HISTORICALLY WE AS THE TOWN HAVE ADOPTED THE COUNTY'S ANIMAL CONTROL CODE SO THAT THE COUNTY'S ANIMAL CONTROL OFFICERS HAVE ONE SET OF ORDINANCES TO ENFORCE COUNTY WIDE RATHER THAN POTENTIALLY HAVING TO CHANGE AS THEY GO IN AND OUT OF JURISDICTIONS WITHIN SOME OF THE OTHER CAPACITIES.
RECENTLY THE COUNTY INSTITUTED SOME CHANGES TO THEIR CODE . THEY'VE BEEN REACHING OUT TO THE MUNICIPALITIES AFTER THAT POINT IN TIME TO LET US KNOW OF THOSE CHANGES.

AND IN THAT CASE I WOULD RECOMMEND THAT THE COMMITTEE JUST POSTPONE TAKING ANY ACTION ON IT WITH A DIRECTIVE FOR STAFF TO COME BACK WITH THAT LANGUAGE OR IF YOU UNDERSTAND WHAT KIND OF THE IMPLICATIONS ARE THAT YOU KNOW BY ADOPTING THE UPDATES BOTH HERE AT THE COUNTY LEVEL AND UNDERSTANDING WHAT THE LANGUAGE IS AT THE STATE LEVEL THAT THE ABILITY TO HAVE A DOG OFF THE LEASH MAY NOT BE ALLOWED ANY LONGER THAN WE WOULD JUST BRING IT FORWARD AS IT CURRENTLY IS. PART OF IT DEPENDS UPON KIND OF WHAT THE THOUGHT OF THE COMMITTEE IS. AND IF I MAY ADD JUST TO PLAY IT OUT RIGHT NOW THE TOWN OF HELENA HAS CLEARLY ADOPTED THE PREVIOUS ORDINANCE.THE THINGS THAT I BROUGHT FORWARD TODAY SUCH AS THE LESSER INCLUDED DANGEROUS DOGGED DETERMINATION THE MOVING OF REQUIREMENTS FOR A DANGEROUS DOG, ANYTHING TO DO WITH THE HURRICANE. WE CAN'T IMPLEMENT THOSE UNTIL THIS IS PASSED.
AND AGAIN, I'M JUST MAKING SURE THAT'S VERY CLEAR BECAUSE THERE HAVE BEEN SITUATIONS THAT HAVE OCCURRED WITH OUR OFFICERS WHERE THEY WOULD LIKE TO PROVIDE NOT THE DANGEROUS DOG BUT A NUISANCE TICKET AND THEY DON'T HAVE THE ABILITY TO DO SO.

BUT THAT WOULD AGAIN HAVE TO BE THE WILL OF COUNCIL THAT FROM A POLICY STANDPOINT YOU WOULD WANT TO TAKE THAT ACTION.
