UM, WE'RE GOING TO GO OVER THE LOCATION AND CURRENT CONDITIONS OF THE PROPERTY, UM, THE OWNERSHIP AGREEMENT, AS WELL AS FINANCIAL AND MAINTENANCE RESPONSIBILITIES AND THE NEXT STEPS FOR THIS AGREEMENT.
UM, THIS IS THE LOCATION OF THE FORD SHOW RING PROPERTY.
IT IS ON SQUIRE POPE ROAD, NEAR THE ROUNDABOUT WITH GUMTREE ROAD, UM, AND IS CURRENTLY HEAVILY VEGETATED.
UM, THERE IS AN EARTH AND TRAIL THAT'S BEEN THERE FOR QUITE SOME TIME.
UM, IT IS OVERGROWN AND THERE HAVE BEEN SOME TREES DOWN FROM MATTHEW THAT BLOCKED PORTIONS OF THE TRAIL AT THIS POINT.
UM, BUT THE INTENT IS TO, TO OPEN THAT BACK UP, BUT THE CURRENT CONDITIONS ARE, UM, THERE IS CURRENTLY AN EARTH AND TRAIL AND A, PROBABLY 10 TO 14 FOOT WIDE ACCESS, UM, TO GET INTO THE PROPERTY.
MAY I INTERRUPTED, UM, WHO PUT THAT EARTH AND TRAIL IN? I THINK IT MAY PREDATE WHEN THE TOWN PURCHASED IT AND IT WAS ALREADY THERE BECAUSE THE NATIVE ISLANDERS WERE USING THAT PROPERTY TO GET TOWARDS THE WATER FOR CRABBING AND FISHING ACTIVITIES.
SO IT WASN'T RELATED DIRECTLY TO THE SHELL RING, BUT JUST ACCESS TO THE, OKAY, GOT IT.
THANK, UM, THE OPERATING AGREEMENT.
UM, THE TOWN AND COUNTY PURCHASED THE PROPERTY JOINTLY IN 2003.
AND AT THAT TIME WE HAD AN INTER-GOVERNMENTAL AGREEMENT, UM, WITH REGARD TO THE PROPERTY.
THIS AGREEMENT WILL SUPERSEDE THAT AGREEMENT.
UM, AND THIS AGREEMENT WAS GONE, HAS GONE TO THE COUNTY COUNCIL IN APRIL OF 2021 WITH THEIR APPROVAL.
UM, AT THAT POINT WE STARTED WORKING ON, UM, THE DETAILS OF THE AGREEMENT GOING THROUGH OUR LEGAL PROCESS, UH, DEVELOPING THE SITE PLAN.
WE WANTED TO MAKE SURE THAT WE HAD EVERYTHING IN ORDER BEFORE WE BROUGHT THE OPERATING AGREEMENT TO YOU.
UM, SO THAT'S WHERE WE ARE TODAY.
AND THERE IS AN OPTION IN THAT AGREEMENT FOR THE COUNTY AND THE TOWN TO ENTER INTO AN AGREEMENT WITH THE HILTON HEAD CHAPTER OF THE ARCHEOLOGICAL SOCIETY, FOR THEM TO DO TOURS, SOME SITE INSPECTIONS, MINOR CLEANUPS, AND MAINTENANCE OF THE PROPERTY.
SHOULD WE WANT TO GO DOWN THAT ROAD FOR THE RESPONSIBILITIES? UM, THE COUNTY'S RESPONSIBLE FOR THE MAJOR PART, THAT CAPITAL IMPROVEMENTS AND ANY MAJOR IMPROVEMENTS.
UM, SO THIS PART, THEY WILL PAY FOR ALL OF THE CAPITAL IMPROVEMENTS TO THE PARK RIGHT NOW.
UM, THERE'LL BE, UH, FENCING THE TRAIL AND THE PARKING AREA.

OUR DRAINAGE CULVERT FAILS, IF THERE'S MAJOR MAINTENANCE TO THE PARKING AREA OF A TREE FALLS ON OFFENSES THAT WILL ALL FALSE THE COUNTY TO TAKE CARE OF THOSE RESPONSIBILITIES, THE TOWN WILL BE THE DAY-TO-DAY RESPONSIBILITY, THE OPENING AND CLOSING OF THE PARK, THEN MOWING AND BLOWING OF THE, UM, THE TRAIL AS WELL AS THE PARKING AREA, WHICH SHOULD BE A MINIMAL COST TO THE TOWN.UM, THIS IS THE SITE PLAN THAT WE HAVE DRAWN UP AT THIS POINT.
UM, THAT IS THE CURRENT LOCATION OF THE TRAIL THAT IS THERE.
WE ARE WIDENING IT TO MAKE IT A LITTLE MORE ACCESSIBLE.
UM, AND THEN WE'RE ADDING THE PARKING AREA, UM, TO THE AREA AND WE PUT IT TO TRY TO PUT IT IN AN AREA WHERE WE'RE, I THINK WE'RE ONLY MOVING LIKE ONE TREE, UM, TO PUT THIS IN.
SO WE TRIED TO DO IT AS MINIMAL DISTURBANCE AS POSSIBLE SINCE IT IS A HISTORICALLY SIGNIFICANT PROPERTY, JAMIE.
WHY ARE THE TRAILS GOING OFFSITE? UM, THE TRAIL THAT GOES OFFSITE TO HIS RIGHT IS, WILL BE A PART OF THE ACCESS AGREEMENT THAT WE HAVE FOR THE BARNWELL PROPERTY.
SO THAT'S WHY YOU SEE THAT TRAIL OFF TO THE OTHER SIDE.
THE OTHER ACCESS IS ACTUALLY SOMETHING WE'VE HAD IN PLACE SINCE WE BOUGHT THE PROPERTY.
IT, UM, THERE IS AN OCCURRENT ACCESS TO FULLER POINT THAT ALLOWS US A SECONDARY ACCESS, UM, TO THE PROPERTY.
AND THAT WILL, WILL NOT BE NECESSARILY A PUBLIC ACCESS.
WE WILL HAVE A SIGN THERE WHERE IT INTERSECTS WITH THE TRAIL THAT THAT'S NOT A PUBLIC PART OF THE PROPERTY.

UM, BUT I KNOW WE WERE PUTTING A GATE THERE BECAUSE RIGHT NOW THERE'S A COUPLE OF BOLLARDS AND FULLER POINT HAS BEEN DUMPING THEIR LANDSCAPE DEBRIS ON THE PROPERTY.
SO WE'RE TRYING TO PREVENT THAT.
I MIGHT WANT TO LOOK INTO THAT JUST TO CLEAR THAT UP.
UM, AND YOU ALSO SEE UP AT THE TOP, THEY'VE DENOTED THAT DARK BOX UP THERE.
UM, TOWN COUNCIL HAS ALSO EXPRESSED AN INTEREST, UM, IN A FUTURE PROJECT, UM, CONNECTING THE PRO THE PROPERTY TO THE WATER.
SO THEY WANTED TO MAKE SURE THAT THERE IS THAT IT'S DENOTED ON THERE, THERE IS A FUTURE OPTION FOR THE TOWN TO TAKE ON PUTTING IN OVERLOOK A BOARDWALK OR SOMETHING UP THERE TO CONNECT THE PROPERTY TO THE WATER, BUT IT WILL NOT BE PART OF, UM, THE FIRST CAPITAL IMPROVEMENT, BUT IT IS PART OF THE, UM, JOINT OPERATING AGREEMENT THAT THERE'S AN UNDERSTANDING THAT'S TOWN MAY CHOOSE TO DO A FUTURE, UM, IMPROVEMENTS TO THE PROPERTY.
YES, IT WILL BE AT THE TOWN'S EXPENSE.
SO OUR NEXT STEPS, UM, WE'RE HERE TO GET A RECOMMENDATION FROM THE COMMITTEE AND IF APPROVED THAT WILL BE ON TOWN COUNCIL'S AGENDA AS EARLY AS MARCH 15TH.
UM, IF WE GET AN APPROVAL FROM TOWN COUNCIL, THERE'LL BE AN EXECUTION OF THE AGREEMENT WITH BUFORD COUNTY TOWN STAFF WILL CONTINUE TO WORK WITH THE COUNTY ON THE PERMITTING AND DISTRICT CONSTRUCTION OF THE PARK.
AND THEN IF WE CHOOSE TO MOVE FORWARD WITH OTHER ELEMENTS, UH, IT WILL BE, HAVE TO PROGRAM IT INTO THE TOWN'S CIP PROGRAM FOR US TO TAKE ON THE COST FOR THAT.
AND SO I'LL BE HAPPY TO TAKE ANY QUESTIONS ON THE JOINT OPERATING AGREEMENT.

AND SO I WOULD ENCOURAGE STAFF AND I THINK IT'S TOWN STAFF, UH, TO TAKE THE SIGNAGE AND THE EDUCATIONAL MATERIALS TO A NEW LEVEL.

WELL, THIS WILL BE PART OF THE UPCOMING BUDGET.
I MEAN, THEY HAVE THE FUNDING FOR IT.
UM, IT WAS ACTUALLY SUPPOSED TO BE IN LAST YEAR'S BUDGET, BUT WE GOT HELD UP IN PERMITTING AND THE PANDEMIC.

UM, WE'LL DISCUSS THE TERMINATION OF THE EASEMENTS, THE CREATION OF THE ACCESS AND UTILITY EASEMENT, AND THEN THE NEXT STEPS.
SO FOR THE SAME PROPERTY, UM, THERE IS A DIRT DRIVEWAY THERE RIGHT NOW, AND THAT IS BECAUSE THE TRIANGLE PIECE IN THE BACK IS OWNED BY THE BARNWELL FAMILY.
AND THE ONLY ACCESS TO THAT PROPERTY IS ACROSS THE FORD SHELL RING PROPERTY.
AND THAT EXISTED WHEN WE BOUGHT THE PROPERTY.
AND WE ACKNOWLEDGED THAT, UM, WHEN THE PROPERTY WAS BOUGHT.
SO THE DIRT TRAIL THAT IS THERE, UM, OFF OF SQUARE POPE ROAD GOES BACK TO THE BARNWELL PROPERTY.
CURRENTLY, THE INTENT IS, UH, FOR THE TOWN AND THE COUNTY TO EXECUTE A TERMINATION OF THE EXISTING EASEMENTS.
UM, FOR TWO REASONS, ONE, BECAUSE IT CONTAINS A, UM, SEPTIC AND DRAIN FIELD ON THE COUNT ON THE TOWN AND COUNTY'S PROPERTY THAT WE WOULD LIKE TO ELIMINATE, UM, IN LIEU OF A UTILITY EASEMENT.
AND THEN ALSO THE ACCESS ITSELF IS GOING TO BE MODIFIED THAT IT WILL BE A WIDER TO ACCOMMODATE TWO WAY TRAFFIC, AND IT'S GOING TO BE SLIGHTLY SHIFTED AWAY FROM THE MARSH, UM, TO GIVE US MORE OF A BUFFER AREA.
SO, UH, WE WILL BE PROPOSING TO TERMINATE THE EXISTING SEPTIC AND DRAIN FIELD AND ABANDONED THE EXISTING EASEMENT IN LIEU OF CREATING A NEW ACCESS EASEMENT.
UM, AND THE TOWN PARCEL, THE PRO THE PARK WILL HAVE A SWING GATE SIMILAR TO IT.
WE HAVE TO ALL OF OUR OTHER PROPERTIES, BUT ONCE YOU GET TO THE END OF THE PARKING AREA, WE'LL HAVE A CHAIN TO ACCESS THAT.
UM, WE'LL BE OPEN FOR THE PUBLIC TO WALK AROUND AND THEN THE TOWN AND THE COUNTY, AS WELL AS THE BARNWELL FAMILY WILL HAVE ACCESS TO A COMBINATION LOCK SPECIFIC TO THAT WHERE THEY COULD DROP THE CHAIN TO BE ABLE TO GET BACK TO THEIR PROPERTY, SHOULD THEY NEED TO, UM, AND WE HAVE MADE IT CLEAR TO THE BARNWELLS THAT WE ARE NOT THE TOWN AND COUNTY NOT RESPONSIBLE FOR ANY OF THE PUBLIC THAT HAPPENED TO WANDER OVER TO THEIR PROPERTY, UM, THAT THEY HAVE THE OPTION TO PUT UP A FENCE.
SHOULD THEY WANT TO, UM, PUT UP NO TRESPASSING SIGNS, THINGS OF THAT NATURE, BUT THAT, UH, THE TOWN AND COUNTY WOULD NOT BE RESPONSIBLE FOR THAT.

UM, I HAVE BEEN IN TOUCH WITH, UM, SUSAN CARTER BARNWELL, WHO IS THE OWNER OF THAT PROPERTY.AND SHE HAS, UH, BEEN BRIEFED ON BOTH OF THE TERMINATION OF THE EASEMENT, AS WELL AS THE CREATION OF THE NEW EASEMENTS.
SO THIS IS THE, UM, CURRENT PROPERTY AS IT IS.
AND YOU'LL SEE THE DARK AREA IS THE NEW ACCESS EASEMENT AND UTILITY EASEMENTS.
SO YOU CAN SEE THAT THE LITTLE RECTANGULAR AREA IN THE BACK IS A SEPTIC AREA, UM, THAT WAS PUT IN, UH, JASON TO THE PROPERTY.
AND YOU CAN SEE THAT, UH, CURRENTLY UP AT THE FRONT THERE AT THE ACCESS EASEMENT IS CLOSER TO THE MARSH.
SO WE'VE SHIFTED IT A LITTLE BIT TO THE LEFT AND WE'LL PUT IN A NEW DRAINAGE CULVERT AND WIDEN IT TO 24 FEET FOR TWO-WAY TRAFFIC THERE.
SO THE NEXT STEPS ON THIS, THIS HAS TO GO THROUGH COUNTY APPROVAL AND TOWN APPROVAL.
SO AT THIS POINT IT'S SCHEDULED FOR THE MARCH 7TH, UM, NATURAL RESOURCES COMMITTEE BEFORE THE COUNTY, AND THEN I'M GOING TO COUNTY COUNCIL ON MARCH 14TH.
AND AGAIN, WE HAVE A RECOMMENDATION BEFORE YOU ALL TODAY, AND IF IT'S APPROVED, IT WOULD GO TO TOWN COUNCIL AS EARLY AS MARCH 15TH.
AND IF BOTH THOSE ARE APPROVED, WE WILL BE EXECUTING AND RECORDING BOTH DOCUMENTS, THE TERMINATION OF EASEMENTS AND THE ACCESS AND UTILITY EASEMENTS WITH THE COUNTY AND SUSAN CARTER BARNWELL.

WHAT ZONING IS APPLIED? WHAT, UM, THE TWO PARCELS THAT ARE THERE, THE ONE IN THE FRONT AS WELL ON THE BACK ARE PART OF A PD TWO FOR THE PROPERTY AT THE CORNER WHERE THE TABBY IS AND THE HORSES, UM, AND WHAT THAT DID AS THOSE PROPERTIES CURRENTLY ARE ZONE WMU, THE WATERFRONT PARCELS.
AND SO WITH THE PD TWO, UM, THE DENSITY OF THAT, OR THOSE PROPERTIES WAS TAKEN AND TRANSFERRED ACROSS THE STREET TO THE SQUARE POPE, THE SITE ON SQUARE POPE AT GUMTREE, AND SUBSEQUENTLY THOSE TWO PARCELS WILL REZONE TO CONSERVATION.
SO THEY HAVE NO ABILITY TO HAVE A LAND USE ON THE OR DEVELOPMENT, BUT THEY DO, WE DO STILL HAVE TO HAVE ACCESS TO THE PROPERTY.
