[Items 1 - 6] [00:00:04] >> AND FIRST I'D LIKE TO INTRODUCE THE CONTRACTOR AND ENGINEERING TEAM. THE GENERAL CONTRACTOR WAS O'QUINN MARINE CONSTRUCTION AND AS A CIVIL ENGINEERING GROUP IT WAS ANDREWS ENGINEERING STRUCTURAL ENGINEERING AND MARINE ENGINEERING WAS COMPLETED BY MCSWEENEY ENGINEERS. THIS IS A PICTURE ON THE RIGHT. THIS. THIS IS THE SECTION. SO THIS THIS PROPERTY IS HAD WAS THREE PROPERTIES INVOLVED A RURAL CRITICAL PROPERTY WHICH IS ATTACHED TO ANOTHER RURAL AND CRITICAL PROPERTY ON THE BEAUFORT RIVER. BY WAY OF PROPERTY OWNED BY SC DNR. THIS IS THE ROADWAY ON SC DNR PROPERTY INTO LOOKING EAST TO THE BEAUFORT RIVER GOING INTO THE PAVILION AREA. THIS CONTRACT WAS A DESIGN BUILD CONTRACT AND THE CONSTRUCTION STARTED ON AUGUST 30 1ST OF THIS YEAR. >> WE ARE SCHEDULED FOR COMPLETION AND ON SCHEDULE TO COMPLETE THE PROJECT BY DECEMBER. THIRTY FIRST PICTURE ON THE RIGHT AGAIN IS AS WE'VE ARRIVED AT THE PAVILION LOOKING OUT ONTO THE BEAUFORT RIVER AND THIS IS THE PAVILION ALMOST COMPLETE AND AGAIN THIS PICTURE IS ABOUT TWO WEEKS OLD. WE HAVE PICNIC TABLES ONSITE AND ALL THE SIGNAGE IS UP. AT THIS POINT OUR PROJECT FUNDING SO THERE'S TWO PHASES TO THIS PROJECT. PHASE ONE WAS THE LAND SIDE ACTUAL CONSTRUCTION WORK DESIGN OF EVERYTHING BOTH LAND SIDE AND WATER SIDE AND PERMITTING OF EVERYTHING LAND SIDE AND WATER SIDE. PHASE 2 WAS SIMPLY WATERSIDE CONSTRUCTION PHASE 1 CONTRACT AMOUNT AGAIN DESIGN BUILD WAS A MILLION EIGHTY THOUSAND DOLLARS THERE ABOUT THE FUNDING WAS A PARTNERSHIP. IT WAS PARTIALLY FUNDED THROUGH Q4 COUNTY RURAL AND CRITICAL LANDS AND PARTIALLY THROUGH THE 2017 GEO BOMB THE PHASE 2 WATERSIDE WORK. THE CONTRACT AMOUNT HAS NOT YET BEEN DETERMINED. AND CURRENTLY IT IS NOT FUNDED AS THE PLAN FOR THIS WHEN WE ARE READY WOULD BE TO GO FOR A OR H TAX APPLICATION FOR THE FUNDING FOR PHASE 2. THE ACTUAL SCOPE OF WORK IN PHASE 1 WAS ALL NEW FENCING AN AUTOMATIC ENTRY GATE AND THE ENTRY GATE 7 DAYS A WEEK WOULD BE OPEN FROM DAWN TO DUSK. IT IS EQUIPPED WITH REQUIRED CLIP TO ENTER FOR FIRST RESPONDERS LAW ENFORCEMENT E MASS. THE GATE ALSO INCLUDES AN AUTO EXIT IN CASE SOMEONE GETS STUCK INSIDE THE GATED AREA AFTER THE GATE HAS CLOSED AT DUSK. THE ROADWAY IS ALL CRUSHED AGGREGATE FROM OLD FORT ROAD TO THE PASSIVE OF PARK. AS YOU CAN SEE HERE AT THE END IF YOU LOOK TO THE RIGHT ON THE PICTURE THERE WE HAD TO PUT IN A EMERGENCY TURN AROUND FOR OBVIOUSLY EMERGENCY VEHICLES FIRETRUCK. SO A GRASS PAVED SYSTEM WAS USED SO STRUCTURALLY IT IS SUPPORTED BUT YOU WILL SEE GRASS GROW IN THIS AREA SO WILL LOOK TO BE PART OF THE PARK. A 20 BY 50 COVERED PAVILION 6 OR SO PICNIC TABLES ONE OF WHICH IS HANDICAP ACCESSIBLE PARKING AREAS DOWN NEAR THE PAVILION. THERE'S A TOTAL SIX PARKING SPOTS AT THE PAVILION. ONE IS HANDICAPPED ACCESSIBLE AND UP AT THE FRONT ENTRY GATE WHICH WILL SHOW YOU A CONCEPT DRAWING IS A MONUMENT SIGN. >> SO THIS IS THE FIRST PARTIAL I TALKED ABOUT THE TRIANGULAR PARCEL THAT COMES OFF OF OLD FORT ROAD. THIS IS WHERE THE ENTRY PEOPLE BE. AS YOU CAN SEE THERE'S FIVE ADDITIONAL PARKING SPOTS UP AT THIS AREA. STEFAN, I DIDN'T KNOW IF YOU WANT TO ADD IN ABOUT MAYBE SOME FUTURE PLANS IN PASSEL. >> SURE. TO THE RIGHT OF THAT DIAGRAM OPPOSITE THE PARKING AREA. THERE IS ROOM THERE FOR JUST SOME SMALL KIND OF NATURAL PLAY ELEMENTS FOR CHILDREN. I KNOW A VENDOR WHO DOES THINGS LIKE LOGS AND STUFF AND THINGS THAT DON'T REALLY FIT INTO THE NATURAL PART CHARACTER PROPERTY BUT THAT WILL GIVE KIDS SOMETHING TO KIND OF CLIMB AND PLAY ON. >> THANK YOU. THIS IS DOWN NEAR THE PASSIVE PARK. JUST A AERIAL CIVIL ENGINEERING DRAWING HERE AND THIS SHOWS THE PAVILION SHOWS THE SIX PARKING SPOTS. THE ACTUAL GREAT GRASS PAY VARIED WHICH IS THE HAMMERHEAD TURNED AROUND FOR EMERGENCY VEHICLES. [00:05:04] WHAT IS NOT SHOWN ON HERE IS THAT MARINE ADDED WAS UP. >> THERE IS A LITTLE DITCH ALONGSIDE GOING FROM THE PAST OF OUR PROPERTY TO LCD. YOU PULL A VERY SMALL BOARDWALK ACROSS THAT DITCH SO THERE IS A NATURAL PATHWAY FROM THE PAVILION TO WALK AND GO OVER TO THE RUINS OF A FORT FREDERICK. >> THIS IS OUR CONCEPT DRAWING OF THE MONUMENT SIGN OUTSIDE THE AUTO GATE. >> AT THE END OF OLD FORT WHERE THE CUL DE SAC IS IT IS BEING CONSTRUCTED AS WE SPEAK AND IT IS KIND OF THE LAST ELEMENT THAT NEEDS TO BE COMPLETED. THE TABBY CAN FINISH ON TOP THE CONCRETE AND IDEA AND THE EMBLEMS DUE FOR COUNTY SC DNR AND HERITAGE TRUST THAT NEED TO BE APPLIED TO THE SIGN PHASE 2 WHICH IS THE WATERSIDE WORK AGAIN NOT FUNDED CURRENTLY BUT DESIGNED AND NOT PERMITTED YET. WANTS TO INCLUDE A PIER OR A BOARDWALK. OUT TO A POINT WHERE THERE WAS GOOD FISHING A THERE'D BE A PIER HEAD FOR FISHING AND CRABBING A GANGWAY DOWN TO A COURTESY FLOAT AND A KAYAK LAUNCH MEANING THAT BOATERS AND KAYAKERS COULD COME TO OUR PARK DOCK AT THE COURTESY DOCK COME UP, HAVE A PICNIC, GO OVER AND SEE THE RUINS. >> ADDITIONAL TOPICS THAT WE TALKED TO THE PORT ROYAL ABOUT WHERE THE REPAIR OR BRIDGE SURFACING OLD FORWARD AND SPOKE WITH THE TOWN PORT ROYAL AND WE WERE ABLE TO THROUGH CONTINGENCY FUND COMPLETE RESURFACING OF OLD FORT ROAD. IT WAS NOT IN GREAT CONDITION WHEN WE STARTED AND WITH ALL THE WORK THAT NOW DETERIORATED. TODAY O'QUINN MARINES CONTRACTOR WAS OUT THERE MILLING THE ROAD. THEY WILL DO A FINAL GRADING TOMORROW AND WEATHER PERMITTING THAT ROAD WILL BE RESURFACED ALL THE WAY UP TO WHERE WE ENTER THE PARK AREA AND THAT SHOULD BE COMPLETED BY WEDNESDAY. AND THEN STEPHANIE, DID YOU WANT TO TALK ABOUT ROUNDS MAINTENANCE? >> SURE. AND WE ALSO DISCUSSED WITH MR. WILLIS THAT THE TOWN OF PORT ROYAL ABOUT AN M.O. YOU BETWEEN THE COUNTY AND THE TOWN AND RETURNING MAINTENANCE OF THE PARK. AND SO HE AND I ARE GONNA BE WORKING TOGETHER TO TRY TO DRAFT THAT AND YOU HOPEFULLY TO START SHORTLY AFTER THE PARK OPENS AND THAT WILL EVENTUALLY COME TO THE COUNTY COUNCIL FOR APPROVAL. I THINK AS A RESOLUTION THAT THAT'S IT FOR THE THE PROGRESS AND THE PRESENTATION AND IF THERE'S ANY QUESTION STEPHANIE AND I WILL TAKE GO TAKE THE QUESTIONS ANY QUESTIONS OR COMMENTS FROM COUNTY COUNCIL MEMBERS OR OTHERS. I RECALL THE KING THAT YOU'VE DESCRIBED A CAPITAL PARK IMPERIALIST PROBABLY CREATED . >> WE ABOUT THE WHITE ROAD. ARE YOU GOING TO GET THERE? HOW ARE YOU GOING TO I MEAN TO KIND OF CARGO WITH THEIR I'M I'M CONFUSED ABOUT THE PARK AND I DON'T SEE HOW CARS CAN GET YOU SHUT OFF THE WHITE ROAD THIS SUMMER. >> SO THIS IS FOR SORT FREDERICK SO THAT I'M GOING BACK TO WHITEHALL. >> YEAH, YEAH IT'S ALL RIGHT. YEAH. WE SWITCHED WE SWITCHED ON THE AGENDA ON YOU. YEAH. WE'RE DOING FORT FREDERICK RIGHT NOW. >> ARE THERE ANY OTHER COMMENTS? YES, SIR. MR. GLOVER. COUNCILMAN GLOVER. >> YES. I JUST WANTED TO THANK THE STAFF. IT LOOKS GOOD. AND WHAT'S REALLY SCARY ABOUT PHASE TWO AND IS THE FUNDING FOR PHASE TWO WILL BE A PART OF THE RULING CRITICAL LAND THAT CAN BE COMING FROM SOMEWHERE ELSE. >> I WOULD LOVE TO SEE THAT ON THE PHASE 2 BUT ALSO THE GROUND THAT YOU TALKED ABOUT WITH THE KIDS. I'D LOVE TO SEE THAT OUT THERE TOO. THAT WOULD BE A NICE ENHANCEMENT FOR THAT AREA. THANK YOU. >> DO YOU WANT TO ADDRESS IT OR BOTH WILL ADDRESS THAT POLICE? YES. FUNDING FOR THE WATERSIDE WORK WILL BE THROUGH AN A AND H TAX APPLICATION. DAPHNE, I'M NOT SURE WHAT THE PLANS ARE FOR THE ACTUAL PLAYGROUND GRANT. [00:10:02] >> SO THE THIS PROPERTY ACTUALLY HAD A DONATION OF A CERTAIN AMOUNT AND SO I'M GOING TO USE THAT DONATION FUNDING TO DO THOSE NATURAL PLAY ELEMENTS. BUT THE WATERSIDE WORK WILL NOT BE FROM RURAL AND CRITICAL. WE'VE ALREADY SPENT THE COUNCIL'S ALLOCATED FUNDING TOWARDS THAT. WHEN YOU GUYS APPROVED THAT IN AT THE END OF 2018 AND THE COUNCIL'S INFORMATION THERE WERE SOME STILL A FEW QUESTIONS ABOUT THE MARSH BUT THE RIGHTS TO THE MARSH WE WERE RUNNING INTO SOME QUESTIONS ABOUT THAT. WHICH KIND OF MADE IT EASIER TO SPLIT THIS UP. THE PROJECT AND ONCE ALL THAT IS SOLVED WE CAN COME BACK WITH THE H TAX APPLICATION FOR IT. AND THIS IS I JUST WANT TO SAY THANK YOU AGAIN TO ALL THE STAFF THAT MADE THIS POSSIBLE AND WORKING WITH YOU KNOW, DNR IS ANOTHER AGENCY IS I'M SURE ALWAYS A CHALLENGE AND THIS IS GOING TO BE SUCH AN ASSET NOT ONLY TO THE RESIDENTS OF THE TOWN OF PORT ROYAL BUT EVERYONE IN THE AREA AND IT'S YOU KNOW, IT'S VERY CLOSE TO THE PARK ACROSS FROM A NAVAL HOSPITAL AND IT WILL OF COURSE BE A ASSET FOR EVERYBODY FROM BOTH THE WATER AND EVEN WALKING AND BICYCLING TO NEARLY ANY OTHER COMMENTS OR QUESTIONS JUST LIKE TO TELL BOTH LEO AND JARED'S ON THE PHONE TO ME ON THE CALL. >> THANK YOU FOR ALL YOUR HARD WORK ON THIS. >> OK. WE CAN MOVE ON TO WHITEHALL NOW IF WE'RE READY. >> READY FOR WHITEHALL. IS THAT GOING TO BE IS THERE SOMETHING ON THE SCREEN CAN BE PUT UP ON? I GUESS NOT. YES, MA'AM. ALL RIGHT. THANK YOU. >> I'M TRYING TO FIGURE OUT THE SHARE OF TO SEE IF THIS WORKS. >> DID IT NOT? NO, THERE WE GO. SIR. GO AHEAD. >> OKAY. BECAUSE I CAN'T I CAN'T SEE YOU GUYS ANYMORE. OH, THERE YOU ARE. >> EVERYTHING WE'VE DONE ROUND CAMERAS OVER HERE. >> BUT THE DOCUMENTS OVER THERE . >> SORRY. JUST A SECOND. OKAY. OKAY. SO THIS IS LAND. I'M GOING TO TRY AND IS A LITTLE BIT BETTER BECAUSE THAT HELPS. ALL RIGHT. >> SO THIS IS THE SOLE CONCEPTUAL PLAN. WOODEN PARTNERS WAS HIRED TO HELP US WITH THIS AT THE END OF LAST YEAR. WE HAD HOPED TO HAVE THIS DONE BY JUNE. BUT BECAUSE OF COVE IT WE COULDN'T HOLD THE STAKEHOLDER WORKSHOPS IN PERSON LIKE WE WANTED. SO WE DID TWO DIFFERENT SURVEY METHODS TO THE PUBLIC AND GOT TREMENDOUS RESPONSE. WE GOT OVER 300 RESPONSES FROM THE PUBLIC FOR EACH SURVEY EVENT. AND SO THE FIRST SURVEY EVENT PROVIDED INFORMATION ABOUT POSSIBLE OPPORTUNITIES AND CONSTRAINTS OF THE PROPERTY INCLUDING THE CONSERVATION EASEMENT THAT IS ON THIS PROPERTY EVEN THOUGH IT'S A FEE SIMPLE PROPERTY. AND FROM THAT FIRST SURVEY WE RECEIVED A LOT OF INPUT INTO THE MAIN STRUCTURES THAT THE PUBLIC WAS INTERESTED IN SEEING PROPERTY WHICH INCLUDED ESSENTIALLY A PUBLIC ACCESS POINT PARKING SOME KIND OF PICNIC PAVILION OR EVENT PAVILION, A BIG OPEN LAWN PICNIC TABLES, BENCHES, SWINGS, PIER AND DOCK AND OBSERVATION AREAS. SO WITH THAT INFORMATION WE DRAFTED A PLAN THAT LOOKED VERY SIMILAR TO THIS AND THEN WE SENT THAT OUT TO THE PUBLIC FOR A SECOND SURVEY. AND IN THAT SECOND SURVEY WE ASKED THEM IF THEY LIKED THE LOCATION AND THE ELEMENTS AND IF IT LOOKED LIKE A USABLE SPACE AND THEN ALSO IF THERE WAS ANYTHING MISSING THAT THEY THOUGHT WOULD BE IMPORTANT TO THEM. AND SO EVERYBODY ESSENTIALLY SAID THE MAJORITY OF PEOPLE SAID THAT THEY LIKED THE WAY THE PLAN LOOKED AS IT WAS PRESENTED. BUT A DOG PARK CAME OUT AS A VERY TOP NEED FOR PEOPLE IN THIS AREA. [00:15:08] SO THE TEAM WHICH INVOLVES MYSELF LINDA ROPER FROM THE CITY FOR TAYLOR REMINDS FROM GOALS AND PAUL TAYLOR FROM THE FLIGHT TO WHITEHALL PARK. WE ALL DISCUSSED THAT AND TRIED TO FIGURE OUT IF THAT WAS SOMETHING THAT WAS FEASIBLE BASED ON WHAT A DOG PARKS NEEDS WOULD BE. AS FAR AS AMOUNT OF ACREAGE, WHAT TYPE OF TURF FENCING ET CETERA AND WE CAME TO THE CONCLUSION THAT A DOG PARK AT WHITEHALL COULD BE POSSIBLE IF THERE WASN'T A CONSERVATION EASEMENT ON PROPERTY. AND SO BECAUSE THE CONSERVATION EASEMENT RESTRICTS CERTAIN THINGS AND BECAUSE THE ACREAGE AMOUNT WAS NOT ENOUGH. BEYOND THAT CONSERVATION EASEMENT THEN WE WOULD NOT BE ABLE TO PROVIDE THAT AT THIS PLACE. HOWEVER, THE CITY OF BEAUFORT TOOK THAT INFORMATION AND NOW AS THAT KNOWLEDGE SO IF THERE IS ANOTHER PROPERTY THAT COMES UP IN THE AREA THAT'S MORE APPROPRIATE FOR IT, THEN THEY KNOW THAT PEOPLE WANT. SO WE'VE SAW THAT AS A DEFINITE BENEFIT. YOU CAN SEE ON THE PROPERTY WE DO HAVE THE TWO ROADS, ROADS A AND ROAD BE COMING FROM MR. LEVIN'S PROPOSED PLAN. WE WORKED WITH HIS ENGINEERS TO GET INFORMATION ON HOW TO INTERFACE WITH HIS PROPERTY. AND SO ASSUMING THAT THOSE ROADS ARE BUILT, THAT WOULD BE THE ENTRANCE WAY INTO THE PARK AT LOCATION C. WE WOULD HAVE AN AUTOMATIC ENTRANCE GATE SIMILAR TO THE SOME OF THE OTHER PARTS OF PARKS THAT I'M DOING NOW. SO IT WOULD AUTOMATICALLY OPEN AND CLOSE AT DAWN AND THEN CLOSE AT DUSK WITH THAT OPTION TO BE ABLE TO EXIT. IF YOU WERE STUCK IN THERE AFTER DARK THERE'S A PATHWAY THAT CONNECTS FROM ROAD A ALL THE WAY DOWN THE CAUSEWAY TO ITEM J WHICH IS THE PERFECT SOON HOPEFULLY SOON TO BE BOARDWALK ACROSS THE SALT MARSH THERE TO SEA ISLAND PARKWAY AND THERE'S A PICNIC PAVILION RESTROOMS AND OPEN LAWN AREA ITEM F AND THEN THERE'S SOME PICNIC TABLES IN ITEM G AS WELL AS A RECONSTRUCTED PIER AND DOCK AT H AND THEN IT M THERE IS THAT OBSERVATIONAL PLATFORM THAT'S MORE FOR WILDLIFE VIEWING SUNSET WATCHING ET CETERA. AND THEN THERE'S A PATH THERE'LL BE A NATURAL PATH THAT RUNS AROUND THE PROPERTY. SO WE TRIED TO PROVIDE CONNECTION ACROSS THE BRIDGE ALL THE WAY THROUGH TO THE EXTERIOR STREETS OUT TO MERIDIAN AND THEN ALSO HIGHWAY 21 BEING ABLE TO PROVIDE THAT THAT PATHWAY FOR BIKING PEDESTRIANS AT NIGHT EVEN THOUGH THERE'S A SEPARATE IN THERE BETWEEN THAT PATH AND THE ACTUAL INTERIOR OF THE PARK SO WE CAN STILL HAVE CONTROL OVER ACCESS INTO THE PARK AFTER HOURS BUT STILL PROVIDE PEOPLE THE OPPORTUNITY TO TRAVEL TO TRAVERSE BACK AND FORTH ACROSS THE BRIDGE AT NIGHT TO DOWNTOWN WATERFRONT PARK. >> SO THAT'S KIND OF IN A NUTSHELL. AND I'LL BE HAPPY TO ANSWER ANY QUESTIONS, OK? COUNCILMAN SOMMERVILLE, DO YOU WANNA ASK YOUR QUESTION NOW? >> YEAH, I DO. THANK YOU VERY MUCH FROM THE POLICE STATION. GENERALLY INSURANCE I UNDERSTAND CAR X IS GOING TO BE WHAT WOULD YOU SAY AT 11:00 THE SHUT THE GATE? >> WELL, THE PARK WILL BE OPEN FROM DAWN TO DUSK SO IT'LL CHANGE SLIGHTLY WITH THE TIME CHANGE BUT ESSENTIALLY SIX TO SIX IN THE WINTER AND THEN PROBABLY SIX TO EIGHT IN THE SUMMER. >> BUT WHAT ABOUT THE JAY THE WALKING? >> THEY CAN YOU CAN'T CLOSE THAT JANUARY OR DO YOU HAVE WAS THE WALKING ENTRANCE AS WELL? NO, THE WALKING ENTRANCE WILL BE THERE. >> THERE WILL BE A FENCE LIKE PROBABLY A SPLIT RAIL FENCE OR SOME KIND OF FENCING BETWEEN THE WALKING TRAIL. AND THE INTERIOR OF THE PARK SO PEOPLE CAN STILL WALK CAN STILL TRAVERSE THROUGH THERE AT NIGHT WHERE IT'LL BE LIGHTED BUT NOT BE INSIDE LIKE THE PICNIC AREA AND THE PAVILION, YOU KNOW, CAUSING A RUCKUS TO NEIGHBORS. SO YOU'RE GOING TO HAVE SOME KIND OF BARRIER AFTER. JAY, JUST AS YOU GET INTO THE PARK TO KEEP PEOPLE IF THEY CAN WORK AND WALK ALONG THAT LITTLE CAUSEWAY BUT THEY CAN'T GET THE [00:20:01] PARK CLOSE. >> RIGHT. >> THEY'LL BE ABLE TO WALK FROM THE K AREA THROUGH THE L.A. AREA OVER TWO STREETS A AND B. SO IT'S A CONNECTION TO A MULTI USE COMMERCIAL AREA ON A PROPOSED MULTI USE COMMERCIAL AREA ON MR. LEVINE'S PROPERTY TO WATERFRONT PARK TRYING TO KEEP THAT COMMERCIAL CONNECTION . OK. BUT YOU'RE GONNA BLOCK HIM FROM COMING DOWN INTO G D. THE. AND THOSE AREN'T MARRIED AFTER DAUGHTER. OK, THAT'S CORRECT. >> ARE THERE ANY OTHER QUESTIONS I HAD ONE OF WHICH SOMEONE ELSE HAVE SOME QUESTIONS. >> JUST QUICKLY OVER SHE MAY HAVE SAID IT BUT MISSED IT. WHAT IS THE PARKING CARS PARKING CABLE FIELD CAPACITY RIGHT NOW WE HAVE PLANNED FOR TWENTY FIVE SPOTS BUT THERE IS A YOU KNOW IF THE PARK ENDS UP BECOMING EXCEEDINGLY POPULAR WE HAVE PLENTY OF SPACE THERE OUTSIDE OF THE DESIGNATED RED CONSERVATION EASEMENT LINE THAT WE COULD ADD SOME ADDITIONAL PARKING IN THE FUTURE IF NECESSARY. >> THANK YOU. >> ANY OTHER QUESTIONS? JUST QUICKLY, THE RED DOTTED BORDER IS INDICATED THAT IS THE INDICATION OF THE EIGHT ACRE CONSERVATION AREA THAT WAS APPROVED AT THE TIME OF ACQUISITION. >> THAT'S THE AREA THAT HAS THE CONSERVATION EASEMENT WAS I UNDERSTAND CORRECT. >> OK, THANK YOU. I HAD A QUESTION I'M ASSUMING IT COULD BE LIKE THE PAVILION COULD BE RESERVED AFTER HOURS FOR WEDDINGS AND THINGS LIKE THAT LIKE THEY TALKED ABOUT ORIGINALLY OR I MEAN THIS IS GETTING INTO THE WEEDS PROBABLY TOO MUCH NOW AND THEN I WAS WONDERING ABOUT THE FUNDING FOR THE CONSTRUCTION PART. >> COULD YOU GO OVER THAT AGAIN HOW THAT'S GOING TO BE PROPOSED SO HAPPEN THAT'S GOING TO RAISE THE PARK. >> WE'LL BE ABLE TO BE RESERVED AFTER HOURS FOR WEDDINGS, EVENTS AND WHATNOT. THAT WILL BE DONE THROUGH THE CITY OF BEFORE THEY HAVE A PROCESS FOR THAT. WE HAVE OUR OWN PROCESS RIGHT NOW BUT ONCE IT'S ACTUALLY CONSTRUCTED THE CITY OF BEAUFORT IS GONNA BE TAKING OVER MANAGEMENT AND MAINTENANCE OF OUR JULY 1 OF NEXT YEAR 2021 AND THE FUNDING FOR THIS COUNTY COUNCIL HAS ALREADY APPROVED IN A PRIOR PASSIVE PARKS FUNDING REQUEST FIVE HUNDRED THOUSAND DOLLARS SHE ALREADY SAID IT BY HER THOUSAND DOLLARS TO GO TOWARDS CONSTRUCTION APPLICATIONS SO THIS WILL VERY LIKELY BE A PHASE PROJECT AND IN OUR SECOND SURVEY WE DID ASK THE PUBLIC WHAT THEIR MOST IMPORTANT ELEMENTS WERE. AND SO WE TOOK THOSE AS OUR FIRST PHASE AND THEN WE'LL DO A SECOND PHASE OF THE OTHER ITEMS THAT ARE LESS IMPORTANT TO THE PUBLIC. >> ALL RIGHT. GREAT. WE APPRECIATE THE UPDATE ON THAT BECAUSE I THINK SOME OF US HAVE FORGOTTEN HOW THAT ALL HOW ALL THIS IS GOING TO HAPPEN. ARE THERE ANY OTHER COMMENTS OR QUESTIONS? JUST QUICKLY, HOW'S THE BOARDWALK COMING FROM THE CONNECTING DOWNTOWN WAS NOT FUNDED SEPARATELY OR WAS THAT INCLUDED IN THE FUNDING THAT YOU'RE TALKING ABOUT AND WHY IT WAS FUNDED? >> DID IT GO AHEAD, STEPHANIE. I'M SORRY. >> IS IT THAT IS A PROJECT THROUGH THE CITY BEFORE AND WE ARE CO COLLABORATORS WITH THEY DID DID THAT THAT PROJECT OUT ACTUALLY RECEIVED AN UPDATE THIS MORNING ABOUT IT AND THE BIDS CAME IN MUCH, MUCH HIGHER THAN THE ENGINEERS ESTIMATE ANTICIPATED AND SO THEY'VE PUT THAT PROJECT ON HOLD AND MADE TRY TO REBID SOMETIME NEXT YEAR. >> THE ONE THING I'LL ADD IS THAT FOR COUNCIL'S KNOWLEDGE AND AS SHARED WITH ME FROM JARED TREY LUX IS THAT THE REASON THE BIDS CAME IN HIGH IS DUE TO COPE WITH THE COST OF LUMBER HAS SKYROCKETED CURRENTLY. >> SO WE DO NOT HAVE THE MONEY TO COMPLETE AT THIS POINT. >> SO I FIND IT INTERESTING THAT THE SURVEY COMMENTS WAS FROM THE DOG PARK BECAUSE I KNOW THE DOG PARK THE SOUTH SIDE AND IN THE CITY OF BEAUFORT IS HEAVILY USED AND THERE ARE PEOPLE THERE WHO COME FROM LADY'S ISLAND AND ALL OVER TO USE. BUT I THINK THE SOUTH SIDE IS [00:25:04] CLOSE ENOUGH TO THIS PARK THAT ANYONE WHO WANTED TO USE A SMALL AND PERSONAL OPINION CAN USE THE DOG PARK SOUTH SIDE AND IT IS AS YOU SAID, IT MAY BE APPROPRIATE MORE APPROPRIATE AND THEY CAN'T DO IT ANYWAY AT ANOTHER LOCATION TO SATISFY THOSE THOSE NEEDS. ARE THERE ANY OTHER COMMENTS OR QUESTIONS? >> ALL RIGHT. THANK YOU VERY MUCH. THOSE OUTSTANDING TO GET AN UPDATE ON THAT AND NOW WE WILL [7. AN ORDINANCE REGARDING FILL STANDARDS AMENDMENDING DIVISION 5.13 OF THE COMMUNITY DEVELOPMENT CODE TO LIMIT FILL IN LOW‐LYING AREAS.] MOVE ON TO NUMBER SEVEN WHICH IS AN ORDINANCE REGARDING PHIL STANDARDS AMENDING DIVISION 5.1 3 OF THE CDC TO LIMIT PHIL AND LOW LYING AREAS AND THIS IS A DISCUSSION ITEM. SO I HOPE MEMBERS OF COUNCIL HAD AN OPPORTUNITY TO READ THAT AND LOOK AT IT. THANK YOU. AND WE'LL BE PRESENTING THAT BE MR. MERCHANT OR THERE WILL BE. >> YES. OKAY. >> I HAVE A REAL BRIEF POWERPOINT TO KIND OF SOME SUMMARIZE THE HIGHLIGHTS OF BOTH ORDINANCES I'D LIKE TO SHARE ON THE SCREEN AND BY BRIEF JUST TWO SLIDES BUT I THINK IT JUST KIND OF COVERS THE SALIENT AND IF YOU IF YOU WILL MR. MERCHANT GIVE US A LITTLE BIT OF BACKGROUND ON HOW THIS CAME ABOUT. >> HOLD ON ONE SECOND. >> THERE WE GO. SO THIS BOTH OF THESE ORDINANCES CAME ABOUT AS RECOMMENDATIONS FROM THE LATEST ISLAND PLAN AND YOU KNOW, PART OF THAT PLANNING EFFORT WAS A RESPONSE TO SOME OF THE DEVELOPMENT THAT JUST OCCURRED ON LADIES ISLAND WITHIN THE LAST FIVE OR SO YEARS. AND ONE OF THE THE MAJOR DEVELOPMENTS THAT HAS CAUSED A LOT OF PEOPLE TO BE CONCERNED ABOUT KIND OF CHANGES IN THE CHARACTER OF THE AREA HAS BEEN THE WAL-MART AND YOU KNOW, SPECIFIC TO THAT DEVELOPMENT HAS BEEN THE AMOUNT OF FILL THAT WAS NECESSARY TO BRING IN ON THAT PROPERTY IN ORDER TO BRING IT UP TO BASE FLOOD ELEVATION AND MAKE IT WORK ON A VERY LOW LYING PROPERTY. AND SO THAT WAS KIND OF ON EVERYONE'S MIND DURING THE DEVELOPMENT OF THAT PLAN AND IT BECAME ONE OF THE MAJOR RECOMMENDED NATIONS. BUT WE REALIZED EARLY ON STAFF THAT THIS ISSUE WAS NOT JUST, YOU KNOW, ISOLATE, DELAY SALE AND IT WAS IT WOULD BE A COUNTY WIDE ISSUE BECAUSE YOU KNOW, HAVE OTHER AREAS OF THE COUNTY THAT ARE LOW LYING AND THAT THERE'S CONCERN THAT AS YOU KNOW, LAND BECOMES MORE AND MORE DEVELOPED. PEOPLE BE, YOU KNOW, WANTING TO DEVELOP LOW LYING PROPERTIES THAT MAYBE YOU WOULD NOT HAVE BEEN CONSIDERED PRIME DEVELOPMENT AREAS. BUT AS LAND GETS DEVELOPED, PEOPLE START MOVING OUT TO THESE AREAS. SO THIS BECAME A RECOMMENDATION OF THE PLAN. WE PUT TOGETHER A TASK FORCE TO LOOK AT, YOU KNOW, WHAT SHOULD BE REQUIRED IN THIS TYPE OF ORDINANCE. IN ADDITION TO THIS WHOLE ORDINANCE AND OTHER RECOMMENDATIONS, THE PLAN WHICH WE REALIZED HAD COUNTYWIDE WIDE THE IMPLICATIONS WAS THE ADOPTION OF A C TAKES AT THE TIME THE SEA LEVEL RISE OVER LAKE DISTRICT WHICH WE'RE CALLING IT COASTAL RESILIENCE OF THE WAY. SO THESE TWO ORDINANCES HAVE COME OUT OF THAT EFFORT. SO WE PUT TOGETHER A TASK FORCE MADE UP OF PLANNERS. FLOODPLAIN MANAGERS THOSE FOLKS INVOLVED IN STORMWATER MUNICIPAL REPRESENT INVESTORS, REPRESENTATIVES FROM THE DEVELOPMENT COMMUNITY AND REALLY DELIBERATED THROUGH WHAT YOU KNOW, WHAT IS IT THAT WE WANT TO LIMIT FROM HAPPENING AND WHAT ARE THE UNINTENDED CONSEQUENCES IF WE ADOPTED A FLAWED. AND WE KIND OF WENT OVER THIS VERY DETAILED FASHION. WE GOT INPUT FROM PEOPLE LIKE DAVID CASSERLY WHO'S A SURVEYOR WHO DEALS WITH A LOT OF UNUSUAL SITUATIONS. SO HE WAS ABLE TO KIND OF WALK US THROUGH YOU CURIOUS THAT WE MAY WANT TO EXEMPT. SO THERE'S THERE WAS A LOT OF VETTING OF THIS. WE ALSO PRESENTED TO THE THE CHAMBER OF COMMERCE WHERE WE HAD A LOT OF HOMEBUILDERS PRESENCE. AND SO THIS KIND OF WENT TO IT A REFINEMENT PROCESS AND BECAUSE IT WAS A RECOMMENDATION OF THE LADY SIDE PLAN, WE HAVE AN IMPLEMENTATION COMMITTEE THAT REVIEWS AND APPROVED THIS LANGUAGE. AND IT ALSO TO THE NORTHERN VIEW FOR COUNTY IMPLEMENTATION COMMITTEE AND THEY APPROVED IT ON NOVEMBER 20TH. SO THAT'S A LITTLE BIT OF A BACKGROUND OF HOW WE GOT TO THIS POINT. RIGHT NOW THE COUNTY DOES NOT REALLY REGULATE SALE AS SUCH FOR DEVELOPMENT EXCEPT FOR [00:30:07] WITHIN THE INTO THE FLOOD AREAS ALONG OUR BARRIER ISLANDS. SO IT'S NOT SOMETHING THAT WE CURRENTLY REGULATE. THAT'S THE REASON WHY WEREN'T THEY VERY CAREFUL TO CONSIDER THE APPLICATION THAT REAL BRIEFLY THIS APPLIES TO ALL LANDS THAT ARE AT OR BELOW 10 FEET ABOVE SEA LEVEL. IT BASICALLY LIMITS FELL TO THREE VERTICAL SEAT OR LESS IN THESE AREAS. SO WHAT IT DOES IS IT WOULD REALLY LIMIT THOSE LOW LYING AREAS WHERE THEY WOULD NEED TO BRING IN PHIL TO BRING IT UP TO BASE FLOOD ELEVATION. IT WOULD ELIMINATE A SITUATION LIKE WAL-MART WHERE YOU WOULD HAVE A LARGE DEVELOPMENT OCCURRING IN A PIECE OF PROPERTY THAT WAS IN A VERY LOW AN DEFINITION. THERE ARE MODULATIONS AND FLEXIBILITY FOR SMALL RESIDENTIAL LOTS. IT'S MAINLY HARD TARGETED TOWARD LARGER COMMERCIAL BUILDINGS IN THESE LOW AREAS. AND ALSO WE ARE MAKING THE SAME PRESENTATION TO THE CITY OF BEAUFORT AND IT'S GOING TO PUT OIL. SO IT'S SOMETHING THAT WE ARE WANTING TO ADOPT MULTILATERALLY . I'M GOING TO BE GIVING THE SAME PRESENTATION ON WEDNESDAY TO PORT ROYAL TOWN COUNCIL. AND THEN AFTER THE FIRST OF THE YEAR WE'LL BE PRESENTING IN THE WORK SESSION WITH THE CITY OF BEAUFORT. SO THAT'S JUST A REAL BRIEF OVERVIEW THAT I WOULD ENTERTAIN ANY QUESTIONS THAT YOU MAY HAVE . OK, LET'S OPEN IT UP FOR QUESTIONS, PLEASE. LET'S SAY ANYONE IN ALICE TO ALICE I QUESTION OK, COUNCILMAN RODMAN, I THINK I HEARD YOU FIRST GO AHEAD AND QUESTION HOW DOES THIS RELATE TO WETLANDS AND THE VARIOUS FEDERAL LAWS SO ON THAT RESTRICT SOME OF THAT IS A LOT OF THIS LAND WETLANDS ANYWAY? >> AND HOW DOES THAT RELATE YOU WRITE SOME OF IT. >> THEY ARE JURISDICTIONAL WETLANDS BUT OTHERS ARE SIMPLY LOW LYING AREAS, LOW ELEVATION AND YOU KNOW OR WITHIN THE COUNTIES FLOODPLAIN NOT NECESSARILY WETLANDS. BUT YOU'RE RIGHT. THERE IS SOME YOU KNOW, THERE ARE RESTRICTIONS FOR FILLING WETLANDS THAT WE CURRENTLY HAVE IN PLACE. >> CHAIRMAN PARK, LIMIT YOUR NECKS. >> YES, ROB, WHEN I WAS AT THE BLUFFTON RECREATION CENTER WHEN THE COMPREHENSIVE PLAN MAPPED FOR BEING SHOWN IS THIS IN IN CONGEAL WITH THE OVERALL COMPREHENSIVE PLAN BECAUSE THEY KNOW THEY HAD VARIOUS SECTIONS THAT THEY WERE TALKING ABOUT DEVELOPMENT AND LOW LYING AREAS THAT WE WANT TO DEAL WITH IN AN APPROPRIATE MANNER OVER THE NEXT 10 YEARS. SO IS IS THIS PART AND PARCEL OF THAT? THIS IS ONE SMALL ELEMENT OF THAT. ONE OF THE THINGS THAT WE DID IS THAT WHEN WE PUT TOGETHER THIS TASK FORCE WE SPENT A LOT OF TIME LOOKING AT BROADER POLICY ISSUES RELATED TO COASTAL FLOODING AND SEA LEVEL RISE. AND SO A LOT OF THOSE RECOMMENDATIONS ARE GOING TO BE PART OF THE CONFERENCE PLAN. WE'RE NOW REQUIRED AS LOCAL JURISDICTIONS TO HAVE A RESILIENCE ELEMENT OF THAT. THERE'S A CHANGE MADE TO OUR STATE ENABLING LEGISLATION SO IT WILL BE ADDRESSED TO THAT IN OUR COMPREHENSIVE PLAN. OKAY. THANK YOU. ANY OTHER COMMENTS? YEAH, MAYBE YOU CAN'T SEE ME. >> OH, PAUL OK. GO AHEAD. YES, SIR. >> THE USING THE WAL-MART EXAMPLE OF LADIES ALLEN THEY THEY RAISE THEIR ENTIRE PROPERTY. NOT TO ME. I SEE THAT WHAT WE'RE PROPOSING YOU CAN ONLY RAISE A THIRD OF IT CAN THAT'S. A LOT OF SENSE. 08 YES. THIRTY. IT'S A THIRD FOR PROPERTIES AND I BELIEVE IT'S 20 ACRES OR GREATER. RIGHT. THAT'S WHAT I'M LOOKING AT. THE OTHER THING IS I HAVE SEEN EXAMPLE AFTER EXAMPLE OF THIS WHERE WE'RE LOT STARTS SELLING OUT. I GUESS TYPICALLY PEOPLE BUY THE HIGHER LODGE. NOT ALWAYS BUT OFTEN THEY BUY THE HIGHER LOTS AND THE OTHER ONES SELL OUT SLOWER LATER AND THE SHOW WILL GO SLOWER LATER. LOTS COME ALONG. SO SOME GUYS WERE REASONABLE. HOW LONG? THERE'S A LOT NEXT YEAR. THEY BUILD THAT LITTLE HIGHER THAN THE HIGHLIGHTS AND THEN RUN UP HIS YARD AGAIN. SO I THINK IT'S KIND OF ONE UPMANSHIP IN THIS BIDDING PLAY FOR HEAVILY AGAINST THE DRESSES THAT THOUGH DOES IT WELL IT WOULD INTEREST IT FOR YOU KNOW, IT STILL APPLIES TO [00:35:02] RESIDENTIAL. LOTS OF THERE'S SOME FLEXIBILITY BUILT IN FOR THESE SMALLER RESIDENTIAL LOTS BUT IT MAY ADDRESS THAT FOR YOU KNOW, IF THEY'RE 10 FEET OR OR BELOW SEA LEVEL, YOU KNOW, IT'S LIMITED TO 30 FEET. >> THERE ARE START THREE FEET OF VERTICAL FEET OF PHIL OR SOMEWHERE ELSE I COULD ADD TO THAT ARE THE SITUATION YOU JUST DESCRIBED JUST FOR YOURS AND COUNT SOULS KNOWLEDGE THAT IS GENERALLY COVERED UNDERNEATH STRONG WATER REGULATIONS IN STATE LAW IT IS TECHNICALLY ILLEGAL FOR FOLKS TO ALTER THEIR LOT IN A MANNER THAT ALTERS THE FLOW OF WATER FROM ITS NATURAL COURSE AS IT FLOWS PRIOR TO CONSTRUCTION THEY CANNOT ALTER THAT AFTER CONSTRUCTIONS AND FLOW IT ON TO SOMEONE ELSE IF IT DIDN'T GO THERE TO BEGIN WITH. >> I HAD A QUESTION REGARDING ICE. I'VE SEEN SOME LOTS THAT WOULDN'T PARK IN THE PAST AND NOW THEY'RE DOING THE ENGINEERED SEPTIC TANKS WHERE THEY BRING IN FILL. JUST REALLY DOESN'T ADDRESS THAT THOUGH DOES IT? I MEAN WE CAN STILL HAVE THOSE SITUATIONS. AND SOME OF THESE LOWER LYING PROPERTIES THAT DON'T PARK. IS THAT TRUE? THAT'S A DIFFERENT SITUATION. YEAH. THIS WASN'T MEANT TO APPLY TO ENGINEERED SEPTIC SYSTEMS. >> ALL RIGHT. ANY OTHER QUESTIONS OR COMMENTS? YEAH, YEAH. YEAH. YES. YEAH. THANK YOU. I APPRECIATE STAFF BRINGING THIS FORWARD. I LIKE WHAT I SEE PARTICULARLY AS IT IMPACTS NEIGHBORS IN A LOT OF FIELDS. IT'S ACTUALLY BROUGHT IN AND THE SURROUNDING NEIGHBORS IMPACTS SEVERELY AND SO THIS WILL ADDRESS THAT. SO I APPRECIATE THIS. THE THING THAT I WAS LOOKING FOR AND I THINK YOU TALKED ABOUT ADDRESSING THIS OR TAKING THIS TO THE MUNICIPALITIES IN WANT TO MAKE SURE THAT WE DON'T PUT THINGS IN PLACE TO LET THE DEVELOPERS CAN GO TO MUNICIPALITIES AND MAKE THE PROPERTY KNOW THAT WE WOULD NOT ALLOW THINGS LIKE THAT TO HAPPEN AND THAT'S A CLASSIC EXAMPLE OF A WAL-MART. SO I'M GLAD THAT YOU ARE TAKING THIS TO THE MUNICIPALITY. HOPEFULLY THEY WILL BUY INTO IT. BUT THIS WHOLE ISSUE OF HIGH LEVEL SERHIY IS A FACTOR FOR ALL OF US AND WE NEED TO BE TOGETHER. >> THANK YOU. THANK YOU FOR THOSE COMMENTS. I GUESS THE NEXT STEP FOR OUR COMMITTEE IS TO WAIT TO HEAR BACK FROM YOU AFTER YOU BRIEF TOWN AND CITY BEFORE IT IS BLUFFTON ON YOUR RADAR TOO? WELL, BLUFFTON WAS PART OF THE TASK FORCE ON ONE OF THE THINGS WE DETERMINED AS WE KIND OF LEFT IT UP TO THEM BECAUSE THERE'S VERY FEW AREAS IN THE TOWN OF BLUFFTON THAT ARE DAIRIES THAT ARE LOW LYING OR NOT COMMERCIAL AREAS. SO THERE'S VERY LITTLE DEMAND FOR PHIL LARGE FOOTPRINT BUILDINGS. >> WE ALSO KNOW HILTON HEAD WAS ALSO PART OF THE PROCESS. THERE ARE THE OPPOSITE SITUATION WHERE A LARGE PORTION OF THE ISLAND WOULD BE IMPACTED. SO WE KIND OF LEFT IT TO THOSE TO WHERE THERE'S LESS OF THIS SHARED JURISDICTION, THESE LOW LYING AREAS TO TO TAKE THIS UNDER TO CONSIDERATION AT THEIR OWN TIME. >> OK, THANK SO WE'LL WAIT. I GUESS THERE'S NO. ANY OTHER COMMENTS? SORT FEEL SO ALONE. GO, ROB. WHAT KIND OF IMPACT WILL THIS HAVE ON STAFF FAR STAFF REVIEW ETC ETC.? >> AND MOVING FORWARD. WELL THIS IS BUILT INTO. YOU KNOW IT'S TRIGGERED BY DEVELOPMENT. SO YOU KNOW WHEN DEVELOPMENT PERMITS WOULD BE REVIEWED BY US THERE WOULD SUBMITTING THEIR GRADING PLANS AND SURVEYS YOU KNOW SHOWING ELEVATION CONTOUR LINES. SO I MEAN THAT'S WHEN IT WOULD BE AN EXTRA STEP IN THAT PROCESS BUT IT'S NOT INTRODUCING A WHOLE NEW PROCESS. SO WE WOULD NEED ADDITIONAL DRAWINGS SUBMITTED WHEN DEVELOPMENT IS SUBMITTED TO OUR DEPARTMENT FOR CONSIDERATION. ALL RIGHT. >> ARE YOU AWARE OF ANY OTHER COUNTIES IN THE STATE THAT HAVE A SIMILAR ORDINANCE RESTRICTION? WELL, WE TOOK SOME OF THE LANGUAGE FROM CHATHAM COUNTY AND GEORGIA. [00:40:05] I KNOW THAT THIS HAS BEEN AN ISSUE THAT HAS BEEN BROUGHT UP IN THE CITY OF CHARLESTON. WE'RE ACTUALLY THEY WENT A STEP FURTHER IN LIMITING AT LEAST THE FIRST RECOMMENDATION WAS LIMITING FILL ACROSS THE BOARD, NOT APPLYING TO LOW LYING AREAS . >> SO IT'S DEFINITELY SOMETHING THAT THE OTHER JURISDICTION SORT OF CONSIDERED OR ADOPTED THE WAY WE LOOK FORWARD TO HEARING BACK FROM YOU AFTER BEER AFTER YOU TALK WITH THE TOWN OF PORT ROYAL AND CITY PEOPLE. >> AND ARE YOU GOING TO BE HANDLING THE NEXT ONE NUMBER EIGHT? >> I'M GOING TO LIKE COUNCILOR SOMERVILLE. GO AHEAD. >> ON ITEM A NONCONFORMING STRUCTURES MAY UTILIZE STILL UP TO 15 PERCENT OF GROSS FLOOR AREA. I DON'T UNDERSTAND WHAT THAT MEANS. SO THAT WOULD MEAN IF YOU HAD A SITE WHERE SOMEBODY ALREADY BROUGHT IN LET'S SAY FOR FREE TO SELL, YOU KNOW AND IT WAS BUILT 10 YEARS AGO AND THEY WANTED TO EXPAND THE STRUCTURE REQUIRED THEM TO BILL BRING IN ADDITIONAL FILL SO THAT THE ADDITIONS WOULD BE AT THE SAME ELEVATION AS THE EXISTING BUILDING. THEY WOULD BE ABLE TO DO THAT FOR 15 PERCENT EXPANSION. IT'S SIMILAR TO OR OTHER RESTRICTIONS WE HAVE ON NONCONFORMING WARMING BUILDINGS WHERE YOU KNOW WHERE THEY CAN DO IN ADDITION TO THE OK THAT MAKES SENSE. ALL RIGHT. THEY NEED A FEW MINUTES TO FIND OUT WHAT NEXT. [8. COASTAL RESILIENCE OVERLAY DISTRICT ORDINANCE AMENDING SECTION 3.4.90 OF THE COMMUNITY DEVELOPMENT CODE TO REQUIRE REAL ESTATE DISCLOSURE WHEN PROPERTY IS TRANSFERRED IN LOW‐LYING AREAS] NOW IT'S THE NEXT SLIDE. HOLD ON A SECOND. OKAY. THIS ORDINANCE IS VERY STRAIGHTFORWARD. WE WERE GIVEN THE INSTRUCTIONS WITH THE LATEST IRELAND PLAN TO CONSIDER A SEA LEVEL RISE OVERLAY. AND WE'VE CONCLUDED THAT THIS POINT WHAT WE'RE RECOMMENDING IS AN ORDINANCE THAT WOULD REQUIRE DISCLOSURE AT REAL ESTATE CLOSINGS. THIS WOULD BE VERY SIMILAR TO WHAT WE REQUIRE WITH THE EA AIRPORT OVERLAY DISTRICT AND THE MARINE CORPS AIR STATION WHERE PROPERTY AND ONCE AGAIN THE SUPPLIES TO LANDS AT OR BELOW 10 FEET ABOVE SEA LEVEL PROPERTY IN THESE LOCATIONS THERE WOULD BE A DISCLOSURE THAT IT IS INCLUDED AS PART OF THE ORDINANCE SO IT NEEDED NEED TO BE SIGNED SO THAT ALL PARTIES ARE AWARE THAT THIS IS A PROPERTY THAT MAY VERY LIKELY YOU KNOW, FACE GREATER THREAT OF FLOODING IN THE FUTURE DUE TO SEA LEVEL RISE. >> KING TIDES, YOU KNOW THE TYPE OF COASTAL FLOODING THAT WE'VE BEEN EXPERIENCING. WITH AN INCREASING FREQUENCY. SO THIS IS PRETTY MUCH THE MAJORITY OF THE LANGUAGE IN THIS OVERLAY HAS TO DO WITH THE WORDING THAT WOULD BE ON THE FORMS. AND WE ARE PLANNING ON REACHING OUT TO THE BOARD OF REALTORS AND JUST YOU KNOW, AS AN F WHY AT THIS POINT AND THEN LATER WE WILL LOOK AT MORE OF A YOU KNOW, JUST MAKING SURE THAT THERE IS AN AWARENESS, YOU KNOW, IF THIS IS ADOPTED, YOU KNOW THAT THIS IS A REQUIREMENT AND I'LL OPEN IT UP IN COMMENTS ON THIS PLACE AS CHAIRMAN. >> JUST ONE QUICK QUESTION, ROB . THE IF A COUPLE BOUGHT SOME PROPERTY ON CAT ISLAND SOME TIME AGO, ONLY SETBACK REQUIREMENT WAS NOT A PART OF THAT. >> IS THIS SOMETHING THAT WOULD INCORPORATE A SET BACK REQUIREMENT BECAUSE THEY ENDED UP BUILDING ON AREAS THAT WAS RESTRICTED TO THE PUBLIC, WERE NOT ALLOWED TO DATE AND THAT THEY WERE NOT AWARE OF THAT WHEN THEY BOUGHT THE PROPERTY AND THEY SAY THAT THEY ARE KNOWN THEY WOULD NOT HAVE BOUGHT THAT PROPERTY IN ANY WAY THAT THIS WOULD INCORPORATE SETBACK REQUIREMENTS AS WELL. WELL, NO, NOT THE WAY IT'S CURRENTLY WORDED. MEAN, I THINK IT'S ONE OF THOSE THINGS WHERE SOMEBODY DIDN'T DO THEIR YOU THE RESEARCH. YEAH. >> WHAT? THE PROBLEM BECOMES WHEN WHEN THE WHEN WHEN THEY ARE UNABLE TO DO WHAT THEY HAVE DONE THINGS THAT ARE IN THE BILL THE THE OWN THAT'S NOT RIGHT. YOU KNOW THE BILLABLE. NOW YOU KNOW THEY EITHER PLACE FENCING OR THEY'VE DONE SOME OTHER THINGS THAT SHOULD NOT HAVE BEEN THERE. BUT JUST WAY AT ALL. SO I DON'T KNOW HOW WE GET THAT [00:45:03] INFORMATION OUT TO PEOPLE BUT TO HAVE THAT INCLUDED WITH THE REAL ESTATE ANNOUNCEMENT. BUT ANYWAY. ANY OTHER COMMENTS QUESTIONS? NOW WE HAD THIS LISTED AS A DISCUSSION. DO WE NEED TO MOVE IT FORWARD TO A FULL COUNCIL? MR. GREENWAY OR WAS IT AN ACTION ITEM? >> OH, WELL, WHAT WE'RE PROPOSING TO DO IS SINCE WHERE AND THIS WAS A RECOMMENDATION FROM THE NORTHERN PLAN IMPLEMENTATION COMMITTEE IS THAT SINCE WE'RE LOOKING AT THIS BEING ADOPTED BY THE CITY AND THE TOWN, THEY REALLY WANTED TO YOU BE ABLE TO GET THE WORD OUT THAT THIS WAS IN THE OFFING BEFORE WE STARTED THE OFFICIAL ADOPTION PROCESS. >> SO WHAT WE'RE HOPING TO DO IS ONCE WE MAKE THE PRESENTATIONS TO LOOK TO OTHER JURISDICTIONS AND WE BELIEVE THAT MOST OF THE QUESTIONS HAVE BEEN ADDRESSED WE WILL THEN SUBMIT TO THE METRO PLANNING COMMISSION, THE PLANNING COMMISSION AND THEN GO TO FORMAL ADOPTION PROCESS. >> OK, EXCELLENT. THAT SOUNDS GREAT. AND I I DIDN'T MEAN TO. SORRY. I WAS SKIPPING THAT STEP, SIR. BUT VERY SIMILAR TO YOUR OTHER ONE. WE'LL WAIT FOR YOU TO COME BACK WITH THIS. OKAY. SOUNDS GOOD. I THINK THIS IS GREAT. WE HAVE THIS COOPERATIVE ATTITUDE ABOUT TRYING TO STOP THE SELECTIVE ANNEXATION SO IT MAY END IN LONG TIME AGO THAT HAPPENED BY HAVING EVERYBODY FOLLOW IN THE SAME GUIDANCE AND [EXECUTIVE SESSION] RULES. SO THIS TIME IF WE WILL GO INTO EXECUTIVE SESSION. >> CORRECT AND MISS BROCK, WILL YOU LET US KNOW WHEN WE'RE READY FOR THAT? >> I WILL MAKE THE MOTION TO GO INTO EXECUTIVE SESSION. I HAVE A SECOND. OKAY. APPROVED WITHOUT EXCEPTION SAID OKAY. ALL RIGHT. WE WILL NOW GO INTO EXECUTIVE SESSION AND THANK. >> WE'RE BACK. OKAY. THANK YOU. WE ARE NOW OUT OF EXECUTIVE SESSION AND WE DO HAVE SOME ITEMS ARISING OUT OF EXECUTIVES SESSION HERE OR ANY MOTIONS WITH. >> MADAM CHAIRMAN, I CAN PUT A MOTION FOR BOTH OF THESE RECOMMENDATION IN ONE OR YOU WANT TO SEPARATE. I THINK WE CAN DO THEM TOGETHER. IF OUR ATTORNEY SAYS IT'S OKAY THAT OUR MOTION THAT WE UPHOLD THE RECOMMENDATION COMING FROM THE RULE AND CRITICAL LAND PROGRAM AND OUR SECOND THAT I HAVE A SECOND IS IF IF IF IT IS WITHOUT OBJECTION WE WILL APPROVE AND THOSE RECOMMENDATIONS WERE NOT TO GO FORWARD WITH EITHER ONE OF THESE LISTED IN THE AGENDA. >> RIGHT. >> YES. [11. CONSIDERATION OF THE APPOINTMENT OF JIMMIE LAWRENCE, JR. TO THE PLANNING COMMISSION] OKAY. ALL RIGHT. THANK YOU. WE HAVE ONE MORE ITEM AND THAT IS A CONSIDERATION OF THE APPOINTMENT OF JIMMY LAWRENCE TO THE PLANNING COMMISSION AND WE HAVE SOME PUBLIC COMMENT THAT WE CAN'T HAVE ANY OBJECTIONS TO HIS APPOINTMENT OR ENDORSEMENTS. SO NO. AND I THINK HE'S COUNTS WHEN DAWSON WHO WE REPRESENT IN HIS DISTRICT. >> CORRECT. HE IS AND I WOULD RECOMMEND THAT WE APPOINT I'M UP FOR A SECOND WELL HERE A SECOND FOR THAT. >> WELL ACTUALLY ALICE WE DON'T NEED A SECOND RIGHT. >> ALICE CAN HEAR ME. YES I CAN. YEAH. ACTUALLY HE'S NOT IN MY DISTRICT. >> HE'S IN COSMETICS WELDON'S DISTRICT. OK. BUT HE IS IN HIS FAMILY. HE GREW UP IN MY DISTRICT. AND SO HE'LL REPRESENT YOUR DISTRICT. >> CORRECT AS WELL. OKAY. ALL RIGHT. >> I WILL OFFER THE SECOND TO THAT. OKAY. ALL RIGHT. WE WILL MOVE WITHOUT OBJECTION TO FORWARD THAT TO FULL COUNCIL IN I AM VERY GLAD TO SEE HIS NAME COME FORWARD. [12.
