HOPEFULLY 190. IT'S A VERY, VERY SPECIFIC I WOULD LIKE VERY MUCH WORK MOSTLY. THANKS TO ALL COUNCILPERSON BUT ESPECIALLY TO ALL OF THOSE THAT ARE RETIRING. LET ME BE SURE THAT YOU UNDERSTAND THAT BASED ON WHAT HAPPENED IN FLORIDA FOR US WE WANT TO KNOW. MY POINT IS THAT IT'S CERTAINLY WOULD BE AN OPPORTUNITY IF THAT WAS TO FROM THE GROUND WAR AND CREEK STAY ABOVE GROUND LEVEL UNTIL IT DUE SPANISH RAILROAD.
THANK YOU FOR THE OPPORTUNITY OF SPEAKING TONIGHT AND MAY GOD BLESS ALL OF YOU ESPECIALLY THOSE RETIRED. THANK YOU CHAIRMAN. I'D LIKE TO INTERRUPT.
I JUST WANT TO ACKNOWLEDGE THAT MR. BARNWELL IS MR. FEBRUARY IN THE SOUTH CAROLINA AFRICAN-AMERICAN CALENDAR THIS YEAR SO EXCELLENT GRANT. MR. GOOD EVENING, GRANT.
GOOD EVENING. SO TOUGH ACT TO FOLLOW. MY NAME IS GRANT MCCLURE IN THE SOUTH THIS PROJECT MANAGER WITH THE COASTAL CONSERVATION LEAGUE.
ITEM ON THE AGENDA EVENING INVOLVES THE POTENTIAL LAND SWAP 60 ACRES FROM THE ROLLING CRITICAL LANDS PROGRAM TO CONSTRUCT A NEW LIBRARY NEW PARKS, REC FIELDS AND A WASTE RECOVERY FACILITY. WE DO NOT QUESTION THE NEED FOR THESE FACILITIES BUT WE BELIEVE TRANSFER OF REMAINING CRITICAL PROPERTY MUST BE SCRUTINIZED. UPHOLD THE INTEGRITY OF THE PROGRAM AND THE ORIGINAL INTENT OF THE PROPERTIES INCLUSION IN THE PROGRAM.
THE LOSS OF 60 ACRES OF PROTECTED AND THEN IN EXCHANGE FOR JUST EIGHT ACRES IS CONCERNING. IN ADDITION THERE NEEDS TO BE AN ANALYSIS OF THE RESOURCE VALUES LOST AND GAINED IN THIS EXCHANGE. WE UNDERSTAND THE EVERGREEN EVERGREEN AND NEWLY TRACTS INCLUDED IN THE ROAD CRITICAL PROGRAM FOR STORMWATER MANAGEMENT AND TO PROTECT WATERS OF THE OKATIE RIVER. THERE NEEDS TO BE AN ASSESSMENT OF AND WHETHER IT IS POSSIBLE FOR THE REMAINING LAND ON THE NEW LEASE TRACT BUILDINGS PURPOSES ESPECIALLY WHEN FACTORING IN CONVERSION OF THE ADJOINING 60 ACRES TO AN PERVIOUS DEVELOPMENT. THERE ALSO NEEDS TO BE AN ASSESSMENT OF THE NATURAL RESOURCE VALUES ASSOCIATED WITH THE STATE MARY'S AND BLUFFTON PARKWAY PARCELS TO ENSURE THAT THEY WILL MEANINGFULLY CONTRIBUTE TO THE REAL AND CRITICAL PROGRAM.
THIS INFORMATION IS CRITICAL FOR TO MAKE A MEANINGFUL AND INFORMED DECISION ON THE SWAP AND WE UNDERSTAND THAT THE REAL AND CRITICAL BOARD TAKE UP THIS AT THEIR DECEMBER MEETING AND DECIDED FURTHER ANALYSIS WAS NEEDED DETERMINE IS INDEED A FAIR SWAP AND WE URGE THE COUNCIL POSTPONE THIS ISSUE UNTIL THE ABOVE ANALYSIS CAN BE CONDUCTED AND THAT CAN GIVE A
[00:15:02]
RECOMMENDATION. NO THANK YOU. YOU KNOW WHAT'S NEXT?[8. LIASION AND COMMITTEE REPORTS]
THAT'S IT. OKAY. THANK YOU VERY MUCH.NAME MEMBER PLEASE TO SPEAK. MR. ROBERT. THANK YOU, MR. CHAIRMAN.
WE DO HAVE ONE ITEM COMING OUT OF PUBLIC FACILITIES ASYLUM FILING CENTER AGENDA AND IT IS BASICALLY A CONTRACT FOR CALVERT RIGHT TO DO THINGS. ONE IS THE FUNDS FOR THE CONSTRUCTION CONTRACT ADMINISTRATION AND THE SECOND IS THE REPACKAGING OF IT SINCE WE'VE DECIDED THAT WE'RE GOING TO REBUILD IT AND I'M IN FAVOR OF WHAT IS PROPOSED JUST COUPLE OF COMMENTS ON IT. YOU KNOW WHEN WE LIKE THE RUNWAY THERE WERE TWO PRIMARY BENEFITS I THINK ONE WAS THAT IT HAD A SIGNIFICANT IMPACT ON AVIATION AND THAT ROLLS INTO HOSPITALITY AND ALSO INTO PROPERTY VALUES. AND THE SECOND WAS IT PRESERVED THE COMMERCIAL SERVICE WHICH WAS REALLY IN THE END THE RUNWAY IS MORE IN LINE IN MY SENSE OF WHERE IT IS AS POINT OF THE COUNCIL AND THE IN THE CITIZENS THERE'S A CONCERN ABOUT TOO MUCH GROWTH AND TOO MANY VISITORS. THERE'S NOT A LARGE APPETITE FOR THEM TO PUT SIGNIFICANT AMOUNT OF MONEY INTO THE CURRENTLY PROPOSED TERMINAL SO IT IS LOGICAL TO DOWNSIZE IT. NOW WHEN WE DO THAT I THINK THERE WILL BE A COUPLE OF THINGS THAT WILL BE COVERED CLEARLY EVEN AT A REDUCED SIZE THAT WILL COVER THE RESIDENTIAL DEMAND. THE PEOPLE THAT LIVE THERE AND IT WILL ALSO SERVICE THE IF YOU WILL SHOULDERS SEASONS IN THE SPRING AND FALL WHICH GOOD HOSPITALITY TIMES FOR THE THE ISLAND APPROPRIATE HOSPITALITY . SO THE ONLY PIECE THAT WOULD PERHAPS BE SLIGHTLY SHORTENED WOULD BE THE PEAK DEMAND DURING THE SUMMER.
IF YOU LOOK AT WHAT'S OVER THE LAST COUPLE OF YEARS IT'S BEEN KIND OF A ROLLER COASTER ON THE THE TRAFFIC GOING UP AND DOWN. A OF ISSUES BEYOND THEIR CONTROL.
SO IN ANY EVENT I DO THINK THAT THIS IS APPROPRIATE THINK IT'S APPROPRIATE TO DOWNSIZE IT.
I THINK THE ONLY QUESTION FOR STAFF TO DEAL WITH IS WHETHER YOU YOU KNOW, JUST OUT WHAT THE SIZE BE AND DO IT ONCE OR WHETHER YOU TAKE THE CURRENTLY ON AND DO IT IN TWO PHASES.
I KIND OF FAVOR PERSONALLY JUST DOWNSIZING TO WHAT WE CAN AFFORD THE MOST PART THE WORST OF ALL WORLDS WOULD BE IF WE ENDED UP DOING TWO PHASES AND THE FIRST ONE GOT COMPLETED EVERYTHING BACK IN THE SECOND YEAR AND THE BRIDGE TO NOWHERE YOU GO OUT OF TOWN ANYWAY.
I THINK THIS IS A GOOD ONE AND I COMMEND THE COUNCIL APPROVAL. THANK YOU.
ANY OTHER THAN THE CAREER SERVICES AND PUBLIC SAFETY COMMITTEE RECOMMENDED APPROVAL AND THE APPOINTMENT OF MARILYN HARRIS COUNTY COUNCIL REPRESENTATIVE ON THE BEAUFORT HOUSING AUTHORITY. THE OTHERS SAY. WE'LL MOVE ON TO ITEM NUMBER
[9. APPROVAL OF CONSENT AGENDA]
NINE WHICH IS THE APPROVAL THE CONSENT AGENDA. I HAVE A MOTION FOR THE APPROVAL OF THE CONSENT AGENDA. I'M SECOND. OKAY.WHO WAS FIRST? MR. SOMERVILLE WAS FIRST AND MR. HARRISON WOULD BE SECOND MOTIONED AND ANY DISCUSSION SAYING NONE. THE CONSENT AGENDA WILL BE
[10. PUBLIC HEARING AND APPROVAL OF A RESOLUTION TO SWAP IDENTIFIED PROPERTIES BETWEEN BEAUFORT COUNTY AND THE RURAL AND CRITICAL LANDS PROGRAM TO BUILD AN ADDITIONAL LIBRARY, ADDITIONAL PARKS AND RECREATION FIELDS, AND A SOLID WASTE MATERIAL RECOVERY FACILITY IN SOUTHERN BEAUFORT COUNTY]
APPROVED WITHOUT. ITEM NUMBER TEN IS A PUBLIC HEARING AND APPROVAL OF A RESOLUTION TO SWAP IDENTIFIED PROPERTIES BETWEEN BEAUFORT COUNTY AND THE RURAL AND CRITICAL LAND PROGRAM TO BUILD THEM AN ADDITIONAL LIBRARY, ADDITIONAL PARKS AND RECREATION FIELD AND THE SOLID WASTE MATERIAL RECOVERY FACILITY IN SOUTHERN COUNTY.MS. HOWARD MIGHT MOTION TO POSTPONE OR DELAY ITS WORD AND POSTPONE THIS PUBLIC HEARING IN THIS MOTION UNTIL RURAL AND CRITICAL LANDS HAVE A CHANCE TO DO THEIR DUE DILIGENCE FEEL FILTER WHICH WILL BE NEXT WEEK AND THEY WILL NEED THE MEETING IN WHICH THE AND JANUARY SO IT MIGHT BE THE LAST COUNTY COUNCIL MEETING OF JANUARY BEFORE WE CAN BRING THIS BACK UP AGAIN. OKAY. AND IF I'M THE COUNTY COUNCIL MEETING IN JANUARY WILL BE THE NINTH AND THE 23RD SO IT WOULD BE THE 20/23 SO YOUR MOTION WOULD BE POSTPONE ACTION THE 23RD OF JANUARY 2023. IS THERE A SECOND MR. HERBERT.
[00:20:13]
WE WILL BE THE SECOND. AND IS THERE ANY DISCUSSION OF THE AMENDMENT TO THE MOTION? FRANKLY, MR. CHAIRMAN. MY YES, FRANKLY I WOULD BE MORE THAN INCLINED TO VOTE TO DENY THIS MOTION. BUT SINCE THIS SEEMS TO BE THE AGREED UPON PATH FOR TODAY I'LL GO AHEAD AND LEAVE THIS FOR THE NEXT COUNCIL. BUT I WOULD LIKE TO EVERYBODY THAT THIS THIS PARTICULAR MOTION THIS PARTICULAR PROGRAM HAS THE OPPORTUNITY OR THE PROBABLY WILL RESULT IN KILLING THE PROGRAM OUR RURAL AND CRITICAL PROGRAM SO I, I REALLY ADVISE THE NEXT COUNCIL BE VERY CIRCUMSPECT AND VERY THOUGHTFUL IN THEIR APPROACH TO THIS MATTER. Q ANY OTHER COMMENTS TO QUICK CAN YOU STILL HOLD THE PUBLIC HEARING TODAY IS AND HOW YOU ADVERTISED IT BEFORE WE DELAY THIS ACTUALLY WASN'T PUBLISHED FOR A PUBLIC HEARING TODAY OR WAS IT? IT WAS OKAY YOU CAN HAVE YOUR PUBLIC HEARING IF YOU WANT TO THEN SURE. I FEEL OBLIGATED TO DO THAT.BUT THE CHAIRMAN IF THERE'S ANYBODY WHO WANTS TALKING MATTER, HAVING IT AND HAVING IT THIS EVENING WILL KEEP US FROM HAVING DO IT AGAIN IN JANUARY. THERE'S NOTHING WRONG WITH DOING IT AGAIN IN JANUARY. WELL, EXCEPT FOR OF THE COST OF THE ADVERTISING.
OKAY. IS THERE ANY MEMBER OF THE PUBLIC AT THIS TIME WHO WISHES TO MAKE THEIR FEELINGS KNOWN? ITEM NUMBER TEN WHICH IS TO BE POSTED UNTIL ACTION IS TAKEN BY RURAL AND CRITICAL LANDS IN JANUARY. SEEING NONE WE WILL CLOSE THE PROBLEM. THERE'S NO ONE. OKAY, I DO HAVE A SECOND QUESTION. SOMEBODY REFRESH MY MEMORY. WE POSTPONE THIS ONCE BEFORE BECAUSE FROM QUICK DIDN'T GET IT IN TIME BUT THEN THEY SAID THAT THEY HAD SOME TYPE OF OTHER FIELD HAVE PREVIOUSLY RIGHT THIS MINUTE LAST WEEK RIGHT.
AND AFTER A VERY LONG DISCUSSION IN PRESENTATIONS THIS WAS WHAT WAS VOTED ON AT THE RURAL AND CRITICAL AND WE'RE MEETING DO A FIELD TRIP TO SEE ALL THE SITES INCLUDING CAMP SITE MARY. IT WASN'T THAT YOU MISSED THAT IN THE LAST MEETING ON THEIR FIELD TRIP IT WAS A DIFFERENT FEEL. I'M TO CLOSE THE DELAY.
I THINK WE'VE ALREADY DELAYED IT ONCE. I THINK THIS COUNTY COUNCIL HAS BEEN EDUCATED ON IT. THAT'S JUST MY PERSONAL OPINION .
SO I WILL VOTE AGAINST THE POSTPONEMENT. OKAY.
ANY OTHER COMMENTS BEFORE WE TAKE ACTION? THIS IS ON THE AMENDMENT WE'RE VOTING ON TO POSTPONE ACTION UNTIL SEPTEMBER JANUARY 20, JANUARY 23RD OF 2023 OF BECAUSE WE'RE GOING TO HAVE NO VOTES. WILL THE ALL THE ROLL PLEASE. COUNCILMEMBER HOWARD IS COUNCILMEMBER HERSHMAN. YES. COUNCILMEMBER CUNNINGHAM.
COUNCILMEMBER DAWSON. NO. COUNCILMEMBER MCGOWAN.
COUNCILMEMBER LAWSON. MARK LAWSON. YES.
COUNCILMEMBER RODMAN. YES. COUNCILMEMBER GLOVER.
IF COUNCILMEMBER BISOU SUMMERVILLE OR. YES.
CHAIRMAN. PLACEMENT. YES IT PASSES EIGHT THREE NOW.
OKAY. THE IS NOW POSTPONED OR ACTIONED UNTIL JANUARY THIRD.
ITEM NUMBER 11 IS A PUBLIC HEARING AND APPROVAL. YOU JUST DON'T PRESS THAT OR DON'T GO ON MUTE. OKAY DON'T PRESS THAT. I WASN'T SURE WHAT TO DO.
IT'S ON ITS OWN. THANK YOU. IN ORDER FOR THIS ONE TO TAKE SIX ELECTION NEEDS EIGHT VOTES TO MAKE THAT HAPPEN. THAT'S CORRECT.
[11. PUBLIC HEARING AND APPROVAL OF A RESOLUTION TO APPROVE A COMMERCIAL PROPERTY LEASE AGREEMENT BETWEEN BEAUFORT COUNTY - 36 HUNTER ROAD, HILTON HEAD ISLAND, SC 29926 - AND AVIS BUDGET GROUP]
OKAY. WHAT MAKES YOU THINK YOU OKAY? GETTING BACK TO ITEM NUMBER 11 IS A PUBLIC HEARING AND APPROVAL OF A RESOLUTION TO APPROVE A COMMERCIAL PROPERTY LEASE AGREEMENT BETWEEN BEAUFORT COUNTY 3600 ROAD HILTON HEAD ISLAND AND THE BUDGET GROUP. MAY I HAVE A MOTION? WE CAN HAVE A PUBLIC HEARING.[00:25:01]
SO MR. MAKES THE MOTION. MR. MCGOWAN IS HERE SOMEWHERE. OKAY.WILL TURN TO THE PUBLIC. IS THERE ANYONE IN AUDIENCE WHO WISHES TO COMMENT ABOUT THIS PARTICULAR ITEM. THAT WE WILL CLOSE THE PUBLIC PORTION? IS THERE ANYONE ON COUNCIL WHICH IS TO DISCUSS THIS? I CAN SING.
[12. THIRD READING OF AN ORDINANCE FOR A TEXT AMENDMENT TO THE COMMUNITY DEVELOPMENT CODE (CDC): SECTION 5.3.20 (ARCHITECTURAL STANDARDS AND GUIDELINES APPLICABILITY) AND APPENDIX, DIVISION A.1.20 (COMMUNITY PRESERVATION DISTRICTS - RELATIONSHIP TO THE COMMUNITY DEVELOPMENT CODE) TO RESTRICT THAT A SHIPPING CONTAINER OR OTHER SIMILAR PORTABLE STORAGE CONTAINER IS NOT CONSIDERED A DWELLING.]
NONE OF THIS WILL BE APPROVED WITHOUT OBJECTION AND I SEE NO OBJECTIONS.ITEM NUMBER 12 IS A THIRD READING OF AN ORDINANCE PROTECTION AMENDMENT AND WILL DEVELOPMENT CODE SECTION 5.3.18 ARCHITECTURAL STANDARDS AND GUIDELINES APPLICABLE AND APPENDIX 8.1. 20 COMMUNITY PRESERVATION DISTRICT'S RELATIONSHIP TO THE COMMUNITY DEVELOPMENT CODE TO RESTRICT OTHER SHIPPING CONTAINER OR OTHER SIMILAR PORTABLE STORAGE CONTAINERS IS NOT CONSIDERED A DWELLING MAY HAVE YOUR MOTION SO MORGAN'S CHAIRMAN OKAY.
MR. DAWSON MAKES THE MOTION MISS HOWARD MAKES THE SECOND MOTION AND SECOND ANY DISCUSSION ON THIS PARTICULAR ITEM. MR. ROSS.
YES. SO THE STORAGE CONTAINER WE'RE DOING IT BECAUSE IT IS A LIFE SAFETY ISSUE THAT SOMEONE PUTS A STORAGE CONTAINER IN SOMEONE'S BACK BACKYARD THAT WE'RE NOT CREATING A FIRE HAZARD SO IT COULD BE KILLED. IT DOESN'T MEET ALL THE HURRICANE CODES NOW I JUST WANNA MAKE SURE EVERYONE KNOWS THAT AND MR. CHUCK AND HEALTH CARE AND ALL THAT KIND OF STUFF YOU UP TO THIS QUESTION BUT IF STILL WANTED TO COME BACK AND THEY WANTED TO BUILD WITH STORAGE CONTAINERS AND THEY WANTED TO COME BEFORE THE ZONING BOARD AND ASK FOR REPEAL IS THAT SOMETHING THAT AGAIN SOME WANT TO PROTECT THAT THEY WANT TO DO THESE KIND OF THINGS BUT THEY STILL TO TO TO TO ASK FOR THE ZONING APPEAL TO BUILD A MORE AMOUNT OF STORAGE CONTAINERS SO THIS AMENDMENT IS PART OF THE ZONING ORDINANCE.
ANYTHING IN THE ZONING ORDINANCE CAN BE APPEALED A VARIANCE ZONING BOARD AND IT WOULD BE ENTIRELY UP TO THE ZONING BOARD WHAT INFORMATION THEY WOULD WANT TO REVIEW IT.
IT WOULD BE UP TO THEM TO MAKE A DETERMINATION. SO IF SOMEONE DID WANT TO BUILD WITH STORAGE CONTAINERS THEY STILL COULD THAT. BUT YOU HAVE TO GO THROUGH THE PROPER PROPER CHANNELS OF ASKING FOR A VARIANCE TO BE ABLE DO THAT IF THEY GOT THE VARIANCE THROUGH THE PROCESS OF JUST GOING THROUGH THE VARIANCE DOESN'T MEAN THAT YOU'RE GOING TO GET THE THE VARIANCE BUT THAT PROCESS WOULD BE AVAILABLE TO THEM.
YES. OKAY THAT'S WHAT I LIKE. YOU DO AGAIN EMPHASIZING AGRICULTURAL NOT BEING IMPACTED BY THIS. RIGHT.
BECAUSE THERE ARE NO DWELLINGS ASSOCIATED WITH THE AGRICULTURE RIGHT.
ANY OTHER COMMENTS THIS WILL BE APPROVED ON THIRD READING WITHOUT OBJECTION.
THERE WE GO. OKAY. I WANT TO SAVE THIS FOR YOU BECAUSE INSTEAD OF IT BEFORE OKAY WOULD YOU CALL THE ROLL PLEASE COUNCILMAN DAWSON? YES, COUNCILMAN HOWARD JUST COUNCILMEMBER CUNNINGHAM NOW COUNCILMAN WELLING, COUNCILMEMBER ELLEN COUNCILMEMBER LAWSON. MARK LAWSON YES.
COUNCILMEMBER RODMAN YES. COUNCILMEMBER HARVEY SOMEONE COUNCILMEMBER GLOVER YES.
VICE-CHAIR SUMMERVILLE YES CHAIRMAN PARSONS YES. THE MOTION PASSES EIGHT THREE
[13. THIRD READING OF AN ORDINANCE TO PROVIDE MAINTENANCE WORK ON PRIVATE ROADS.]
YES. ITEM NUMBER 13 IS A THIRD READING OF AN ORDINANCE TO PROVIDE MAINTENANCE WORK ON PRIVATE ROADS. I HAVE A MOTION SO MR. CHAIRMAN MR. FLOORING MAKES THE MOTION SECOND MR. GLOVER MAKES THE SECOND ULI MOTION THE SECOND IN THE DISCUSSION I'D LIKE TO MAKE SOME COMMENTS. YES SIR, GO AHEAD MR. MCCOLLUM.THIS IS YOUR THIRD READING. THE FIRST TWO READINGS PROVED TO BE POSITIVE AND AS A RESULT OF INFORMATION THAT WAS DEVELOPED THEREAFTER THIS REFERRED BACK TO THE COMMITTEE FOR A RECOMMENDATION TO BE BROUGHT FORWARD TO THE COUNCIL TONIGHT FOR REVIEW, CONSIDERATION AND A FINAL VOTE. THE COMMUNITY SERVICES COMMITTEE CONVENED A MEETING
[00:30:06]
OF WHO RESEARCHED THIS SITUATION AND IT WAS DISCOVERED CLEARLY THAT IS A CONSTITUTIONAL RESTRICTION IN THE STATE OF SOUTH CAROLINA THAT PREVENTS US FROM USING PUBLIC FUNDS TO IMPROVE PRIVATE PROPERTY IF IMPROVEMENT IS THROUGH THE EXCLUSIVE USE OF THOSE PRIVATE OWNERS AND NOT FOR THE PUBLIC GOOD WITH THAT PROHIBITION MIND THE COMMITTEE DECIDED THAT THIS MATTER SHOULD COME WITH THE FOLLOWING INFORMATION INCLUDED THERE ARE PROCESSES AND PROCEDURES IN PLACE IN BEAUFORT COUNTY FOR PUBLIC FUNDS TO BE SPENT ON PRIVATE TO MAINTAIN THEM HOWEVER TO DO SO THE PROPERTY OWNERS HAVE TO AGREE TO ALLOW THE COUNTY TO DO THE WORK AND THEN THE PROPERTY OWNERS HAVE TO AGREE TO REIMBURSE THE COUNTY FOR THE WORK THAT WAS DONE SO THE COUNTY COULD OBTAIN AN ESTIMATE FOR THE TO BE DONE AND INFORM THE OWNERS OF PRIVATE ROAD THAT THE WORK WAS BEING DONE.THE OWNERS OF THE ROAD WOULD HAVE TO ALLOW THE COUNTY TO UNDERTAKE REPAIR AND THEN THEY WOULD HAVE TO AGREE TO PAY FOR IT. WE'VE DISCOVERED THAT THERE ARE OVER A THOUSAND PRIVATE ROADS IN THE COUNTY 287 MILES AND THAT THE LEAST EXPENSIVE REPAIR WILL PROBABLY BE ABOUT $10,000 A MILE. MODERATE ABOUT $25,000 MILE AND AN EXPENSIVE WOULD BE ABOUT $35,000. AND WHILE SO THE PEOPLE WHO OWN THE PROPERTY WOULD HAVE TO AGREE TO PAY THAT BACK TO THE COUNTY THAT REPAIR WAS UNDERTAKEN THEY COULD PAY ALL AT ONCE OR THEY COULD AGREE TO CREATE A SPECIAL TAX DISTRICT AND THEY COULD HAVE THE REPAIRS PLACED ON THEIR PROPERTY TAX OVER A PERIOD 3 TO 5 YEARS IF THEY WOULD NOT AGREE TO THAT NO PUBLIC FUNDS COULD BE EXPENDED. THERE'S ALSO ANOTHER IN THE COUNTY THAT WOULD ALLOW THE OWNERS OF A PRIVATE TO GIVE THE ROAD TO TOWN AND THEN THE COUNTY BE THE OWNER AND BE RESPONSIBLE FOR MAINTAINING IT IN THE FUTURE.
THAT PROCESS IS CLEARLY IDENTIFIED AND CAN BE MADE AVAILABLE TO PEOPLE WHO WISH TO DONATE OWED TO THE COUNTY. THERE ARE PEOPLE WHO OWN PRIVATE ROADS AND WOULD CONDUCT THEIR OWN MAINTENANCE ON THE ROADS AND PAY THE BILL THAT MAINTENANCE THE MAINTENANCE IN THIS SITUATION WOULD BE TO ALLOW EMERGENCY VEHICLES ACCESS ON THAT RUN PASSABLE SOMETIMES AFTER A STORM OR FIRE TRUCKS THAT COULD NOT GET DOWN THE ROAD BECAUSE OF THE GROWTH OF TREES OVER THE ROAD AND NOT THE THE FIRE ENGINE OFF AS THEY TRY TO PASS SO THE WORK CONSISTS OF MAINTAINING A PRIVATE ROAD USUALLY A DIRT ROAD AND THEN ALSO DOING SOME WORK ON THE TREES TO REMOVE THE BRANCHES THAT WERE HANGING OVER THE ROAD THAT WOULD MAKE IT IMPOSSIBLE. YES. SO THE COMMUNITY SERVICES COMMITTEE DECIDED NOT TO TAKE A POSITION ON THE MATTER BUT TO SEND IT REVIEW AND CONSIDERATION OF THIS FULL DELIBERATIVE BODY TONIGHT SO THEY CAN MAKE A DECISION WITH A MOTION AND A SECOND AND A VOTE TO ALLOWED THIS ORDINANCE TO BE CREATED .
WE WOULD ESSENTIALLY BE AUTHORIZING AN ILLEGAL ORDINANCE THAT IS AGAINST THE CONSTITUTION OF THE STATE WHEN WE ISSUE THAT ORDINANCE AND YOU THEN PROBABLY HAVE TO UNDERTAKE A EFFORT TO HAVE THAT REPEALED AND TO DO THAT YOU HAVE TO GO TO COURT OF COMPETENT JURISDICTION, HAVE THE ORDINANCE INVALID CITATIONS AND AGAINST THE LANGUAGE CONSTITUTION SO TWO OCCASIONS WE WOULD PROBABLY LOOK FOOLISH WE WOULD LOOK FOOLISH TO PASS THE ORDINANCE AND THEN WE WOULD LOOK FOOLISH OURSELVES AND REPEAL THAT.
YES. SO WE'RE MAKING ALL OF THAT INFORMATION AVAILABLE THROUGH THE COUNTY TO THE COUNCIL. RIGHT. SO THEY'RE MAKING FULLY INFORMED DECISION AS TO HOW THEY WOULD LIKE TO PROCEED. SO A YES VOTE FOR YES IS THE PASSING OF AN ILLEGAL ORDINANCE A NO VOTE IS THE FINAL VOTE AND IT WILL GO AWAY.
LET ME FINISH BY SAYING THAT LOOKING WE ARE GOING TO ENCOURAGE THE COMMUNITY SERVICES TO CONTINUE TO STUDY THIS MATTER. WE ARE TRYING TO DECIDE IF IT WOULD BE A BENEFIT TO BUYING FOUR WHEEL DRIVE AMBULANCES IN THE AND MAKING THEM AVAILABLE MORE THAN A THOUSAND PRIVATE ROADS SOME OF WHICH MAY BE IMPASSABLE AFTER THE STORMS SO THE AMBULANCE THAT WOULD BE GOING IN PERFORM A LIFE SAVING MANEUVER WOULD NOT BE ALLOWED
[00:35:06]
IT WOULDN'T BE ABLE TO COME DOWN THE ROAD THE PROBLEM WITH THAT IS HOW MANY AMBULANCES WE NEED WHAT WOULD COST BE AND WHERE WOULD WE PUT THEM TO ENSURE THAT THE APPROPRIATE RESPONSE THE SECOND THING THAT WE WOULD LIKE TO DO IS HAVE THAT COMMITTEE CONSIDER THE LONG RANGE OCCASIONS OF THIS TO SEE IF THERE A WAY WITHIN THE LANGUAGE OF THE CONSTITUTION TO PROVIDE SERVICE FOR THE MAINTENANCE OF THESE ROADS AND A PART OF THE PUBLIC GOOD.THE PROBLEM WITH THAT IS THAT THE MAINTENANCE AND IMPROVEMENT IN THE ROADS CAN'T BE DONE IF IT'S FOR THE EXCLUSIVE OF THOSE PRIVATE PROPERTY OWNERS. AND I'LL GIVE YOU AN EXAMPLE WE DO PERFORM MAINTENANCE ON SHIPS THAT ARE PRIVATELY BUT THAT'S THE PUBLIC GOOD.
IT'S MORE PEOPLE THAN THE OWNER OF THE BOAT RAMP USES THE BOAT RAMP IF THE LOGIC THERE IF YOU FOLLOW THAT LOGIC SO MY FATHER ONCE TOLD ME TO STOP TALKING WHEN I WAS FINISHED SO I THINK I'LL STOP. I THINK I'VE MADE ENOUGH POINTS .
WE WANT TO CONSIDER WHAT ACTION THEY WOULD LIKE TO TAKE GOING FORWARD IS THERE ANYONE ELSE WHICH IS GOING TO MAKE A MOTION MR. MCCAIN'S OFFER OF A SOLUTION THAT MEETS NOT ONLY LEGAL REQUIREMENTS IN THE STATE BUT THE GENERALLY THE LENGTH OF THE COUNTY TO RESPECT PRIVATE PROPERTY OWNERSHIP. WELL, WE'LL SEE. SO AND I THANK YOU FOR OFFERING US WAY OUT AND I THINK WHAT IT ENTAILS REALLY IS THAT WE DELAY A FINAL VOTE ON THIS AND HAVE THIS MATTER RETURNED AFTER A BREAK CONSIDERATION OF THE PUBLIC SAFETY COMMITTEE AND RETURN WITH AN AMENDED ORDINANCE SPELLS EXACTLY WHAT OUR OPTIONS ARE, WHAT THE OPTIONS TO THE PUBLIC ARE. AND SO I'M WONDERING IF PERHAPS YOU WOULD OFFER A MOTION POSTPONE IN RETURN FOR SECOND READING AFTER RECONSIDERATION BY THE COMMUNITY SERVICES COMMITTEE. WELL, THIS THIRD READING LIKE THIS BEFORE WELL RIGHT.
AND YOU CAN MAKE A MOTION TO RETURN IT TO YOUR COMMITTEE. I WASN'T MAKER I WAS JUST COMMENTING IN THE DISCUSSION STAGE IF MR. PLURAL MAKES THE MOTION I'LL GO AHEAD AND MAKE THOSE STARTED. WE RETURN THIS MATTER TO THE THE COMMUNITY SERVICES OR EXECUTIVE COMMITTEE FOR RECONSIDERATION AND AMENDMENT OF THEIR PROPOSED ORDINANCE BE MORE IN COMPLIANCE STATEMENT SO SECOND COMMENT ON AN EVENT WELL LET'S MAKE SURE WE HAVE THE CORRECT LANGUAGE WE'RE POSTPONING ACTION SO WE HAVE TO HAVE A SPECIFIC DATE AS TO WHEN WE'RE POSTPONING THIS REFERRAL TO A COMMITTEE THAT'S NOT REALLY REQUIRED.
ALL RIGHT. WE WANT TO REFER THIS BACK TO COMMUNITY SERVICES COMMUNITY.
THAT'S CORRECT UNDERSTANDING SO THAT IT WILL BE RETURNING TO US SECOND READING AT THAT TIME.
OKAY. WELL, MR. FOLEY MADE THE MOTION AND MR. GLOVER MADE, 2 SECONDS.
IS THERE ANY DISCUSSION REGARDING THIS? I WOULD LIKE TO CLARIFY WHETHER IT'S SECOND AND THIRD READING PRESENTED THE THIRD READING TONIGHT I ASSUME THAT WITH MAJOR CHANGES CIRCLES WE CAN DEAL WITH THAT YEAH WE'LL WE'LL PROBABLY HAVE TO BRING IT BACK FOR TO READING TO THE COUNCIL MEMBERS TO ALAN'S POINT AND YOU DO THE PUBLIC HEARING AND ALL THAT BECAUSE IT'LL BE SIGNIFICANT IT'LL BE A SIGNIFICANT REWRITE WHAT WE'VE CURRENTLY PRESENTED TO YOU I WOULD LIKE MAKE ONE OTHER STATEMENT FOR THE COUNCIL JUST FOR THEIR KNOWLEDGE THAT IT'S VERY LIKELY THAT THE COMMITTEE STRUCTURE MAY CHANGE IN THE NEW YEAR. SO EVEN THOUGH IT'S BEING REFERRED TO THE COMMUNITY SERVICES COMMITTEE TONIGHT, THERE IS A POSSIBILITY THAT THAT MAY NOT BE WHAT THE COMMITTEE CALLED IN JANUARY. OKAY. MR. CUNNINGHAM YEAH.
WHEN THIS ORIGINALLY GOT PUSHED BACK TO THE COMMITTEES I WAS ON THAT MOTION BECAUSE I WAS AWARE THAT IT WAS ILLEGAL AND WITH THE HOPES OF FINDING A WAY TO GET THIS PASSED THE RIGHT WAY LEGALLY HERE IN OUR COUNTY IN SOUTH CAROLINA THAT GOT PUSHED BACK TO THE COMMITTEE WE GOT THE INFORMATION AND IT CAME BACK IN HOW IT IS ILLEGAL AND NOT ONLY THAT WE GOT A DOLLAR AMOUNT WHICH A LOT OF US REQUESTED AND IT'S GOING TO BE SOMEWHERE BETWEEN 5 TO $10 MILLION BASED ON NUMBERS WE WERE GIVEN. WITH THAT SAID, IF WE'RE GOING TO HAVE THAT MUCH OF A MAJOR STRUCTURE. DOESN'T IT JUST MAKE MORE SENSE TO SHOOT THIS DOWN NOW AND RESTART FROM THE GROUND UP AND SEE WHICH ROUTE TO GO BECAUSE WE HAVE A LOT DIFFERENT TYPES OF PROPERTY. WE HAVE HEIRS PROPERTY, WE HAVE
[00:40:01]
COMMUNITIES THAT ONE ROAD THERE'S A LOT OF DIFFERENT OTHER AVENUES WE CAN TAKE IT IT MIGHT NOT BE A ONE SHOE FITS ALL IT MIGHT BE TWO OR THREE DIFFERENT ORDINANCES FOR DIFFERENT TYPES OF PROPERTIES AND I DON'T SEE HOW THAT GETS DONE THIS ORDINANCE AND I KNOW THE AMOUNT OF TIME AND EFFORT THAT'S PUT IN THIS PROJECT AND I THINK THERE'S A LOT OF GOOD PIECES IN IT THAT WE CAN USE AS BUILDING BLOCKS BUT I DON'T SEE HOW ONE WE'RE COMING OUT THE FINDING THAT IF WE USE PUBLIC DOLLARS THAT THIS IS GOING TO BE LEGAL OTHER THAN THE ORDINANCES WE ALREADY HAVE PUT IN PLACE HOW WE CAN MAKE AN INFRASTRUCTURE WHERE THIS EVEN COMES BACK TO THE COUNCIL SO I'M GOING TO VOTE AGAINST IT. I THINK IT SHOULD BE TURNED DOWN TODAY AND I IT SHOULD BE PUT BACK TO THE COMMITTEE AND WE SHOULD COME UP WITH A SOLUTION FOR SPECIFIC TYPES OF ROADS THAT WHERE WE'RE TALKING AND THE OTHER COMMENTS AND THINGS TO I YOU KNOW, I APPRECIATE THE MOTION THAT BRIAN IS OFFERED TO SUPPORT THE MOTION. I WOULD ALSO LIKE TO ADD TO THAT AT THIS ORDINANCE TO NOT DEAL WITH ALL PRIVATE ROAD IN COUNTY YOU ONLY DEALT WITH ROADS THAT WAS THAT WAS NECESSARY FOR EMERGENCY PURPOSES SO THAT IS PROVIDED BY THE PART WE REFUSE TO GO DOWN A ROAD BECAUSE OF MAINTENANCE OF THE ROAD THEN THE COUNTY WOULD STEP IN IF THE AMBULANCE SERVICES DECIDED THAT THE RULE WAS TOO IT WAS IMPASSABLE WOULD REFUSE TO GO DOWN THERE.THEN THE COUNTY WOULD STEP IN TO TAKE ITS CITIZENS YOU KNOW, GO TO LITTLE FURTHER HOME HEALTH ALSO SEE ISSUES AROUND THESE ROADS ON A REGULAR BASIS AND THEY ARE REFUSING TO GO DOWN THESE ROADS BECAUSE OF THAT. SO IT'S BECOMING MORE AND MORE OF AN HEALTH ISSUE FOR OUR CITIZENS. EVERY CITIZENS IN COUNTY DO NOT NEED MAINTENANCE IN THE COUNTY WOULD NOT BE MAINTENANCE ON ALL ROADS OF PRIVATE.
THERE ARE SOME ROADS THAT THE OWNER REQUESTED FOR THE COUNTY TO TAKE OVER BUT EVERYBODY DOWN THAT ROAD HAS TO ASSIGN THAT THAT RIGHT AWAY AND THEY'RE REFUSING TO DO THAT.
SO IT MAKES IT VERY DIFFICULT BUT YET THE SERVICES HAS TO HAVE TO BE PROVIDED FOR THE CITIZEN. IT'S REALLY I KNOW IT WOULD BE PERCEIVED AS BEING AGAINST THE LAW BUT SOMETIMES YOU HAVE TO HAVE THE COURAGE STAND UP AGAINST A LAW THAT'S NOT WORKING FOR YOU AND I'M ONE OF THEM DOING THIS UNIT NOW I ALSO WOULD GO FURTHER I SEE THAT WE DO HAVE AN ASSET TO WHAT IT WAS WORTH AND THAT OF A COUNCIL MEMBER WHO SEES SOME OF THIS ORDINANCE. MR. NEWTON IS NOW THE CHAIRMAN OF THE JUDICIARY COMMITTEE AND . HE MAY BE ABLE TO HELP US NAVIGATE THIS.
I DON'T KNOW. BUT IF WE ALLOW THAT TO HAPPEN AND TO CHOOSE TO SEEK OUT FOR THE RESOURCES WE MAY COME BACK WITH SOMETHING THAT WE CAN GIVE TO OUR CITIZENS THAT ARE IN NEED OF THIS MAINTENANCE AT THIS TIME AS CHAIRMAN JUST THIS WITHIN THIS BODY NUMEROUS TIMES AND IT HAS BEEN SENT BACK TO COMMUNITY SERVICES AND I WAS PART OF THAT DISCUSSION IN THE SERVICES I DON'T REMEMBER WHO WAS PRESENT AT DISCUSSIONS BUT I THINK COMMUNITY SERVICES HAVE DONE JUST THAT THEY CAN DO WITH THIS ORDINANCE AS IT'S CURRENTLY CONFIGURED.
I'M GOING TO VOTE AGAINST POSTPONING IT BECAUSE I DON'T THIS ORDINANCE AS IT'S CURRENTLY CONFIGURED CAN BE CAN BE FACED. I THINK IT'S GOING TO HAVE TO I THINK I THINK IT'S GOING TO HAVE TO START FROM SCRATCH AND THINK I CERTAINLY WOULDN'T WANT TO DO ANYTHING THAT WOULD DEPRIVE THE NEW COUNCIL OF AN OPPORTUNITY TO TAKE THIS.
BUT I THINK YOU'RE GOING TO TO TAKE A TO A DIFFERENT PERSPECTIVE.
I THINK WE GOT OFF WE GOT OFF ON THE ROAD TO NOWHERE HERE. SO I'M GOING TO I'M GOING TO VOTE NO ON THE MOTION TO POSTPONE IT AND. MR. DAWSON YES, I, I HEAR ALL THAT HAS BEEN SAID AND I CONCUR WITH THE FACT THAT MAYBE POSTPONEMENT IS THE TO GO
[00:45:03]
TEMPORARILY. BUT I SAY TO COUNCIL AS A WHOLE THAT WE HAVE A SITUATION ON HAND WHERE WE PUT THE ADMINISTRATOR AND HIS STAFF IN A IN A TERRIBLE SITUATION WHEN AN EMERGENCY DOES ARISE AND WE CAN PROVIDE THE SERVICE THAT ARE NEEDED ON THESE PRIVATE ROADS, I'LL GIVE YOU A PRIME EXAMPLE. ABOUT TWO YEARS AGO WE HAD IT WASN'T A HURRICANE OR JUST A AND THERE WAS A PRIVATE RAMBLIN ROSE WHERE A TREE FELL ACROSS THE ROAD TO WHERE THE ALL THE HOMES THAT WERE ON THE ROAD COULDN'T GET OUT OF THE ROAD TO GIVE TO ACCESS TO MAIN HIGHWAY TO ACTUALLY GO TO WORK GO SHOP GO TO DO ANYTHING THEY COULDN'T GET OUT AND SO I, I EMAILED THE COUNTY AND PUBLIC WORKS DIRECTOR DESIGN AND ASKED BOTH OF THEM TO TAKE A LOOK AT THIS AND GET THESE FOLKS ON THAT ROAD SOME RELIEF.NEIL DECI RESPONDED AND SAID THAT PRIVATE OWNED PROPERTY AND THE COUNTY CAN'T DO CAN'T PERFORM ANY WORK ON PRIVATE ROADS AND SO AFTER TWO DAYS OF THOSE PEOPLE NOT BEING TO GET OUT OUT OF THERE ON THEIR ROADS THEY CALLED THE CHANNEL 11 NEWS FOLKS W T C AND THEY BROUGHT CASC IT BROADCAST ON LIVE TELEVISION. IT WAS AFTER THAT BROADCAST THAT A COUNTY ADMINISTRATOR TOOK AN EFFORT TO INFORM OUR PUBLIC WORKS DEPARTMENT TO ACTUALLY GO AND REMOVE THAT TREE SO IF THOSE FOLKS GET OUT OUR ROAD NOW I SAID ALL OF THAT JUST TO SAY IT SHOULDN'T HAVE EVER HAD TO COME TO THAT POINT WE HAVE TO DO SOMETHING WE GOT TO PUT SOMETHING IN PLACE TO DEAL WITH THIS SITUATION BECAUSE IF WE DON'T THE COUNTY ADMINISTRATOR AND COUNCIL WHERE WE'RE GOING TO BE SUED AT SOME POINT BECAUSE OF THESE PRIVATE ROADS BECAUSE OF AN EMERGENCY SITUATION WE DON'T GIVE THEM THE ASSISTANCE THAT ARE NEEDED . SO I, I SAY THAT RATHER WE VOTE THIS DOWN RATHER TO POSTPONE BUT WHATEVER DO WE NEED TO PROBABLY ASK OUR LEGAL STAFF THE ADMINISTRATOR, OUR LEGAL STAFF TO CONFER WITH OUR STATE LEGISLATORS TO SEE WHAT ASSISTANCE THEY CAN GIVE US ABOUT THIS. BUT WE HAVE TO HAVE SOME MEASURE IN PLACE TO WHERE WE CAN WITH THIS SITUATION. OTHER THAN THAT, OUR EMERGENCY SERVICES FOLKS, THEY'RE NOT GOING TO BE ABLE TO ACCESS THESE ROAD THESE PRIVATE ROADS UNDER EXTREME CONDITIONS FOUR WHEEL DRIVE, A FOUR WHEEL DRIVE WON'T DO US ANY GOOD IF YOU CAN'T GET ACROSS A TREE THAT'S BLOCKING THE ROAD. I'M STOPPING NOW. I'M STOPPING THAT.
MR. ROBERT THANK YOU, MR. CHAIRMAN. THIS IS PROBABLY MY HOPE GETS RESOLVED IN DUE COURSE AND I DO THINK IT LENDS ITSELF TO STEPPING BACK TAKING A DEEP BREATH TO FIGURE OUT WHAT CAN HAPPEN BECAUSE WE ARE DEALING WITH FINALLY A STATE CONSTITUTION. SO I AGREE WITH I THINK I THINK WE BETTER BE SERVED TO NOT ONLY THIS BUT TO STEP BACK TAKE A FRESH APPROACH PIECE OF PAPER AND FIGURE OUT IF THERE'S A BETTER WAY TO DO IT. THERE'S CERTAINLY A LOT OF LEGAL DISCUSSIONS IT'S NEEDED SO I POSIT THAT AROUND THIS FOR SOMEONE ELSE IS THERE ANY OTHER ONE WHO HAS NOT SPOKEN YET WOULD LIKE TO SPEAK? YES THIS IS THE FIRST FEW TIMES BUT AFTER ALL THE EVIDENCE, EVERYTHING WE'VE SHOWN PROVES THAT THE COMMUNITY AND I DON'T THINK THIS ORDINANCE IS FEASIBLE SO I WILL BE VOTING AGAINST THAT BUT I DON'T WANT US TO QUIT WORKING ON IT.
OKAY. DID YOU CALL THE ROOM? YES.
WRAP IT UP. WRAP UP. I WANT TO ACKNOWLEDGE WAS THE DOSSIER SAID THAT I CAN ACKNOWLEDGE WHAT HAPPENED THE PAST BUT I'M CERTAINLY NOT BOUND BY IT AND I THINK THAT WAS A TERRIBLE MISTAKE I THINK THAT WAS AN INJUSTICE NOT TO GO DOWN HERE AND MEET YOU ACTUALLY HOWEVER THIS POSTPONING THIS FOR FIVE OR SIX MONTHS DOESN'T DO US ANY GOOD I THINK THIS SHOULD BE DISPOSED OF AND A WHOLE EFFORT SHOULD BE UNDERTAKEN TO FIND A WAY TO IF THERE IS A WAY FOR US TO IMPROVE PRIVATE FOR THE PUBLIC GOOD IN LINE WITH THE LANGUAGE OF THE STATE CONSTITUTION. I DON'T THINK IT'S NECESSARY TO THIS ON THE BOOKS FOR FIVE OR SIX MONTHS. I THINK WE SHOULD JUST CLOSE
[00:50:02]
OUT, DEVELOP THAT COMMITTEE, LET IT DO ITS WORK AND THEY'RE FINISHED COME BACK CAN YOU WITHOUT A DATE CERTAIN AND WE SHOULD CONSIDER ORDINANCE IT IS THAT THEY BRING IN THIS DOESN'T HAVE TO BE ADJUSTED MEANS A WHOLE NEW LOOK AND A WHOLE NEW ORDINANCE I THINK KEEPING THIS OPEN IS REALLY UNNECESSARY. OKAY COULD YOU PLEASE CALL THE ROOM THIS IS ON THE REFERRAL TO THE COMMUNITY SERVICES AND A POSTPONEMENT. YEAH.COUNCILMAN RUSSELL LLEWELLYN. YES. COUNCILMEMBER GLOVER YES.
COUNCILMEMBER CUNNINGHAM NO. COUNCILMEMBER DODSON YES. COUNCILMEMBER MCGOWAN NO.
COUNCILMEMBER LAWSON. MARK LAWSON NO. COUNCILMEMBER HOWARD NO.
COUNCILMEMBER RODMAN NO COUNCILMEMBER I KNOW VICE-CHAIR SUMMERVILLE NO CHAIRMAN PERCENT NO THE MOTION FAILS WE'RE BACK TO THE ORIGINAL THIRD READING OF THE ORDINANCE ANY FURTHER MR. RAHMAN I GUESS EXPAND BRIEFLY CHAIRMAN AND LARRY'S COMMENTS BECAUSE I THINK ALTERNATIVE WAY OF FUNDING THIS IS WHAT'S CALLED A SPECIAL DISTRICT AND ASSUMING THAT A GROUP OF PEOPLE UNANIMOUSLY AGREE TO DO SOMETHING ON STATE LAW IN THE SPECIAL TAX DISTRICT AND ESSENTIALLY THE WAY IT IS PEOPLE DRAW A BOUNDARY AROUND WHATEVER IS IN THIS CASE WOULD BE THE ROAD AND WE TO MECHANISMS TO GO FORWARD IF 75% OF THEM BASED ON A PROPERTY VALUE BASIS AGREE CAN DO IT BY PETITION IF 15% OF THEM WANT TO HAVE AN ELECTION THEY CAN PETITION THE COUNTY TO CONDUCT THAT ELECTION AND THEN WHEN THE ELECTION IS CONDUCTED IF THERE'S A MAJORITY THEN ALL OF THEM GO ALONG. SO FOR EXAMPLE 60% OF THE PEOPLE AGREED AND 40% DIDN'T DO IT ALL END UP PAYING YOU WOULD GO THROUGH THE TAX RULES AND IT CAN BE DONE IN A WAY THAT IT CAN BE SPREAD OUT OVER MULTIPLE YEARS.
SO THERE IS THERE IS A GOOD WAY TO DO IT HUNDREDS OF THESE AROUND THE STATE AND STATE CONSTITUTION AND THE STATE STATUTES PROVIDE FOR THE COMMONS.
YES, MR. GLOVER, APPRECIATE MS. TO MR. RAMA MAKING THOSE COMMENTS IS JUST TRYING TO SKEW THIS AND WE HAVE BOOKS 15 AND 17 THAT THE CHAIRMAN OF THE COMMUNITIES WAS SO ELOQUENT HE GAVE US TO READ AND I DO NOT BELIEVE THAT ANYBODY IN THIS COUNTY AND IT'S TRUE ALL I THINK IS THIS TO HAVE THEM THINGS THAT HAVE A ONE HAND ACTUALLY TO CREATE THOSE SPECIAL TAX DISTRICTS IT'S A LAW BUILT IN THE ORDINANCE HERE AT THE STATE LEVEL IN THE COUNTY LEVEL THAT ARE REALLY FOR THOSE WHO HAVE NEEDS AND THOSE THAT DO NOT MEANS A LIFT OUT. IF I HAD THE RESOURCES I CAN DO EXACTLY WHAT'S IN PIECE 15 AND 70 FOR MY FOR MY COMMUNITY FOR MY NEIGHBORHOOD FOR MY ROLE MOST OF CITIZENS IN MY DISTRICT CANNOT AFFORD TO DO THAT NOR WOULD THEY EVER KNOW WHO ACTUALLY WILL BE RESPONSIBLE OTHER THAN THE TAXPAYER AT THIS TIME BECAUSE OF IS PROPERTY AND SOME OTHER MEANS.
SO I SAY THAT TO SAY WE NEED TO TRY TO PROVIDE SERVICES TO THE LEAST AMONG US AND THAT'S THE ONLY THING I'M ADVOCATING I DON'T NEED TO MYSELF BUT IS THE LEAST AMONG US THAT'S ALL.
THANK OKAY. WOULD YOU PLEASE CALL ROLL? WE'RE VOTING ON THIRD READING OF THE ORDINANCE YES MEANS THAT WE WANT TO GO FORWARD WITH AN ORDINANCE THAT BEEN DEEMED ILLEGAL COUNCILMEMBER FLUE ELLING YES. COUNCILMEMBER GLOVER YES COUNCILMEMBER CUNNINGHAM NO COUNCILMEMBER DAWSON NOW COUNCILMEMBER MCGOWAN

ONE DAY HE GAVE ME AN ASSIGNMENT TO DO AND I THOUGHT I DID PARTICULARLY WELL AND I WAS VERY PROUD OF WHAT I'D DONE AND SO I WAS I WAS DOING WHAT YOU SHOULD NEVER DO. I WAS PUSHING FOR A COUPLE AND
