I HAVEN'T CHANGED MY POSITION ON THE FOLLY OF THESE AMENDMENTS TO THE PALMETTO BLUFF, UH, DEVELOPMENT AGREEMENT IN THE YEAR.

IT HAS BEEN DELIVERED BY TOWN COUNCIL.

THE PLANNING COMMISSION AND YOUR COMMITTEE ARGUMENTS TO THE ENVIRONMENTAL IMPACTS ARE OVERWATER FUELING AND RUNOFF FROM 35,000 SQUARE FEET UP A ROOF ABOVE THE PROPOSED DRY STACK STORAGE HAVE BEEN MADE IN NUMEROUS FORMS. THERE HAS BEEN NO SERIOUS DISCUSSION IN PUBLIC MEETINGS OVER THE LAST YEAR ON THE GROSSLY OVERSIZED MARINA CONCEPT PLAN, WHICH WOULD BRING 899 DODS TO THE SOUTHERN ROUGH.

A MASSIVE COVERAGE OF MARSA HABITATS WITH THE PROPOSED DOCKS AT THE BIG HOUSE TRACK IN THE IMPACTS OF 170 WET SLIPS ON THE NEW RIVER ESTRING SYSTEM AND EFFECTS OF BRINGING OCEAN GOING VESSELS UP FROM THE INTERCOASTAL WATERWAY FOR REFUELING THAT ANSWER IN THE LIGHT OF WHERE WE ARE ON OCTOBER 4TH, 2022 JUST AFTER BEING MISSED BY HURRICANE IN 17 YEARS AFTER THE CORE OF ENGINEER GAVE THE DEVELOPER A PERMIT APPROVAL FOR THE ANSEN COMPLEX, WHICH HAS NOT BEEN REVIEWED OVER 20 YEARS OF WPA GROWTH IN SOUTHERN BEFORD COUNTY.

THESE AMENDMENTS SHOULD BE FIRMLY DENIED.

SECOND POINT, I THINK IS, UH, UH, BEHALF OF THE MEMBERSHIP.

FIRST POINT IS IN THE RESPONSE THAT, UM, THE DEVELOPERS MADE BACK TO YOUR QUESTIONS.

THERE WERE 13 QUESTIONS.

QUESTION NUMBER 13 WAS AROUND THE CAPITAL STRUCTURE FINANCIAL BACKING.

IN THE RESPONSE THEY TELL YOU THAT THE CAPITAL IS PERMANENT.

UM, THERE'S MANY OF US WHO'VE BEEN INVOLVED IN THE PRIVATE EQUITY WORLD.

I'M PERSONALLY HAVE INVESTED IN, I THINK I COUNTED THEM LAST NIGHT, 27 DIFFERENT PRIVATE EQUITY PARTNERSHIPS OVER THE LAST 25 YEARS AND NEVER HAVE ANY OF US EVER SEEN SOMETHING THAT SAYS PERMANENT CAPITAL.

SO I WOULD JUST URGE THE COMMITTEE TO SEEK, UM, AFFIRMATION THAT SIMPLY TAKING AN ASSERTION, UM, FROM THE DEVELOPERS OR THEIR LAWYER, I DON'T THINK IS ENOUGH.

I THINK, UH, MANY OF US KNOW THAT THE ORIGINAL BUSINESS PLAN CALLED FOR AN EIGHT YEAR HOLD.

WE'RE ALREADY TWO YEARS INTO THAT HOLD.

UM, SO THIS PRESUMPTION OF PERMANENT CAPITAL, I THINK YOU JUST NEED TO, YOU KNOW, SATISFY, UM, AND GET TO THE TRUTH ON THAT QUESTION.

SECOND POINT, AND THIS IS MORE ON BEHALF OF, OF THE MEMBERSHIP, IS IT'S REALLY TOUGH TO TRACK THE NEGOTIATING COMMITTEE SCHEDULES.

AGAIN, MY PARTICULAR CONCERN IS WHETHER POST PROJECT, THERE ARE ANY CONTINUING INSURANCE AND BONDING REQUIREMENTS IN THE EVENT THAT WE HAVE A SERIOUS STORM AND THERE IS DAMAGE.

WE'VE SEEN WHAT'S HAPPENED AT SANDAL ISLAND AND HOW THAT BRIDGE HAS BEEN DESTROYED AND HOW THE DAMAGE IS ENORMOUS.

AND I DON'T THINK THAT ANY OF US IN THE TOWN AS A WHOLE OR IN DEPARTMENTAL BLUFF WANT TO BE FACED WITH THE SITUATION WHERE WE WIND UP PAYING THE FREIGHT FOR A PRIVATE DEVELOPMENT WHERE THEY HAVEN'T GOT ADEQUATE ARRANGEMENTS IN PLACE FROM BOTH AN INSURANCE AND A BONDING PERSPECTIVE.

I LIVE AT 5 8 27 GCO LANE IN BLUFFTON AND PRETTY MUCH WHAT HE JUST SAID, UM, WE GOTTA KEEP IN MIND WHEN WE'RE CONTEMPLATING EXPANDING MARINA OPERATIONS ON OUR SENSITIVE WATERS HERE.

UH, THE IMAGES THAT WE'RE LOOKING AT THAT ARE COMING IN RIGHT NOW FROM FLORIDA AND THE DAMAGE THAT WAS DONE DOWN THERE FROM THE SAME HURRICANE THAT WE JUST DODGED, WE GOT BOATS STACKED ON TOP OF BOATS, BOATS STACKED ON THE, UH, SHORELINE.

ALL THE WATERFRONT PROPERTIES PUSHED BACK, ROLLED OVER.

UM, WHAT WE CAN'T SEE IS THAT THE FUEL AND THE OIL AND THE WASTE FROM ALL THOSE VESSELS DOWN THERE ARE IN THE WATER AND A LOT OF THOSE, UH, MARINE OPERATIONS HAVE PUMP OUT, LARGE PUMP OUT OPERATIONS WITH FUELING STATIONS AND, UM, FUEL LINES.

I DON'T KNOW IF THEY HAD FUEL LINE RUPTURES, BUT I CAN'T IMAGINE THAT THEY DIDN'T.

THE THE DIFFERENCE BETWEEN THERE AND HERE IS THAT THOSE POLLUTANTS GO INTO BIG WATER IN FLORIDA.

WHAT WE'RE TALKING ABOUT HERE IS THE SAME KIND OF DISASTER THAT POLLUTANTS WOULD GO INTO OUR ESTUARIES, THE INCUBATORS FOR MARINE LIFE, THAT IS WHO DIFFERENT, IT'S A COMPLETELY DIFFERENT SCENARIO.

AND IF FOR SOME REASON THIS COMMITTEE BELIEVES THAT IT'S, IT'S A GOOD IDEA TO EXPAND MARINA OPERATIONS IN OUR ESTUARIES, THEN I WOULD ALSO THINK THAT IT'D BE, YOU'D HAVE TO INSIST ON ALL THE GUARDRAILS BEING IN PLACE.

THINGS LIKE THE UH, DRY STACK MARINA CAP FIVE RATED, ALL OF THE SERVICE LINES GOING ON.

UH, WHARFS THE FUEL WATER POWER WASTE ALL HAVE AUTOMATIC SHUTOFFS.

THE, UM, THE, THE OTHER GENTLEMAN JUST MENTIONED THAT, UM, THE INSURANCE, THE OWNER OPERATORS OF THIS FACILITY SHOULD HAVE A BOND IN PLACE THAT WOULD BE SUFFICIENT TO COVER WORST CASE SCENARIO FOR IMMEDIATE AND THOROUGH CLEANUP SO THAT NOT ONE PERSON IN BLUFFTON OR THE COUNTY OF BEAUFORT OR FOR THAT MATTER, FOR THE STATE OF SOUTH CAROLINA, SINCE THIS IS STATE WATERWAY, WOULD HAVE TO PAY A DIME WHEN THIS THING GETS WHACKED WITH A HURRICANE AND IT WILL EVENTUALLY.

I WORK FOR THE COASTAL CONSERVATION LEAGUE.

OUR OFFICE IS AT, UH, 1212 KING STREET AND AT IN BEAUFORT.

UH, THE COASTAL CONSERVATION LEAGUE HOLDS THE POSITION THAT THE ENVIRONMENTAL IMPACTS OF THE REQUESTED CHANGES TO, TO THE PALMETTO BLUFF DEVELOPMENT AGREEMENT WILL HAVE A RIPPLE EFFECT WHICH TRANSCENDS THE GATES OF THE COMMUNITY, THE LEAGUE EMPLOYERS, THE DEVELOPERS TO DEPLOY A MORE HOLISTIC OUTREACH STRATEGY TO BETTER ASSESS CONCERNS RAISED AND IMPACTS TO STAKEHOLDERS IN SURROUNDING COMMUNITIES.

TO DATE, NO SUCH PUBLIC ENGAGEMENT HAS OCCURRED DESPITE TOWN COUNCIL AND THIS COMMITTEE'S SPECIFIC, SPECIFICALLY REQUESTING IT OUT OF SOUTH STREET PARTNERS.

MANY STAKEHOLDERS FROM VARIOUS DEMOGRAPHICS USE THE NEW RIVER WATERSHED FROM COMMERCIAL ANGLERS TO ECO-TOURISM COMPANIES TO RECREATIONAL USERS WHO FISH BOAT AND ENJOY WILDLIFE VIEWING.

THESE COMMUNITY MEMBERS SHOULD BE CONSULTED SINCE THEIR LIVELIHOODS AND QUALITY OF LIFE ARE AT STAKE AND COULD BE ADVERSELY IMPACTED BY ALLOWING OXIDE FUELING AT A NEW MARIN.

NEW MARINA ON THE NEW RIVER MARINA ARE NOT CLEAN PLACES BECAUSE THEY OBSTRUCT REGULAR TIDAL FLUSHING, ALLOWING CONCENTRATED CONTAMINANTS TO SINK TO THE BOTTOM WHERE THEY CAN THEN ENTER THE FOOD CHAIN.

THIS MEANS CHEMICALS FROM BOAT CLEANING PRODUCTS, ANTI FOULING PAINTS FUEL AND ENGINE OIL AND OTHER NUTRIENTS AND INTOXICANTS POLLUTE ARE SHARED NATURAL RESOURCES.

THIS IS ESPECIALLY CONCERNING UH, HERE, GIVEN THE SIGNIFICANT NATURAL MEANDERING OF THE NEW RIVER, THE SCALES ARE UNBALANCED IN THIS DEAL.

ADDING AN ADDITIONAL DRY STACK AND DOCKSIDE FUELING THREATENS A PUBLICLY SHARED RESOURCE FOR THE GAIN OF A PRIVATE ENTERPRISE, WHICH IS ALREADY WELL UNDERWAY IN BUILDING OUT THE SUBSTANTIAL ENTITLEMENTS GRANTED IN THE DEVELOPMENT AGREEMENT, INCLUDING THE CONSTRUCTION OF A NINE HOLE GOLF COURSE.

OVER UH, 2,500 PEOPLE SIGNED A PETITION WHICH CITED HOW THESE AMENDMENTS CONTRADICT THE ENVIRONMENTAL ETHOS THAT GUIDED THE ORIGINAL 1998 DEVELOPMENT AGREEMENT.

THERE'S CLEARLY SUBSTANTIAL PUBLIC INTEREST AND CONCERN OVER THIS PROJECT, WHICH DESERVE ATTENTION AND MEANINGFUL MITIGATION FOR ANY COMMUNITY AND ENVIRONMENTAL IMPACTS.

THE CONSERVATION LEAGUE URGES THE COMMITTEE TO UPHOLD THE UNANIMOUS DENIAL RECOMMENDATION FROM THE PLANNING COMMISSION.

HOWEVER, IN THE EVENT NEGOTIATIONS ARE CONSIDERED, WE RECOMMEND THAT THE MAXIMUM NUMBER OF WET SLIPS OF BIG HOUSE ANSEN SHOULD BE REDUCED SIGNIFICANTLY, EVEN 50 SLIPS IS A SIGNIFICANT SIZE MARINA AT THIS LOCATION.

WE FURTHER RECOMMEND COMMITMENT TO PERMANENT PROTECTIONS FOR LONG AND DOUGHBOY ISLANDS, WHICH PROVIDE CRITICAL STORM PROTECTION AND MIGRATORY BIRD HABITAT.

UM, I'VE HAD MANY OPPORTUNITIES TO SPEAK AND OPPOSITION TO THIS AND MY OPPOSITION REMAINS UNCHANGED, AS DOES THAT OF

I WAS SURPRISED, HOWEVER, TO SEE 62% OF THEM THOUGHT THAT IT WAS BENEFICIAL TO HAVE JEWEL OVER WATER.

I WONDER WHERE THEY GOT THAT INFORMATION AND WHOSE BENEFIT THEY WERE TALKING ABOUT.

I SAW ALSO THAT THEY HAD THEIR CONSERVATION GROUP SPEAK.

I WONDERED IF THEY HAD ANOTHER ENVIRONMENTAL GROUP THAT WAS NOT FUNDED BY SOUTH STREET PARTNERS SPEAK TO THEIR, UM, RE OWNERS AND RESIDENTS DOWN IN THERE.

SO BOTTOM LINE IS, I'M STILL AGAINST IT.

HOW GREAT IS IT TO LIVE HERE? THIS WATERSHED IS ONE OF THE HEALTHIEST IN THE WORLD.

PEOPLE ARE INTOXICATED BY THE WONDERS OF THIS NATURE.

OUR ANCESTORS DEVOTED THEIR TIME, MONEY, AND CONTRIBUTED THEIR LAND TO THE PROTECTION OF THE WATERSHED.

THINK ABOUT THAT.

THIS IS A MIRACLE OF SURVIVAL.

NOW THINK ABOUT THE MEADOWLANDS IN NEW JERSEY, THE OTHER TITLE SHED, IT'S GONE OIL REFINERS SHIPYARDS, TI RIVERS GONE TO ACCOMMODATE ONE GIANT DUMP.

THE PLANNING COMMISSION UNANIMOUSLY VOTED NO ON NOVEMBER THE NINTH, 2021 BASED UPON THE AGREED DOCUMENTS, ENVIRONMENTAL CONCERNS AND DENSITY.

YOU AS A NEGOTIATING COMMITTEE ARE, ARE NOT REQUIRED TO NEGOTIATE YOUR STANDARD OF CAREAWAY WITH ANY DEVELOPER.

THE ORIGINAL DEVELOPMENT AGREEMENT DEALT WITH DOCKS AND WATER ISSUES.

MIKE HUGHES OF THOMAS AND HUTTON, WHO I'M SURE IS A FINE LAND ENGINEER, WAS ASKED ABOUT DREDGING BOAT TRAFFIC AFFECTS ON ESTUARIES POLLUTION AROUND ANSON AND LONG ISLAND.

BUT MY CUES IS NO MARINE ENGINEER, HE'S NO BIOLOGIST.

SOUTH STREET PARTNERS ARE NOT TRAINED TO SPEAK ON THE EFFECTS OF WATER SPILLAGE POURING OFF ROOFS AND CONCRETE FROM 900 HOUSES AND 3000 RESIDENTS.

WHAT HAPPENS TO THE WATER RUNOFF THAT POURS INTO THE NEW RIVER THAT ALTERS THE PH LEVELS, THE SPAWNING GROUND, CRITICALLY SENSITIVE RIVER, IT DIES AND IT DIES QUICKLY.

THERE ARE PLENTY OF LARGE MARINAS, PLENTY OF ACCESS TO FUEL.

WHY RISK A TIDAL SURGE LIKE THE ONE WE HAD IN FLORIDA IN THE EN IN THE ENVIRONMENTAL LIABILITY? ARE THEY GONNA HAVE A A FIREBOAT DOWN THERE AROUND THAT ARENA? THINK ABOUT IT.

WHAT IF THERE'S A FIRE DOWN THERE? ARE THEY REQUIRED TO HAVE A FIREBOAT IN THAT AREA? ARE THEY REQUIRED TO HAVE FIRE TRUCKS RIGHT THERE, RIGHT IN THAT AREA THERE? THINK ABOUT THAT.
