SO THESE NEXT TWO ITEMS, UM, ARE BOTH ITEMS ON THEIR FACE, UM, COULD POSSIBLY FALL INTO THE EMPLOYEE EXCEPTION, UH, UM, SOMETHING THAT TO BE DISCUSSED IN EXECUTIVE SESSION.

HOWEVER, IN THE INTEREST OF TRANSPARENCY, WHAT WE'VE DECIDED TO DO IS TO PUT BOTH OF THEM, UM, ON THE UNBLOCK AGENDA, UM, AND TO RATHER THAN TO PUT THEM IN EXECUTIVE SESSION AND TO SEE WHERE THE DISCUSSION GOES.

AND I THINK I PROVIDED DOCUMENTATION TO COUNSEL AND INDICATE IN 2018, UH, COUNCIL AUTHORIZED ACCOUNTING TO ENTER INTO A LEASE, UM, WITH, UH, A TENANT PROPERTY MANAGEMENT COMPANY, LLC, UM, FOR THE LISA, UH, RESTAURANT THAT HAD BEEN KNOWN AS MORE SIDE MOMMAS IN THE GENERAL STORE.

UM, THE COMPANY HAS UNDERTAKEN THE REPAIRS NECESSARY TO OPEN UP THE RESTAURANT AND THE GENERAL STORE.

UM, WE LEARNED WHAT WE LEARNED THE LEGAL DEPARTMENT DURING THE LAST WEEK THAT, UM, THE COMPANY, UH, WILL NOT BE ABLE TO OPEN UP A RESTAURANT UNDER THE NAME OF MARSEILLE, THE HISTORIC THING OF MARSEILLES NORMALS, UM, BECAUSE THE, UM, PRI PREVIOUS, UH, TENANT, UH, VET CHIPMAN HAS HAPPY WRITTEN THE NAME OR TRADEMARK THE NAME, THINKING SOME ACTIONS THAT PREVENTS, UM, THE TENANT FROM BEING ABLE TO DO THAT.

AND, UM, SO THE TENANT WOULD LIKE TO RENAME THE, UH, RESTAURANT TO CALL UP.

WE CALL THEM THE FIRSTIES, UM, AS WE'VE LISTED HERE ON THE DOCUMENTS THAT YOU HAVE.

UM, AND, UM, OF COURSE WE, BECAUSE JUST AS A MATTER OF THE KING FOR COUNCIL, UM, AND IT'S AN INTEREST AND IT'S A MATTER THAT COULD BE A PARTICULAR INTEREST TO THE PUBLIC ART.

WE BELIEVED IT WAS PRUDENT, UM, TO BRING THIS BEFORE COUNCIL FOR, UM, AUTHORIZATION FOR THE TENANT,

AND THE REASON FOR THAT IS SO THAT WHEN WE HAVE THESE LITTLE CHANGES, WE DON'T NEED TO AMEND THE WHOLE ORDINANCE AND GO THROUGH THAT IN AN INVOLVED PROCESS.

AND WE WANTED EVERYBODY OF EVERY MEMBER OF COUNCIL TO KNOW ABOUT THIS CHANGE AND TO GET THEIR BLESSING ON IT BEFORE WE AUTHORIZED THEM.

SIX, WHICH IS THE LITIGATION UPDATE REGARDING NEWFORD MEMORIAL HOSPITAL.

SO YOU MAY RECALL THAT WHEN B FROM MEMORIAL HOSPITAL INITIALLY FILED THEIR SUMMONS, IF SOME OF THAT COULD FIND AGAINST THE COUNTY, UM, WITH REGARD TO THE APPOINTMENT OR REINSTATEMENT OF KATHY COOPER TO THE BOARD, UM, THE HOSPITAL, THE RELEASE AT THE HOSPITAL LAST FLOOR WAS AN INJUNCTION AND A DECLARATORY JUDGMENT, UM, WITH REGARD TO PUTTING HER ON REINSTATING HER ON THE BOARD, UM, WHEN COUNCIL CHOSE NOT TO BE IN STATER, UM, WE BELIEVE THAT THAT WOULD MOST LIKELY RESULT IN, UM, THE HOSPITAL DISMISSING NEW SUIT, IF IT DID NOT, IT CHOSE INSTEAD, UM, TO AMEND THE COMPLAINT, UH, TO ENJOIN JOIN THE, UH, TO ENJOIN THE COUNTY COUNCIL FROM, UH, REINSTATING ANY BOARD MEMBER, UM, WHO RESIGNS, UM, AND WHO DOES SO, AND THEN PREVENT THE COUNTY FROM DOING SO WITHOUT A NOMINATION PROCESS FROM THE HOSPITAL.

AND ALSO IT NOW SEEKS AN INJUNCTION TO ENJOIN COUNTY COUNCIL FROM, UM, AMENDING YOUR TONE, UM, ORDINANCE, UM, PURSUANT TO THE LAST SECTION OF OUR EXISTING ORDINANCE.

SO I JUST WANTED COUNCIL TO KNOW THAT THE LAWSUIT DID NOT GO AWAY BY VIRTUE OF COUNCIL'S DECISION, NOT TO REINSTATE MS. COOPER.

UM, AND I WANT TO PULL THAT COUNCIL KNOW THAT YOU RETAINED COUNSEL TO REPRESENT US.

UM, AND THAT IS THE LAW FIRM OF TO MAKE A LOOP AND KENDRA AND CHARLESTON LAWYERS, WE RETAINED SPECIALIZE IN THIS KIND OF WORK.

AND SO WE WILL BE, UM, WE'LL BE MOVING FORWARD.

UM, QUESTIONS FROM COUNSEL, MR. HARVEY SHINE, MR. CHAIRMAN, UM, IF I'M REMEMBERING CORRECTLY, I ASKED THAT SPECIFIC QUESTION ABOUT WHETHER OR NOT THE LOSS WOULD GO AWAY IF WE TOOK THAT ACTION.

AND I BELIEVE THAT THE RESPONSE WAS, IT WOULD THEN BE MOVED.

SO I'M JUST WONDERING WHAT HAS HAPPENED TO MADE IT NOT MOVE WELL.

IF YOU'VE LOOKED AT THE MATERIALS THAT I'VE PROVIDED, UM, IN MY BACK OF THE APPEAL, WE'LL SEE THAT THE, UM, UH, HOSPITAL AMENDED COMPLAINT, UM, SO THAT, UM, IT REFERRED TO SOME CONVERSATION THAT MR. SOMERVILLE, SOME DISCUSSION THAT MR. SUMMERVILLE, UH, MADE REGARDING AN EFFORT OR AN INTEREST IN REVISITING OUR ORDINANCE.

AND SO WHILE THE ISSUE IS ALL THE ISSUE ABOUT PUTTING MS. COOPER BACK ON THE BOARD, HIS MOOD, UM, THE, UM, UH, DISCUSSION OF AMENDING OUR ORDINANCE IS NOT.

SO THEY HAVE CHOSEN TO AMEND THEIR COMPLAINT TO DO CERTAIN THAT THAT ISSUE WORK TO ACTUALLY ADD A NEW ISSUE INTO THE LAWSUIT, WHICH IS WHAT THEY DO.
