THESE FOLKS ARE SOME OF THE MOST IMPORTANT PEOPLE THAT WE HAVE IN THE ORGANIZATION. THEY WORK TIRELESSLY AND LITERALLY THEY WILL WORK TIRELESSLY BECAUSE THEY ARE SHORT STAFFED AND THEY HAVE TO
[00:10:06]
WORK MULTIPLE SHIFTS. >> SOME SOME WEEKS HAVE NOT EVERY WEEK STANDING BESIDE ME THIS IS JESSE SCOTT WHO IS A LANCE CORPORAL IN OUR DETENTION CENTER HAS BEEN WITH US FOR SIX YEARS AS A PART OF THAT IS RESPONSIBLE FOR THE CARE CUSTODY AND CONTROL OF INMATES.
IN ADDITION TO THAT, HE PROVIDES ASSISTANCE THE INMATES IN CRISIS SITUATION AND ENSURES REFERRALS REMAIN TO GET THE PROPER CARE. HE MAINTAINS SECURITY POSTS AT THE HOSPITAL COURTROOMS AND OUTSIDE APPOINTMENTS AND PATROLS, HOUSING UNITS AND SECURITY AREAS AND REPORTS CBS SPECIOUS ACTIVITY FAMILIES. THIS IS ON THE VERY UNIQUE WAY.
AND I'M VERY IMPRESSED WITH WITH YOUR THINGS THAT YOU'RE WILLING TO SHARE HERE.
HE IS A NATIVE OF ST. HELENA ISLAND, IS AN AVID GARDENER AND FISHERMAN.
HE HAD TOWN'S FIRST AFRICAN BAPTIST CHURCH WHILE ST. HELENA ISLAND.
AND THERE HE BEGAN THE UNITED COMMUNITY FOUNDATION TO ASSIST SENIOR CITIZENS, LOW INCOME FAMILIES AND YOUTH. HE LATER PARTNERED WITH THREE OTHER CHURCHES IN THE COMMUNITY THE JEHOVAH'S CHURCH OF JESUS CHRIST OF THE NOT SO BAD CHURCH AND THE NASCENT BAPTIST CHURCH TO RAISE MONEY BY DONATIONS, FOOD SALES AND SPONSORING COMMUNITY EXPLOSIONS.
THESE COMMUNITY EXPLOSIONS GAVE THE CHURCHES THE OPPORTUNITY TO ASSEMBLE AND INVITE GUESTS SPEAKERS THROUGHOUT THE COMMUNITY THAT WOULD GIVE INSIGHTFUL MESSAGES TO THE YOUTHS IN HOPES OF OPENING THEIR MINDS TO MAKE POSITIVE CHOICES IN LIFE.
THE MONEY IS COLLECTED IN FROM THESE AMOUNTS ARE USED TO MAKE MINOR REPAIRS TO HOMES IN THE COMMUNITY, CONTRIBUTE TO YOUTH ABOUT GRADUATING SENIORS AND WHENEVER NECESSARY AND HELPING REBUILD THE ST. HELENA COMMUNITY. WE'LL GIVE YOU A CHANCE.
SAY A FEW WORDS. I KNOW THAT THAT'S VERY IMPRESSIVE.
APPRECIATE YOUR SERVICE TO THE COUNTY, TO COUNTY AND YOUR COMMUNITIES.
THANK YOU. FIRST I'D LIKE TO THANK GOD FOR THIS OPPORTUNITY.
I'M A PERSON OF FEW WORDS WHEN IT COMES DOWN TO THIS BUT I LIKE TO THANK THREE PEOPLE THAT'S HERE. WELL FOR THEM BECAUSE THEY MADE MIGHT THINK SHE IS A WHOLE NOT EASY ESPECIALLY AFTER THE PANDEMIC HITS LIKE HE SAID IT WAS KIND OF DIFFICULT OVER THEIR SHOULDER. HOW LONG HOURS AND ALL THAT. BUT ON MY FIRST DAY MY WIFE FOR SUPPORTED ME WHEN I COME HOME AND I'M TIRED AND SHE'S THERE FOR ME ENCOURAGE ME.
KIND OF GREAT ALWAYS. ALSO ENCOURAGING EVEN IF IT'S JUST A SMILE OR A COUPLE OF WORDS TO INSPIRE. BECAUSE WE HAD OUT OUR TEAM. I DON'T THINK I WOULD HAVE BEEN IN BECAUSE IT WAS HARD TO DO THE LAST COUPLE OF YEARS. MY SERGEANT SERGEANT BUSH
ALWAYS PUSH US TO DO BETTER. >> ENCOURAGE US. SHOW US THAT SHE CAME AND IT JUST RUB OFF ON US TO CARE FOR ONE ANOTHER. AND I DON'T WANT TO BRAG BUT WE HAVE THE BEST TEAM OVER THERE BECAUSE THE SERGEANT AND MY FRIEND LANCE CORPORAL BOL, HE ALWAYS HAVE SOMETHING TO SAY EVEN WHEN YOU DON'T WANT TO HEAR.
HE JUST GIVES YOU HE'S HE'S A LISTENING EAR. HE'S HE HE SHOW TO BE FRIENDLY TO TO ALL THE TEAM NO MATTER WHAT TEAM IT IS. AND I LIKE TO THANK THE PEOPLE IN BAGHDAD IN WHICH WHICH IS YOU GUYS. I DON'T KNOW WHAT YOU DO BEHIND THE SCENES BUT OBVIOUSLY IF THEY STILL HEAR YOU'VE GOT TO BE DOING SOMETHING GOOD.
SO THANK YOU. THANK YOU AS ALWAYS, CHAIRMAN WILL MAKE A QUICK THING ABOUT
GROUP CORPORAL SCOTT. >> HE'S A VERY INVOLVED PERSON IN THE COMMUNITY AND LET ME
JUST TELL YOU THAT YOU'RE WORKING IN TOO HARD. >> IT'S SIMILAR TO A COMMUNITY ORGANIZATION THAT HE'S BEEN LEADING IS IS NOT AS GOOD AS IT USED TO BE BECAUSE I GOT TO I'LL TAKE THAT INTO CONSIDERATION. ARE NEXT I EMPLOY IN OUR FINAL EMPLOY IS ALSO FROM OUR DETENTION CENTER AS YOU CAN NOT SEE BY THE UNIFORM TRACY BIBLE AS A LANCE CORPORAL BEING WITH US FOR SIX YEARS. AGAIN, HE HAS ESSENTIALLY THE SAME DUTIES AS LANCE CORPORAL SCOTT AND DOES THE SAME THINGS. THEY'RE SOMETHING UNIQUE TO SHARE ABOUT HIM IS THAT HE IS A NATIVE OF PENNSYLVANIA. HE COMPLETED 26 YEARS IN THE
[00:15:03]
ARMY. DON'T TAKE THIS NEXT PART IS IMPRESSIVE AS WELL.IS ACTIVE DUTY SERVICE IN THE MILITARY. LANCE CORPORAL BALLARD JOINED THE PENNSYLVANIA NATIONAL GUARD. HE SERVED HONORABLY UNTIL HIS TRANSFER IN 2012 TO THE SOUTH CAROLINA STATE NATIONAL GUARD. THE UNIQUE THING ABOUT THIS UNIT IS THAT IT'S A VOLUNTEER UNIT WITH NO PAY. SOME OF THE DUTIES OF THE UNIT INVOLVES ASSISTING FLOODS, HURRICANES AND RESUPPLY POINTS OF DISTRIBUTION FOR FOOD AND WATER. HE IS ALWAYS QUOTED AS SAYING I LOVE THE MILITARY.
IT'S IN MY BLOOD. AND DUTY DOES NOT ONLY APPLY IN THE MILITARY.
THANK YOU FOR YOUR SERVICE TO THE COUNTY TO STATE OF PENNSYLVANIA TO YOUR COMMUNITY AND I APPRECIATE. TURNOVER MIKE TO YOU AND LET'S SAY IF YOU WORKED.
>> THANK YOU GENTLEMEN AND LADIES FOR PUTTING ME IN FRONT THIS I REALLY DO APPRECIATE IT AND I ACCEPT IT ON BEHALF OF ALL THOSE PEOPLE THAT WORK AT THE DETENTION CENTER BECAUSE AS FAR AS I'M CONCERNED WE ALL AS YOUR TEAM AND IF YOU'RE NOT THERE TO HELP OUT YOU'RE GOING
TO FALTER. >> EVERYONE HAS TO PULL THEIR WEIGHT AND THEY DO THEIR BEST TO DO SO EVEN WITH US BEING SHORTHANDED AND I ALWAYS HAVE SOME THINGS PEOPLE NEED TO LEARN. I LEARN SOMETHING NEW EVERY DAY.
I'M ONLY 58 SO MANY YEARS GET TO GO. BUT AGAIN I WAS GONNA SAY SOMETHING BUT WHEN THEY SAID THE PRAYER IT BASICALLY SAYS IT ALL.
WE TRY TO WORK HARD. SLOW TO ANGER. WE HAVE TO BE DILIGENT WITH WHAT WE DO AND BE COGNIZANT OF OTHER PEOPLE'S NEEDS AND RESPONSIBILITIES AS WELL AS THEIR ESSENTIAL REQUIREMENTS SO THAT I SAY THANK YOU. THANK YOU VERY MUCH.
>> AS YOU HAVE TWO ADDITIONAL ANNOUNCEMENTS ONE DOES TO LET COUNT ON THE CITIZENS KNOW THAT WE ARE BEGINNING TO IMPLEMENT A NEW PROGRAM HERE AT THE COUNTY REGARDING OUR FLEET IS SOMETHING THAT OUR TEAM HAS BEEN WORKING ON FOR OVER A YEAR NOW.
>> WE HAVE NEARLY 300 VEHICLES IN OUR FLEET. 67 OF THOSE VEHICLES ARE DRIVEN
LESS THAN 5000 MILES A YEAR. >> SO WE ARE PUTTING THOSE INTO A POOL THAT VARIOUS DEPARTMENTS AND VARIOUS EMPLOYEES CAN GRAB INSTEAD OF HAVING INDIVIDUAL VEHICLES ASSIGNED DEPARTMENTS THAT SET OUT IN THE PARKING LOT. WE PROJECT BASED ON THE STUDIES THAT WE'VE DONE REGARDING THIS POOL OF VEHICLES IS THAT THIS IS GONNA SAVE THE COUNTY OVER ONE HUNDRED THOUSAND DOLLARS A YEAR PLUS REDUCE THE AMOUNT VEHICLES THAT WE HAVE TO PURCHASE THROUGH THE BUDGET. SO THAT'S THE FIRST ANNOUNCEMENT SECOND ANNOUNCEMENTS ON TIME A LITTLE BIT ABOUT SOMETHING THAT RECENTLY OCCURRED HERE IN THE COUNTY AND IT IS ONGOING AND THAT'S SOMETHING I FEEL I NEED TO ADDRESS THIS EVENING WITH YOU ALL. AND THAT'S THE PROCESS THAT'S BEEN UNDERTAKEN BY CONSULTANTS WITH OUR PARKS AND REC DEPARTMENT. COUNCIL AUTHORIZED ME MONTHS AGO FUNDING TO HIRE A CONSULTANT TO DO A PARKS AND REC MASTERPLAN THAT HAS RESULTED IN THE FIRST STEPS OF BEGAN AN INVENTORY OF FACILITIES AND INVENTORY OF PUBLIC DESIRES AND COMMENTS. WE RECENTLY COMPLETED FIVE SESSIONS WITH THOSE PUBLIC COMMENTS VISITS AROUND THE COUNTY. THEY WERE ALL WELL ATTENDED.
MANY OF THEM WERE ATTENDED OVER AND OVER BY THE SAME FOLKS. SUE TO HOUSE JUST SPECIFIC INTEREST WITH REGARDS TO RECREATION IMPROVEMENTS THAT THEY'D LIKE TO SEE MADE IN THE
COUNTY. >> I'M HERE TONIGHT TO TELL COUNCIL IS THAT I AM AWARE
OF THE PROBLEMS AND PARKS AND REC. >> I AM AWARE OF THE PROBLEMS
WITH SOME OF OUR FACILITIES. >> I RECENTLY HAD TO SHUT DOWN A POOL BECAUSE DEFERRED MAINTENANCE MAINTENANCE THAT WAS NOT TAKEN CARE OF OVER A PERIOD OF SEVERAL YEARS BY PREVIOUS FOLKS AND THE TROLL TO RECOMMEND ALL FUNDING OPTION TO DEAL WITH THOSE ISSUES.
THAT'S HOURS THE SAFETY SITUATIONS THERE ARE PART OF YOUR FACILITIES AROUND THIS COUNTY THAT ARE IN DISREPAIR THAT HAVE NOT HAD MAINTENANCE ON THEM IN MANY, MANY YEARS.
SOME OF THEM ARE BETTER THAN WHAT YOU ALL ARE BEING REPORTED TO BE IN THE CONDITION.
>> I TOURED ONE OF THEM ON THE DAY THAT YOU RECEIVED AN EMAIL OVER THE WEEKEND WITH MY DEPUTY AND PEELING PAINT AND HAVING TAPE ALMOST HANGING SEALANT AND PARKS DIRECT FACILITY IS NOT A
[00:20:08]
CATASTROPHIC EVENT THAT I'M GOING TO SPEND A LOT OF EFFORT AND PRIORITIZE WHEN I'M LOOKING AT FAILING ROOF STRUCTURES ON POOLS AND OTHER STRUCTURES AROUND THE COUNTY.>> I'M ASKING YOU ALL TO BE PATIENT WITH THE PARKS AND REC STUDY THAT'S ONGOING NOT ASK ME TO DO THINGS IN ADVANCE OF THAT STUDY WANTS TO STUDY IS COMPLETE.
I WILL DO WHAT I ALWAYS DO IS WE WILL GIVE YOU A FULL REPORT OF THAT STUDY AND WE WILL MAKE APPROPRIATE RECOMMENDATIONS THROUGH THE APPROPRIATE PROCESS FOR FUNDING THE RECOMMENDATIONS OF THAT STUDY AFTER WE'VE HAD A CHANCE TO PRIORITIZE THOSE. THERE ARE A LOT OF PRIORITIES IN THE COUNTY RIGHT NOW THAT I'M BEING ASKED TO WORK ON. I'VE GOT TO TRY TO FIGURE OUT
HOW TO FUND AN AIRPORT EXPANSION. >> I'VE GOT TO FIGURE OUT HOW TO DO DEFERRED TAKE CARE OF MAINTENANCE ON ADMINISTRATIVE BUILDINGS AROUND THE COUNTY. I'VE GOT TO FIGURE OUT HOW TO IMPLEMENT A FACILITIES MASTER PLAN AND FIGURE OUT HOW TO KEEP THE COMP CLASSIFICATION CLASSIFICATION THE COMPENSATION STUDY CURRENT AND PROTECT OUR EMPLOYEES. I ALSO HAD TO FIGURE OUT HOW TO DEAL WITH A MASSIVE SHORTAGE OF EMPLOYEES THAT ARE AVAILABLE AND TREMENDOUS VACANCIES IN THE COUNTY. THAT DOESN'T ONLY APPLY TO COUNTIES UNDERNEATH MY DEPARTMENT'S UNDERNEATH MY RESPONSIBILITY BUT ALSO ASSISTING ELECTED OFFICIALS WHERE THEY MAY NEED MY ASSISTANCE IN HELPING DEVELOP A PLAN TO DEAL WITH THEIR
SHORTAGES AS WELL. >> I'M COMMITTED TO DOING ALL OF THOSE THINGS BUT IT'S GOING TO TAKE TIME. I'M JUST ASKING FOR YOUR PATIENCE.
I'M ASKING FOR YOU ALL TO ASSIST ME WITH ANY MEMBERS OF THE PUBLIC OR ANY MEMBERS OF CITY COUNCIL THAT MAY FEEL LIKE I'M NOT MOVING FAST ENOUGH.
PLEASE DO NOT GET OUT AHEAD OF ME AND DO THINGS THAT ARE NOT IN KEEPING OR GET AHEAD OF THE RESPONSIBILITY OF THE COUNTY ADMINISTRATOR. SO THANK YOU ALL VERY MUCH.
APPRECIATE IT. WE'RE GOING TO DEAL WITH THESE ISSUES.
I PROMISE YOU THAT THAT'S MY COMMITMENT TO YOU ALL AND I'M JUST ASKING YOU ALL TO BE PATIENT AND LET THE CONSULTANTS THAT WE'VE HIRED TO DO THE WORK ON THE PARKS AND REC PROGRAM DO THEIR WORK AND COME BACK FOR YOU WITH A SET OF RECOMMENDATIONS.

>> WE HAD A PRESENTATION THAT WAS MADE WORSE RONALD MCDONALD HOUSE.
EVERYONE PROBABLY IS VERY FAMILIAR SERVICE THAT'S PROVIDED BY THE RONALD DONALD KNOWS THEY HAVE A PARTICULAR SECTION OF RE THE HOUSE THAT DEALS WITH THE DENTAL ISSUES AND CALL THE MOBILE DENTAL UNIT ITS STAFF AND OPERATED BY THE YOU FOR JASPER HAMPTON COMPREHENSIVE HEALTH SERVICE. THIS MOBILE DENTAL UNIT PROVIDES SERVICE TO OVER 3000 CHILDREN ANNUALLY WITH DENTAL SCREENINGS AND SERVICES THAT THEY WOULDN'T NECESSARILY BE ABLE TO OBTAIN THROUGH ANY OTHER WAY THEIR CHILDREN ARE REFERRED THIS DENTAL UNIT A SOCIAL SCHOOL, SOCIAL WORKERS OR NURSES AND IF THEY WERE NOT REFERRED THERE THEY WOULD OTHERWISE NOT RECEIVE THOSE SERVICES. BRIAN MCDONALD HOUSE HAS A BUDGET ANNUALLY FOR THEIR HOUSE OPERATION AND FOR THE DENTAL UNIT WHICH OPERATES IN SOUTH CAROLINA EVEN THOUGH THE HOUSE IT'S IN SAVANNAH THIS SUM TOTAL REVENUE THEY HAVE IS ABOUT TWO
HUNDRED THIRTY THOUSAND DOLLARS . >> BEAUFORT COUNTY DONATES ONE HUNDRED THOUSAND DOLLARS A YEAR TO THIS RONALD MCDONALD NOW SPECIFICALLY PRIMARILY FOR THE OPERATION OF THE DENTAL UNIT BECAUSE IT DOES PROVIDE SUCH OUTSTANDING SERVICE TO US HERE IN BEAUFORT COUNTY WITH REGARD TO TWO ITEMS ON THE AGENDA TONIGHT ITEM NUMBER 20, FLOOR NUMBER 27 THERE WAS A READING ON AN ORDINANCE FOR A CHANGE AFFECTS AMENDMENTS ON THE ANIMAL ORDINANCE AND A RESOLUTION TO ESTABLISH THE COUNTY'S COMMUNITY DEVELOPMENT PRIORITY LIST WITH REGARD TO THE ORDINANCE OR THE ANIMAL CONTROL, WE'RE GOING TO SUGGEST

THERE HAVE BEEN CHANGES TO THE ORDINANCE AND THERE'LL BE A MEMBER OF THE EXECUTIVE STAFF AVAILABLE IF THERE ARE ANY FURTHER QUESTIONS AS THIS MATTER COMES UP.
THE ORDINANCE CHANGES THAT WILL BE DISCUSSED TONIGHT PRIMARILY INCLUDE THE FACT THAT THERE WILL BE LANGUAGE INSERTED IN THE ORDINANCE THAT WILL ALLOW A JUDGE TO DETERMINE IF A DOG IS A RESTRICTED BREED WHICH IS A CHANGE. THERE WILL BE THE CREATION OF A CHARGE DEALING WITH ANIMAL NEGLECT IF AND IF A PERSON IS SUSPECTED OF NEGLECT IN ANIMAL
[00:35:07]
THEY'LL BE ISSUED A CITATION AND IF FOUND GUILTY THEY WILL BE FINED.THERE IS NO CHANGE IN LANGUAGE DEAL WITH ABANDONMENT OF AN ANIMAL BEARING A NAME STORM THAT WILL BE ADDED AS A MISDEMEANOR. THE ANIMAL CONTROL CODE THERE WILL BE VERY CLEAR REQUIREMENTS TO ESTABLISH A DANGEROUS DOG. THAT DETERMINATION ONCE AGAIN WILL BE MADE AND FINAL FORM IN A JUDICIAL PROCEEDING. AND THEN THERE IS A REQUIREMENT ESTABLISHED TO AMEND THE NUISANCE PET LANGUAGE IN THE ORDINANCE TO ENSURE THAT IT IS MORE CURRENT USE ORDINANCES ALSO GIVE THE COUNTY ADMINISTRATOR THE ABILITY TO WORK WITH BEAUFORT COUNTY ANIMAL SERVICE DIRECTOR TO ESTABLISH LICENSE AND FEE SCHEDULES ALONG WITH A BREEDER LICENSE FEE SCHEDULE IF PASSED THIS EVENING WILL BE A PUBLIC HEARING AND TWO MORE READINGS WHERE IT COMES IN OFFICIAL COUNTY ORDINANCE WITH REGARD TO THE DIFFERENT TOWN AND COMMUNITY DEVELOPMENT GRANT. I ALREADY ASKED THIS RESOLUTION WILL BE USED TO ENDORSE ACTIONS TO PROVIDE NEW PUBLIC SERVICES AND MATERIALS THAT WILL PRIMARILY BENEFIT LOW AND MODERATE INCOME INDIVIDUALS AND AFTER SCHOOL PROGRAMS AND YOUTH SERVICE PROGRAMS ALTERATION OR RETROFIT OF PUBLICLY OWNED FACILITIES OR FACILITATE COMPLIANCE OF PUBLIC HEALTH GUIDELINES AND ADD MEDICAL AND MENTAL HEALTH SERVICES TO THE DETENTION CENTER. THERE WILL BE DRAINAGE IMPROVEMENTS CONSIDERED.

THERE WILL BE WATER AND SEWER HOOKUPS TO REPLACE FELLING SO THAT SYSTEMS AND WELLS IN LOW MODERATE INCOME COMMUNITIES THEY'LL BE STREETSCAPE STREETSCAPE IMPROVEMENTS IN ALL
AREAS COUNTY. >> THE ONLY IMPROVEMENTS PUBLIC RECREATIONAL FACILITIES AND WE WILL EXTEND ACCESS AND AFFORDABLE OPTIONS TO UNDERSERVED AREAS WILL THROUGH COORDINATION INTERNET SERVICE PROVIDERS PROVIDE SERVICE IN AREAS THAT ARE UNDERSERVED.

THANK YOU MR. CHAIRMAN. >> ANY OTHER MEMBER OF COUNCIL? MR. LAWSON? YES, FROM THE FINANCE COMMITTEE. WE HAVE TWO THINGS THAT ARE ON THE CONSENT AGENDA. ONE IS THE THIRD READING OF AN AUDIENCE AMENDING ARTICLE 3 SECTION 2 OF OUR BUSINESS LICENSES. BASICALLY THAT ALLOWS SOMEONE THAT IS RENTING A UNIT WHICH IS CONSIDERED A BUSINESS USE IF THEY HAVE ONE UNIT THAT'S RENTED FOR MORE THAN 30 DAYS. THEY WILL NOT HAVE TO GET A BUSINESS LICENSE.
SO AGAIN THAT'S GOING TO HELP HELP FOLKS OUT THERE. AND THEN THE SECOND ITEM ON THE CONSENT AGENDA IS THE PART OF THE FUN JOBS THAT WE GET AS IS AUDITS APPROPRIATING FUNDS FROM ACCOMMODATION TAX FUNDS BASED ON RECOMMENDATIONS FROM OUR ACCOMMODATIONS TAX BOARD TO TOURISM RELATED ORGANIZATION. THIS IS ALWAYS GOOD TO SEE THE MONEY GOING OUT TO THE FOLKS THAT CAN USE IT THEN FOR THE GOOD OF THE COUNTY. OUR NEXT COUNCIL.

APPROVED UNANIMOUSLY WITHOUT OBJECTION AND I SEE NO OBJECTIONS.NEXT IS ITEM NUMBER TWELVE. I ASK A MEMBER TO OFFER A MOTION TO HOLD A PUBLIC HEARING AND SECOND READING OF THE ORDINANCE OR THE APPROVAL OF THE ZONING MAP AMENDMENT REZONING REQUEST FOR 19 RURAL AND CRITICAL LANDS PRESERVATION PROGRAM PROPERTIES FROM VARIOUS ZONE ZONING DISTRICTS TO T1 NATURAL PRESERVE. MR LUCAS CHAIRMAN.
OK. MR. FLEMING MADE THE MOTION AND MISS HOWARD MADE THE SECOND.
ARE THERE ANY COMMENTS? HOLD ON A SECOND. I'M SORRY I NEED TO DO IT THE CORRECT WAY. IS THERE ANYBODY FROM THE PUBLIC HERE THIS EVENING WHO WISHES TO MAKE A COMMENT REGARDING THIS PARTICULAR ITEM ?
>> SEEING NONE WILL CLOSE THE PUBLIC COMMENT. MR. LAWSON.
>> YEAH, I'VE WATCHED THIS. EACH TIME THAT WE'VE DONE THIS AND I'M GOING TO VOTE AGAINST THIS JUST BECAUSE I THINK WE'RE ACTUALLY JUST PROTECTING OURSELVES FROM OURSELVES.
>> THE ONLY PEOPLE THAT CAN CHANGE ZONING OF PROPERTIES IS US AND SO WE'RE ACTUALLY CHANGING THE ZONING OF ALL THESE PROPERTIES WHICH ARE UNDER OUR JURISDICTION.
ANY HOUSE KIND OF CURIOUS? I'M NOT SURE WHERE THIS CAME FROM BUT SO I'M GOING TO VOTE AGAINST THIS JUST BECAUSE I THINK IT'S OVER BUREAUCRATIC CONTROL AND AGAIN WE WE'RE
PROTECTING OURSELVES FROM OURSELF. >> ANY OTHER COMMENTS SIGNAL? I BELIEVE THE REASON FOR THIS IS A STANDARDIZATION BECAUSE LIKE YOU SAID, WE'RE THE ONLY ONES THAT COULD CHANGE THE ZONING BUT WE HAVE 19 DIFFERENT WE WANT TO PUT THEM ALL IN ONE BASKET. THAT'S THE ONLY REASON FOR THIS.
BUT I UNDERSTAND I MIGHT IF I MIGHT ADD SOMETHING, MR. CHAIRMAN, IT'S NOT ONLY NOT ONLY IT'S NOT ONLY PROTECTING US FROM OUR SELVES BUT ANY OF THE SURROUNDING PROPERTIES WHO ATTEMPT TO CHANGE THEIR ZONING NOW HAVE ANOTHER HURDLE BECAUSE WE TRIED TO KEEP
PROPERTIES RELATIVELY CONSISTENT FROM ONE NEXT. >> IF WE CHANGE THE ZONING TO THE LEAST DENSE PROPERTY THEN THE NEXT PROPERTY YOU WILL HAVE WE'LL HAVE MUCH MORE DIFFICULTY CHANGING THEIR ZONING THEIR PROPERTY TO SOMETHING THAT IS DRASTICALLY DIFFERENT FROM WHAT WE HAVE. SO IT'S REALLY A STRATEGY TO LIMIT PROPERTY THROUGHOUT THE COUNTY THAT IS NEAR OUR OUR WORLD CRITICAL PROPERTY. THANK YOU.
>> ANY OTHER COMMENTS? THIS WILL BE ACCEPTED WITH ONE NEGATIVE VOTE.
IS THERE ANYONE ELSE IN OPPOSITION OF THIS? >> IF NOT, THIS WILL PASS AS
THE PUBLIC HEARING AND SECOND READING WITH 10 YES AND 1 NO. >> OK, MOVING ON TO THE NEXT

ONE ITEM NUMBER 13. I WOULD ASK A MEMBER TO OFFER A MOTION FOR A PUBLIC HEARING AND SECOND READING OF AN ORDINANCE FOR THE APPROVAL OF A ZONING MAP AMENDMENT REQUEST FOR SIX POINT TO SIX ACRES ALSO KNOWN AS ONE 86 CHEROKEE FARMS ROAD FROM T TO RURAL TO T4 HAMLETSCENTER OPEN A MARSH DISTRICT. >> CHAIRMAN I'LL MAKE THE MOTION MR. FLEMING MAKES THE MOTION A SECOND PLEASE. LET'S LOOK AT THE MOTION. YES, HOWARD MAKES THE SECOND.
IS THERE ANY MEMBER OF THE PUBLIC WHO WISHES TO MAKE A COMMENT ABOUT THIS ITEM? I'M GOING TO BE ASKING THIS SEVERAL TIMES OF YOU SEEING NONE.
THE PUBLIC PORTION WILL BE CLOSED. ANY COUNCIL MEMBER WISHES TO MAKE A COMMENT. YES. AS I SAID LAST TIME, MR. CHAIRMAN. THIS IS BENEFICIAL TO THE THAT AREA OF THE COUNTY WHERE WE SEE A NEED FOR THIS TYPE OF DEVELOPMENT THAT'S BEING PROPOSED HERE.
AND I'M IT'S ALREADY A HAMLET CENTER IN THAT AREA IN THAT RIGHT NEXT TO ABBOT JAM.
AND SO STAND A LITTLE MORE DEVELOPMENT AND SO WE APPRECIATE YOUR VOTE.
THANK YOU. >> YES. THIS IF THERE ARE NO OTHER COMMENTS, THIS WILL BE APPROVED UNANIMOUSLY WITHOUT OBJECTION. AND I SEE NO OBJECTIONS.
[14. PUBLIC HEARING AND SECOND READING OF AN ORDINANCE FOR APPROVAL OF A TEXT AMENDMENT TO THE COMMUNITY DEVELOPMENT CODE (CDC): SECTIONS A.2.40 (PERMITTED ACTIVITIES), A.4.40 (PERMITTED ACTIVITIES), AND A.5.40 (PERMITTED ACTIVITIES) TO REVISE THE LADY’S ISLAND COMMUNITY PRESERVATION, LADY’S ISLAND NEIGHBORHOOD ACTIVITY CENTER, AND LADY’S ISLAND PROFESSIONAL OFFICE DISTRICTS TO INCLUDE SHORT-TERM RENTALS AS A SPECIAL USE]
MOVING ON TO THE NEXT ONE A MOTION PLEASE TO HOLD A PUBLIC HEARING AND SECOND READING[00:45:01]

CHAIRMAN .
MS. HOWARD MAKES THE MOTION A SECOND ALSO LIKE YOU MR. DAWSON MAKES THE SECOND ANY MEMBER OF THE COUPLE PUBLIC WISH TO COMMENT ON THIS ONE SEEING NONE. PUBLIC PORTION IS CLOSED. ANY DISCUSSION BY ANY MEMBER OF COUNCIL I SEE NONE. THEREFORE THIS WILL BE APPROVED UNANIMOUSLY WITHOUT ANY
[15. PUBLIC HEARING AND SECOND READING OF AN ORDINANCE FOR APPROVAL OF A ZONING MAP AMENDMENT/REZONING REQUEST FOR 6.55 ACRES (R600 041 000 0172 0000) AT 28 BUCKINGHAM PLANTATION DRIVE FROM T4 HAMLET CENTER OPEN TO T4 NEIGHBORHOOD CENTER]
OBJECTIONS AND I SEE NO OBJECTIONS. THE NEXT ONE IS A MOTION TO HOLD A PUBLIC HEARING AND SECOND READING OF AN ORDINANCE FOR THE APPROVAL OF A ZONING MAP AMENDMENT REZONING THAT REQUEST FOR SIX POINT FIVE FIVE ACRES KNOWN AS TWENTY EIGHT BUCKINGHAM PLACE DRIVE FROM T FOR HAMLET CENTER OPEN TO T FOR NEIGHBORHOOD CENTER A MOTION PLEASE ALL JUMP AT ONCE. MOTION FOR DISCUSSION IS OKAY. MR. RUDMAN MAKES THE MOTION THE SECOND PLACE LIKE MR. LAWSON MAKES THE SECOND. IS THERE ANY MEMBER OF THE PUBLIC WISHED TO MAKE A COMMENT ON THIS ONE? SEEING NONE THE PUBLIC PORTION WILL BE CLOSED. ANY MEMBER OF COUNCIL WISH TO MAKE A STATEMENT ABOUT THISONE. MR. FLOWING. >> THANK YOU.
YOU KNOW I. I WILL DEFER TO MR. HERBERT SHANA.
SEE HIS HAND WAS UP. I BELIEVE THIS IS HIS DISTRICT AND I'D LIKE HIM TO HAVE AN OPPORTUNITY TO SPEAK BEFORE I DO. MR. VACHON, I APPRECIATE THAT.
AND YOU ARE CORRECT. IT IS MY DISTRICT VOTED AGAINST THE LAST TIME.
GONNA BE CONSISTENT VOTE AGAINST THIS TIME. I CONTINUE TO BE CONCERNED WITH THE AMOUNT OF DEVELOPMENT THAT'S HAPPENING IN THAT AREA OF THE COUNTY WHICH IS RIGHT KIND OF AT THE GATEWAY TO THE BRIDGE ON THAT BRIDGE THERE ESPECIALLY BLUFFTON PARKWAY.
GOT A NUMBER OF UNITS THAT ARE ALREADY PLANNED TO GO IN THERE AND APPROVED TO GO IN THERE AND I THINK OBSERVING THIS TO JUST BASICALLY ADD TO THE DENSITY. I DON'T THINK IT'S A GOOD IDEA FRANKLY. SO WE'LL VOTE AGAINST THE OTHER COMMENTS.
>> YES, CHAIRMAN, IF I MIGHT TAKE A WHACK AT IT NOW. THANK YOU.
YOU KNOW, I DON'T REMEMBER EXACTLY THE DATES. I THINK IT WAS MAYBE 10 OR 12 YEARS AGO. THIS PROPERTY WAS THE OWNER OF THE PROPERTY REQUESTED AN ZONING AND IT WAS DENIED BY COUNTY. SO I THINK IT'S RECOLLECTION SERVES ME. I VOTED IN FAVOR AND IN IT THIS PROPERTY HAS A LOT OF HISTORY.
I VOTED IN FAVOR OF A AT THE TIME OF THE ORIGINAL REZONING REQUEST MAYBE ELEVEN YEARS AGO OR SO AND I WAS OVERRULED BY COUNTY COUNCIL AND I THINK THAT THAT YOU KNOW, THE REASONS GIVEN AT THE TIME WERE FOR WERE REALLY NOT APPROPRIATE. BUT YOU KNOW, AS TIME HAS GONE ON I DON'T WE NEED TO SAY THIS PROPERTY WON'T BE UPSET. SO I'M GOING VOTE AGAINST THIS REQUEST REZONING THE PROPERTY AND KEEP IT AS T FOR HAMEL CENTER.
AND LET'S LET'S JUST SEE HOW IT GOES. >> ANY OTHER COMMENTS, MR. CUNNINGHAM? THANK YOU, MR. CHAIRMAN. I TOO VOTED AGAINST US AT THE COMMITTEE LEVEL AND IN THE FIRST READING. MY BIGGEST CONCERNS ARE THE SAME THAT CHRIS POINTED OUT WE USE A BLUFF AND PARKWAY IS ACCESS TO GET FROM HILTON HEAD THROUGHOUT THE NEIGHBORHOODS THAT ARE ALREADY THERE. BUT NOW WE'RE ABOUT TO ADD EVEN MORE HOMES RIGHT THERE AT THE BRIDGE THAT WE DON'T EVEN KNOW WHERE THE NEW BRIDGE IS GONNA BE. WE'RE NOT SURE WHAT THE NEXT PATH IS ON THE BLUFFTON PARKWAY BUT I BELIEVE CONTINUE DENSITY TO THAT IS JUST GOING TO CREATE MORE PROBLEMS. AND THE COUNTY LEVEL I THINK WE'RE JUST GONNA CONTINUE TO CHASE THE TAIL AND TRY TO FIX ONE PROBLEM THAT WE CREATED BY SPENDING MORE MONEY TO FIX NOT A PROBLEM LATER ON WITH ROADS AND JUST PLAY A LITTLE BIT OF DEVIL'S ADVOCATE. I WAS GOING OVER THIS ON FRIDAY AND THINKING ABOUT IT AFTER OUR COMMITTEE MEETING. I FIND IT INTERESTING HOW WE DEBATED FOR 30 MINUTES ON MONDAY NIGHT ABOUT ANOTHER PIECE OF PROPERTY ABOUT CHANGING THE ZONING FOR AFFORDABLE HOUSING THAT DIRECTLY AFFECTS A NEIGHBORHOOD BUT YET WE DON'T HAVE EITHER THE ARGUMENT TO REQUIRE AFFORDABLE HOUSING HERE ON THIS PROPERTY WHEN THEY'RE GOING FOR AN UP ZONING OR THE FACT THAT WE'RE WILLING TO DO THAT WITHOUT EVEN NEGOTIATING OR DEBATING. I THINK RIGHT NOW IN THE COUNTY
[00:50:04]
WE DO HOLD THE CARDS IF WE'RE GOING TO SAY THAT WE HAVE A PROBLEM WITH WORKFORCE HOUSING AND AFFORDABLE HOUSING AND WE'RE JUST GOING TO LET THIS ONE SLIDE BY IN AN AREA THAT IS DIFFICULT TO ALREADY ACCESS. I DON'T THINK THAT'S A SMART PLAY.SO I WILL CONTINUE TO ARGUE AGAINST IT AND NOT SUPPORT IT. ANY OTHER COMMENTS FROM THE
APPLICANT SPEAK? >> WHO WAS THAT? THIS IS THE OPPORTUNITY PROJECT
ECONOMIST. >> INTRODUCE YOURSELF, SIR. >> SURE.
MY NAME IS MICHAEL ECONOMISTS. I'M THE APPLICANT. THE PROJECT WITH CAREY ARCHITECTURE AND DESIGN. THE REASON. JUST GIVE YOU A LITTLE HISTORY ON THE PROJECTS. I WAS THE ONE WHO ACTUALLY REZONING THE PARTS OF ADJACENT FROM MR. K'S BACK IN FIVE YEARS AGO TO FOR NC. AT THE TIME MR. CHASE.
SO AT THIS PROPERTY TO MY NEW CLIENT ARM AND ME. SO RIGHT NOW CLIENT HAS FIVE ACRES. IT'S IN T FOR NC AND FIVE ACRES AND T FOR H.
YO THE ZONE FIVE CREATES THE PROPERTY. THE GOAL HERE THIS UPSET ME WAS NOT TO HAVE MORE DENSITY. THE GOAL HERE WAS TO MAKE THE ARCHITECTURE TO GROW IT AND IN THE HEIGHT BUILDING THE POSSIBILITY OF GOING TALLER IN ORDER TO ALLOW FOR MORE OPEN SPACE AND MORE RECREATES WHAT PARKS? JUST BECAUSE THE ZONE BUILDS UP AND ALLOWS THIRD OR FOURTH STORY DOES NOT MEAN WE ARE ADDING MORE UNITS.
IN FACT WHEN YOU DO THE CALCULATION OF AN ARCHITECT PLAN.
>> IF YOU ADD MORE UNITS HAVE TO ADD MORE PARTY YOU HAVE TO ADD MORE OPEN SPACE YOU HAVE TO A DIFFERENT SET OF FACTS AND THE GOAL HERE WAS NOT TO ADD ANY MORE.
>> IT'S A CALCULATION NOT A HANDSOME OF NUMBER FOR UNITS PER ACRE.
THIS IS JUST BASED ON AN ENTRY WAY ARCHITECTURE AND HOW THE PROJECT SHOULD WORK TOGETHER NOT THE ONLY REASON WE ARE ASKING. THE ZONES TO BE EXACTLY THE SAME TO RAISE THE BUILDINGS AND TO BE ABLE TO DO MORE GARDEN. SO I DON'T WANT PEOPLE TO GET CONFUSED IN THE ZONE CONSTITUTION WE WE'RE ZONING MORE DENSITY.
THAT IS NOT THE CASE AT ALL. >> THANK YOU. ANY OTHER COMMENTS? OKAY. MR RUDD IS ONE WHO'S NOT FAMILIAR WITH THIS.
IT WOULD BE USEFUL IF EITHER THE ADMINISTRATION OR COUNCIL MEMBERS THAT WERE IN FAVOR OF THIS MIGHT SPEAK TO IT. IS THERE ANYONE WHO IS GOING TO SPEAK FOR THIS? OR ARE WE JUST GOING TO TAKE THE VOTE? OKAY.
MR RUDMAN, YOU MADE THE MOTION YOU GET TO VOTE FIRST OF ALL THAT VOTE JUST FOR A COMMENT.
>> I'M A WHAT HAS WHAT IS WHAT IS PLANNING DEPARTMENT SAYING ABOUT THIS?
>> HOLD ON A SECOND. MR MERCHANT IS GOING TO COME FORWARD, GET OKATIE IN OUR STAFF REPORT AND SUPPORTED THIS CHANGE FOR BASICALLY THE SAME REASONS THAT THE APPLICANT DID.
WE'VE BEEN WORKING WITH THE APPLICANT ON SEVERAL VERY CONCEPTUAL PLANS FOR THIS PROPERTY AND THE SPLIT ZONING ON THE PROPERTY HAS ALWAYS CREATED KIND.
IT'S BEEN AN OBSTACLE FOR THEM PLANNING FOR THE PROPERTY. WE HAVE AT THE LAST MEETING I THINK I QUOTED THE DIFFERENTIAL THAT IS ZONING WOULD CHANGE WOULD AMOUNT TO 44 ADDITIONAL UNITS. THAT'S MERELY BY KIND OF DOING A BACK IN THE ENVELOPE CALCULATION BECAUSE WE THAT DISTRICT DOES NOT HAVE A DENSITY OR GROSS DENSITY REQUIREMENT. IT BASICALLY GOES BY, YOU KNOW, FITTING THE BUILDINGS IN THE PROPERTY. YOU HAVE A MAXIMUM BUILDING HEIGHT STORMWATER OPEN SPACE AND THEN WHATEVER THE PROPERTY YIELD. SO WE CAN DO IT ANALYSIS AND AT 44 DIFFERENT BASED ON THAT. SO WE JUST FELT THAT THAT WAS NOT A SIGNIFICANT CHANGE AND THAT THE ABILITY FOR THIS FOR HIM TO PLAN FOR THAT MONEY THE SPLIT ZONING SEEMED TO BE MORE ARBITRARY. THAT ONE WAS SLIGHTLY LOWER DENSITY THAN THE OTHER.
[00:55:01]
AND SO AS A DEPARTMENT WE SUPPORTED THE CHANGE. THANK YOU.SO IS IT FAIR TO SAY THAT GROANING THAT YOU APPROVED TO ALLOW AN ADDITIONAL 40 UNITS ON AN ADJACENT PROPERTY? THAT IS NOT WHAT THE DEVELOPMENT AGREEMENT IS ASK
FOR. >> THAT'S WHAT THE THE ZONING CHANGE BASED ON OUR ANALYSIS SAID. THE THE PROPERTY OWNER OWNS TWO PROPERTIES THAT MAKE UP
APPROXIMATELY 12 ACRES. >> WITHOUT THE CHANGE OUR ANALYSIS SAID HE COULD PROBABLY DEVELOP ONE HUNDRED SEVENTY UNITS ON HIS PROPERTY WITH THE CHANGE.
TWO HUNDRED AND FOURTEEN. SO THAT GIVES YOU AN IDEA OF THE MAGNITUDE OF CHANGE THAT
THIS THIS RESULT WOULD WOULD CREATE. >> FIRE EVEN WITH THE ACTION UNITS YOU'VE INDICATED YOU RECRUIT THAT THE DEVELOPER TO GET DOESN'T INTEND TO DO THAT.
BUT DO WE HAVE ANYTHING IN WRITING THAT THAT ASSURES US THAT THAT WON'T HAPPEN?
NO. >> I MEAN JUST ZONING HAS TO BE BASED ON SIMPLY WHAT THE NEW DISTRICT WOULD ALLOW. SO I UNDERSTAND THEY CAN MOVE AWAY AND A NEW DEVELOPER CAN COME IN AND SO WHATEVER THEY'RE ABLE TO PROVIDE THAT LOT. GIVEN THE REQUIREMENTS OF THAT
ZONING DISTRICT THEY CAN DO. >> YEAH. SO THIS DEVELOPER MAY HAVE THE INTENTION OF NOT DEVELOPING IT AT ALL AND PUTTING IN PARK VIEW OR WHATEVER ELSE.
IF YOU SAID LOOK THAT PROPERTY IS SOLD IN THE NEXT PERSON CAN DEVELOPERS TO THEIR HEART'S
CONTENT IS REALLY EVER NUMEROUS. >> YES.
I MEAN THE SONGS ARE MEETING REQUIREMENTS WE'VE WITNESSED WITH THIS HAIN IN THE UPS ON WHEN HE UPSET ME CHANGED THEN THIS IS ALLOWABLE SOMETIME IN THE FUTURE THAT IT'S FAIR TO
SAY YES. >> YOU KNOW REGARDLESS OF WHETHER ZONING REMAINS THE SAME AS IT IS OR WHETHER IT IS CHANGED TO T FOR NEIGHBORHOOD CENTER WHOEVER DEVELOPS PROPERTY WOULD SIMPLY FOLLOW THE REQUIREMENTS. THOSE DISTRICTS AND SO DO I FOLLOW THAT WHAT THE APPLICANT SAID IF HE WAS TO PUT MORE UNITS IN WHAT YOU'RE SAYING IT
COULD BE UP TO 44 OR MORE UNITS. >> IT WOULD THEN REQUIRE HIM TO PUT IN ADDITIONAL PARKING ADDITIONAL OPEN SPACE, ADDITIONAL ONE MORE THING HE SAID I FORGOT THAT IT IS VERY DIFFICULT YOU KNOW THAT THEY HIRE ENGINEERS TO FIGURE OUT HOW MUCH A PIECE OF PROPERTY CAN YOU KNOW HOW MUCH DEVELOPER CAN YIELD.
THERE IS A SIMILAR PROPERTY NEXT STORE IN THIS VERY SIMILAR SHAPE WHICH WE HAVE SEEN VERY CONCEPTUAL PLANS FOR THAT. WE BASED ON WHAT THEY'VE PRESENTED WE CAME UP WITH A DENSITY OF SOMEWHERE IN THE NEIGHBORHOOD OF 18 YEARS PER ACRE AND SO WE USE THAT AS A WAY TO CALCULATE WHAT COULD BE DONE ON THIS PROPERTY INCLUDING THE PARKING WE'RE JUST GOING BY. YES, THAT'S WHAT APPROVED AND THE OTHER ONE YEAR PER ACRE YOU KNOW WHERE THE BUILDINGS AND ALL THE PARKING SO THAT NUMBER OF 44 UNITS WOULD YOU GOT YOU WOULD ALREADY BE CALCULATING THE FACTOR OF PARKING BECAUSE YOU USE THAT SAME METHOD FOR ANOTHER PIECE OF PROPERTY. YES. I DO HAVE ONE QUESTION.
SORRY. GO AHEAD MR GO. MARK, THANK YOU.
I APPRECIATE ADDITIONAL INFORMATION. OK.
>> MR RAHMAN, YOU HAD YOUR HAND UP AND THEN MR CUNNINGHAM. SO IF I HEAR WHAT YOU'RE SAYING IS THAT THERE WOULD BE SOME ADDITIONAL UNITS WE HAVE TO ASSUME THAT THAT COULD HAPPEN.
BUT THERE'S ALSO AN ARGUMENT THAT THERE'S SOMETHING TO BE SERVED BY HAVING IT LOOK THE SAME FOR THE TWO PARCELS RIGHT NEXT TO EACH OTHER. AM I INTERPRETING THAT
CORRECTLY? YES. >> I MEAN WE'VE WORKED WITH THIS PROPERTY OWNER ON THIS PROPERTY. YOU KNOW, IT'S IT'S COME BACK TO US SEVERAL TIMES VERY MUCH ON THE CONCEPTUAL SCALE AND I THINK THE PREVIOUS ARCHITECT WANTED TO DO SOME SORT OF UNIFIED DESIGN OF THE PROPERTY WAS HAMPERED BY THE SPLIT SETTING AND AND SO I THINK WITH THAT THAT'S WHAT HAS BEEN OUR EXPERIENCE IN WORKING
WITH THE WITH THIS PROPERTY. >> AND IF YOU LOOK AT THE OTHER PROPERTIES IMMEDIATELY ADJACENT TO THESE TWO PROPERTIES, IS THIS WHAT'S PROPOSED FIT WITH THOSE PROPERTIES OR IS IT DRASTICALLY DIFFERENT? WELL, THE PROPERTY THAT IS LOCATED DIRECTLY TO THE WEST OF THIS PROPERTY OF HE ACTUALLY THIS THE APPLICANT OWNS TWO PROPERTIES ONE IS ABOUT FIVE ACRES AND THE OTHER ONE'S ABOUT SIX ACRES THAT NEXT TO THAT IS ABOUT A 14 ACRE PROPERTY AND THAT'S SEVENTY FOUR NEIGHBORHOOD CENTER WHICH IS THE ZONING THAT THE APPLICANT
IS REQUESTING. >> SO THIS WOULD BE THE SAME THEN AS THE ONE THAT'S ADJACENT TO IT. YES. HOW ABOUT THE OTHER DIRECTIONS AROUND THE EFFINGHAM TAILORED TO 78 THERE IS AN EXISTING APARTMENT COMPLEX I'M TRYING TO
[01:00:03]
REMEMBER THE NAME BUT THAT ASSUMES EDGEWATER FOR EDGEWATER EDGEWATER.>> YES, THAT'S SOON T FOR HAMLETS CENTER OPEN. SO IT'S IT'S THE LESSER OF THE
TWO DISTRICTS BUT THAT'S ALREADY DEVELOPED. >> SO BASICALLY YOU'RE SAYING THIS IS SOMEWHAT CONSISTENT WITH THE NEIGHBORHOOD AROUND IT .
YES. OK. BASED ON OUR MIGRATION COMING IN WAS NEXT AND THEN MS. HOW SARA WOULD BE POSSIBLE GET THAT MAP PUT UP AGAIN PLEASE.
>> THANK YOU. JUST FOR SAKE OF ARGUMENT THE APPLICANT SAID TALKING ABOUT KEEPING THE BUILDINGS THE SAME AND MR ROBBINS TALK ABOUT THE SAME THING WOULD BE BAD BUSINESS IF HE LOWERED THE ZONING TO THE ONE NEXT TO IT BECAUSE HE'D MAKE LESS REVENUE ON SALES. IF WE SAID YOU HAD TO GO TO TWO TO STORE TWO AND HALF STOREYS WHICH IS THE ORIGINAL ZONING AND NOT ALLOWED TO GO FOR HE COULD EASILY LOSE OUT ON REVENUE. SO IF THAT WAS THAT IMPORTANT TO KEEP THE BUILDINGS THE SAME I DON'T SEE WHY IT'S THAT IMPORTANT THING. GO TO STORIES.
DON'T GO FOR BECAUSE YOU'RE GOING TO CUT DOWN ON YOUR PARKING ANYWAYS ACROSS THE PROPERTY YOU CAN STILL GET THE SAME AMOUNT OF HOMES. I DON'T SEE HOW THAT MATH ADDS UP. THAT'S AN ARGUMENT JUST FOR THE BUILDINGS TO BE THE SAME FOR US THE CHANGES ZONING AND I DON'T THINK IT'S MR ROBIN STEVEN SAYING IT'S COMPARABLE TO THE
OTHER ZONING AROUND. >> WELL THE ZONING DIRECTLY ACROSS THE STREET FROM IT IS THE ORIGINAL ZONING THAT WE'RE TALKING ABOUT RIGHT NOW WHICH IS HAMLET CENTER RIGHT? YEAH HAMLET CENTER WHICH IS TWO AND A HALF STOREYS WHICH THE APARTMENT COMPLEX ACROSS THE STREET IS DONE FOR TWO STOREY APARTMENTS. IT'S BEEN THERE FOR YEARS.
SO I STILL CAN'T GIVE YOU SOUND. WE'RE JUST PLAYING A CAT AND MOUSE GAME BUT IT STILL DOESN'T CHANGE THE FACT THAT THEY CAN ADD 44 EXTRA BUILDINGS IF WE UP ZONE IT WE CAN PAINT IT HOWEVER WE WANT BUT IT'S THE SAME ARGUMENT IF YOU WANT TO LOOK THE SAME BUILD ON TWO STOREY ALL THE WAY ACROSS. YOU'RE GOING TO CUT DOWN YOUR PARKING ON YOUR PROPERTY SO YOU HAVE THE EXTRA ROOM FOR THE EXTRA BUILDING THE ZONE REALLY COMMON IS THAT THIS IS NOT EVEN IF I APPRECIATE COUNCILMAN CUNNINGHAM'S COMMENT ABOUT WHAT WE DISCUSSED FOR HALF AN HOUR, THE DIFFERENCE BETWEEN THESE TWO SITUATIONS IS ONE WAS A POINT IN UNIT DEVELOPMENT, AN AGREEMENT THAT WE WERE TALKING ABOUT OPENING BACK UP.
THIS IS SIMPLER. IT'S JUST A ZONING REQUEST. IT'S NOT BOTH.
SO THERE'S REALLY NOT THE ROOM FOR NEGOTIATION. I APPRECIATE YOUR COMMENT ABOUT AFFORDABLE HOUSING BUT IT'S NOT THE SAME IN MY OPINION IT'S DIFFERENT IT'S A DIFFERENT CREATURE. I'D JUST LIKE TO MAKE THAT COMMENT MR SHARPE.
THANK YOU. >> COUPLE OF QUESTIONS. YOU'VE MENTIONED THAT THE PROPERTY DIRECTLY WEST WHICH IS THE WHICH IS AN UPSIDE DOWN VERSION OF WHAT WE HAVE HERE
WAS OWNED BY THE SAME DEVELOPER AT SOME POINT THAT CORRECT. >> THE APPLICANT MENTIONED
SOMETHING ABOUT THAT. I CAN'T REALLY SPEAK TO THAT. >> I'M JUST CURIOUS WHY THAT WHOLE STRIP FRANCE OFF THE PARKWAY WASN'T OBSERVED AT THE SAME TIME.
>> I'VE GOT A COUPLE OF I'M TRYING TO REMEMBER THE HISTORY GOING TO HELP.
YOU KNOW, MAYBE I COULD HELP YOU SINCE WE HAD GRAVES OR CPA BANKS IN IN IN HER HUSBAND WHO OWNED THIS PROPERTY AT ONE TIME. DOES THAT REFRESH YOUR MEMORY AT ALL? YES. AND THAT WAS BACK WHEN WE HAD THE OLD SOUNDING ORDINANCE. YEAH, SO I THINK I'M THINKING THAT WAS ABOUT 10 YEARS AGO.
>> WELL, MORE THAN THAT. YEAH, I'M NOT SURE WHY THOSE TWO PROPERTIES ARE THE WAY THEY ARE. YOU KNOW WHY ONE IS FOR HAMLET CENTER OPEN AND THE OTHER ONE'S
KEY OR NEIGHBORHOOD CENTER. >> SO I THINK FROM OUR STANDPOINT THAT ALSO MAKES SENSE THAT CONSISTENT ZONING ALONG THAT SIDE STREET IN THE PROPERTY TO THE WEST.
>> I BELIEVE THAT WAS RESERVED SOMETIME IN 2016. THE OTHER DENSITY DEFINITELY PREDATES MY TIME IN COUNCIL. ONE MORE QUESTION. SOUTH OF THAT PROPERTY IS OLD SOUTH. YES, IT WAS UNDER A FEW DAYS. I GUESS I GOT THIS IF THEY WANTED TO OPEN THAT BACK UP NO DOUBT ABOUT OPENING UP BEAUTIES AGAIN.
WHAT COULD POTENTIALLY HAPPEN THERE? >> I DON'T HAVE THE NUMBERS BUT THEY HAVE A RESIDENTIAL COMPONENT THAT'S NEVER BEEN CONSTRUCTED.
SO RIGHT NOW THERE'S A GOLF COURSE WITH I BELIEVE JUST WOODED AREA BETWEEN THE GREENS BUT THE BEAUTY ALLOWS SINGLE FAMILY DEVELOPMENT IN THAT AREA.
OKAY. NOW MY COMMENT DIRECTLY TO THE WEST OF ALL OF THAT SO THEY'RE NATIONAL. WE ALL KNOW WHAT'S BEEN GOING ON THERE FOR SINCE BEFORE WE GOT A COUNCIL. I IT JUST FEELS LIKE WE TAKE THESE THINGS PIECEMEAL TIME.
[01:05:06]
AND THEN IN THE GRAND VISION OF THIS 10, 20, 30 WHATEVER YEARS IS GONNA BE FROM NOW WE'RE GONNA END UP WITH A WHOLE LOT OF DEVELOPMENTS SITTING RIGHT THERE AT THE FOOT OF THEBRIDGE THAT YOU KNOW WEREN'T THERE. >> HELP HAD NATIONAL TEA TO RURAL. IT'S STILL 72 AT THE MOMENT. YES.
>> WEREN'T THERE DEVELOPMENT AGREEMENTS THAT ARE LITERALLY 30 YEARS OLD? THEY'VE BEEN YOU KNOW, VARIOUS TIMES ACROSS THIS SPAN THAT WERE NEVER DEVELOPED.
THEY'RE NOW BEING DEVELOPED BUT THEY WERE ON THE BOOKS BUT NOT ON THIS PIECE OF PROPERTY.
>> NO, I DID NOT OWN THIS PIECE OF PROPERTY IN SOUTH. I DON'T HAVE THE DATA BUT THAT'S ONE OF HER OLDER DUTIES THAT'S BEEN IN PLACE FOR 90 SINCE THE 90S.
I THINK OK. >> ANY FINAL COMMENTS? MR. FURLONG, THANK YOU.
>> MR. CHAIRMAN, I'M WONDERING SHOULD THIS SURVIVE SECOND READING? I WOULD HOPE THAT STAFF WOULD RESURRECT DETAILS OF THEIR PREVIOUS REQUEST OF HIS OWN PROPERTY WHEN THE BENCHES ON THIS PROPERTY PROVIDE THE ARGUMENTS OF COUNSEL AT THE TIME. SO THAT WE CAN AT LEAST HAVE THOSE MEMBERS OF COUNCIL VOTE CONSISTENTLY. YOU KNOW, OBVIOUSLY CIRCUMSTANCES CHANGE FOR THEM TO HAVE SOME REFRESHMENT ABOUT WHY THEY BUY THOUGH THEY STARTED WAY TEN YEARS AGO.
>> OK, CAN I JUST MAKE ONE FINAL COMMENT? >> I'M GENERALLY OPPOSED TO REQUESTS FROM ZONING WITHOUT FORMAL HOUSING COMPONENT BUT I'M ALSO OBJECTING TO AFFORDABLE HOUSING. IT'S PROPOSED THEY'RE GOING TO PILE 200 PEOPLE ON TOP OF ANOTHER THREE HUNDRED AND SIXTY ONE. I THINK WE HAVE OTHER OPPORTUNITIES THAT WE CAN PURSUE. I'M GOING TO VOTE NO ON THIS.
>> OK, BACK TO THE MOTION, MR. RUDMAN. YOU WENT FIRST.
WE MADE THE MOTION. YOU WILL VOTE FIRST. >> I WILL VOTE YES.
PRIMARILY TO KEEP THIS OPEN SO THAT WE CAN UNDERSTAND ALL THE BETTER AND BEING SENSITIVE TO THE STAFF RECOMMENDATION. MR. LAWSON, YOU MADE THE SECOND MARK LAWSON.
>> YES, MR. CUNNINGHAM. NOW MR. DAWSON, I'M GONNA VOTE NO AGAINST KNOB ZONING.
>> MR. FLOWING I'M NO MR. GLOVER NO MR. HER VISION. NO.
MS. HOWARD. YES, MR. MCKELLEN.
THE CHAIR VOTES YES. >> BUT THE MOTION IS DEFEATED. ONE, TWO, THREE, FOUR, FIVE, SIX, SEVEN. NO. AND FOUR.
YES. >> I WOULD ASK A MEMBER TO MAKE A MOTION TO HOLD A PUBLIC

BASED ON THE COUNTY'S LEVEL OF SERVICE STANDARDS FOR IMMENSE FACILITIES AND CAPITAL IMPROVEMENT PLAN AND TO ASSIGN THE COSTS OF SUCH IMMENSE FACILITIES ON A PROPORTIONATE SHARE BASIS TO THE NEW DEVELOPMENT IN MOTION PLEASE MR. RUNYAN MAKES THE MOTION DR MCKELLAR MAKES THE SECOND.
>> ANY MEMBER PUBLIC WISH TO MAKE COMMENT ABOUT THIS PARTICULAR ITEM.
SEEING NONE THE PUBLIC PORTION IS CLOSED. ANY MEMBER OF COUNCIL WISHED TO MAKE A STATEMENT. YOU'RE RIGHT. IT'S NOT OUR BEST IN BEST INTEREST TO POINT OUT THAT HILTON HEAD HAS BEEN EXCLUDED FROM THIS PURPOSEFULLY BECAUSE THEY HAVE THEIR OWN FIRE EMS SERVICE ON RHODE ISLAND. WHICH IS WHY THEY'RE EXCLUDED.
>> THAT'S CORRECT. MR. CUNNINGHAM. ONE QUESTION DO WE KNOW IF EXCITED ABOUT IS IT POSSIBLE TO BRING UP PAGE 154? SARAH, I'M SORRY.
ONE OF THE QUESTIONS I ASKED LAST TIME WAS WHEN YOU LOOK AT THE NONRESIDENTIAL DEVELOPMENT ON THE SCALE THIS IS A BREAKDOWN FOR THE FEES ON ONE OF THE QUESTIONS I ASKED WAS.
SO WHEN WE TAKE AN ACCELERATION LIKE A STRIP MALL WHERE THEY HAVE LIKE A SUBWAY OR A NEW RESTAURANT GOES IN THERE WE TALKED ABOUT IS THAT WHEN IT'S INITIALLY BUILT OR EVERY TIME A NEW BUSINESS COMES IN. AND I WAS TOLD IT'S WHEN IT'S INITIALLY BUILT.
CORRECT. THAT'S THE REASON I'M SUPPORTING THIS BECAUSE IT'S NOT GOING TO GO INTO EFFECT OF HURTING OUR SMALL BUSINESS OWNERS OR LOWER WELLS THAT ARE STARTING NEW BUSINESSES. IT'S GOING TO GO ON THE DEVELOPER.
INITIALLY WHEN THE PROPERTY IS BEING BUILT. SO I JUST POINT THAT OUT THAT THAT IS THE SCALE FOR THE IMPACT ON OUR COMMERCIAL AND RESIDENTIAL.
>> YES. OKAY. MR. FLEMING, I THINK YOU HAD
YOUR HAND UP. >> THANK YOU. YES, I GUESS, MR. CHAIRMAN.
SURE. MY SPEAKERS ON. >> YOU KNOW, I I I SAID VERY PUBLICLY LAST MEETING WHEN WE VOTED FOR THIS I VOTED IN FAVOR OF IT TO MOVE IT FORWARD SO THAT WE COULD HAVE AN OPPORTUNITY FOR MUNICIPALITIES TO SIGN ON TO PROVIDE THE NECESSARY TO START THE PROCESS TO PROVIDE THE NECESSARY INTERGOVERNMENTAL AGREEMENTS.
AND HERE WE ARE SECOND READING AND THERE'S BEEN NO MOVEMENT THAT I CAN ASCERTAIN FROM ANY OF THE MUNICIPALITIES TO SIGN ON FOR THIS. AND SO I'M GOING TO GO NO AND I'M GOING TO I'M GOING TO BE A LITTLE OUT OR NEXT TIME THIS TIME I'M SAYING NO.
ANY OTHER COMMENTS, MR. RUN? >> WELL, I'M SENSITIVE TO WHAT WHAT BRIAN IS SAYING IS IT WOULD SEEM TO ME A POSSIBILITY IT WOULD BE THAT WE STILL APPROVE THIS BUT MAKE ITS EFFECTIVE DATE BE WHEN THE MINUTE ALL THE MUNICIPALITIES ARE SIGNED ON BECAUSE I DON'T THINK WE WANT TO BE IN A POSITION WHERE WE'RE NOT INCLUDING THEM BUT WE'RE
PROVIDING SERVICE. >> BRIAN. WOULD THAT WORK FOR YOU KNOW,
WHEN I'M SORRY. >> NO, I IN FACT AT THE NEXT MEETING I'M IN GREECE A MOTION THAT WE REMOVED THE SCHOOL IMPACT PIECE THAT WE PUT ON THE INCORPORATED AREA COUNTY WITHOUT ANY BUYING FROM THE MUNICIPALITIES. I THINK IT REALLY IS DETRIMENTAL TO THE DEVELOPMENT IN THE UNINCORPORATED AREA AND WE NEED TO NEED TO MAKE SURE
THAT IT'S THE SAME ACROSS THE COUNTY. >> DID YOU HAVE ANY COMMENT? I'M HERE TO ANSWER QUESTIONS ON HOUSING. YOU ALL KNOW THE ISSUES THAT THE COUNTY ADMINISTRATION IS HAVING WITH GETTING THEM IN THOSE COUNTIES TO STEP UP TO THE PLATE ON THE RGA. THEY TELL US SAY IF YOU DO THIS THEN WE'LL SIGN WE DO THAT.
[01:15:05]
AND THEN IT GOES BACK TO THEM AND THEN THEY SAY OH, WE'VE GOT ADDITIONAL CARD CONCERNS ANDQUESTIONS. >> I ASK WHAT THOSE CONCERNS AND QUESTIONS ARE AND I GET NO RESPONSE. SO WE'VE DONE EVERYTHING WE CAN WITH THEM AS PENALTIES THEY CONSENTED TO SIGN THE RGA IS IF WE PUT LOST ON THE BALLOT WE PUT LOST ON THE BALLOT.
I STILL HAVE THE RGA SO I'M AT A LOSS AS TO HOW TO MOVE MOVE THEM FORWARD.
I HAVE A MEETING SOMETIME THIS WEEK WITH DR. RODRIGUEZ TO TALK ABOUT SCHOOL IMPACT FEE BECAUSE I'VE I'VE SPENT A LOT OF COUNTY RESOURCES FIGHTING FOR THE SCHOOL IMPACT FEE WITH PARODIES AND I NO LONGER FEEL THAT IT'S APPROPRIATE FOR ME TO DO THAT. IF THE SCHOOL DISTRICT WANTS THE SCHOOL IMPACT THESE THEN THEY AND THE SCHOOL BOARD NEED TO STEP UP TO THE PLATE AND DEAL WITH THE MUNICIPALITIES IN ORDER TO GET THOSE MINUTES. MISS POLITICS BROUGHT TO SIGN THOSE RGA. I MEAN DON'T YOU AGREE MR. GREENWAY?
>> I HAVE A QUESTION. DON'T STEP AWAY. WE WE ARE ALL IN AGREEMENT THAT WE NEED THESE FACILITIES. IF THE MUNICIPALITIES USE THEIR FULLY I DO NOT AGREE.
JUST TRYING THE OTHER DAY WHERE WHAT WE HAVE THE REVENUE COMING TO US TO FUND THESE FACILITIES
THAT WE SO DESPERATELY NEED FOR FORMAT VALOREM TAXES. >> SO THE ONLY OTHER OPTION YOU HAVE THEN USED TO CHANGE THE TAX ACCRUES SO THAT WE CAN COLLECT ADDITIONAL REVENUE.
FROM THE TAXPAYERS TO FUND THESE THINGS BECAUSE FATALITIES INSIDE THE RGA WE'RE REQUESTING
TO DO IS THAT CORRECT? >> THAT'S CORRECT. OK.
THANK YOU. >> OK. MR. SUMMERS AND MR. SOMERVILLE . THANK YOU, SIR. I HAVE A PRETTY GOOD SUSPICION THAT THIS IS AN AREA WHERE THE GENERAL PUBLIC IS GOING TO DISAGREE WITH SOME OF THEIR ELECTED OFFICIALS. I THINK THE GENERAL PUBLIC UNDERSTOOD THE ISSUE HERE WHICH IS WHEN NEW FACILITIES ARE REQUIRED AND WHETHER TO OR WHETHER IT'S A PARK OR WHATEVER IT IS BECAUSE OF BECAUSE OF NEW DEVELOPMENTS, VERY SPECIFIC IDENTIFIABLE NEW DEVELOPMENT.
>> AND THEY ELECTED SOME ELECTED OFFICIALS WOULD PREFER TO HAVE THOSE COSTS SOCIALIZED ACROSS ACROSS THE US BOARD RATHER THAN HAVE THOSE CAUSING THE IMPACTS TO PAY FOR THE IMPACTS. I HAVE A FEELING THAT WE'D HAVE THE PUBLIC ON OUR SIDE AND FORTUNATELY IN THAT CASE HAS NOT BEEN MADE. THE MEDIA FOR WHATEVER REASON HAS NOT PICKED UP ON THIS AND HAS NOT ELECTED TO DISCUSS THIS MATTER OPENLY IN THE PRESS.
THEY MAY PREFER TO DO OTHER THINGS WHICH IS UNFORTUNATE BUT I THINK THAT IF WE COULD FIGURE OUT A WAY TO MAKE OUR CASE TO THE PUBLIC I THINK YOU'D SEE A LOT OF PRESSURE ON A LOT OF PUBLIC OFFICIALS WHO'VE BEEN DOUBLE CLUTCHING, WHO'D BEEN EQUIVOCATING, WHO'VE BEEN STONEWALLING, WHO'VE BEEN DRAGGING THEIR FEET ON ON TAXES IN GENERAL.
THIS IS THIS GOES BEYOND SCHOOLS AND SCHOOLS IS A HUGE ONE BECAUSE IT'S A BIG, BIG NUMBER. THE NUMBER OF DOLLARS THAT WE'RE GOING TO HAVE TO SPEND ON SCHOOLS AND BLUFFTON. YES. I SUPPOSE I SUPPOSE THE FOLKS IN WASHINGTON WOULD LIKE SOMEBODY ELSE TO PAY FOR THEIR SCHOOL.
BUT THE QUESTION IS WHETHER THAT'S REASONABLE OR NOT. THE LEGISLATURE GAVE US THE OPTION OF HAVING IMPACT FEES FOR A REASON BECAUSE THEY UNDERSTOOD THAT WHEN YOU CAN IDENTIFY SPECIFIC IMPACTS THAT IS THE STATE SPECIFIC NEW DEVELOPMENT IT CREATES AN IMPACT WHICH REQUIRES YOU PHYSICAL FACILITIES AND THOSE FOLKS OUGHT TO PAY FOR THOSE FACILITIES OR AT LEAST PROPORTIONATE THERE IS THERE'S A FORMULA FOR THIS WHICH IS WELL THOUGHT OUT HAS BEEN A LOT OF MONEY ON CONSOLES. SO WE CAN COME UP WITH THE ACTUAL IMPACTS IN THE NUMBERS THAT ARE ATTACHED TO THOSE IMPACTS.
AND SO JUST TO BE TO SIT BACK AND SAY OH WELL MUNICIPALITIES DON'T WANT TO PLAY BALL BECAUSE FOR WHATEVER REASON AND THIS PARTICULARLY GALLS ME SOME OF THE FOLKS THAT ARE RESISTING ARE PEOPLE WHO WERE INVESTED HEAVILY INVESTED IN DEVELOPMENT OR REAL ESTATE BECAUSE THEIR ARGUMENT HAS ALWAYS BEEN WELL YOU CAN'T HAVE THESE BECAUSE IT CUTS DOWN ON THE NUMBER OF HOUSES WE SELL. THERE'S PLENTY OF EVIDENCE IN OTHER PARTS OF THE STATE WHERE THIS IS ABSOLUTELY NOT YOUR COUNTY IS A PERFECT EXAMPLE WHERE THEY HAD A SEVENTEEN THOUSAND IMPACT FEE. THE HELP AND THE REAL CRIME, THE HIGH HEAVENS.
OH MY GOD WHEN THEY WOULD BE ABLE TO SELL ANOTHER HOUSE HAD MISLED KEPT AND KEEP SELLING
STILL SELLING SO I'M NOT. >> I UNDERSTAND THE ARGUMENT CONCERNED LEARNED SOME OF THE
[01:20:04]
MEMBERS OF COUNCIL HAVE THE FACT WE HAVE A PARTICULARLY SCHOOL FEES IN THE UNINCORPORATED KIND OF BUT I AM NOT READY TO THROW IN THE TOWEL.I'M READY TO FIGHT THIS ISSUE AND I THINK WE SHOULD. >> I'M GOING TO DO EVERYTHING I CAN TO FIGURE OUT A WAY TO GET THIS OUT TO THE PUBLIC AND I PROVIDE I PLEDGE MYSELF.
I JUST DON'T THINK IT'S RIGHT AND I JUST DON'T THINK WE SHOULD GIVE THE MUNICIPALITIES A PASS BECAUSE THERE THEY'RE THEY'RE STONEWALLING OR OR FABRICATING OR WHATEVER IT IS IF THEY'RE DOING ON THESE IMPACTED I DON'T REMEMBER ANY OF THEM COMING OUT NOW AND LOOK IN THE CAMERA DID I? WE WILL NOT AGREE TO AN IMPACT FEE BECAUSE LIST THE REASONS IT'S ALWAYS WELL WE'RE LOOKING AT THAT WELL WE'RE GOING TO DO THAT.
WELL WE'RE GOING TO GET SOME MORE INFORMATION. WELL, WE'VE GOT TO STUDY IT A LITTLE MORE AS CALL KICKING THE CAN DOWN THE ROAD. NO, THAT'S NOT FAIR.
IT'S NOT FAIR TO OUR TAXPAYERS. IT'S NOT REASONABLE BUT THEY'RE GETTING AWAY.
SO THAT'S MY POSITION. THANK YOU, MR. CHAIRMAN. IF I MAY I APPOINTED AFTER THE HEARING THAT HAS ITS MASS. IS THERE A COUNTY ADMINISTRATOR IS IT FAIR TO SAY THAT THE COUNTY PROVIDES FUNDING FOR ALL THE SERVICES THAT THE TOWNS RECEIVE OTHER THAN HILTON HEAD ? THAT IS CORRECT. THANK YOU.
>> AND I WOULD SAY ONE ADDITIONAL THING THAT I THINK WHAT'S HAPPENING HERE I THINK THESE MUNICIPALITIES ARE COMING UP WITH THESE QUESTIONS THAT THEY THE COUNCIL ABOUT ANSWER AND THESE MODIFICATIONS TO THE RGA SO THAT THEY CAN MAKE THE COUNCIL LOOK LIKE THE STOPPING
POINT FOR THE IMPACT FEE. >> RGA IS NOT BE AN INNER TWO BECAUSE THEY CAN SAY WELL WE SAID THAT WE WOULD SIGN THE RGA IS UNDER THESE TERMS BUT THE COUNTY COUNCIL REJECTED OUR
TERMS SO IT'S NOT OUR FAULT. THE RGA IS DIDN'T GET SIGNED. >> IT'S THE COUNTY COUNCIL'S FAULT. SO JUST BE CAREFUL WITH THAT AND BE MINDFUL OF THAT AS WE
MOVE THROUGH THIS PROCESS. >> FINAL COMMENT, MR. CUNNINGHAM AND THEN MR. LAWSON.
JUST DOESN'T TELL PAUL AND MR. MCCLELLAN HAD A LOT OF FUN WITH YOU GUYS THE LAST COUPLE OF WEEKS. I'M ENJOYING BRIAN. I DO AGREE WITH YOU.
I THINK IF THEY DON'T SIGN ON, WE'RE GOING TO BE IN THE SAME BOAT THAT WE ARE NOW.
MR. LAWSON AND YOUR JUST ASK YOU BECAUSE OBVIOUSLY WE HAVE A IMPACT FEE A FIRE FEE THAT'S IN PLACE AND EVERYTHING THAT I'VE UNDERSTOOD RECENTLY IS THAT WE'VE ACTUALLY BUILT THE IMUS
AS PART OF THE FIRE STATION. >> SO THE ONLY REASON WE'RE RECOMMENDING THIS RIGHT NOW IS BECAUSE TISCHLER VISES SAID WE NEED TO COLLECT ADDITIONAL FUNDS THOUGH CAN CAN THE MSP BUILT WITH THE FIRE FEE FUNDS AS PART OF THAT AS PART OF THE ORIGINAL BUILDING WE HAVE
CURRENTLY? >> NO, WE FABRICATE THEM TO THINK ABOUT THE DOMESTIC IMPACT FEES. YOU GOT TO KEEP IN MIND THE IMPACT FEES NOT ONLY ALLOW YOU TO BUILD BUILDINGS BUT IT ALLOWS YOU TO BUY EQUIPMENT IN EXCESS OF 100000 DOLLARS.
SO THIS WOULD ALSO ALLOW IMPACT FEES FOR UMASS AND ALSO ALLOW US TO BUY AMBULANCES AND THINGS
LIKE THAT SERVICE ART E-MAILS, DEPARTMENT SOUTH OF THE BROAD. >> THANK YOU REMNANT NETWORK.
YOU KNOW, I UNDERSTAND THE SCHOOL PIECE AND I THINK YOU'RE ON A TRACK TO RESOLVE THAT ONE WAY OR THE OTHER. THESE OTHER ONES ARE SMALLER AMOUNTS.
ARE YOU ARE YOU GETTING PUSHBACK ON THE AGES ON THESE ONES OR JUST ON THE SCHOOL?
>> YES, I THINK THAT THE WAIT IS THIS ONE IGAD COVER ALL OF THEM OR CAN THEY BE?
>> ARE THEY CONSIDERED SEPARATELY BY THE MUNICIPALITIES? THEY'VE DONE WE'VE DONE SEPARATE. OK.
BUT DO YOU SENSE ANY THAT YOU'RE GETTING A LOT OF PUSHBACK THAT MEMORY THESE NUMBERS WERE NOT REAL BIG LIKE NO COME OUT FOR ME AND THAT THEY'RE GOING TO I MEAN I HOPE
PEOPLE TELLING ME THAT THEY'RE REALLY BY THE RGA. >> ONCE YOU ADOPT THEM BUT YOU KNOW, I ALSO HAD THEM TELL ME THAT WHENEVER WE ADOPTED THE SCHOOL IMPACT FEE AS WELL AS REASONED ARIA I WENT AHEAD RECOMMEND YOU ALL THAT WE DO IT SO THAT WE COULD NOT LEAVE MONEY ON THE TABLE IN THESE DEVELOPMENTS AND THAT'S KIND OF BLOWN UP IN MY FACE.
AND I HAD I HAD A HAD A BEEN A LITTLE WISER I WOULD NOT HAVE DONE THAT.
SO I AGREE WITH COUNCIL MEMBER FLEW ELEMENT THAT YOU KNOW, I WOULD I WOULD RECOMMEND THE COUNCIL THAT YOU ALL SAY WE'RE GOING TO GIVE THE SECOND READING WE'RE GOING IN THIS OTHER IMPACT FEE SECOND READING. BUT I MEAN THOSE PENALTIES GIVE US THE IGAD BEFORE THIRD READING AND IF YOU DON'T DON'T COME AND ASK US TO GET INVOLVED
IN TRYING TO PROTECT GROWTH IN YOUR COMMUNITY. >> DON'T COME TO US ASKING US TO PROVIDE ADDITIONAL REFERENDUMS FOR YOUR COMMUNITY. DON'T COME TO US AND ASK US FOR ANY TYPE OF REVENUE STREAM. I THINK WE'RE AT THAT POINT RIGHT NOW IF I MAY BE SIMPLE.
>> I THINK YOU STATED VERY WISELY AND THAT'S WHERE I THINK WE SHOULD DO.
YES, I TOTALLY AGREE WITH EVERYONE WHO SAYS WE NEED MORE PUBLICITY ON THIS AND WE NEED
[01:25:05]
TO TOOT OUR OWN HORN BECAUSE THE NEWSPAPERS HAVE NOT BEEN DOING THAT FOR US.LOOK, FOR WHATEVER REASONS I HAVE OTHER PRIORITIES. BUT WHEN YOU TALK ONE ON ONE WITH CONSTITUENTS THEY TOTALLY UNDERSTAND IMPACT FEES. THEY GET IT.
THE ELECTED OFFICIALS MISS PENALTIES. SOME OF THEM ARE SUPPORTIVE.
SOME OF THEM ARE. AND I THINK WE NEED TO GET OUR CONSTITUENTS BOTH AND UNINCORPORATED AREAS AND UNINCORPORATED THAT EVERYONE PAYS THEIR FAIR SHARE IF WE'RE GOING TO BUILD HOUSES, BUILD BUILDINGS, BUILD COMMERCIAL FACILITIES IN OUR COUNTY.
IT'S NOT PUT ON THE OTHER TAXPAYERS WHO ARE ALREADY HERE. >> ONE FINAL COMMENT.
I BELIEVE I ASKED THE ADMINISTRATION TO PUT TOGETHER A CHART OF ALL OF THE IMPACT FEES WHICH I THINK YOU DID AND MAY HAVE SENT IT TO ME AND I DON'T THINK IT WENT TO ALL
COUNCIL. >> WE WILL SEND THAT TO YOU. OK.
IF WE WOULD DO THAT BECAUSE I THINK THAT IS ESSENTIAL WHEN WE GO ON TO DO THESE FOR THE FINAL READINGS THAT WE ALL UNDERSTAND AND THAT THE PUBLIC SEES EXACTLY WHO IS PAYING WHAT.
>> OK. ALL RIGHT. I'M GOING TO CALL THE QUESTION MR. RUDMAN, YOU MADE THE MOTION YOU WILL VOTE FIRST. YES, MR. MCCLELLAN, YOU.
>> I'M SORRY YOU SAID YES. YOU ASKED RODMAN OR ME IF MR. RODMAN SAID YES.
>> YOUR NEXT. YES, MR. CUNNINGHAM. YES.
>> MR. DAWSON. YES, MR. FLOWING? NO.
>> MR. GLOVER. >> WE KNOW MR. HER VISION. YES.
BUT BARELY MISS HOWARD. YES, MR. LAWSON. MARK LAWSON.
[20. PUBLIC HEARING AND SECOND READING OF AN ORDINANCE FOR APPROVAL OF A TEXT AMENDMENT TO THE BEAUFORT COUNTY CODE OF ORDINANCES, CHAPTER 82: IMPACT FEES, ARTICLE I, IN GENERAL; ARTICLE II, DEVELOPMENT IMPACT FEE PROCEDURES; ARTICLE, III, PARKS, AND RECREATION FACILITIES; ARTICLE V, LIBRARY FACILITIES; ARTICLE VI, FIRE FACILITIES; AND EFFECTIVE DATES.]
CHAIR VOTE YES. >> THE MOTION PASSES 9 YES TO NO.
ITEM NUMBER 20 I ASKED FOR A MEMBER TO OFFER A PUBLIC HEARING AND SECOND READING OF THE ORDINANCE FOR THE APPROVAL OF A TEXT AMENDMENT TO THE BEAUFORT COUNTY CODE OF ORDINANCES CHAPTER 22 IMPACT FEES. ARTICLE 1 IN GENERAL ARTICLE 2 DEVELOPMENT IMPACT FEE PROCEDURES. ARTICLE 3.
PARKS AND RECREATION FACILITIES. ARTICLE 5 LIBRARY FACILITIES.
ARTICLE 6 FIRE FACILITIES. AND EFFECTIVE DATES. A MOTION PLEASE.
I'LL MAKE THE MOTION, MR. CHAIRMAN. MISS HOWARD MAKES THE MOTION SECOND PLEASE. I'LL SECOND MR. LAWSON MAKES THE SECOND.
ANY MEMBER OF THE PUBLIC WHO'S LEFT THE ENTIRE YOU OUT JUST TO MAKE A COMMENT SAYING THE
PUBLIC PORTION IS CLOSED. ANY COMMENT FROM MY COLLEAGUES? >> YES.
I MEAN WE HAVE THE SAME OBJECTIONS TO THIS AND WE'LL ALSO VOTE NO AGAIN.
GOOD. ANY OTHERS AS CHAIRMAN? CHAIRMAN.
MR. GLOVER IS NEXT AND THEN YOU, MR. DOTSON. OH.
>> ONLY THE. JUST FOR ME. PROBABLY WILL VOTE NO FOR THIS AS WELL. BUT WHAT IS THE DIFFERENCE BETWEEN THE RATES ON NORFOLK ROW ITSELF AND WHY THERE IS THAT BIG DISTINCTION BETWEEN THE TWO JUST SUZY'S DONE.
WE'LL GET AN ANSWER TO THAT. IN THE MEANTIME, MR. DAWSON. I WAS JUST GOING TO ASK ONE OF OUR STAFF MEMBERS TO PROVIDE A LITTLE DETAILED INFORMATION ON THIS.
ON THIS SECOND READING FOR THE TAXMAN, OK. VERY GOOD TO US ALL.
MR. GREENWAY, MR. GLOVER ASKED THE QUESTION WHY IS THERE A DIFFERENTIAL BETWEEN NORTH OF THE BROAD AND SOUTH OF THE BROAD REGARDING THESE FEES? NUMBER ONE, AND MR. DAWSON WOULD LIKE A LITTLE BIT MORE OF AN EXPLANATION OF WHAT DO YOU MEAN BY THE TEXT AMENDMENTS SO. SO THE DIFFERENTIAL IMPACT FEES OR ARE EXACTLY WHAT THE TITLE SAYS IS BASED ON THE IMPACT. AND IT'S BASED ON THE PORTION OR SHARE FOR THE SERVICE AREA FOR WHICH THAT FEE IS DESIGNATED. SO WHENEVER YOU HAVE MORE PEOPLE YOU HAVE A NEED FOR MORE FACILITIES WHICH MAY MAKE THE NEED FOR AN IMPACT FEE TO BE HIGHER IN THOSE AREAS MORE POPULATION SPREAD OUT PROPORTIONATELY BECAUSE OF THE NEED FOR ADDITIONAL SERVICES IN THOSE AREAS FOR CAPITAL IMPROVEMENTS AND ADDITIONAL
[01:30:03]
CAPACITY COULD GRAB A DIFFERENTIAL IN THE FEES. >> BRAWL VS. NORTH OF THE BROAD PREVIOUSLY MANY CURRENTLY MANY OF THESE IMPACTED DISTRICTS HAVE SEVERAL SERVICE AREAS.
WHENEVER WE DID THE IMPACT FEES STUDY WE COMBINE ALL THOSE SERVICE AREAS TO HAVE US OUT OF THE BROAD SERVICE AREA AND AWARDS AND THE BROAD SERVICE AREA OR IN THE CASE I BELIEVE MASS IS AN ALL COUNTY SERVICE AREA. SO EVERYBODY ACROSS THE COUNTY WILL PAY THE SAME IMPACT FEE IF THAT GETS ADOPTED BUT SET FREE FOR MOST AROUND THESE SOUTH LIBERAL SERVERS HERE IN NORTH AND BROAD SERVICE AREA THERE IS DISTINGUISH THESE IN THOSE TWO
AREAS. >> SO IT'S BASED ON THE NEED FOR FACILITIES AND BASED ON THE NUMBER OF PEOPLE THAT CAN PAY FOR THOSE FACILITIES AND THAT'S BASED ON WHAT THE CAPITAL IMPROVEMENT PLANS CALL FOR OR FOR THOSE SERVICE AREAS IN THE COUNTY.
SO WE DON'T NEED AS MANY LIBRARIES MORE THAN ABROAD AS WE MIGHT NEED IN THE FUTURE.
SOUTH ABROAD. SO THEREFORE THERE'S LESS LIBRARIES IN THE CAPITAL IMPROVEMENT PLAN FOR THE LIBRARIES DIVISION ABROAD. THAT LOWERS THE FEE IF THAT
MAKES SENSE DOESN'T MAKE SENSE . >> WELL, I THINK IF I UNDERSTAND YOU IT'S WHAT YOU WHAT WAS SHE SAYING SHOWING HERE IS THE OPPOSITE WHICH IS SAYING WHAT DO YOU MEAN BY THAT? WELL, I WOULD THINK THE GROWTH ON SOUTH ROAD MAKING THEY NEED GREATER MEANS THAT THE IMPACT FEE MAY BE HIGHER NOT ABROAD.
THE NEED IS NOT AS GREAT BUT THE FEES ARE REFLECTING A HIGHER FEE NORTH ABROAD VERSUS
SOUTH AND ABROAD NOT NOT IN ALL CASES SHOULDN'T. >> OH LOOK, I DON'T.
>> I DON'T HAVE I DON'T HAVE THE NUMBERS IN FRONT OF ME. BUT IF I RECALL CORRECTLY I BELIEVE AND SEVERAL CASES ACROSS THE BOARD FOR VARIOUS WELL-FUNDED OPPONENTS OF THE LIBRARY IMPACT FEE DROPPED IN THE SYDNEY BEACHFRONT TOWN OF CORAL DID NOT COLLECT LIBRARY FEES AT ALL. SO I'M ONE OF ONE OF THE ADDITIONAL THINGS THAT MR.
DOBSON DID I ANSWER YOUR QUESTION? >> SO CURRENTLY THIS IS A DIFFERENT SITUATION THAN WE HAVE IN ANY OTHER SITUATION THAT I'M WITH THE E-MAILS THAT I TO MAKE COUNCIL AWARE. CURRENTLY YOU'RE CONSIDERING RIGHT NOW AN AMENDMENT TO
IMPACT FEES THAT WE ALREADY HAVE IN PLACE. >> STATUTORILY REQUIRED TO UPDATE THE IMPACT STUDY. GIVEN A PERIOD OF TIME 10 YEARS.
SO IF YOU ALL DO NOT VOTE FOR THIS PARTICULAR TEXT THEN YOU'RE GOING TO ESSENTIALLY VOTING TO DO AWAY WITH THE EXISTING IMPACT FEES THAT WE CAN'T COLLECT TRASH PATIENT PARKS REC FIRE AND THE AND THE ONES AND LIBRARIES THAT WE HAVE IN PLACE CURRENTLY.
>> IS THAT CLEAR TO EVERYONE BECAUSE WE'RE NOT GOING TO BE ABLE TO CONTINUE TO COLLECT
THAT FEE IF WE DON'T UPDATE THE STUDY? >> I WANT YOU ALL TO BE CLEAR ABOUT WHAT YOU'RE GETTING READY TO VOTE ON ANY I.D. ON THESE ONES.
THERE ARE CURRENTLY DAYS ON SOME OF THE TIME WITH BLUFFTON AND TOWN AT HILTON HEAD OKATIE TOWN OF VIEW STUDIO BEAUFORT AND CAL PORTNOY OF TRANSPORTATION CITY OF BEAUFORT DOES NOT COLLECT LIBRARY IN PARKS AND REC FEES DUE BACK TO THE E-MAIL THAT YOU RECEIVED THIS WEEKEND ABOUT THE CONDITIONS OF PARKS REC FACILITIES IN THE CITY OF BEAUFORT. THERE'S A REASON WHY THEY ARE THAT WAY.
THEY DO ALSO NOT COLLECT THE LIBRARY IMPACT FEE TOWN OF PORT ROYAL.
THE SAME REASON SO CELIA BEAUFORT ON THE LIBRARY IMPACT FEE.
MANY, MANY HERE ARE A COUPLE YEARS AGO AGREED TO SIGN THE LIBRARY RGA TO COLLECT THE CURRENT FEE IF WE WOULD MOVE THE TRASH COMPACTOR AT THE LIBRARY.
WE MOVE SAID TRASH COMPADRE AT THE LIBRARY. GUESS WHAT? STILL DON'T HAVE THAT RGA. THESE IJA WITH THE EXISTING ONES HAVE TO BE RENEGOTIATED OR DO THEY AUTOMATICALLY CONTINUE? YOU KNOW WE WOULD GIVE THEM NEW ADJECTIVES BASED ON THE NEW FEES. OK. DOES EVERYBODY NOW UNDERSTAND
WHAT WE'RE VOTING ON? >> OK, IS THERE ANY OTHER COMMENTS THIS WILL BE APPROVED
UNANIMOUSLY WITHOUT OBJECTIONS . >> ARE THERE?
>> NO, NO. YEAH, I HAVEN'T A PROJECTION. LIKE DALLAS NEVER MIND THE ADMINISTRATOR THEN ANOTHER CONDITION THAT WAS PUT ON YEARS AGO WAS THAT THE LIBRARY BOARD
[01:35:05]
HAD CONTEMPLATING MOVING THE HEADQUARTERS THE ADMINISTRATION SECTION.THE LIBRARY. HOW DID YOU. HORTON WEALTH PARK.
IN ORDER TO FREE UP SPACE FOR THE LIBRARY AND REMOVE THE ADMINISTRATION PART OF IT.
AND SO IT HAD BEEN IN THE LIBRARY'S COMPREHENSIVE PLAN OR THEIR PLANNING DOCUMENTS.
THAT MOVE WAS GOING TO TAKE PLACE AND THEY OBJECTED TO THAT WITHHELD VOTE ON THE IMPACT FEES BECAUSE OF THAT AND THE LIBRARY BOARD EVENTUALLY REMOVED THAT REQUEST THAT THAT COMPREHENSIVE PLAN START TO END AND PERMITTED TO RETAIN THE ADMINISTRATION OF THE LIBRARY
SYSTEM WITHIN THE CITY OF BEAUFORT. >> THEY STILL HAVEN'T VOTED FOR THE IDEA, VOTED FOR VS THE CITY OF BEAUFORT. SO ON.
YES. >> IS THERE ANYONE I WOULD KNOW WHICH IS TO VOTE NO? BESIDES MR. CAN I COMMENT BEFOREHAND AFTER HERE MISCREANTS IT'LL BE QUICK I PROMISE. I JUST HOPE PEOPLE CAN SEE LIKE WE'RE ALL UP HERE ON COUNCIL AND WE'RE CONTINUALLY HAVE TO WORK WITH ALL THE MUNICIPALITIES AND I JUST LEARNED THIS INFORMATION ABOUT YOU FOR NOT SIGNING ON FOR THE LIBRARY AND I LIVE IN BLUFFTON AND IT'S REALLY FRUSTRATING FOR US TO BE UP HERE WHEN THE ONES THAT ARE BEING AFFECTED ARE THERE THE VOTERS YOU GUYS ARE THE ONES BEING AFFECTED BY PEOPLE NOT SIGNING ON TO THE AGREEMENT. WE HAVE A SCHOOL IMPACT FEE IN PLACE FOR I THINK SIX, SEVEN MONTHS NOW. AND RIGHT NOW THE COUNTY IS THE ONLY ONE SIGNED ON THAT NOBODY ELSE IS COLLECTING A DIME, JUST THE COUNTY. EVERYONE ELSE SAID THEY SIGN ON. THEY HAVE NOT. THIS IS WHY WE'RE UP HERE WARY ABOUT MOVING FORWARD WITH THESE BECAUSE APPARENTLY BEAUFORT HASN'T SIGNED ON TO A LIBRARY, ONE THAT'S DONE YEARS AGO AND NOW WE HAVE ISSUES WE DON'T HAVE THE REVENUE TO GET IT DONE. BUT THEY'RE GOING TO COME TO BLUFFTON SIDES EXACTLY WHAT'S GOING TO HAPPEN. BLUFFTON IS GONNA FIX THE LIBRARY IN BEAUFORT BECAUSE THEY SIGNED ON TO IT. OR VISE VERSA DOWN THE STREET. THUS THE SCHOOL IMPACT FEE NORTH OF LEBRON ISN'T PAYING FOR THE SCHOOL IMPACT FEE THAT SOUTH OF ABROAD IS BUT IT'S GONNA GO ACROSS THE COUNTY. THIS IS WHY THESE THINGS ARE FRUSTRATING.
AND HONESTLY I FEEL FOR IT AND I HOPE THAT PEOPLE THAT ARE WATCHING IT'S NOT JUST US THAT MAKE THESE DECISIONS. IT IS THE TOWN OF BEAUFORT, TOWN OF PORT ROYAL, TOWN OF BLUFFTON AND TOWN OF HILTON HEAD THAT ALSO NEED TO ANSWER THE SAME QUESTIONS THAT WE DO.
THANK YOU. >> ANYONE ELSE WHO WISHES TO VOTE NO BESIDES MR. FLEW ALONG
MR. GLOVER OR ANYONE ELSE? >> THEREFORE SEEING NO OTHER OBJECTIONS.
THIS MOTION WILL BE APPROVED 10 9 YES AND 2 OUR LAST PUBLIC HEARING.
[21. PUBLIC HEARING AND SECOND READING OF AN ORDINANCE FOR APPROVAL OF A TEXT AMENDMENT TO THE COMMUNITY DEVELOPMENT CODE (CDC): SECTION 4.1.70 (DRIVE-THROUGH FACILITIES) TO CLARIFY THE STANDARDS FOR DRIVE-THRU IN TRANSECT ZONES AND TO ADD/AMEND STANDARDS TO MANAGE THE DEVELOPMENT OF DRIVE-THROUGHS IN BOTH THE TRANSECT AND CONVENTIONAL ZONES.]
>> A MOTION FOR A PUBLIC HEARING AND SECOND READING OF THE NEW ORDINANCE FOR THE APPROVAL OF A TEXT AMENDMENT TO THE COMMUNITY DEVELOPMENT CODE SECTION FOUR DASH ONE DASH 17 DRIVE THROUGH FACILITIES TO CLARIFY THE STANDARDS FOR DRIVE THRU TRANSACT ZONES AND TO ADD SLASH AMEND STANDARDS TO MANAGE THE DEVELOPMENT OF DRIVE THRU. IN BOTH THE TRANS AND CONVENTIONAL ZONES A MOTION PLEASE. I'LL MAKE THE MOTION MR CAMERON HOWARD MAKES THE MOTION A SECOND PLEASE. I'LL TAKE AN MR SOMERVILLE MAKES THE SECOND. MISS HOWARD DO YOU WISH TO COME IN FIRST?
>> NO, I DON'T. MR SOMERVILLE THANK YOU CHAIRMAN.
>> I HAVE BECOME CONVINCED THAT HAVING THESE HIGH DENSITY AREAS PARTICULARLY IN THE LADY'S ISLAND AREA WHERE FUNNELED THROUGH OR LARGE TO TO HAVE DRIVE THROUGH IS THAT HAVE THE POTENTIAL OF HAVING LONG, LONG LINES. IT'S JUST TOO DANGEROUS TO HAVE THE THING OFF BORROWED FROM AN ARTERIAL ROAD. I KNOW THIS.
THIS SUGGESTS THAT THEY CAN ACCESS OFF AN ARTERIAL ROAD AS LONG AS THEY HAVE A SECONDARY ACCESS. I'M NOT SURE I'M EVEN COMFORTABLE WITH THAT BUT I'M GOING TO VOTE FOR MY SISTER. THIS WILL BE BETTER AND CERTAINLY BETTER THAN WHAT WE HAVE WHICH IS WHO I HAD ACCESS PRIMARY ROAD AND BACKUP IN THE STREET.
I'VE HAD ONE DEVELOPER TELL ME THAT THE SOLUTION ISN'T TO RESTRICT RESTRICT ACCESS TO
SECONDARY ROADS, SECONDARY ACCIDENTS. >> THE SOLUTION IS TO HAVE MORE DRIVERS FOLLOW ME ON THOSE SOLUTIONS HAVE MORE DRIVE BECAUSE WE HAVE MORE DRIVE THROUGH AS IT SPREADS THE POPULATION OF PEOPLE INTO THE DRIVE THRU IS OUT AND SIMPLY
[01:40:03]
NOT ENOUGH AT ANY ONE GIVEN LOCATION BACKUP. SO I SAID I DON'T ACCEPT THAT LOGIC. ANYWAY I'M GOING TO ABSOLUTELY SUPPORT THIS.>> THANK YOU. >> OK. BASED UPON WHAT YOU JUST HEARD, IS THERE ANY MEMBER OF THE PUBLIC WHO WISHES TO COMMENT ON THIS ITEM? IMPORTANT AS IT IS SAYING NONE WILL CLOSE THE PUBLIC PORTION. MR. BLOSSOM NO.
>> MISS BROCK WOULD JUST WANT TO HELP YOU TO LET YOU KNOW. >> LET ME EXPLAIN THAT.
I THOUGHT IT WOULD STIR UP THE FINALLY BECAUSE THIS IS THIS IS VERY TOPICAL.
THIS PARTICULAR ONE. ANY OTHER COMMENTS FROM ANYONE SEEING NONE.
THIS WILL BE APPROVED UNANIMOUSLY UNLESS THERE IS ANY OBJECTION.
IS THERE ANY OBJECTION SEEING NONE. THE ITEM IS APPROVED

[24. FIRST READING OF AN ORDINANCE TO APPROVE THE TEXT AMENDMENTS TO CHAPTER 14, ARTICLE II: ANIMAL CONTROL ORDINANCES]
THIS WILL BE APPROVED UNANIMOUSLY WITHOUT OBJECTION. AND THERE ARE NO OBJECTIONS.ITEM NUMBER 24 A MOTION FOR THE FIRST READING OF THE ORDINANCE TO APPROVE THE TEXT AMENDMENTS TO CHAPTER 14 ARTICLE 2 ANIMAL CONTROL ORDINANCES. MAY I HAVE SUCH A MOTION
PLEASE? REMOVE MISS THE CHAIR. >> MR. MCCOLLUM MAKES THE MOTION. SECOND AND MR. CUNNINGHAM MAKES THE SECOND.
IS THERE ANY DISCUSSION, MR. LLEWELLYN? THANK YOU.
MR. CHAIRMAN, I HAVE. I HAVE QUESTIONS AND COMMENTS AND POTENTIALLY A POTENTIALLY A MOTION. MY FIRST QUESTION I ASSUME SOMEONE AROUND STAFFERS THERE TO BE ABLE TO ANSWER THIS WHAT WHAT MAKES STAFF BELIEVE THAT MAGISTRATE WOULD HAVE THE ABILITY TO DETERMINE A BREED? WHAT SPECIAL SPECIAL TRAINING THEY GET WHAT WHAT KIND OF EVIDENCE IS REQUIRED FOR THEM TO MAKE THAT KIND OF DETERMINATION? THERE IS A REGISTERED BREED VIOLATION EVIDENCE WOULD BE BROUGHT IN FRONT OF THE JUDGE BY PROSECUTION DEFENDANTS ATTORNEY OR COUNSEL WOULD HAVE THE ABILITY TO DEFEND THEIR CASE. I'M NOT SURE I'M NOT SURE I UNDERSTAND YOUR QUESTION AS FAR
AS SPECIAL TRAINING. >> SURE. >> JUST DID THE MAGISTRATES OBTAIN ANY KIND OF SPECIAL TRAINING? DID THEY HAVE ANY SPECIAL QUALIFICATIONS TO BE ABLE TO DETERMINE AGREED THAT THEY KNOW? TO ANSWER YOUR QUESTION, THERE IS NO SPECIAL TRAINING FOR THE JUDGES.
SO WHAT KIND OF EVIDENCE WOULD BE PRESENTED TO THAT MAGISTRATE TO MAKE A JUDICIAL
DETERMINATION? >> OKATIE SAID THE FIRST THING YOU KNOW STATE LAWS TO PROVIDE RABIES AND ON THE RABIES IT HAS THE BREED OF DOG FROM A VET. SO THAT'S TYPICALLY WHAT WE BRING TO THE JUDGE IS THAT IT SAYS RIGHT THERE WITH THE BREED IS DOES THAT MAKE SENSE? YES, AND I APPRECIATE THAT. WELCOME. I'M WONDERING IF IF IT MIGHT BE MORE BENEFICIAL I'M SURE THAT THERE IS DNA TESTS THAT CAN BE DONE TO DEFINITIVELY DETERMINE
THE DOG'S GRADE. >> I DON'T THINK IT'S APPROPRIATE TO INCLUDE DNA AS A LEGAL RESOURCE AT OUR ORDINANCES. WHY? WHY DO YOU THINK THAT'S DNA? DOG TESTING IF YOU LOOK UP THE ASPCA CASEY CASEY HAS ACTUALLY STATED ONLINE THAT DNA TESTING CANNOT BE USED TO DETERMINE BREEDS.
>> DID THEY GIVE A REASON THAT THERE'S THERE'S BEEN STUDIES THAT PEOPLE HAVE USED FOR DIFFERENT TESTS AND IT COMES BACK ALL DIFFERENT? SAME OLD ONES NOT IDENTICAL.
[01:45:02]
SO YOU KNOW, AGAIN IN THE VEGETARIAN CELL THESE. BUT ANYWAY, WE DON'T.I DON'T EIGHT CASES AGAINST IT. A LOT OF ORGANIZATIONS ARE AGAINST IT.
THAT'S WHAT WE'D BRING IT. SO I'M SURE THAT THAT DOG BREEDS ESPECIALLY DIFFICULT
USING DNA EVIDENCE TO THE DETERMINE THE BREED. >> BUT IT'S CERTAINLY I THINK WOULD BE POTENTIALLY HELPFUL. WE OUGHT TO CONSIDER TALLULAH PLEASE KEEP TRACK OF THAT AS
THAT HAS AS A POTENTIAL RESOURCE FOR US. >> I'M I'M LEERY OF PUTTING THIS ON MAGISTRATE FOR YOU WITH LIMITED INSTRUCTION ON HOW TO HOW TO GO THROUGH IT AND LIMITED TRAINING ON IT. SO I'M GOING TO I'M OKAY WITH IT BUT I'M I'M I'M DOUBTFUL I
HAVE MY DOUBTS. >> SO JUST BE BE WARY THAT YOU KNOW, AS IT'S TECHNOLOGY IMPROVES IN THAT AREA, MAYBE WE CAN THEN ADD THAT AS AN AIDE TO THE MAGISTRATE THAT REQUIREMENT FOR A DNA TEST AS AN AIDE TO THE MAGISTRATE. I'M NOT AGAINST REQUIRING IT IN THOSE CIRCUMSTANCES WHEN WHEN A DOGS BREED IS DETERMINED JUDICIALLY.
OK, THAT'S NUMBER ONE. NUMBER TWO, I'M I'M UNAWARE OF ANY SEES THIS WILL BE FOR BRITAIN OR ANY SPECIES THAT ARE DETERMINED SOLELY BY THE ADMINISTRATOR.
>> I'M WONDERING WHETHER THAT'S EVEN LEGAL. HOW CAN IT BE IMPOSED WITHOUT A VOTE? THE COUNTY COUNCIL APPROVING CHANGING, MODIFYING.
HOW WAS THAT EVEN LEGAL? >> MINNESOTA CAN SET CERTAIN FEES.
THOSE THAT PLACE WHICH FEES DOES HE SET RIGHT? I CAN'T NAME ONE OFF THE TOP
OF MY HEAD BREEDERS BECAUSE HE DOESN'T LICENSE. >> WELL, THAT'S AN AD TO ADD THAT IN WHAT I'M SAYING RIGHT NOW IS THERE A FEE THAT IS DETERMINED BY THE ADMINISTRATOR? WAS THERE A SINGLE FEE THAT'S NOT APPROVED BY CURRENT
COUNCIL? >> I CAN'T NAME OFF THE TOP OF MY HEAD NOW.
>> IT'S BECAUSE I DON'T BELIEVE ONE EXISTS AND I DON'T BELIEVE IT'S LEGAL.
AND SO I'M GOING TO MAKE A MOTION, MR. CHAIRMAN, THAT WE REMOVE ANY REFERENCE TO THE COUNTY ADMINISTRATOR SETTING FEES AND THAT WE RETAIN THE ABILITY TO SET FEES AT THE COUNTY COUNCIL LEVEL BECAUSE THERE IS A CERTAIN DOES EVERYBODY UNDERSTAND THE MOTION ,THE AMENDED MOTION? IS THERE A SECOND TO THE AMENDMENT? SECOND. SECOND MR. RODMAN MAKES THE SECOND IT WAS MOTION DIDN'T SECONDED MR. FOR LONG. WHAT'S THE LANGUAGE CHANGED TO REMOVE ANY REFERENCE TO THE
COUNTY ADMINISTRATOR SETTING FEES? >> IS THAT A FAIR STATEMENT
OF YOUR MOTION? >> YES. BROOKE.
RIGHT NOW IN THIS THROUGHOUT THAT THEY MAKES THE COUNTY ADMINISTRATOR THE RESOURCE SETTING PIECE AND I THINK THAT THAT ANY FEES COUNTY THAT ARE CHARGED BY THE COUNTY NEEDS TO
BE APPROVED BY CAN WE COUNT? >> SO I JUST CAN'T SEE THE ADMINISTRATOR.
AND THE REASON FOR THAT IS THAT THE THAT THE ABILITY TO SET THESE IS VESTED IN THE COUNTY AND NOT IN THE ADMINISTRATOR BECAUSE THE COUNTY IS DIRECTLY RESPONSIBLE TO THE PEOPLE AND THE CITIZENS WOULD BE FOR COUNTY IT'S TOO FAR REMOVED HAVING THE ADMINISTRATOR BE
RESPONSIBLE TO THE CITIZENS FOR THAT. >> MR. RUDMAN.
DO YOU WISH TO REMARK ON THE. NO, I AGREE I DID. I WAS ALWAYS UNDER THE
IMPRESSION THAT COUNCIL HAD TO SET FEES. >> IS THERE ANYONE ELSE WISHES
TO SPEAK ON THE OK? ALL RIGHT. >> THIS WILL BE APPROVED WITH OUT OBJECTION MOTION MADMEN THE AMENDMENT MOMENT. OK, EVERYBODY STAY.
I UNDERSTANDS THE AMENDMENT IS TO REMOVE LANGUAGE IN THE PROPOSED TEXT AMENDMENT REFERRING TO THE COUNTY ADMINISTRATOR MOTION IS APPROVED UNANIMOUSLY WITHOUT
OBJECTION. >> NOW WE'RE BACK TO THE MAIN MOTION WITH THE AMENDMENT.
IS THERE ANYONE HAS ANY FURTHER DISCUSSION? >> BANGING ON DOOR.
LA SCENE SEEING NONE. THE AMENDED MOTION WILL BE APPROVED WITHOUT OBJECTION.
[Items 25 & 26]
>> OK. >> THE NEXT TWO ITEMS WILL BE TAKEN TOGETHER.
ITEMS 25 AND 26 ARE APPROVAL OF RESOLUTION RESOLUTIONS OF STORM WATER
