALITY OF LIFE DESPITE DEVELOPMENT OVER DEVELOPMENT IN BEAUFORT COUNTY AND THE REGION DO NOT EXCHANGE GOLF RESORT LIVING AND GATED LUXURY PLANTATIONS FOR A NATIONAL HERITAGE ASSET STATUS HELD THERE IS DEEP IN THE HEART OF THE CORRIDOR IT IS THE WRONG PLACE FOR SOULLESS DEVELOPMENT . THANK YOU IAN. MR. ARNOLD BROWN EVERYONE GOOD . GOOD EVENING. LET'S SUPPOSE THAT JOHN DOE FROM NEW JERSEY WANTED TO PURCHASE THE ROBERT SMALLS HOUSE IN BEAUFORT FOR $2 MILLION AND LET'S SUPPOSE THAT HE TO CONVERT THE HOUSE TO A PANCAKE HOUSE AFTER ALL, ROBB SUPPOSEDLY PANCAKES. OKAY. I THINK THE OVERWHELMING SENTIMENT IN THE COMMUNITY WOULD BE NO THAT YOU CANNOT HAVE A PANCAKE HOUSE THERE.

OKAY BECAUSE OF ZONING BY THE WAY THIS NOT A JOBS PROGRAM EITHER.

I WORKED ON PHILLIP ISLAND GOLF COURSE. I WORKED ON PARRIS ISLAND GOLF COURSE. I HAVE SOME EXPERIENCE IN INDUSTRIAL ENGINEERING AND DOES NOT CREATE A LOT OF JOBS. THE JOBS THAT WE HAD BACK THEN HAVE BEEN REPLACED BY AUTOMATION. OKAY SO I PASSED OUT A ON EVERYONE'S DESK TO TAKE A LOOK FROM A LEGAL STANDPOINT. OKAY WHAT DOES THE WHAT DOES THE PC2 OF THE CPO SAY OKAY UNDER SITE DESIGN EVERYTHING UNDER DESIGN IS PROHIBITED EXCEPT.

ONE ITEM OKAY. AND THEN THE SECOND PARAGRAPH WITHOUT FILING THE LIMIT LIMITING AND FOREGOING C THE FOLLOWING SPECIFIC NEW ITEMS THEY ARE EXCLUDED SO EVERYTHING UNDER IS EXCLUDED EVERYTHING THAT IS EXCLUDED EXCEPT ONE ITEM PARAGRAPH NUMBER ONE RESTRICTED GAIN COMMUNITY THAT IS NOT INCLUDED PARAGRAPH NUMBER TWO KEY KEITH SIMMONS THESE USE INCLUDES DOESN'T MEAN THAT IT'S ALLOWED EXCLUDED IN THE MIDDLE OF THE PARAGRAPH GOLF WE GO TO PLAY GOLF GOLF IS NOT ALLOWED THAT IN A PARAGRAPH THIS NOT INCLUDE AIRCREW TOURISM SO THAT IS ALLOWED OR EVERYTHING IS DISALLOWED EXCEPT THAT GOLF COURSES NOTICE IT SAYS THIS USE INCLUDES IS THE SAME AS PARAGRAPH NUMBER TWO SO IF IT'S INCLUDED EXCLUDED IN NUMBER TWO THEREFORE IS EXCLUDED IN NUMBER THREE. OKAY THAT IS LOGICAL.

WE TALKED ABOUT WHAT IS LOGICAL, WHAT IS PRACTICAL, WHAT MAKES SENSE, WHAT'S COMMON SENSE IS COMMON SENSE. MR. EMERY CAMPBELL WHO SITTING RIGHT HERE HE IS ONE OF THE AUTHORS THAT WROTE THIS DOCUMENT. IF YOU WANTED TO KNOW THE TRUTH THEN ASK HIM. ASK HIM. WE'LL ASK QUEEN QUINN.

IF YOU WANTED TO KNOW THE TRUTH IF YOU DON'T WANT KNOW THE TRUTH DON'T TALK TO MR. CAMPBELL. HE'S AN AUTHOR. HE'S A BUSINESS OWNER, VERY

[00:25:03]

SUCCESSFUL. RECEIVE AN AWARD AT THE FEBRUARY HIGH SCHOOL ON HILTON HEAD FOR HIS LONG DEVOTEE OF A VERY GOOD WORK IN THE COMMUNITY.

THANK YOU ELVIA OTERO PIANO GERMPLASM COUNSEL THANK YOU FOR HAVING ME THIS EVENING.

MY NAME IS JOE PIANO. I LIVE THE ONES IN ELLISVILLE ROAD.

I'M THE OWNER OF PINE ISLAND. TONIGHT'S MEETING WAS NOT SUPPOSED TO BE ABOUT MY PROPERTY. IT WAS SUPPOSED TO BE ABOUT STRENGTHENING AN ORDINANCE THAT'S EXTREMELY IMPORTANT TO THIS COMMUNITY AND FOR THE BENEFIT OF ALL SAINT HELENA RESIDENTS. UNFORTUNATELY THAT CERTAINLY IS NOT THE CASE.

ON NOVEMBER 16TH MY MY TEAM IS 2022. MY TEAM HAD A FREE HAND MEETING WITH COUNTY STAFF BEFORE SUBMITTING THE ZONING MAP AMENDMENT FOR PINE ISLAND.

I SOUGHT TO REMOVE THE PROPERTY FROM THE CPO FOR MULTIPLE REASONS BUT MOST IMPORTANTLY BECAUSE OUR TEAM TO DO SOMETHING BIGGER AND BETTER THAN THE CURRENT ZONING ALLOWS . AS THE COUNTY ADMINISTRATOR JUST POINTED OUT IN HIS PRESENTATION MY PROPERTY IS ZONED A SIGNIFICANT AMOUNT OF DENSITY AND DOCKS.

OUR PLANS OUR PLANS WERE TO REDUCE HOUSING DENSITY BY OVER 60%, REDUCE DOCKS BY 99% AND PUT AND PUT 250 TO 400 ACRES INTO CONSERVATION FOREVER TO PROTECT SPACE IN THE WATERWAYS.

WE PLAN TO HAVE NO PERMANENT RESIDENCE DISPLACE ZERO LOCAL RESIDENTS, REDUCE TRAFFIC AND CREATE NEW SEASONAL PUBLIC ACCESS THAT'S NEVER BEEN HAD TO MY PROPERTY.

WE WANTED TO CREATE A BUSINESS ALLOWING FOR LOCAL EDUCATION NOT INTERNSHIP OPPORTUNITIES CREATE 35 TO 70 NEW FULL TIME JOBS AND GENERATE A RECURRING REVENUE BUSINESS THAT WOULD KICK OFF HUNDREDS OF THOUSANDS IF NOT MILLIONS OF DOLLARS A YEAR INTO A FOUNDATION BUILT TO FOCUS EXCLUSIVELY ON SUPPORTING THE SAINT HELENA COMMUNITY, YOUTH, ITS BUSINESSES AND LONG TIME RESIDENTS. THAT'S BIGGER AND BETTER. COUNTY ADMINISTRATION ASKED ME IF THEY COULD TABLE OUR MAP AMENDMENT BECAUSE THEY REALIZE THE CURRENT LANGUAGE OF THE OVERLAY WAS EXTREMELY WEAK. WE RESPECTFULLY AGREED BECAUSE IT WAS THE RIGHT THING TO DO.

APPLICATION WAS NEVER DENIED BUT RATHER COLLECTIVELY WE DECIDED TO PAUSE TO FIX A GLARING WEAKNESS FOR THE BENEFIT OF THE RESIDENTS OF SAINT HELENA.

WHAT'S TRANSPIRED SINCE THEN HAS BEEN THE SEA OF MISINFORMATION HAS LED TO A VISCERAL REACTION RATHER THAN CAREFUL CONSIDERATION OF ALL THE THINGS I TALK TALK TO YOU ABOUT. I CAME TO BE FOR COUNTY OVER TWO YEARS AGO TO BUILD A BUSINESS. I FEAR THAT THE CHANGE IN LAWS IS TRYING TO PREVENT ME FROM ACCOMPLISHING THAT AND PREVENTING ME FROM THE MISSION AND PREVENTING ME FROM ACCOMPLISHING MISSION OF USING MY PROPERTY AND MY DEVELOPMENT AS AN INSTRUMENT TO PRESERVE THE COMMUNITY OF SAINT HELENA WHILE CREATING OPPORTUNITIES FOR ITS CITIZENS.

WE WANTED TO FUEL A MISSION OF PHILANTHROPY, COMMUNITY AND COMMUNITY DRIVEN INITIATIVES AND CULTURE AND ENVIRONMENTAL STEWARDSHIP. I SINCERELY HOPE THAT EACH AND EVERY COUNCIL MEMBER RECOGNIZES THE DEEP I HAVE FOR ALL CITIZENS OF THE COUNTY.

THE ORIGINAL CENTER MISSION WAS TO HONOR A PROUD HISTORY AND POINT TOWARDS PROMISING FUTURE.

THAT'S WHAT TONIGHT'S SHOULD HAVE BEEN ABOUT. THAT'S WHAT WE'VE ALWAYS ASPIRED TO DO. THANK YOU AND I APPRECIATE ALL YOU DO FOR ME.

I HAVE TIME FOR ONE MORE PERSON. IS THERE ANY PERSON IN HERE WHO NEEDS TO SPEAK ABOUT ANY OTHER ITEM ON THE AGENDA? IS THAT YOU, SIR? MY NAME WAS ON THE LIST. YOU SPEAK IN FAVOR OF MEMORIAL HERE.

ARE YOU HERE TO SPEAK ABOUT SOME OTHER ITEM ON THE AGENDA? YES SIR I AM.

PLEASE COME. PLEASE STATE YOUR NAME AND THE ITEM YOU'RE REFERRING TO.

I BELIEVE IT'S AGENDA ITEM 15. GOOD AFTERNOON, MR. CHAIRMAN AND COUNTY COUNCIL MEMBERS.

MY NAME FELICIA ROTH AND I'M THE PROPERTY OWNER OF FOUR STILLWELL ROAD WHICH IS DIRECTLY TO THE EAST OF THE SUBJECT PROPERTY THREE BENTON LANE WHICH I THINK IS NUMBER 15. THE APPLICATION THAT IS BEFORE YOU DOES NOT MEET THE LEGAL STANDARD FOR REZONING. PLANNING STAFF SAID AS MUCH WHEN THEY RECOMMENDED DENIAL THAT APPLICATION. THE PLANNING COMMISSION RECOMMENDED DENIAL OF THAT APPLICATION. COMMUNITY SERVICES AND LAND USE RECOMMENDED DENIAL OF THAT APPLICATION BUT THE ARGUMENT THAT THEY MAKE IS THAT PROPERTY NEXT DOOR WAS REZONE THEREFORE THEY TOO SHOULD BE REZONE. BUT THE FACT PATTERN OF THAT PARCEL ONE TWO TO ME RIVER ROAD IS VASTLY DIFFERENT THAN THAT OF THIS PARCEL. I SENT YOU ON EMAIL AND WILL NOT REHASH THE DETAILS OF THAT BUT IS NO CASE FOR GRANDFATHERING TO BE MADE FOR

[00:30:05]

THREE BENTON LANE. I DO NOT OBJECT TO I DOCTOR'S OFFICES AS A MATTER OF COURSE.

MY CONCERN IS THAT ONCE THREE BENTON LANE IS UP ZONED A HOST OF OBJECTIONABLE USES WOULD BE ALLOWED AS A MATTER OF RIGHT. I MAY FIND MYSELF RAISING MY CHILD NEXT TO A BAR OR RESTAURANT WITH LATE NIGHT HOURS AND VERMIN ATTRACTING DUMPSTERS A FEW YEARS DOWN THE ROAD. WHEN THESE FOLKS REALIZE THAT THEIR IS NOT AS PROFITABLE AS IT COULD BE ONCE THAT PARCEL IS UP ZONED IT CAN NEVER GO BACK. I URGE THE COUNCIL TO PLEASE CONSIDER THE QUIET ENJOYMENT AND PROPERTY RIGHTS OF EXISTING OWNERS OVER THE DEVELOPMENT DESIRES OF A POTENTIAL OWNER. THIS APPLICANT IS FREE TO PLY HIS TRADE AS AN OPTOMETRIST IN BEAUFORT AND THERE'S PLENTY OF COMMERCIAL SPACE AVAILABLE FOR RENT IN NEARBY NEW RIVERSIDE. BUT IF HIS HEART DESIRES TO OWN THE PARCEL OF LAND FOR HIS BUSINESS TO BE ON HE MAY DO SO BY PURCHASING ONE OF THE SEVERAL OUT PARCELS AVAILABLE AT NEW RIVERSIDE OR AN UNDEVELOPED PARCEL IN THE GILBERT ROAD COMMERCIAL DISTRICT. THERE IS NOTHING THAT INTERFERES WITH HIS RIGHTS TO DO SO ON THAT IS ZONED FOR THAT PURPOSE. INSTEAD HE WANTS TO BUY LAND CHEAPLY AND INTERFERE WITH THE QUIET ENJOYMENT OF THE RURAL RESIDENTIAL AREA THAT SURROUNDS HIM. PLEASE DO NOT UNDERMINE THE ORDINANCE THAT THIS BODY PUT IN PLACE COMPREHENSIVE PLAN IT WAS JUST RECENTLY PASSED. DOING SO GRANTING HIS APPLICATION WOULD COMPLETELY UNDERMINE YOUR OWN AUTHORITY FOR THE LAW THAT YOU PASSED.

THANK YOU. THANK YOU. YOU.

OKAY. WE WILL CLOSE THIS SECTION PUBLIC COMMENTS.

WE ARE NOW AT ITEM NUMBER TEN WHICH IS OUR LIAISON AND COMMITTEE REPORTS.

IS ANY MEMBER WHO HAS A COMMITTEE REPORT? MISS BROWN, I JUST WANT LET EVERYBODY KNOW THAT EARTH DAY IS NEXT IS APRIL 21ST AND THAT YOU AND MR. GREENWAY WILL BE SPEAKING THE AFTERNOON AT THE CEREMONY AND WE'RE PEOPLE GET OUT THAT DAY AND PICK UP LITTER OFF THE STREET. TAKE IT TO YOUR HEAD. OH, YOU CAN'T HEAR ME.

OH, I'M SORRY. ANYWAY, APRIL 21ST IS EARTH EARTH DAY AND MR. PASS.

MISS AND MR. GREENWAY WILL BE SPEAKING IN THE AFTERNOON CEREMONY.

YOU KNOW THAT ANY OTHER MEMBER OF COUNCIL. MISS HOWARD BRIEFLY MR. CHAIRMAN, PORT ROYAL IS HAVING A WORKSHOP TONIGHT ON THEIR TREE ORDINANCE.

IT IS GETTING TO THE FINAL STAGES. THEY WORKING ON A MORE STRINGENT TREE ORDINANCE. STAY TUNED THAT. THANK YOU.

ANYONE ELSE? THANK YOU. I JUST WANT TO MAKE A PUBLIC ANNOUNCEMENT THAT TOMORROW AT 530 AT THE SINKHOLE ALIVE VERY I'M HOSTING A STORMWATER AND DEALING WITH A STUDY THAT WAS DONE FOR HELENA ISLAND AND SO INVITING THE PUBLIC TO COME OUT AT THAT TIME TO ASK QUESTIONS BUT IT WAS A STUDY DONE SPECIFICALLY FOR SELF ENFORCING ON THE ISLAND. THANK YOU. ANYONE ELSE?

[11. APPROVAL OF CONSENT AGENDA]

OKAY WE WILL MOVE ON TO THE PUBLIC HEARING AND ACTION ITEMS .

MAY I HAVE A MOTION? AND SECOND FOR THE APPROVAL OF THE CONSENT AGENDA.

MR. CHAIRMAN. MR. CUNNINGHAM MAKES THE MOTION A SECOND, PLEASE.

MR. LAWSON MAKES THE SECOND DULY MOTION AND SECONDED ANY QUESTIONS?

[12. TIME-SENSITIVE ITEM ORIGINATING FROM THE APRIL 10TH COMMUNITY SERVICES AND LAND USE COMMITTEE - FIRST READING OF AN ORDINANCE FOR TEXT AMENDMENTS TO THE COMMUNITY DEVELOPMENT CODE (CDC): ARTICLE 3, DIVISION 3.4, SECTION 3.4.50- CULTURAL PROTECTION OVERLAY (CPO); SECTION 3.4.10- PURPOSE; AND DIVISION 3.1, SECTION 3.1.70- LAND USE DEFINITIONS, RECREATION FACILITY: GOLF COURSE, TO UPDATE DEFINITIONS, REGULATIONS, AND STANDARDS IN THE CULTURAL PROTECTION OVERLAY ZONE]

THERE ARE NO QUESTIONS. THESE WILL BE APPROVED WITHOUT OBJECTION AND I SEE NO OBJECTIONS. WE HAVE THREE TIME SENSITIVE ITEMS FROM OUR PRIOR COMMITTEE . ITEM NUMBER 12 IS THE FIRST READING OF AN ORDINANCE FOR TEXT AMENDMENTS TO THE COMMUNITY DEVELOPMENT CODE . ARTICLE THREE DIVISION 3.4 SECTION 3.4.50 CULTURAL. CULTURAL PROTECTION OVERLAY SECTION 3.40.10 PURPOSE AND DIVISION 3.1 SECTION 3.17 LAND USE DEFINITIONS A RECREATION FACILITY GOLF COURSE TO UPDATE DEFINITIONS REGULATIONS AND STANDARDS IN THE CULTURAL PROTECTION OVERLAY ZONES.

MAY I HAVE A MOTION SECOND PLEASE MOVE. MR. DAWSON MAKES THE MOTION A SECOND. MR. GLOVER MAKES THIS SECOND. IS THERE ANY DISCUSSION BEFORE WE VOTE? MR. CUNNINGHAM BUT I'LL GO AFTER MR. CUNNINGHAM.

THANK YOU, MR. CHAIRMAN. WHERE TO START WITH IT, I GUESS.

REALLY BEFORE I DOVE INTO IT I'D SAY IT'S NOT THAT I DON'T BELIEVE WE NEED TO STRENGTHEN

[00:35:04]

IT. IT'S NOT THAT I'M SAYING THAT WE NEED TO CLEAN UP THE GRAY AREA THE ISSUE THAT I AM RUNNING INTO THIS ENTIRE SCENARIO AT SOME POINT AT SOME POINT WHEN DO WE OVERSTRETCH OUR AUTHORITY AND ALL OF US HAVE DIFFERENT ON THAT AND ALL OF US HAVE, YOU KNOW, DIFFERENT IDEAS OF WHAT THAT MEANS. WE'RE TALKING ABOUT ONE BIG PIECE OF PROPERTY AND A PERSON THAT OWNS IT. TO ME THAT PROPERTY IS THE SAME VALUE AS IF ANYBODY IN THIS ROOM DECIDED TO BUY A PROPERTY AND WE CAME IN THERE AND YOUR ZONING OR CHANGED WHAT YOU WERE ALLOWED TO BUILD IN THE PROPERTY THAT YOU PURCHASED.

THAT IS YOUR RIGHT YOU PURCHASE SOMETHING BASED ON A BELIEF OF WHAT YOU COULD DO ON IT.

I'VE READ THIS OVER AND OVER. I'VE GOTTEN MULTIPLE DIFFERENT VERSIONS AND COPIES OF IT AS WELL PEOPLE COPY CUTTING PASTING SENDING THE PARTS THAT THEY WANT READ THE PARTS THEY DON'T WANT READ ON BOTH SIDES OF THE AISLE SO THE ISSUE THAT I RUN INTO IS AND I WANT EVERYBODY TO ACTUALLY THINK ABOUT THE STATEMENTS THAT MR. GREENWAY SAID BEFORE THIS IS IT THAT WE DON'T WANT A GOLF COURSE AND WE DON'T WANT A GATED COMMUNITY OR IT THAT WE DON'T WANT IT DEVELOPED AT ALL BECAUSE NONE DEVELOPMENT AT ALL IS NOT AN OPTION.

THIS IS THIS PROPERTY IS STILL ZONED AND IS ALLOWED GET A 143 HOUSES, 143 SEPTIC TANKS AND BETWEEN 75 AND 95 DOCKS. THIS PROPERTY IS ALLOWED TO DO THAT EVEN IN THE CURRENT OVERLAY PLAN AND THE NEW OVERLAY PLAN THAT WE WE'RE GIVING HERE THE NEW ONE.

IT IS STILL ALLOWED. NO MATTER WHICH WAY THERE'S VOTES THAT DOES NOT STOP DEVELOPMENT OF PINE ISLAND. THIS IS WHERE MY ISSUE LIES IS WHAT'S MORE DETRIMENTAL TO THE COMMUNITY AND TO THE AND THE WATERWAYS. IS IT 145 RESIDENCES AND 90 DOCKS WITH THE WELLS SEPTIC TANKS OR IS IT 50 HOUSES, TEN COTTAGES AND A GOLF COURSE AND THEN 250 ACRES PRESERVED? EXACTLY. AND THAT AND THAT IS THE ISSUE THAT I HAVE FOUND EVERY AT THE PAST THREE WEEKS THAT PEOPLE PERFECT.

I'LL WAIT FOR Y'ALL BUT I DEFINITELY RESPECTED EVERYBODY'S TIME AND GET MY FULL ATTENTION WHEN THEY SPOKE AND I WOULD ASK FOR THE SAME EVERYBODY CAME UP HERE TALKING ABOUT PRESERVING THE LAND. EVERYBODY CAME UP HERE TALKING ABOUT KEEPING THE LAW.

UM TALKED ABOUT DEVELOPMENT TALKED ABOUT THE PROBLEMS ON THE ROADS BUT PUTTING IN 1400 CARS BACK AND FORTH ON 143 RESIDENCES IS WHAT WE'RE ESTIMATING WHETHER IT BE GOING IN AND ON THE ISLAND AS MORE OF A TRAFFIC FLOW THAN A GOLF COURSE.

AGAIN, NOT SAYING I AGREE WITH THE GOLF COURSE. I UNDERSTAND THE PROPERTY WAS ZONED INTO THREE DIFFERENT DISTRICTS I BELIEVE ARE THREE DIFFERENT PARCELS 15 YEARS AGO.

SO IT'S NOT THE BUYER SUBDIVIDED THAT HE PURCHASED IT SUBDIVIDED.

I UNDERSTAND THE LOOPHOLES THAT COULD BE TAKEN. NOT SAYING SUPPORT THOSE EITHER BUT I DO BELIEVE AND PEOPLE'S INVESTMENTS FOR EVERY SINGLE PERSON AND FOR THE PROPERTY RIGHTS AND INVESTMENTS WERE MADE. THAT'S OUR TIME TO SPEAK.

CONTINUE INVESTMENTS WERE MADE FROM YOU GUYS AND AS WELL FROM THE INDIVIDUAL THAT BOUGHT THE PROPERTY JUST LIKE INVESTMENTS WERE MADE ON PEOPLE FOR HILTON HEAD WHEN THAT GOT DEVELOPED AND I'LL BE HONEST AND I'LL SAY IT BECAUSE A LOT OF PEOPLE DON'T WANT EVERYBODY LOVES TO HATE ON THE DEVELOPMENT OF HILTON HEAD BUT THEY CREATE OVER 60% OF OUR TAX REVENUE AND WITHOUT THE DEVELOPMENT HILTON HEAD YOU FOUR COUNTY WOULD NOT BE A COUNTY IS TODAY ACROSS BOARD SO THE QUIET PLACE. SO WITH THAT SAID WE HAVE TO FIGURE OUT WHAT'S THE BEST THING NOT EMOTIONALLY BUT FISCALLY ECONOMICALLY FOR TRANSPORTATION, FOR SAFETY, FOR SCHOOLS ACROSS THE BOARD WHAT IS THE BEST THING FOR SAINT HELENA AND COUNTY AND I'LL BE HONEST I DON'T KNOW WHICH ONE IT IS BUT I CAN TELL YOU THIS I THINK THAT THIS DECISION TO MOVE THIS FORWARD WAS 100% BECAUSE OF THIS PROPERTY. WE ALL KNOW THAT THAT'S WHY EVERYONE'S HERE TODAY. EVERYBODY SIGNED THAT. I SUPPORT MOVING FORWARD WITH THE CPA BUT FOR MOVING FORWARD JUST BECAUSE OF THIS ONE PROPERTY BENEFITS AND NO WITCH QUEEN SAYING IT'S NOT BUT I GUARANTEE YOU NOBODY WOULD WANT TO SAY THAT THEN WE CAN ALLOW

[00:40:06]

PINE BUT WE TO MOVE THIS FORWARD FOR THE FUTURE DEVELOPMENT.

SO IT IS FOR THIS BECAUSE WE WANT TO STOP THIS DEVELOPMENT AS WHAT IT'S COME ACROSS TO ME.

SO WITH THAT SAID I DON'T KNOW HOW THIS IS GOING TO GO BUT I AM GOING TO MOTION FOR POSTPONEMENT FOR THIS BECAUSE I THINK WE NEED TO TAKE A HARD LOOK AT WHAT IS THE BEST THING FOR THE COMMUNITY BECAUSE I PROMISE YOU 145 HOUSES AND 90 DOCS IS A HUGE IMPACT ON SAINT HELENA AND YOUR ROADS. VERY MUCH SO. SO I WILL MAKE THAT MOTION AND POSTPONE THIS. MR. CHAIRMAN, YOU ALREADY HAVE THE ROOM AS HE'S AMENDING THE MOTION. HE DIDN'T SAY A MINUTE POSTPONEMENT, A MOTION OF ORDER. SO I WILL AMEND IT TO POSTPONE .

YEAH. IS THAT RIGHT? IS THERE A SECOND I SECOND THAT AGAIN DULY MOTION SECONDED FOR POSTPONING NOW POSTPONING THE ACTION ACTION UNTIL WHEN YOU DIDN'T SEE IT SAY FOR POSTPONEMENT BY ITSELF MEANS THAT IT'S KILLED NO THAT'S NOT CORRECT IT REQUIRES THE SECOND IT IS DEBATABLE. TIME PACIFIC YEAH YOU NEED TIME FOR SPECIFIC SO WE'RE SECOND WEEK OF APRIL NOW MR. WOOD A MONTH A HALF BE ENOUGH TIME FOR STAFF TO COORDINATE WHAT WOULD MR. GREENWAY WHAT A MONTH AND A HALF BE ENOUGH TIME FOR THE STAFF TO COORDINATE CONVERSATIONS WITH WHETHER IT BE THE DEVELOPER OR THE PUBLIC TO FIGURE OUT WHAT IS THE BEST THING FOR THIS COMMUNITY AND WHOLE COMMUNITY MORE TO KNOW THE STAFF THE STAFF WILL COMPLY WITH WHATEVER DIRECTION THE COUNCIL DO WITH THIS SORT OF DIFFICULT SITUATION. IF YOU ALL FEEL 45 DAYS IS APPROPRIATE DELAY THEN WE WILL DO WHAT WE CAN IN THAT PARTICULAR TIME FRAME TO TO TRY TO REACH SOME SORT OF COMPROMISE. WE DO THE FIRST MEETING OF JUNE THAT WHICH I BELIEVE IS JUNE 5TH THAT'S THAT'S THE MOTION YES. OKAY.

THAT'S THE MOTION. AND SECOND, THIS IS WHAT WE WILL DEBATE.

MR. GLOVER MR. CHAIRMAN, THERE IS THERE IS NO NEED TO NEGOTIATE IN WHO IS NEGOTIATING . I DON'T THINK THIS COUNCIL WANTS TO TELL HELENA RESIDENTS WHAT THEY SHOULD DO WITH THEIR PROPERTY OR WHAT THEY SHOULD HAVE IN THEIR COMPLAINT.

I MEAN THAT'S NOT A QUESTION OF DEBATE AT THIS TIME. ALL ARE ASKING FOR RIGHT NOW IS TO MOVE THIS LANGUAGE IN THE COMP PLAN TO STRENGTHEN THE LANGUAGE OF THE COMPLAINT IS NOT TO CHANGE IT IT IS REALLY TO STRENGTHEN IT. SO IT'S CLEAR AND THAT'S ALL WE ASKING FOR NEGOTIATING IS NOW YOU ABOUT NEGOTIATING WITH DEVELOPERS.

THE COMMUNITY NEVER DEALT DEVELOPERS. IT DEALT WITH THE COMP PLAN AND THAT'S WHAT WE WANT TO MOVE FORWARD. SO I DON'T SEE WHERE YOU'RE GOING TO NEGOTIATE AT THIS TIME AND WHO DO YOU NEGOTIATE WITH THE COMMUNITY RIGHT HERE JUST TELL ME THEY WANT TO HEAR ME SO I WILL WIN IS FOR NEGOTIATION YOU'LL SEE THAT PEOPLE IN THIS ROOM TODAY AND FOUND OUT NEW INFORMATION MYSELF INCLUDED AND WITH SAID I KNOW SOME OF THEIR LEADERS RIGHT IN THE FRONT ROW WE'RE NOT GOING TO HAVE COMMENT AND TALK WITH THE DEVELOPER BUT YOU SAID THAT WE'RE NOT HERE TO TELL SAINT HELENA WHAT TO DO WITH THEIR PROPERTY BUT THAT'S WHAT WE'RE DOING WITH THE PROPERTY OWNER IN SAINT HELENA. NO WE DON'T DO THEM.

ALL WE'RE DOING IS CLARIFYING ALREADY THERE THE MEETING CHANGING ANYTHING IS CLARIFYING AND IS STRENGTHENING THE COMMUNITY ONLY DIFFERENCE BETWEEN THE THE MEETING WILL BE JUNE 12 NOT JUNE 12TH. OKAY MY MOTION STANDS THERE. OKAY THIS IS WE'RE DEBATING WHETHER OR NOT WE'RE GOING TO POSTPONE THE ACTION OF THIS UNTIL JUNE 12TH.

THAT'S THE DEBATE WE'RE HAVING THIS HOUR. MR. CHAIRMAN, I'M TOTALLY AGAINST DELAYING THIS VOTE TONIGHT. IT IT IS ABOUT THE CPO.

I WITH ALL DUE RESPECT, COUNCILMAN CUNNINGHAM, I DON'T SEE ANY PURPOSE IN DELAYING THIS. WE NEED TO GO FORWARD WITH THIS FIRST READING NO MATTER WHETHER NO MATTER WHAT THE VOTE IS MR. LAWSUIT. YES AND I'VE BEEN KIND OF WAITING TO SPEAK AND USUALLY WHEN I TRY TO SPEAK I TO SPEAK WITHOUT EMOTION AND TRY TO THINK ABOUT BOTH SIDES OF THIS AND AS WE LOOK FORWARD I AM PROBABLY NOT FOR IT BECAUSE I

[00:45:02]

THINK IT'S GOING TO HAPPEN. THE INEVITABLE WE HEAR FROM THE FOLKS THAT ARE HERE BUT I DO WANT TO SET THE RECORD STRAIGHT . I'VE RECEIVED LOTS AND LOTS OF EMAILS. PROBABLY NINE OUT OF TEN OF THEM HAVE SAID SOMETHING ABOUT THE CPO THAT'S BEEN IN PLACE FOR A QUARTER OF A CENTURY AND THEY'RE SAYING TO US PLEASE DON'T CHANGE THE CPO . WELL THAT CPO HAS BEEN IN PLACE AND OUR JOB HERE IS NOT TO CHANGE A CPO BUT THAT'S ACTUALLY EVERYONE'S COMING FORWARD AND ASKING US TO DO IS TO CHANGE THE CPO AND YOU SAY WHY WHY IS THAT? WELL IT'S BECAUSE THE DEVELOPER OR THE PROPERTY OWNER I'M NOT IF HE'S A DEVELOPER IF HE'S A PROPERTY WHO PURCHASED PINE ISLAND, LOOKED AT DEVELOPING THAT PROPERTY AND WE LOOKED AT THAT PROPERTY TO DEVELOP IT. HE OBVIOUSLY WANT TO DO A GOLF COURSE.

WE'VE ALL HEARD HIM SAY THAT AND IT WAS DISCOVERED THAT THE LANGUAGE IN THE CURRENT CPO DOES NOT EXCLUDE ANYTHING EXCEPT FOR A GOLF COURSE THAT'S OVER NINE HOLES IF YOU READ THIS THAT CPO CURRENTLY HAVE THAT CPO SAYS YOU CAN YOU CAN BUILD LESS THAN NINE HOLES FOR EACH PARCEL YOU HAVE SO YES IT'S PROBABLY A LOOP LOOPHOLE THAT GOES AROUND BUT THOSE PEOPLE. HE WOULD HAVE THE OPPORTUNITY THEN TO COME BACK AND AND GO AHEAD AND BUILD THAT GOLF COURSE SIX HOLES IN EACH. SO THAT IS WHY WE HAVE SEEN THIS RUSH AND THE PUSH FOR THIS TO FOR US TO GO AHEAD AND APPROVE THE THE NEW LANGUAGE.

WE'RE NOT APPROVING THE DEVELOPMENT. WE'RE NOT GOING RIGHT NOW WHAT WE'VE BEEN ASKED TO DO IS TO APPROVE THE NEW LANGUAGE THAT SAYS NO GOLF COURSES.

THIS WOULD BEEN SO MUCH EASIER IF IF THAT LANGUAGE WAS IN THERE FROM 25 YEARS AGO.

SO THAT'S WHAT IS LACKING WHEN YOU WHEN YOU READ THAT AND GO THROUGH AND I'VE READ THE CPO, I'VE GONE THROUGH A READ THE CPO AND AND AGAIN SO THAT'S WHAT WE'RE TALKING ABOUT HERE TODAY. IT'S ACTUALLY STRENGTHENING THE LANGUAGE TO GET RID OF A GOLF COURSE. SO THAT'S THE ISSUE THAT WE HAVE THE ISSUE I HAVE IS IT MAKES ME FEEL UNCOMFORTABLE THAT MR. TRAPIANTO HAS PURCHASED THIS PROPERTY THINKING THAT HE'D BE ABLE TO DEVELOP IT AND WE ARE NOW MAKING THIS CHANGE TONIGHT TO PUSH THIS FORWARD TO CHANGE A CPO SO IT SAYS NO GOLF COURSES, NO RESORTS SO AGAIN THAT'S WHAT WE'RE TALKING ABOUT. SO THAT'S WHY I FEEL UNCOMFORTABLE AS GOT TO SOMEONE WHO PURCHASED PROPERTY AND AGAIN I'VE HAD THIS SAME ARGUMENT THE SAME FIGHT WHETHER SOMEONE OWNED ONE ACRE OR TEN ACRES THAT IF YOU BUY THE PROPERTY AND THEN WE TURN AROUND AND CHANGE THE ZONING I'M GOING TO VOTE TODAY TO ACTUALLY APPROVE THE CPO OR ACTUALLY FIRST OF ALL TO TO NOT TO TO TO PUSH IT FORWARD TO TO NOT DELAY IT.

THAT'S THE VOTE TONIGHT BECAUSE I DON'T THINK YOU'RE GOING TO CHANGE YOUR MIND.

BUT THE BIGGEST THING I WANT TO MAKE SURE IS EVERYONE UNDERSTOOD THE REAL THINGS THAT HAVE HAPPENED AND HOW THIS IS HAPPENING AND WHY IT'S HAPPENING BECAUSE AGAIN ALL THOSE EMAILS I GOT THAT THAT HAD THAT IN THERE OBVIOUSLY THERE WAS MISSED UNDERSTANDING OF EXACTLY WHERE WE ARE AND HOW WE GOT TO WE ARE TODAY. MR..

YOU KNOW I JUST WANT TO SAY THAT I'M NOT IN FAVOR OF KICKING THIS DOWN THE ROAD AND IN FACT I THINK WE NEED TO TAKE AT LEAST A FIRST READING HERE.

I'M OPEN. I WOULD LOVE FOR EVERYBODY TO SIT DOWN AND TALK AND TRY TO WORK THIS OUT BUT THERE'S NO REASON TO KICK IT DOWN THE ROAD.

WE NEED TO TAKE ACTION IT NOW AND THEN OPEN IT UP FOR MORE PUBLIC COMMENT.

WE NEED MORE PUBLIC INPUT DURING THIS PROCESS ANYONE IS THE CHAIRMAN IF I MAY MR. MCCALLUM, GO AHEAD. I THINK WE HAVE TO BE VERY CLEAR EYED ABOUT THIS MATTER CONSIDERING BOTH THE OWNER'S PROPERTY RIGHTS AND THE SENTIMENT OF THE RESIDENTS REGARDING THEIR WISHES AND EFFORTS TO PRESERVE THE HISTORY ,CULTURE AND HERITAGE OF THEIR COMMUNITY. THE OWNER OF THE CURRENT ZONING CAN BUILD HUNDRED AND 40 HOMES AS LOGAN SAID AND 95 DOCKS AND HE WOULD HAVE TO ACCOMPANY THOSE WITH ABOUT 140 SEPTIC TANKS AND DEEP WATER WELLS. THE OWNER SAID HE WANTS TO BUILD AN 18 HOLE GOLF COURSE CREATING A GOLF RESORT IN A GATED COMMUNITY ALL IN COUNTRY ADDICTION TO THE STATED PROHIBITIONS OF THE 25 YEAR OLD COMMUNITY OVERLAY PROTECTION ZONE.

THE RESIDENTS AND SEVERAL ENVIRONMENTAL AND CONSERVATION GROUPS HAVE STATED THEY WANT THE PROPERTY TO BE PRESERVED AS IS WITH NO DEVELOPMENT FINE DIRECT CONTRAVENTION OF CURRENT ZONING REGULATIONS. SO WITH REGARD TO THIS MATTER I'LL SUPPORT THIS ORDINANCE ON THE FIRST READING WITH THE HOPE THAT BY THE SECOND AND THIRD READING WE CAN ALL AGREE ON A REASONABLE PATH FORWARD THAT'S SATISFACTORY TO EVERYONE IN THE COMMUNITY AND THAT PATH FORWARD

[00:50:03]

IS NOT NEGATIVELY IMPACT THE SENSITIVE ENVIRONMENT SURROUNDING THIS PROPERTY I DON'T THINK IT'S WISE FOR US TO POSTPONE IT AND I THINK WE SHOULD AND I THINK WE SHOULD TAKE ACTION ON IT TONIGHT. AND ANYONE ELSE CALL THE QUESTION MR. CHAIRMAN OKAY.

MOVE MY MOTION. YOU WILL REMOVE THE MOTION TO WILL YOU TAKE BACK THE SECOND.

YES. OKAY WE'RE AT THE ORIGINAL MOTION.

ARE WE READY TO VOTE? DOES ANYONE NEED TO SAY ANYTHING ELSE? OKAY. WOULD YOU PLEASE THE ROLL BEGINNING WITH MR. DAWSON WHO MADE THE MOTION MR. GLOVER MADE THE SECOND COUNCILMAN DAWSON? YES, COUNCILMAN GLOVER? YES, COUNCILMEMBER HOWARD? YES COUNCILMEMBER LAWSON. MARK LAWSON YES.

COUNCILMEMBER REEVES YES. COUNCILMEMBER TAVERNIER. YES.

COUNCILMEMBER BARTHOLOMEW YES COUNCILMEMBER BROWN. YES.

COUNCILMEMBER CUNNINGHAM NO. VICE-CHAIR ALLEN YES AND CHAIRMAN YES.

THAT MOTION WAS SUCCESSFUL. I WOULD LIKE TO TAKE ITEMS AND 14 AS ONE MOTION PLEASE SO

[Items 13 & 14]

THESE ARE FROM THE LAST COMMITTEE MR. GLOVER MAKES THE MOTION ALSO MISS HOWARD MAKES THE SECOND DULY MOTION AND SECONDED THE TWO ITEMS IS THERE ANY DISCUSSION SEEING NO

[15. SECOND READING OF AN ORDINANCE FOR A ZONING MAP AMENDMENT/REZONING REQUEST FOR 1 ACRE (R600 036 000 0369 0000) AT 3 BENTON LANE FROM T3 EDGE TO T2 RURAL CENTER]

DISCUSSION THESE WILL BE APPROVED WITHOUT OBJECTION AND I SEE NO OBJECTIONS.

ITEM NUMBER IS A SECOND READING OF AN ORDINANCE FOR A ZONING MAP AMENDMENT REZONING REQUEST FOR ONE ACRE AT THREE BENTON LANE FROM T3 EDGE 2 TO 2 RURAL CENTER MR. CHAIRMAN, IF I MAY I THOUGHT THIS WAS ACTUALLY GOING TO BE SENT BACK OUT FOR TO LOOK AT THAT ENTIRE ROADWAY.

I AGREE WITH THAT. YEAH, I DIDN'T THINK IT IS SUPPOSED TO BE BACK ON THE AGENDA. IT WASN'T SUPPOSED TO BE OH IT'S ON THE SO YOU CAN MAKE AN AMENDMENT TO HAVE IT POST AMENDMENT OR SEND IT BACK TO SECOND DATE AS WELL.

WE GOING TO SEND IT BACK COMMITTEE? CORRECT.

GO AHEAD, MR. GRAY WHAT ARE WE TALKING ABOUT BECAUSE IF YOU ARE LEAVING PLEASE LEAVE QUIETLY AND YOU MIGHT WANT TO CALL A BREAK AFTER WE DO THIS SO THAT FOLKS CAN LEAVE, SO WE CAN GET ON WITH OUR AGENDA SO WE WERE UNDER THE IMPRESSION THAT WE WERE TO KEEP THIS MOVING FORWARD AND HOLD IT PRIOR TO THIRD READING. OKAY.

SO WE'RE GOING TO HOLD A COMMUNITY ON APRIL 24TH. THIS WAS SCHEDULED FOR THE 25TH. ON THE 25TH THIS WAS SCHEDULED FOR THIRD READING ON APRIL 24TH WE WILL HOLD A THIRD READING ABOUT HOW TO READ. YOU ALL WANT TO HANDLE IT.

IT'S FINE WITH US. YEAH, WE'RE AWARE OF THAT. SO THE MEETING WILL BE APRIL 25TH. THE PUBLIC MEETING ON THE PLAN AMENDMENT WILL APRIL 25TH.

OKAY. TEMPERATURE WILL PREVAIL. YES, GO AHEAD.

WE REGARDING THIS ITEM WE'RE GOING TO VOTE WE'RE GOING TO DO A SECOND READING TONIGHT IT'S MY UNDERSTANDING THEN WE GO TO A PUBLIC MEETING AT PORTERVILLE HIGH'S ELEMENTARY SCHOOL ON TUESDAY 25TH I BELIEVE IT IS AT 6:00. AND THEN WE GO TO THE THIRD READING AFTER THAT AND IN COMMENT TO THE LADY THAT CAME UP HERE AND SPOKE EARLIER THE CAMPBELLS MR. DR. CAMPBELL HAS BEEN ON HILTON HEAD IN THE BLUFFTON AREA FOR 35 YEARS HE HAS TWO SONS THAT ARE KNOW NOW GOING INTO THE FAMILY BUSINESS THE RATIO FOR OPTOMETRISTS AND ANY ONE GIVEN AREA IS 1 TO 5000 PEOPLE GUESS WHAT IT IS IN THIS AREA WHERE HE WANTS TO BUILD AN OFFICE 0 TO 20000 THEY DON'T HAVE THE ME THE CAMPBELLS DO NOT HAVE THE MEANS LIKE PUBLIX AND PARKER'S AND THE BIG THE BIG BOX STORES TO BE ABLE TO AFFORD WHAT PROPERTY IS AND SO I'M ASKING ALL OF US TO PLEASE VOTE YES FOR THE SECOND READING.

OKAY. ANY OTHER QUESTIONS BEFORE WE VOTE? I YES, GO AHEAD. I JUST WANT TO SAY THAT I VOTED TO MOVE IT TO THE FIRST READING JUST SO WE COULD GET INFORMATION. I JUST WAS REELECTED TALKING TO

[00:55:07]

THE PEOPLE OF BLUFFTON. THEY ARE LOOKING FOR US TO SLOW GROWTH, LOOKING FOR US TO CONTROL GROWTH, LOOKING FOR US TO BRING THINGS TO A MINIMUM IF WE CAN ON THINGS BUY UP ZONING THIS PROPERTY DOES NOT DO THAT AND SO I WILL VOTE AGAINST IT TONIGHT EVEN IF WE MOVE IT FORWARD TO THE THIRD I'M GOING TO VOTE AGAINST IT TONIGHT AND I THINK I DID NOT CALL A MOTION AND A SECOND SO THAT WE COULD HAVE YOU SORRY YOU DID, MR. CHAIRMAN.

I'LL MAKE THAT MOTION. OKAY. MR. CUNNINGHAM AND MR. BOTH MADE THE MOTION IN SECOND. NOW IS THERE ANY FURTHER DISCUSSION KNOW I'M IN AGREEMENT WITH MR. LAWSON. THIS I BELIEVE IS IN MY DISTRICT AND WHAT WE HEAR FROM PEOPLE IS TRAFFIC IS HORRIFIC ESPECIALLY AT THE NEW RIVER TRAFFIC CIRCLE.

THEY WANT TO SLOW GROWTH. THEY WANT TO REDUCE DENSITY. THEY HAVE PROBLEMS WITH THE ELECTRICAL I'M TOLD BY PEOPLE IN NEW RIVERSIDE IT GOES ON AND OFF ALL THE THEM THANKS TO MR. CUNNINGHAM NO RELATION THERE ARE THERE ARE ISSUES PEOPLE HAVE AND I'M GOING TO VOTE NO AGAIN I VOTED NO THE FIRST THING. OKAY.

ANY OTHER QUESTION I WOULD LIKE TO SAY WITH I LIKE TO ASK IF EITHER A COUNCIL MEMBER TABERNACLE COUNCILMEMBER LAWSON HAVE ACTUALLY BEEN OUT TO WHERE THE PROPERTY IS I KNOW WHERE IT IS. I USED TO REPRESENT NOW HAVING BEEN PRESENT THERE THREE TIMES AND IN THE LAST WEEK OR SO AND ACTUALLY I'M SURPRISED THAT IT'S ACTUALLY NOT EVEN HIGHWAY SIX IT'S ACTUALLY BACK A LOT INTO THE RESIDENTIAL AREA WHICH MAKES ME EVEN WANT TO EVEN MORE NOT VOTING AND ALSO THE PEOPLE GOING BY THERE EVERY SINGLE DAY ARE COMING OUT OF PALMETTO BLUFF OR NEAR RIVERSIDE AND THEY'RE GOING BY THERE ANYWAY TO GO TO THE STORE, GO DOWNTOWN CLIFTON OR WHEREVER GOING IT'S NOT GOING TO ADD THAT MUCH TRAFFIC HE'S ONLY GETS 18 PATIENTS A DAY. OKAY. OKAY.

THAT'S ALL RIGHT, MR. CHAIRMAN . GOOD.

YEAH, I THINK I JUST WANT TO GET THE PUBLIC COMING. THAT'S WE TALKED ABOUT LAST TIME NOT SAYING I'M FOR OR AGAINST IT AFTER VISITING THE PROPERTY FOR THE SECOND TIME BUT WE DIDN'T GET TO THAT PUBLIC COMMENT. SO I'D LIKE TO SEE THAT THROUGH ESPECIALLY EVEN IF IT'S NOT FOR THIS PROPERTY ITSELF BUT TO KNOW WHAT WE'RE GOING TO DO WITH THE REST OF THAT CORRIDOR AFTER I'D LIKE TO HAVE THIS ON THE TABLE WHEN WE HAVE THAT.

OKAY. WOULD YOU CALL THE ROLL PLEASE ? MR. CUNNINGHAM MADE THE MOTION MR. BARTHOLOMEW MADE THE SECOND OKAY.

COUNCILMAN CUNNINGHAM? YES. COUNCILMAN BARTHOLOMEW? YES. COUNCILMEMBER BROWN. YES.

COUNCIL MEMBER DAWSON. YES. COUNCIL MEMBER GLOVER AND YOU KNOW DO NOT SUPPORT THIS AND WHAT I HOPING THAT WE HAD PUBLIC COMMENTS ON THIS BEFORE WOULD BE BEFORE BUT THERE'S NOT SO I'M TO ABSTAIN AND IF IT ALLOW FOR THE PASSAGE BUT I'M IN FAVOR OF IT AT ALL THANK YOU COUNCILMEMBER HOWARD NO COUNCILMEMBER LAWSON MARK LAWSON NO COUNCILMEMBER. YES. COUNCILMEMBER TAMINA I KNOW VICE CHAIR MCCLELLAN MY INCLINATION ON THIS MATTER VOTE NO.

HOWEVER I DO WANT TO HEAR FROM THE PEOPLE IN THE COMMUNITY AND THE POSITION THAT THEY TAKE AND IF WE ARE SUCCESSFUL WITH NO VOTES THERE WON'T A PUBLIC MEETING.

SO I THINK THAT WE HAVE FRAUGHT HERE WITH DIFFICULT I WOULD HAVE PREFERRED THE PUBLIC MEETING BEFORE THE SECOND VOTE BUT I'LL VOTE YES TONIGHT JUST TO KEEP IT ALIVE SO.

WE CAN HAVE THE PUBLIC MEETING HEAR FROM THE PEOPLE WHO LIVE THERE AND THEN THE THIRD READING I'LL MAKE A DECISION AS TO WHICH WAY I'LL GO. I'M A NO OKAY BUT IT DOES PASS.

HOW ARE YOU DOING? MY NAME IS WILLIAM SMITH TONIGHT YOU LIVE ON IN A WATERWAY TO THE PUBLIC LIBRARY. I'VE BEEN COMING TO THIS COUNCIL FOR INTENSELY TIME NOW ABOUT COMMUNITY LIBRARIES. WE HAVE A BEAUTIFUL STATE LIBRARY SYSTEM ISLAND BUT THE LIBRARY CLOSED ALL BANKER'S HOURS. HOW CAN MY KIDS GET THINGS DONE WHEN LIBRARIES IS CLOSED SO? IT'S GOOD TO HAVE IT BUT WE CAN'T UTILIZE IT SO.

I MEAN ONCE AGAIN I BRING THE QUESTION TO YOU WHEN ARE WE GOING TO CHANGE THE HOURS THE LIBRARY ALSO IN SO THAT WE CAN ACTUALLY GOOD USE OF THE USE OF THE LIBRARY AND HAVE IT OPEN LATE AFTERNOONS BECAUSE IT IS DIFFERENT WHEN YOU WHEN YOU GO TO THE BANK GET SOMEONE YOU GOT YOU GOT A CREDIT CARD BUT WHEN YOU HAVE THAT ACCESS AT HOME YOU NEED THE LIBRARY TO GO SO THAT'S WHY WE PAY TAX OURSELVES TO KEEP THAT UP AND RUNNING. SO ONCE AGAIN PLEASE LOOK AT THE LIBRARY TAX I LOOK AT THE LIBRARIES I WAS IN ALSO THIS MEETING HERE I'M SO DISAPPOINTED THIS COUNCIL STARTED MEETING AT 5:00 BECAUSE I WAS ONCE AGAIN WHEN PEOPLE AT WORK REGARDS TO SOMETHING IS ON THE AGENDA THAT THAT MAY BE FRUITFUL THAT THEY MAY WANT TO PUT TEETH IN YOU ALL WITH ALONG WITH ME WE WORK FOR PEOPLE WHO REPRESENT US WELL THE OFFICIALS WE ELECTED MY PEOPLE TO SAY THAT YOU WANT TO MEET AT 5:00 WHEN PEOPLE ARE AT WORK OR JUST GETTING OFF THAT'S A BOLD STATEMENT THAT SAYS THAT YOU DON'T CARE WHAT THEY SAY YOU'RE GOING TO MEET WHEN YOU FEEL LIKE ME AND YOU DON'T WANT THEM TO THE MEETING I MEAN I CAN'T PUT IT NO OTHER WAY IT'S TOXIC AND IT'S UNHEALTHY AND THEN YOU SAY YOU WANT YOUNGER PEOPLE OR YOU WANT THE PEOPLE THE COMMUNITY BEING GET INVOLVED. OH MAN I SAID BABY DON'T DON'T DON'T TELL ME YOU CRY AND GIVE ME CROCODILE TEARS SHOW ME OR SHOW US AND PUT THIS MEAN AT A TIME THAT'S FEASIBLE FOR PEOPLE WHO ARE WHO ARE INVOLVED AND WHO WANT TO HEAR AND WHO WANT TO SPEAK AND THEY CAN GET FROM WORKING NOT TO GET A SPEEDING TICKET TOGETHER AND VOICE THEIR OPINIONS THEN BRING TO THE MEETING BY TIME LATER NO ONE ASKED.

[01:05:03]

NO ONE WAS BROUGHT HERE TO SIGN UP FOR THAT YOU ALL CHOSE TO GO SIGN UP AND PUT YOUR NAME ON THE BALLOT BOXES THAT YOU WANT TO REPRESENT YOUR CONSTITUENT MAKE TIME OR GO HOME.

BUT THIRDLY AND LASTLY WE TALKED ABOUT YA'LL TALK ABOUT THAT LAST SITUATION YOU GAVE US STUDY FOR HILTON GULLAH PEOPLE. WELL WHY NOT GIVE US A STUDY FUSSING HELENA SAY I SAY HELLO GULLAH PEOPLE SEE HOW LONG THE PEOPLE WHO'VE BEEN OVER TO WHO WE ARE FROM WE'RE BORN AND RAISED HERE TO SEE IF THAT'S WHAT REALLY BENEFIT AND SEE HOW Y'ALL HOW JUST TAKE THIS VACATION IT'S TAKING PLACE IF YOU REALLY CARED I MEAN WE KEEP WE KEEP KICKING THIS THING KICKING THIS THING I'M GONNA ROLL HEAD AND WE AND WE AND WE AS BLACK PEOPLE WE HAVE TO STOP LETTING PEOPLE PIMPLES BECAUSE WHEN THE NEXT PERSON WHO WHO COMES HERE AND THEY WANT TO PUT A GOLF COURSE WANT TO PUT THEIR MOTHER IN THEY'LL BE USING US TO THE CONSULTATION IN THERE AND EVERYBODY ELSE. THANK YOU, SIR. ANYONE ELSE? WHAT DO YOU WISH TO SPEAK ABOUT, SIR? YOU KNOW WE ALREADY DID THAT RIGHT? WE'RE TALKING ABOUT NON AGENDA ITEMS. THAT WAS AN AGENDA ITEM.

WE DISCUSSED IT. WE VOTED ON YES SIR. NO, I HAVE NOTHING.

YES SIR. RICHMOND COUNTY COUNCIL MY NAME IS JOE MACY GREW UP IN THE CITY OF BEAUFORT SINCE 1975. THAT WOULD MAKE ME I'VE BEEN HERE THROUGH KINDERGARTEN RIGHT HERE IN THE CITY. HONESTLY BE NEXT TO THE CITY OF BEAUFORT.

AND THEN I MOVED INTO THE CITY OF BEAUFORT. I SPEAK ABOUT PARKS AND REC.

I BIKED A BIKE ALL OVER BY CONEY ISLAND. I HAVE BIKE PANEL FOUR YEARS AGO AND NOW THAT I THINK ABOUT IT I THINK I WAS THINKING TODAY OR YESTERDAY ALL THE BIKE RIDES I'VE BEEN ON WHICH ONES AROUND BEAUFORT COUNTY WHAT I PUT IN THE TOP 20 HUNTING ISLAND PINE ISLAND NOT ONLY PINE ISLAND BUT THE ROAD LEADING TO PINE ISLAND IS BEAUTIFUL IN ITS OWN RIGHT AND I MIGHT ADD MCPHERSON A ROAD I DON'T KNOW IF THAT'S IN YOU FOR COUNTY OR NOT.

I DON'T KNOW WHICH COUNTY THAT'S IN BUT NOW THEY CAN FENCE THAT OFF.

THERE'S A TWO MILE ROAD UP THERE. IT'S NOT UP BUT EDGE POINT SOUTH AND GO UP NORTH. MY PERSONAL OPINION IS PINE ISLAND IS THE HUNTING ISLAND OF SAINT HELENA. MAYBE IT SHOULD JUST BE LEFT ALONE.

NO, DON'T LET THE CARS GO IN THEIR PARK. LET THEM RIDE YOUR BIKE AND DO WHATEVER. ONCE THE CARS GO WHO KNOWS WHAT HAPPENED? BUT MAYBE YOU SHOULD BACK PEOPLE SAYING BUY IT FROM THE GENTLEMAN WE WE WHO GREW UP IN BEAUFORT OR SAINT HELENA AIRPORT ROAD AND A LOT OF THESE FOLKS WE'VE BEEN CHEATED ON OUR PARKS AND SUMMER AND I KNOW SOMEBODY MADE A COMMENT IT'S LIKE PACMAN IT CAN BE NOT THE LAND IF THE PARK'S NOT GOING PINE ISLAND WHERE'S IT GOING? WHERE ARE THESE PARKS GOING? AND I COULD GO ON YOU KNOW THE GREEN STREET GYM, THE TENNIS COURTS WE NEVER GOT OUR CENTER AND THIS AND THIS WAS DOWN WITH THIS PARKS AND REC ISSUES THE SAME IT'S NOT THE SAME ISSUES BUT IT'S THE SAME OLD YEAH IT'S NOT ONLY THE PERFORMANCE IT'S NOT A NICE THING TO SAY BUT IT'S NOT IT'S NOT ONLY THE PERFORMANCE BUT IT'S THE RESPONSE WHEN WE START SCREAMING AND YELLING AND HOW SOMEBODY WANT WON FOR THE GOLF COURSE THERE I CHALLENGE ALL OF YOU TO GO SEE PINE ISLAND I'LL GIVE YOU I'LL LET YOU BORROW A BICYCLE HECK I'LL GIVE YOU A BICYCLE IF YOU WANT TO GO SEE IT IF YOU HAVEN'T SEEN IT YOU CAN GO SEE IT YOU WOULD NEVER PUT A GOLF COURSE. WELL MAYBE IF YOU'RE A GOLF FANATIC YOU WOULD BUT A LOT OF DON'T WANT TO PLAY GOLF SO MAYBE YOU WANT MAYBE WE'LL PLAY PING PONG WITH THAT NEW ONE.

PICKLEBALL. YEAH. THANK YOU.

PICKLEBALL. SO PROTECT THE PEOPLE WHO LIVE HERE WHO GREW UP HERE? YES WE SEE IT EVERY DAY. YOU CAN'T CON US YOU CAN'T CHEAT US.

YOU CAN'T ROB US YOU CAN'T BETRAY IT STOP IT. HOW MANY TIMES DID IS THERE ANYBODY ELSE WHO WISHES TO MAKE ? YES SIR.

I WAS ON THE LIST EARLIER. I DON'T THINK MANY. ARE YOU TALKING THE CPO? ARE YOU TALKING ABOUT PINE ISLAND PINE ISLAND NUMBER FIVE ON THE LIST BUT SOMEHOW I GUESS THAT'S EXACTLY WHAT WE DID IN THE FIRST ROUND. WE'VE DONE THAT.

WE'VE HEARD FROM EVERYBODY WE'VE PASSED IT WELL WHEN YOU COME BACK NEXT TIME COME BACK NEXT TIME WE'LL DO IT AGAIN BECAUSE WE'RE GOING TO HAVE A SECOND READING.

[01:10:02]

WE'RE GOING TO HAVE A THIRD READING AND PUBLIC HEARING. MR. CHAIRMAN, I HEAR WHAT YOU'RE SAYING, BUT AT THE AT THE READINGS WE ONLY PERMITTING FIVE PEOPLE THAT IT THAT'S CORRECT. RIGHT AT THE MEETING YEAH NO THAT'S A SOME OVERFLOW AND THEY WANT TO SPEAK AND YOU KNOW I'M NOT CHANGING OUR RULES TO ACCOMMODATE THIS THAT'S OUR RULES. I KNOW IT'S NOT ON THE AGENDA. THE CPO WAS ON THE AGENDA BUT HIS THE AGENDA NO. IS THERE ANY FURTHER ACTION TO COME THIS BODY SEEING NONE.
